407.3000.1.Theprovisionsofsections407.3000to407.3002shallbeknownand
2maybecitedasthe"DigitalFairRepairAct".
3 2.Asusedinsections407.3000to407.3002,thefollowingtermsmean:
4 (1)"Authorizedrepairprovider",anindividualorbusinessthatisunaffiliated
5withanoriginalequipmentmanufacturerandthathasanarrangementwiththe
6originalequipmentmanufacturer,foradefiniteorindefiniteperiod,underwhichthe
7originalequipmentmanufacturergrantstotheindividualorbusinessalicensetousea
8tradename,servicemark,orotherproprietaryidentifierforthepurposesofoffering
9theservicesofdiagnosis,maintenance,orrepairofdigitalelectronicequipmentunder
10thenameoftheoriginalequipmentmanufacturer,orotherarrangementwiththe
11originalequipmentmanufacturertooffersuchservicesonbehalfoftheoriginal
12equipmentmanufacturer.Anoriginalequipmentmanufacturerthatofferstheservices
13ofdiagnosis,maintenance,orrepairofitsowndigitalelectronicequipmentbutthatdoes
14nothaveanarrangementdescribedinthissubdivisionwithanunaffiliatedindividualor
15businessshallbeconsideredanauthorizedrepairproviderwithrespecttosuch
16equipment;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)"Digitalelectronicequipment"or"equipment",anyproductthatdepends
18foritsfunctioning,inwholeorinpart,ondigitalelectronicsembeddedinorattachedto
19theproduct;
20 (3)"Documentation",anymanual,diagram,reportingoutput,servicecode
21description,schematicdiagram,orsimilarkindsofinformationprovidedtoan
22authorizedrepairproviderforpurposesofitseffectingtheservicesofdiagnosis,
23maintenance,orrepairofdigitalelectronicequipment;
24 (4)"Embeddedsoftware",anyprogrammableinstructionsprovidedon
25firmwaredeliveredwithdigitalelectronicequipment,orwithapartforsuch
26equipment,forpurposesofequipmentoperation,includingallrelevantpatchesand
27fixesmadebythemanufacturerofsuchequipmentorpartforthesepurposes;
28 (5)"Fairandreasonableterms"forobtainingapart,tool,ordocumentation;at
29costsandtermsincludingconvenienceofdeliveryandofenablingfunctionality,and
30includingrightsofuse,equivalenttothemostfavorablecostsandtermsofferedbythe
31originalequipmentmanufacturertoanauthorizedrepairprovider,usingthenetcosts

37physicalprintedform,achargemaybeincludedforthereasonableactualcostsof

58 (9)"Motorvehicle",avehiclethatisdesignedfortransportingpersonsor

16 (b)Theownerofdigitalelectronicequipmentmanufacturedbyoronbehalfof,
17orsoldby,theoriginalequipmentmanufacturer,

19anyspecialdocumentation,parts,andtoolsneededtoresetthelockorsecurity-related
20functionwhendisabledinthecourseofdiagnosis,maintenance,orrepairofthe

24unlawfulpracticeundertheMerchandisingPracticesAct,sections407.010to407.130.
25Allremedies,penalties,andauthoritygrantedtotheattorneygeneralundersections
26407.010to407.130shallbeavailablefortheenforcementofsections407.3000to
27407.3002.
28 3.(1)Nothinginsections407.3000to407.3002shallbeconstruedtorequirean
29originalequipmentmanufacturertodivulgeatradesecrettoanowneroran
30independentrepairproviderexceptasnecessarytoprovidedocumentation,parts,and
31toolsonfairandreasonableterms.
