1515 4operatingunderthesanctionofapublicorprivatecollegeoruniversity,thatrecklessly
1616 5endangersthementalorphysicalhealthorsafetyofastudentorprospectivememberforthe
1717 6purposeofinitiationoradmissionintoorcontinuedmembershipinanysuchorganizationto
1818 7theextentthatsuchpersonisknowinglyplacedatprobableriskofthelossoflifeorprobable

2525 14prospectivemember,includingbutnotlimitedtosleepdeprivation,physicalconfinement,or

3737 25 5.TheoffenseofhazingisaclassAmisdemeanor,unlesstheactcreatesasubstantial
3838 26risktothelifeofthestudentorprospectivemember,inwhichcaseitisaclassDfelony.
3939 27 6.Apersonshallnotbeguiltyoftheoffenseofhazingifthepersonestablishesall
4040 28ofthefollowing:
4141 29 (1)Thatheorshewaspresentataneventwhere,asaresultofhazing,aperson
4242 30appearedtobeinneedofimmediatemedicalassistance;
4343 31 (2)Thatheorshewasthefirstpersontocall911orcampussecuritytoreport
4444 32theneedforimmediatemedicalassistance;
4545 33 (3)Thatheorsheprovidedhisorherownname,theaddresswhereimmediate
4646 34medicalassistancewasneeded,andadescriptionofthemedicalissuetothe911operator
4747 35orcampussecurityatthetimeofthecall;and
4848 36 (4)Thatheorsheremainedatthescenewiththepersoninneedofimmediate
4949 37medicalassistanceuntilmedicalassistance,lawenforcement,orcampussecurity

5151 39 7.Notwithstandingsubsection6ofthissection,apersonshallbeimmunefrom

5454 42arrivedonthesceneofthehazingevent.Forpurposesofthissubsection,"aid"
5555 43includes,butisnotlimitedto,renderingcardiopulmonaryresuscitationtothevictim,
5656 44clearinganairwayforthevictimtobreathe,usingadefibrillatortoassistthevictim,or
5757 45renderinganyotherassistancetothevictimthatthepersonintendedingoodfaithto
5858 46stabilizeorimprovethevictim'sconditionwhilewaitingformedicalassistance,law
5959 47enforcement,orcampussecuritytoarrive.
