BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section442.404,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection442.404,toreadasfollows: 442.404.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Homeowners'association",anonprofitcorporationorunincorporatedassociation 3ofhomeownerscreatedunderadeclarationtoownandoperateportionsofaplanned 4communityorotherresidentialsubdivisionthathasthepowerunderthedeclarationtoassess 5associationmemberstopaythecostsandexpensesincurredintheperformanceofthe 6association'sobligationsunderthedeclarationortenants-in-commonwithrespecttothe 7ownershipofcommongroundoramenitiesofaplannedcommunityorotherresidential 8subdivision.Thistermshallnotincludeacondominiumunitowners'associationasdefined 9andprovidedforinsubdivision(3)ofsection448.1-103oraresidentialcooperative; 10 (2)"Politicalsigns",anyfixed,ground-mounteddisplayinsupportoforinopposition 11toapersonseekingelectedofficeoraballotmeasureexcludinganymaterialsthatmaybe 12attached; 13 (3)"Solarpanelorsolarcollector",adeviceusedtocollectandconvertsolarenergy 14intoelectricityorthermalenergy,includingbutnotlimitedtophotovoltaiccellsorpanels,or 15solarthermalsystems. 16 2.(1)Nodeedrestrictions,covenants,orsimilarbindingagreementsrunningwith 17thelandshallprohibitorhavetheeffectofprohibitingthedisplayofpoliticalsigns. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (2)Ahomeowners'associationhastheauthoritytoadoptreasonablerules,subjectto 19anyapplicablestatutesorordinances,regardingthetime,size,place,number,andmannerof 20displayofpoliticalsigns. 21 (3)Ahomeowners'associationmayremoveapoliticalsignwithoutliabilityifsuch 22signisplacedwithinthecommonground,threatensthepublichealthorsafety,violatesan 23applicablestatuteorordinance,isaccompaniedbysoundormusic,orifanyothermaterials 24areattachedtothepoliticalsign.Subjecttotheforegoing,ahomeowners'associationshall 25notremoveapoliticalsignfromthepropertyofahomeownerorimposeanyfineorpenalty 26uponthehomeownerunlessithasgivensuchhomeownerthreedaysafterprovidingwritten 27noticetothehomeowner,whichnoticeshallspecificallyidentifytheruleandthenatureofthe 28violation. 29 3.(1)Nodeedrestrictions,covenants,orsimilarbindingagreementsrunningwith 30thelandshalllimitorprohibit,orhavetheeffectoflimitingorprohibiting,theinstallationof 31solarpanelsorsolarcollectorsontherooftopofanypropertyorstructure. 32 (2)Ahomeowners'associationmayadoptreasonablerules,subjecttoanyapplicable 33statutesorordinances,regardingtheplacementofsolarpanelsorsolarcollectorstotheextent 34thatthoserulesdonotpreventtheinstallationofthedevice,impairthefunctioningofthe 35device,restricttheuseofthedevice,oradverselyaffectthecostorefficiencyofthedevice. 36 (3)Theprovisionsofthissubsectionshallapplyonlywithregardtorooftopsthatare 37owned,controlled,andmaintainedbytheowneroftheindividualpropertyorstructure. 38 4.(1)Nodeedrestrictions,covenants,orsimilarbindingagreementsrunningwith 39thelandshallprohibitorhavetheeffectofprohibitingthedisplayofsalesignsonthe 40propertyofahomeownerorpropertyownerincluding,butnotlimitedto,anyyardonthe 41property,ornearbystreetcorners. 42 (2)Ahomeowners'associationhastheauthoritytoadoptreasonablerules,subjectto 43anyapplicablestatutesorordinances,regardingthetime,size,place,number,andmannerof 44displayofsalesigns. 45 (3)Ahomeowners'associationmayremoveasalesignwithoutliabilityifsuchsignis 46placedwithinthecommonground,threatensthepublichealthorsafety,violatesanapplicable 47statuteorordinance,isaccompaniedbysoundormusic,orifanyothermaterialsareattached 48tothesalesign.Subjecttotheforegoing,ahomeowners'associationshallnotremoveasale 49signfromthepropertyofahomeownerorpropertyownerorimposeanyfineorpenaltyupon 50thehomeownerorpropertyownerunlessithasgivensuchhomeownerorpropertyowner 51threebusinessdaysafterthehomeownerorpropertyownerreceiveswrittennoticefromthe 52homeowners'association,whichnoticeshallspecificallyidentifytheruleandthenatureof 53theallegedviolation.
