offenseoftamperingwithelectronicmonitoringequipment,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section575.205,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection575.205,toreadasfollows:
575.205.1.Apersoncommitstheoffenseoftamperingwithelectronicmonitoring
2equipmentifheorsheintentionallyremoves,alters,tamperswith,damages,[or]destroys,
3failstocharge,orotherwisedisableselectronicmonitoringequipmentwhichacourt,the
4divisionofprobationandparoleortheparoleboardhasrequiredsuchpersontowear.
5 2.Thissectiondoesnotapplytotheowneroftheequipmentoranagentoftheowner
6whoisperformingordinarymaintenanceorrepairsontheequipment.
7 3.TheoffenseoftamperingwithelectronicmonitoringequipmentisaclassDfelony.
8 4.Theoffenseoftamperingwithelectronicmonitoringequipmentifaperson
9failstochargeorotherwisedisableselectronicmonitoringequipmentisaclassEfelony,
10unlesstheoffenseforwhichthepersonwasplacedonelectronicmonitoringwasa
11misdemeanor,inwhichcaseitisaclassAmisdemeanor.
