JOINT RESOLUTION
Submitting to the qualified voters of Missouri, an amendment repealing sections 2(b) and 3(c) of
article XII of the Constitution of Missouri, and adopting three new sections in lieu
thereof relating to constitutional amendments.
Be it resolved by the Senate, the House of Representatives concurring therein:
That at the next general election to be held in the 1
state of Missouri, on Tuesday next following the first Monday 2
in November, 2024, or at a special election to be called b y 3
the governor for that purpose, there is hereby submitted to 4
the qualified voters of this state, for adoption or 5
rejection, the following amendment to article XII of the 6
Constitution of the state of Missouri:7
Section A. Sections 2(b) and 3( c), article XII, 1
Constitution of Missouri, are repealed and three new sections 2
adopted in lieu thereof, to be known as sections 2(b), 2(c), 3
and 3(c), to read as follows:4
Section 2(b). All amendments proposed by the general 1
assembly or by the initia tive shall be submitted to the 2
electors for their approval or rejection by official ballot 3
title as may be provided by law, on a separate ballot 4
without party designation, at the next general election, or 5
at a special election called by the governor pr ior thereto, 6
at which he may submit any of the amendments. No such 7
proposed amendment shall contain more than one amended and 8
revised article of this constitution, or one new article 9 SJR 33 2
which shall not contain more than one subject and matters 10
properly connected therewith. If possible, each proposed 11
amendment shall be published once a week for two consecutive 12
weeks in two newspapers of different political faith in each 13
county, the last publication to be not more than thirty nor 14
less than fifteen day s next preceding the election. If 15
there be but one newspaper in any county, publication for 16
four consecutive weeks shall be made. Notwithstanding the 17
provisions of Article III, Section 51 of this constitution, 18
if a majority of the votes cast thereon statewide and also a 19
majority of votes cast thereon in each of more than half of 20
the state house of representatives districts is in favor of 21
any amendment, the same shall take effect at the end of 22
thirty days after the election. More than one amendmen t at 23
the same election shall be so submitted as to enable the 24
electors to vote on each amendment separately. 25
Section 2(c). No person shall be eligible to vote on 1
any measure submitted to the people that amends, repeals, or 2
replaces this constitution, whether pursuant to this Article 3
or Article III, Section 50 of this constitution, unless such 4
person is a legal resident of the state of Missouri and a 5
citizen of the United States of America. 6
Section 3(c). Any proposed constitution or 1
constitutional amendment adopted by the convention shall be 2
submitted to a vote of the electors of the state at such 3
time, in such manner and containing such separate and 4
alternative propositions and on such official ballot as may 5
be provided by the convention, at a special election not 6
less than sixty days nor more than six months after the 7
adjournment of the convention. Upon the approval of the 8
constitution or constitutional amendments by a majority of 9
the votes cast thereo n statewide and also a majority of 10 SJR 33 3
votes cast thereon in each of more than half of the state 11
house of representatives districts, the same shall take 12
effect at the end of thirty days after the election. The 13
result of the election shall be proclaimed by the governor. 14
Section B. Pursuant to chapter 116, and other 1
applicable constitutional provisions and laws of this state 2
allowing the general assembly to adopt ballot language for 3
the submission of this joint resolution to the voters of 4
this state, the official summary statement of this 5
resolution shall be as follows: 6
"Shall the Missouri Constitution be amended to: 7
● Specify that only legal residents of Missouri 8
who are citizens of the United States may vote 9
on any change to the state constitution; and 10
● Require for ratification both a majority of 11
votes statewide and also a majority of votes in 12
more than half the state house districts?". 13
