42.022.1.Inadditiontoanyotherdutiesimposedunderthischapter,the
2commissionshallreviewtheprovisionsoftheCommanderJohnScottHannonVeterans
3MentalHealthCareImprovementActof2019,enactedbythe116thUnitedStates
4Congress(Pub.L.116-171),asamended,andanyregulationsrelatedthereto.After
5review,thecommission,incollaborationwiththedepartmentofmentalhealth,shall
6providerecommendationsandmakeeffortstoadoptprocedures,programs,treatment
7options,additionalaid,andanyotherassistancedeemednecessarybythecommissionto
8assistintheeffortstopreventveteransuicide,subjecttoappropriation.
9 2.BeforeJuly1,2025,andbeforeeveryJulyfirstthereafterthecommission
10shallfileareportwiththedepartmentofpublicsafetyandthegeneralassemblyonthe
11recommendations,implementation,andeffectivenessoftheeffortsbythecommissionto
12preventveteransuicide.
13 3.Thedepartmentofpublicsafetymaypromulgateallnecessaryrulesand
14regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
15termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
16sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
17provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter

42.028.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Compensation",paymentofanymoney,thingofvalue,orfinancialbenefit;
3 (2)"Person",anindividual;corporation;businesstrust;estate;trust;
4partnership;limitedliabilitycompany;association;jointventure;publiccorporation;
5governmentorgovernmentalsubdivision,agency,orinstrumentality;oranyotherlegal
6orcommercialentity.Theterm"person"shallnotincludetheMissouriveterans
7commission;
8 (3)"Veteransbenefitsmatter",thepreparation,presentation,orprosecutionof
9anyclaimaffectinganypersonwhohasfiledorexpressedanintenttofileaclaimfor
10anybenefit,program,service,commodity,function,orstatus,entitlementtowhichis
11determinedunderthelawsandregulationsadministeredbytheUnitedStates
12DepartmentofVeteransAffairsortheMissouriveteranscommission,pertainingto
13veterans,theirdependents,theirsurvivors,andanyotherindividualeligibleforsuch
14benefits.
15 2.Exceptaspermittedunderfederallaw,nopersonshallreceivecompensation
16foradvisingorassistinganyindividualwithregardtoanyveteransbenefitsmatter.
17 3.Nopersonshallreceivecompensationforreferringanyindividualtoanother
18persontoadviseorassistthisindividualwithanyveteransbenefitsmatter.
19 4.Apersonseekingtoreceivecompensationforadvisingorassistingany
20individualwithanyveteransbenefitsmattershall,beforerenderinganyservices,
21memorializealltermsregardingtheindividual'spaymentoffeesforservicesrendered
22inawrittenagreement,signedbybothparties,thatadherestoallcriteriaspecified
23within38CFR14.636.
24 5.Nopersonshallreceiveanycompensationforanyservicesrenderedbeforethe
25dateonwhichanoticeofdisagreementisfiledwithrespecttotheindividual'scase.
26 6.Nopersonshallguarantee,eitherdirectlyorbyimplication,thatany
27individualiscertaintoreceivespecificveteransbenefitsorthatanyindividualiscertain
28toreceiveaspecificlevel,percentage,oramountofveteransbenefits.
29 7.Nopersonshallreceiveexcessiveorunreasonablefeesascompensationfor
30advisingorassistinganyindividualwithanyveteransbenefitsmatter.Thefactors
31articulatedwithin38CFR14.636shallgoverndeterminationsofwhetherafeeis
32excessiveorunreasonable.
HCSHB1490	2 33 8.(1)Nopersonshalladviseorassistforcompensationanyindividual
34concerninganyveteransbenefitsmatterwithoutclearlyproviding,attheoutsetofthe
35businessrelationship,thefollowingdisclosure,bothorallyandinwriting:
36 Thisbusinessisnotsponsoredby,oraffiliatedwith,theUnited
37 StatesDepartmentofVeteransAffairsortheMissouriVeterans
38 Commission,oranyotherfederallycharteredveteransservice
39 organization.Otherorganizations,including,butnotlimitedto,
40 theMissouriVeteransCommission,yourlocalveteransservice
41 agency,andotherfederallycharteredveteransservice

