AN ACT 
To amend chapter 1, RSMo, by adding thereto one new section relating to implementation of 
federal law in this state, with an effective date. 
 
Be it enacted by the General Assembly of the State of Missouri, as follows: 
     Section A.  Chapter 1 , RSMo, is amended by adding thereto 1 
one new section, to be known as section 1.340, to read as 2 
follows:3 
     1.340.  1.  The general assembly may review any 1 
executive order issued by the President of the United 2 
States, federal agency rule, or federal co ngressional action 3 
to determine the constitutionality of such action.  Upon  4 
recommendation from the general assembly, the attorney 5 
general shall review such action by the federal government 6 
to determine the constitutionality of the action and whether 7 
the state should seek an exemption from the application of 8 
the action or seek to have the action declared 9 
unconstitutional. 10 
     2.  Should the attorney general decline to pursue 11 
action based upon the determination of the general assembly, 12 
the general assembly may declare the action unconstitutional 13 
by passing of a concurrent resolution by a majority vote of 14 
both houses. 15 
     3.  Notwithstanding any other provision of law to the 16 
contrary, the state, any political subdivision or any other 17 
publicly funded organization shall not implement any action 18   SB 286 	2 
that restricts a person's rights or that the attorney 19 
general or the general assembly determines to be 20 
unconstitutional under subsection 1 of this section and 21 
which relates to: 22 
     (1)  Pandemics or other health emergencies; 23 
     (2)  The regulation of natural resources, including oil 24 
and natural gas; 25 
     (3)  The regulation of the agriculture industry; 26 
     (4)  The use of land; 27 
     (5)  The regulation of the financial sector as it 28 
relates to environmental, social, or governance standards; 29 
     (6)  The regulation of the constitutional right to keep 30 
and bear arms; 31 
     (7)  The regulation of education; 32 
     (8)  The regulation of interscholastic, intramural, or 33 
other extracurricular sports sponsore d by an institution of 34 
higher education, a school district, or a charter school; or 35 
     (9)  Any other powers reserved by the state of Missouri 36 
or the people of Missouri. 37 
     Section B.  Section A of this act shall become 1 
effective November 1, 2023.  2 

