Thisbillestablishesthe"KratomConsumerProtectionAct",which
requiresdealerswhoprepare,distribute,sell,orexposeforsale
afoodthatisrepresentedtobeakratomproducttodiscloseon
theproductlabelthebasisonwhichthisrepresentation ismade.
Adealerisprohibitedfrompreparing,distributing,selling,or
exposingforsaleakratomproductthatdoesnotconformtothese
labelingrequirements.
TheGeneralAssemblypreemptstheentirefieldofregulatingkratom
productstotheexclusionofanyorder,ordinance,orregulationof
anypoliticalsubdivisionofthestate.Anyexistingorders,
ordinances,orregulationsofanypoliticalsubdivisionofthe
staterelatingtokratomarevoidunderthisbill.
Adealermaynotprepare,distribute,sell,orexposeforsalea
kratomproductthatisadulteratedorcontaminatedwithadangerous
non-kratomsubstance,containsalevelof7-hydroxymitragynine in
thealkaloidfractionthatisgreaterthan2%compositionofthe
product,containsanysyntheticalkaloids,ordoesnotincludeon
itspackageorlabeltheamountofmitragynine,7-
hydroxymitragynine, orothersyntheticallyderivedcompoundsofthe
plantMitragynaspeciosa. Adealermaynotdistribute,sell,or
exposeforsaleakratomproducttoanyoneunder18yearsofage.
Thebillspecifiespenaltiesforaviolationofthelabeling
requirementsandallowsforapersonwhoisaggrievedbya
violationofthelabelingrequirementstobringacauseofaction
fordamagesresultingfromtheviolation.
