BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter170,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection170.027,toreadasfollows:
170.027.1.Asusedinthissection,"drivereducationinstructionandtraining"
2meansinstructionandtrainingthatoffersinstructionintheuseandoperationofmotor
3vehiclesincluding,butnotlimitedto,instructioninthesafeoperationofmotorvehicles
4andrulesoftheroadandthelawsofthisstaterelatingtomotorvehicles.
5 2.Thestateboardofeducationshalldevelopandrecommendaprogramof
6drivereducationinstructionandtrainingtobeofferedaspartoftheone-halfunitof
7creditinhealtheducationineachpublicschooldistrictandcharterschooloffering
8coursestopupilsingradestenthroughtwelve.Theboardshallmakesuchdriver
9educationinstructionandtrainingavailableforthe2025-26schoolyearandall
10subsequentschoolyears.Eachpublicschooldistrictandcharterschoolshalloffersuch
11instructionandtrainingorasubstantiallysimilarprogramofdrivereducation
12instructionandtrainingtopupilsingradestenthroughtwelveinthe2025-26school
13yearandallsubsequentschoolyears.
14 3.Thedrivereducationinstructionandtrainingrequiredunderthissection
15shall:
16 (1)Instructpupilsabouttheoperationofmotorvehicles;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Emphasizethedevelopmentofknowledge,attitudes,habits,andskills
18necessaryforthesafeoperationofmotorvehicles;
19 (3)Provideinstructionondistracteddrivingasamajortrafficsafetyissue;
20 (4)Provideinstructiononspecialhazardsexistingatemergencysituationsand
21requiredsafetyanddrivingprecautionsthatshallbeobservedinsuchsituationsandat
22highwayconstructionandmaintenancezones,railroadcrossings,andtheapproaches
23thereto;
24 (5)Provideinstructionconcerninglawenforcementproceduresfortrafficstops,
25includingademonstrationoftheproperactionstobetakenduringatrafficstopand
26appropriateinteractionswithlawenforcement;and
27 (6)Providesuchotherinstructiondevelopedbythestateboardofeducationin
28conjunctionwiththedepartmentoftransportationandtheMissouristatehighway
29patrolthatisdeemednecessarytoinstructpupilsontheoperationandequipmentof
30motorvehicles.
31 4.(1)Thedrivereducationinstructionandtrainingrequiredunderthissection
32shallnotrequireanypupiltophysicallyoperateamotorvehicleaspartofsuch
33instructionandtraining.
34 (2)Thissectionshallnotbeconstruedtoprohibitanypublicschooldistrictor
35charterschoolfromofferinganelectivedrivereducationcoursethatisdifferentfrom
36thedrivereducationinstructionandtrainingrequiredunderthissection.
37 5.Thestateboardofeducationmaypromulgateallnecessaryrulesand
38regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
39termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
40sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
41provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
42536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
43pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
44arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
45andanyruleproposedoradoptedafterAugust28,2024,shallbeinvalidandvoid.
