FIRST REGULAR SESSION SENATE BILL NO. 316 102ND GENERAL ASSEMBLY INTRODUCED BY SENATOR HOSKINS. 1134S.01I KRISTINA MARTIN, Secretary AN ACT To amend chapters 34, 347, and 351, RSMo, by adding thereto three new sections relating to prohibiting discrimination against businesses based on environmental, social, and governance scores. Be it enacted by the General Assembly of the State of Missouri, as follows: Section A. Chapters 34, 347, and 351, RSMo, are amended 1 by adding thereto three new sections, to be known as sections 2 34.710, 347.800, and 351.018, to read as follows:3 34.710. 1. The state, any agency of the state, an y 1 political subdivision of the state, or any instrumentality 2 thereof, when engaged in procuring or letting contracts for 3 any purpose shall ensure that bidders, offerors, 4 contractors, or subcontractors are not discriminated against 5 or given preferentia l treatment based on an environmental, 6 social, and governance score. 7 2. For purposes of this section, the term 8 "environmental, social, and governance score" means an 9 evaluation conducted by an entity that takes into 10 consideration one or more of t he following: 11 (1) The use of energy and raw materials by the bidder, 12 offeror, contractor, or subcontractor; 13 (2) Whether the bidder, offeror, contractor, or 14 subcontractor spends funds on social welfare or makes 15 charitable donations; 16 SB 316 2 (3) The wages and working hours of the employees of 17 the bidder, offeror, contractor, or subcontractor; 18 (4) The environmental policies of the bidder, offeror, 19 contractor, or subcontractor; 20 (5) The bribery and corruption policies of the bidder, 21 offeror, contractor, or subcontractor; and 22 (6) The information transparency of the bidder, 23 offeror, contractor, or subcontractor. 24 347.800. 1. No limited liability company registered 1 pursuant to this chapter shall be discriminat ed against or 2 given preferential treatment based on an environmental, 3 social, and governance score. 4 2. For purposes of this section, the term 5 "environmental, social, and governance score" means an 6 evaluation conducted by an entity that takes into 7 consideration one or more of the following: 8 (1) The use of energy and raw materials by the limited 9 liability company; 10 (2) Whether the limited liability company spends funds 11 on social welfare or makes charitable donations; 12 (3) The wages and working hours of the employees of 13 the limited liability company; 14 (4) The environmental policies of the limited 15 liability company; 16 (5) The bribery and corruption policies of the limited 17 liability company; and 18 (6) The information transparency of the limited 19 liability company. 20 351.018. 1. No corporation registered pursuant to 1 this chapter shall be discriminated against or given 2 preferential treatment based on an environmental, social, 3 and governance score. 4 SB 316 3 2. For purposes of this section, the term 5 "environmental, social, and governance score" means an 6 evaluation conducted by an entity that takes into 7 consideration one or more of the following: 8 (1) The use of energy and raw materials by the 9 corporation; 10 (2) Whether the corporation spends funds on social 11 welfare or makes charitable donations; 12 (3) The wages and working hours of the employees of 13 the corporation; 14 (4) The environmental policies of the corporation; 15 (5) The bribery and corruption policies of the 16 corporation; and 17 (6) The information transparency of the corporation. 18
