Torepealsection260.558,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
radioactivewasteinvestigationfund.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section260.558,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection260.558,toreadasfollows:
260.558.1.Thereisherebycreatedinthestatetreasurythe"RadioactiveWaste
2InvestigationFund".Thestatetreasurershallbecustodianofthefund.Inaccordancewith
3sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefundshallbe
4adedicatedfundand,uponappropriation,moneysinthefundshallbeusedsolelybythe
5departmentofnaturalresourcestoinvestigateconcernsofexposuretoradioactivewaste.
6Uponwrittenrequestbyalocalgoverningbodyexpressingconcernsofradioactivewaste
7contaminationinaspecifiedareawithinitsjurisdiction,thedepartmentofnaturalresources
8shallusemoneysintheradioactivewasteinvestigationfundtodevelopandconductan
9investigation,usingsoundscientificmethods,forthespecifiedareaofconcern.Therequest
10byalocalgoverningbodyshallincludeaspecifiedareaofconcernandanysupporting
11documentationrelatedtotheconcern.Thedepartmentshallprioritizerequestsintheorderin
12whichtheyarereceived,exceptthatthedepartmentmaygiveprioritytorequeststhatarein
13closeproximitytofederallydesignatedsiteswhereradioactivecontaminantsareknownor
14reasonablyexpectedtoexist.Theinvestigationshallbeperformedbyapplicablefederalor
15stateagenciesorbyaqualifiedcontractorselectedbythedepartmentthroughacompetitive
16biddingprocess.Inconductinganinvestigationunderthissection,thedepartmentshallwork
17withtheapplicablegovernmentagencyorapprovedcontractor,aswellaslocalofficials,to

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18developasamplingandanalysisplantodetermineifradioactivecontaminantsintheareaof
19concernexceedfederalstandardsforremedialactionduetocontamination.The
20investigationmayincludethecollectionofsoil,dust,andwatersamplesfromthe
21specifiedarea.Withinaresidentialarea,thisplanmayinclude[dust] samplescollected
22insideresidentialhomesonlyafterobtainingpermissionfromthehomeowners.Thesamples
23shallbeanalyzedfortheisotopesnecessarytocorrelatethesampleswiththesuspected
24contamination,asdescribedinthesamplingandanalysisplan.Withinforty-fivedaysof
25receivingthefinalsamplingresults,thedepartmentshallreporttheresultstotheattorney
26generalandthelocalgoverningbodythatrequestedtheinvestigationandmakethefinalized
27reportandtestingresultspubliclyavailableonthedepartment'swebsite.
28 2.Thetransfertothefundfromthehazardouswastefundshallnotexceed[one
29hundredfifty]threehundredthousanddollarsperfiscalyear.Investigationcostsexpended
30fromthisfundshallnotexceed[onehundredfifty]threehundredthousanddollarsfromthe
31hazardouswastefundandanyadditionalgeneralrevenuefundsappropriatedperfiscal
32year.Anymoneysremaininginthefundattheendofthebienniumshallreverttothecredit
33ofthehazardouswastefund.
34 3.Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother
35fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto
36thefund.
