FIRST REGULAR SESSION SENATE BILL NO. 674 102ND GENERAL ASSEMBLY INTRODUCED BY SENATOR MAY. 2672S.01I KRISTINA MARTIN, Secretary AN ACT To amend chapter 67, RSMo, by adding thereto one new section relating to accountability of St. Charles county government, with an emergency clause. Be it enacted by the General Assembly of the State of Missouri, as follows: Section A. Chapter 67, RSMo, is amended by adding thereto 1 one new section, to be known as section 67.2200, to read as 2 follows:3 67.2200. 1. This section may be known and cited as 1 the "Fire Them All Act II". 2 2. As used in this section, "elected official" of any 3 county with a charter form of government and with more than 4 four hundred thousand but fewer than five hundred thousand 5 inhabitants or "official" shall mean any member of the 6 governing body of the county, the county executive, or the 7 prosecuting attorney of a county with a charter form of 8 government and with more than four hundred thousand but 9 fewer than five hundred thousand inhabitants. 10 3. The members of a governing body of the county, 11 county executive, or prosecuting attorney of a county wit h a 12 charter form of government and with more than four hundred 13 thousand but fewer than five hundred thousand inhabitants 14 may be removed by the qualified voters by recall in 15 accordance with the procedure under this section subject to 16 the following limitations: 17 SB 674 2 (1) The recalled official shall have held office for 18 at least six months; and 19 (2) The recalled official shall not be a candidate to 20 succeed himself or herself at a special election held to 21 fill the vacancy created by the official's recall and shall 22 not be appointed to fill the vacancy. 23 4. A special election shall be held on the recall on 24 the first Tuesday after the first Monday in November, 2023. 25 The question to be presented to the voters at such election 26 shall be in substantially the following form: 27 5. If a majority of the qualified electors voting on 34 the question at such election vote for the removal of the 35 official, a vacancy shal l exist in such office. If a 36 majority of the qualified electors voting on the question at 37 such election vote against the removal of the official, the 38 official shall continue to serve for the remainder of the 39 term for which he or she was elected. 40 Section B. Because of the need for peace and safety in 1 St. Charles County, section A of this act is deemed 2 necessary for the immediate preservation of the public 3 health, welfare, peace, and safety, and is hereby declared 4 to be an emergency act within the meaning of the 5 constitution, and section A of this act shall be in full 6 force and effect upon its passage and approval. 7 28 29 30 □ FOR the removal of ______ (name of official) from the office of ______ (name of office). 31 32 33 □ AGAINST the removal of ______ (name of official) from the office of ______ (name of office).
