radioactivewasteinvestigationfund.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section260.558,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection260.558,toreadasfollows:
260.558.1.Thereisherebycreatedinthestatetreasurythe"RadioactiveWaste
2InvestigationFund".Thestatetreasurershallbecustodianofthefund.Inaccordancewith
3sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefundshallbe
4adedicatedfundand,uponappropriation,moneysinthefundshallbeusedsolelybythe
5departmentofnaturalresourcestoinvestigateconcernsofexposuretoradioactivewaste.
6[Uponwrittenrequestbyalocalgoverningbodyexpressingconcernsofradioactivewaste
7contaminationinaspecifiedareawithinitsjurisdiction,]
8 2.(1)Thedepartmentofnaturalresourcesshallusemoneysintheradioactivewaste
9investigationfundtodevelopandconductaninvestigation,usingsoundscientificmethods,
10forthespecifiedareaofconcern.[Therequestbyalocalgoverningbodyshallincludea
11specifiedareaofconcernandanysupportingdocumentationrelatedtotheconcern.The
12departmentshallprioritizerequestsintheorderinwhichtheyarereceived,exceptthatthe
13department] Theselectionandpriorityofsitesshallbedeterminedbythedepartment.
14Thedepartmentmaygiveprioritytorequeststhatareincloseproximitytofederally
15designatedsiteswhereradioactivecontaminantsareknownorreasonablyexpectedtoexist.
16 (2)Thedepartmentmayuseinformationreceivedfromlocaljurisdictionsor
17individualsastowhereinvestigationsmaybeneeded.Thedepartmentmayalsodecide

20 (3)Thedepartmentshallorganizeandprioritizetheinformationfromall
21sourcestodevelopaplanastohowanyinvestigationmayproceed.Thedepartment
22mayholdpublicmeetingsrelatedtotheorganizationanddatacollection.Allmeetings
23relatedtotheprioritizationofinvestigationsshallbeheldduringapublicmeeting.All
24plansrelatedtoanyinvestigationshallbeconsideredpublicinformation.Preliminary
25investigationandworkproductmaybepublicatthedepartment'sdiscretion.Allfinal
26reports,includinganysupportingdocumentationandtestresults,shallbepublic
27followingapubliccommentperiodofnotlessthanninetydays.Duringthepublic
28commentperiod,thedepartmentshallacceptcommentsfromthepubliconthe
29preliminaryreport.Duringthepubliccommentperiod,thepreliminaryreportandall
30supportingdocumentationandtestresultsshallbeavailableonthedepartment's
31website.
32 3.Theinvestigationshallbeperformedbyapplicablefederalorstateagenciesorbya
33qualifiedcontractorselectedbythedepartmentthroughacompetitivebiddingprocess.In
34conductinganinvestigationunderthissection,thedepartmentshallworkwiththeapplicable
35governmentagencyorapprovedcontractor,aswellaslocalofficials,todevelopasampling
36andanalysisplantodetermineifradioactivecontaminantsintheareaofconcernexceed
37federalstandardssetbytheUnitedStatesEnvironmentalProtectionAgencyforremedial
38actionduetocontamination.Theinvestigationmayincludethecollectionofsoil,dust,
39andwatersamplesfromthespecifiedarea.Withinaresidentialarea,thisplanmayinclude
40[dust] samplescollectedinsideresidentialhomesonlyafterobtainingpermissionfromthe
41homeowners.Thesamplesshallbeanalyzedfortheisotopesnecessarytocorrelatethe
42sampleswiththesuspectedcontamination,asdescribedinthesamplingandanalysisplan.
43 4.Ifthedepartmenthasevidenceorreasonablysuspectsthatradioactive
44contaminantsarelocatedonpropertyownedbyagovernmentalagency,regardlessof
45whetherthepropertyisaccessibletothepublic,oraprivateentitythatwillnotgrant
46accesstocollectsamples,thedepartmentshallseekawarranttoaccessthepropertyto
47collectanysamplesauthorizedundersubsection4ofthissection.
48 5.Withinforty-fivedaysofreceivingthefinalsamplingresults,thedepartmentshall
49reporttheresultstotheattorneygeneral[andthelocalgoverningbodythatrequestedthe
50investigation] andmakethefinalizedreportandtestingresultspubliclyavailableonthe
51department'swebsite.
52 [2.]6.Thetransfertothefundfromthehazardouswastefundshallnotexceed[one
53hundredfiftythousand] onemilliondollarsperfiscalyear.Investigationcostsexpended
54fromthisfundshallnotexceed[onehundredfiftythousand] onemilliondollarsfromthe
HCSHB1673	2 55hazardouswastefundandanyadditionalgeneralrevenuefundsappropriatedperfiscal
56year.Anymoneysremaininginthefundattheendofthebienniumshallreverttothecredit
57ofthehazardouswastefund.
58 [3.]7.Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother
59fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto
60thefund.