42.312.1.Thereisherebycreatedwithinthestateadjutantgeneral'sofficethe
2"OperationEnduringFreedom,OperationFreedom'sSentinel,andOperationAllies
3RefugeProgram".EveryveteranwhohonorablyservedonactivedutyintheUnited
4StatesmilitaryserviceatanytimebeginningOctober7,2001,andendingAugust30,
52021,shallbeentitledtoreceiveanOperationEnduringFreedom,OperationFreedom's
6Sentinel,andOperationAlliesRefugemedallion,medal,andcertificateofappreciation
7underthissection,providedthat:
8 (1)Suchveteranisalegalresidentofthisstateorwasalegalresidentofthis
9stateatthetimeheorsheenteredorwasdischargedfrommilitaryserviceoratthetime
10ofhisorherdeath,orsuchveteranservedinaunitoftheMissouriNationalGuard
11regardlessofwhethersuchveteranisoreverwasalegalresidentofthisstate;and
12 (2)Suchveteranwashonorablyseparatedordischargedfrommilitaryservice,is

4 (1)Theveteranreceivingthetherapyhasbeendiagnosed,byahealthcare
5practitioner,withposttraumaticstressdisorderoratraumaticbraininjuryandhas
6demonstratedthatheorshepreviouslysoughtservicesforposttraumaticstressdisorder
7oratraumaticbraininjurythroughtheVeteransHealthAdministrationservice
8deliverysystemor,ifavailabletotheveteran,throughtheprivatehealthinsurance
9system;
10 (2)Theveteranreceivingthetherapyvoluntarilyagreedtothetherapy;
11 (3)Thefacilitycomplieswithapplicablefirecodes,oversightrequirements,and
12anytreatmentprotocolsrequiredundersections191.2600to191.2630;
13 (4)Theveteranreceivingthetherapyresideswithinthisstate;
14 (5)Anyhyperbaricchamberusedtotreattheveteranmeetstheminimum
15standardsforpatientsestablishedbytheUnitedStatesFoodandDrugAdministration;
16 (6)ThefacilitycomplieswiththefederalHealthInsuranceandPortability

