191.1014.1.Thedepartmentofhealthandseniorservicesshallestablisha
2registrationprocessforentitiesdesiringtooperateaprogramthatdistributesfentanyl
3testingstripsinordertoreducedrugoverdosesandoverdosedeathswherebyanyentity
4thatwouldliketooperatesuchaprogramshallbeallowedtodosoifitmeets
5requirementssetbythedepartmentofhealthandseniorservices.
6 2.Noentityregisteredwiththedepartmentofhealthandseniorservicesunder
7subsection1ofthissectionshallbepresentwithinfivehundredfeetofanyschool
8buildingunlesstheschoolbuildingwasconstructedorestablishedasaschoolafterthe
9entitywasinoperation.
10 3.Thedepartmentofhealthandseniorservicesshallpromulgaterulesto
11implementtheprovisionsofthissection.Anyruleorportionofarule,asthattermis
12definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection
13shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof
14chapter536and,ifapplicable,section536.028.Thissectionandchapter536are
15nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto
16chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17subsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandanyrule

579.040.1.(1)Apersoncommitstheoffenseofunlawfuldistribution,delivery,or
2saleofdrugparaphernaliaifheorsheunlawfullydistributes,delivers,orsells,orpossesses
3withintenttodistribute,deliver,orselldrugparaphernaliaknowing,orundercircumstances
4inwhichonereasonablyshouldknow,thatitwillbeusedtoplant,propogate,cultivate,grow,
5harvest,manufacture,compound,convert,produce,process,prepare,test,analyze,pack,
6repack,store,contain,conceal,inject,ingest,inhale,orotherwiseintroduceintothehuman
7bodyacontrolledsubstanceoranimitationcontrolledsubstanceinviolationofthischapter.
8 (2)Thefollowingentitiesandpersonsshallbeexemptfromtheprovisionsofthis
9section:
10 (a)Anyentityregisteredwiththedepartmentofhealthandseniorservices
11undersection191.1014thatpossesses,distributes,ordeliversfentanyltestingstripsfor
12thepurposeofoperatingaprogramdescribedundersection191.1014;and
13 (b)Anystaffmember,volunteer,orparticipantinaprogramdescribedunder
14section191.1014thatisoperatedbyanentitydescribedunderparagraph(a)ofthis
15subdivisionwhopossesses,distributes,ordeliversfentanyltestingstripsinconnection
16withhisorherdutiesorparticipationintheprogram.
17 2.TheoffenseofunlawfuldeliveryofdrugparaphernaliaisaclassAmisdemeanor,
18unlessdoneforcommercialpurposes,inwhichcaseitisaclassEfelony.

2paraphernaliaifheorsheunlawfullymanufactureswithintenttodeliverdrugparaphernalia,
