195.778.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"Applicant",anapplicantforalicense;
3 (2)"License",acomprehensivemarijuanacultivationfacilitylicense,
4comprehensivemarijuanadispensaryfacilitylicense,orcomprehensivemarijuana-
5infusedproductsmanufacturingfacilitylicense,asdescribedinArticleXIV,Section2of
6theConstitutionofMissouri;
7 (3)"Minimumstandards",theminimumstandardsrequiredtoreceivealicense
8thatareconsistentwiththeprovisionsofArticleXIV,Section2oftheConstitutionof
9Missouri.
10 2.Duetothedemandformarijuanainthisstateandconsistentwithits
11obligationtoliftoreaseanylimitonthenumberoflicensesinordertomeetsuch
12demandasdescribedinArticleXIV,Section2,Subsection4,Subdivision(2)ofthe
13ConstitutionofMissouri,thedepartmentofhealthandseniorservicesshallissuea
14licensetoanyapplicantwhomeetsminimumstandardsforthelicenseforwhichthe
15applicantapplies.
16 3.Notwithstandingsubsection2ofthissection,thedepartmentofhealthand
17seniorservicesmaydenyalicensetoanapplicantwhomeetsminimumstandardsfor