191.2615.1.(1)Thereisherebycreatedinthestatetreasurythe"Veterans
2TraumaticBrainInjuryTreatmentandRecoveryFund".Thefundshallconsistofany
3appropriations,gifts,bequests,orpublicorprivatedonationstosuchfund.Thestate
4treasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180,
5thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,
6uponappropriation,moneysinthisfundshallbeusedsolelyforreimbursementsto
7facilitiesforhyperbaricoxygentherapyprovidedtoveterans,foradministrative
8expensesincurredbythecommissionindistributingsuchreimbursements,andfor
9studiesontheuseofalternativetherapiestotreatveteranswithposttraumaticstress
10disorderandtraumaticbraininjuries.
11 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
12remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
13generalrevenuefund.
14 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
15otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
16creditedtothefund.
17 2.Anyfacilitythatintendstoseekreimbursementfromthefundforhyperbaric
18oxygentherapyprovidedtoaveteranshallrequestadvanceapprovalfromthe
19commissionforreimbursementbeforeprovidingsuchtherapy.Uponapprovalbythe
20commission,thecommissionshallsetasidetheappropriateamountoffundstoensure
21fullpaymentfortheveteran'stherapy.Ifmoneysremaininginthefundareinsufficient
22toensurefullpayment,thecommissionshalldenythefacility'srequestforadvance
23approval.
24 3.Ifattheendofthesix-monthperiodimmediatelyfollowingthedatethe
25commissionapprovedthefacility'srequestforadvanceapprovalthefacilityhasnot
26submittedanybillstothecommissionfortheveteranorprovidedanytherapyforthe
27veteran,thecommissionshallnotifytheveteranandthefacilitythatthefunding
HCSHB1490	7 28reservedfortheveteranshallexpirewithinthirtydaysifthefacilityfailstonotifythe
29commissionthattherapyisscheduledorcontinued.Ifthefacilityfailstonotifythe
30commissionthattherapyisscheduledorcontinuedwithinthirtydays,thecommission
31shallreleasethefundsreservedfortheveteranandmakethemavailableforanother
32veteran'stherapyundersections191.2600to191.2630.
33 4.Afterreceivingadvanceapprovalfromthecommissionandproviding
34hyperbaricoxygentherapytoaveteraninaccordancewithsections191.2600to
35191.2630,thefacilityshallnotbilltheveteranforthetherapybutshallsubmitthebill
36forthetherapytothecommission.
37 5.Thecommissionshallpaythebillforthetherapyreceivedinaccordancewith
38subsection4ofthissectionfromthefundwithinforty-fivedaysofreceipt.Ifthecostsof
39thetherapyexceedtheavailabilityofmoneysremaininginthefund,thefacilityshallnot
40holdtheveteranresponsibleforanypayment,andthecommissionshallnothaveany
41obligationtomakepaymentstothefacilityinanamountthatexceedstheamountthat
42wassetasideuponadvanceapprovalasdescribedinsubsection2ofthissection.
43 6.Thecommissionshallseekreimbursementforpaymentsmadetofacilitiesfor
44treatingveteranswithhyperbaricoxygentherapyfromanyofthefollowingentities
45basedontheefficacyoftreatmentsasdemonstratedinthehealingoftraumaticbrain
46injuriesthroughhyperbaricoxygentherapybycognitivetesting,brainscans,orother
47assessmentprotocolsmedicallyacceptedbytheUnitedStatesFoodandDrug
48AdministrationortheUnitedStatesDepartmentofDefenseundertheWarRisk
49InsuranceAct,asamended:
50 (1)TheTricareprogramoftheUnitedStatesDepartmentofDefense;
51 (2)Appropriatefederalagencies,includingtheVeteransHealthAdministration;
52and
53 (3)Anyotherresponsiblethird-partypayer.
54 7.Thedepartmentofhealthandseniorservicesshallawardfundstoentitiesto
55studytheuseofalternativetherapiestotreatveteranswithposttraumaticstress
56disorderandtraumaticbraininjuries.
191.2620.1.Anyfacilitymayapprovehyperbaricoxygentherapyforaveteran
2inaccordancewithsections191.2600to191.2630.
3 2.Alicensingboardshallnotrevoke,failtorenew,suspend,ortakeanyaction
4againstahealthcarepractitionerbasedsolelyonthehealthcarepractitioner's
5recommendationstoaveteranregardingaccesstoortreatmentwithhyperbaricoxygen
6therapy.

