SectionA.Section590.653,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection590.653,toreadasfollows:
590.653.1.Eachcity,county, andcitynotwithinacountymayestablishacivilian
2reviewboard,divisionofcivilianoversight,oranyotherentitythatprovidescivilian
3revieworoversightofpoliceagencies,ormayuseanexistingcivilianreviewboard, [which]
4divisionofcivilianoversight,orothernamedentitythathasbeenappointedbythelocal
5governingbody,withtheauthoritytoinvestigateallegationsofmisconductbylocallaw
6enforcementofficerstowardsmembersofthepublic.Themembersshallnotreceive
7compensationbutshallreceivereimbursementfromthelocalgoverningbodyforall
8reasonableandnecessaryexpenses.
9 2.Theboard, division,orothersuchentityshallhave[the]itspower[toreceive,
10investigate,makefindingsandrecommend] limitedtoreceiving,investigating,making
11findingsupon,andrecommendingdisciplinaryactionuponcomplaintsbymembersofthe
12publicagainst[membersofthepolicedepartment] locallawenforcementofficersthatallege
13misconductinvolvingexcessiveuseofforce,abuseofauthority,discourtesy,oruseof
14offensivelanguage[,] including,butnotlimitedto,slursrelatingtorace,ethnicity,religion,
15gender,sexualorientation, anddisability.Thefindingsandrecommendationsoftheboard,
16division,orothersuchentity,andthebasistherefor,shallbesubmittedtothechieflaw
17enforcementofficial.Nofindingorrecommendationshallbebasedsolelyuponanunsworn