8carepractitioner'sMedicareorMedicaidcertificationbasedsolelyonthehealthcare
9practitioner'srecommendationthataveteranhaveaccesstohyperbaricoxygentherapy.
10 4.Noofficialemployeeoragentofthestateshallblockorattempttoblockaccess
11tohyperbaricoxygentherapybyaveteranwhomeetsallrequirementstoreceivesuch
12therapyundersections191.2600to191.2630.
13 5.Counseling,advice,orrecommendationsprovidedbyahealthcare
14practitionerconsistentwiththemedicalstandardsofcareshallnotbeconsidereda
15violationofsections191.2600to191.2630.
16 6.Hyperbaricoxygentherapymaybeusedunderthedirectionofan
17institutionalreviewboardwithanationalclinicaltrialnumberforthepurposeof
18collectingclinicaltrialdata.
191.2625.1.Anyfacilitythatreceivesreimbursementfromthefundshall:
2 (1)Providereportsonindividualveteransandgroupsofveteranstothe
3commissiononmeasuredhealthimprovementsfromacceptedandapprovedcognitive
4testingprotocols,brainimaging,orothermedicalassessmentsapprovedbytheindustry,
5theUnitedStatesFoodandDrugAdministration,theUnitedStatesDepartmentof
6Defense,Tricare,ortheCentersforMedicareandMedicaidServicesconductedbefore
7andaftertherapy;and
8 (2)Submitanannualreporttothecommissionwiththefollowinginformation:
9 (a)Thenumberofveteranswhoreceivedhyperbaricoxygentherapyatthe
10facility;
11 (b)Thedemographicsoftheveteranswhoreceivedhyperbaricoxygentherapy
12atthefacility;
13 (c)Thenumberofactualhyperbaricoxygentherapydivesbyveterans
14completedatthefacility;
15 (d)Cognitivetestresultsofveteranswhoreceivedhyperbaricoxygentherapyat
16thefacility;and
17 (e)Anytestimonialsprovidedbyveteransvoluntarily.
18 2.(1)BeforeJanuaryfirsteachyear,thecommissionshallprepareareport
19detailingeachtreatmentofhyperbaricoxygentherapyprovidedtoaveteranin
20accordancewithsections191.2600to191.2630,theprovidertypeforeachtreatment
21provided,thenumberofveteranstreatedorserved,thetreatmentoutcomesforthe
22veteranstreatedorserved,andadetailedaccountingofthemoneysusedinthefund
23duringtheimmediatelyprecedingfiscalyear.
24 (2)Thecommissionshallsubmitthereportpreparedundersubdivision(1)of
25thissubsectiontothegovernor,thepresidentprotemporeofthesenate,thespeakerof
HCSHB1490	9 26thehouseofrepresentatives,andthedirectorofthedepartmentofhealthandsenior
27services.
28 3.BeforeJanuarythirtietheachyear,thedepartmentofhealthandsenior
29servicesshallsubmittothegovernorareportcontaining:

191.2630.Thecommissionandthedepartmentofhealthandseniorservicesshall
2jointlypromulgateallnecessaryrulesandregulationsfortheadministrationofsections
3191.2600to191.2630.Anyruleorportionofarule,asthattermisdefinedinsection

4vehiclelicenseplates,foranymotorvehiclethepersonowns,eithersolelyorjointly,
5otherthananapportionedmotorvehicleoracommercialmotorvehiclelicensedin
6excessoftwenty-fourthousandpoundsgrossweight.Anysuchpersonshallmake
7applicationforthelicenseplatesauthorizedbythissectiononaformprovidedbythe
8directorofrevenueandfurnishsuchproofofserviceinAfghanistanandIraq,the
9awardingoftheAfghanistanCampaignmedalandtheIraqCampaignmedal,and
10statusascurrentlyservinginabranchoftheArmedForcesoftheUnitedStatesorasan
11honorablydischargedveteranasthedirectormayrequire.Uponpresentationofthe
12proofofeligibility,paymentofafifteen-dollarfeeinadditiontotheregularregistration
13fees,andpresentationofdocumentsthatmayberequiredbylaw,thedirectorshallthen

301.3182.AnypersonwhoservedasamemberoftheArmedForcesofthe
2UnitedStatesinAfghanistan,whowasawardedtheAfghanistanCampaignmedal,may
3applyforAfghanistanVeteranvehiclelicenseplates,foranymotorvehicletheperson
4owns,eithersolelyorjointly,otherthananapportionedmotorvehicleoracommercial
5motorvehiclelicensedinexcessoftwenty-fourthousandpoundsgrossweight.Anysuch
6personshallmakeapplicationforthelicenseplatesauthorizedbythissectiononaform
7providedbythedirectorofrevenueandfurnishsuchproofofserviceinAfghanistan,
8theawardingoftheAfghanistanCampaignmedal,andstatusascurrentlyservingina
9branchoftheArmedForcesoftheUnitedStatesorasanhonorablydischargedveteran
10asthedirectormayrequire.Uponpresentationoftheproofofeligibility,paymentofa
11fifteen-dollarfeeinadditiontotheregularregistrationfees,andpresentationof
12documentsthatmayberequiredbylaw,thedirectorshallthenissuelicenseplates
