HB1695 2 210.115.1.Whenanyphysician,medicalexaminer,coroner,dentist,chiropractor, 2optometrist,podiatrist,resident,intern,nurse,hospitalorclinicpersonnelthatareengagedin 3theexamination,care,treatmentorresearchofpersons,andanyotherhealthpractitioner, 4psychologist,mentalhealthprofessional,socialworker,daycarecenterworkerorotherchild- 5careworker,juvenileofficer,probationorparoleofficer,jailordetentioncenterpersonnel, 6teacher,principalorotherschoolofficial,ministerasprovidedbysection352.400,peace 7officerorlawenforcementofficial,animalcontrolofficer,animalhumaneinvestigatoras 8definedinsection273.415,volunteerorpersonnelofacommunityserviceprogramthat 9offerssupportservicesforfamiliesincrisistoassistinthedelegationofanypowersregarding 10thecareandcustodyofachildbyaproperlyexecutedpowerofattorneypursuanttosections 11475.600to475.604,orotherpersonwithresponsibilityforthecareofchildrenhasreasonable 12causetosuspectthatachildhasbeenormaybesubjectedtoabuseorneglectorobservesa 13childbeingsubjectedtoconditionsorcircumstanceswhichwouldreasonablyresultinabuse 14orneglect,thatpersonshallimmediatelyreporttothedivisioninaccordancewiththe 15provisionsofsections210.109to210.183.Nointernalinvestigationshallbeinitiateduntil 16suchareporthasbeenmade.Asusedinthissection,theterm"abuse"isnotlimitedtoabuse 17inflictedbyapersonresponsibleforthechild'scare,custodyandcontrolasspecifiedin 18section210.110,butshallalsoincludeabuseinflictedbyanyotherperson. 19 2.Iftwoormoremembersofamedicalinstitutionwhoarerequiredtoreportjointly 20haveknowledgeofaknownorsuspectedinstanceofchildabuseorneglect,asinglereport 21maybemadebyadesignatedmemberofthatmedicalteam.Anymemberwhohas 22knowledgethatthememberdesignatedtoreporthasfailedtodososhallthereafter 23immediatelymakethereport.Nothinginthissection,however,ismeanttoprecludeany 24personfromreportingabuseorneglect. 25 3.Thereportingrequirementsunderthissectionareindividual,andnosupervisoror 26administratormayimpedeorinhibitanyreportingunderthissection.Nopersonmakinga 27reportunderthissectionshallbesubjecttoanysanction,includinganyadverseemployment 28action,formakingsuchreport.Everyemployershallensurethatanyemployeerequiredto 29reportpursuanttosubsection1ofthissectionhasimmediateandunrestrictedaccessto 30communicationstechnologynecessarytomakeanimmediatereportandistemporarily 31relievedofotherworkdutiesforsuchtimeasisrequiredtomakeanyreportrequiredunder 32subsection1ofthissection. 33 4.Notwithstandinganyotherprovisionofsections210.109to210.183,anychildwho 34doesnotreceivespecifiedmedicaltreatmentbyreasonofthelegitimatepracticeofthe 35religiousbeliefofthechild'sparents,guardian,orotherslegallyresponsibleforthechild,for 36thatreasonalone,shallnotbefoundtobeanabusedorneglectedchild,andsuchparents, 37guardianorotherpersonslegallyresponsibleforthechildshallnotbeenteredintothecentral HB1695 3 38registry.However,thedivisionmayacceptreportsconcerningsuchachildandmay 39subsequentlyinvestigateorconductafamilyassessmentasaresultofthatreport.Suchan 40exceptionshallnotlimittheadministrativeorjudicialauthorityofthestatetoensurethat 41medicalservicesareprovidedtothechildwhenthechild'shealthrequiresit. 42 5.Inadditiontothosepersonsandofficialsrequiredtoreportactualorsuspected 43abuseorneglect,anyotherpersonmayreportinaccordancewithsections210.109to210.183 44ifsuchpersonhasreasonablecausetosuspectthatachildhasbeenormaybesubjectedto 45abuseorneglectorobservesachildbeingsubjectedtoconditionsorcircumstanceswhich 46wouldreasonablyresultinabuseorneglect. 47 6.Anypersonorofficialrequiredtoreportpursuanttothissection,including 48employeesofthedivision,whohasprobablecausetosuspectthatachildwhoisormaybe 49undertheageofeighteen,whoiseligibletoreceiveacertificateoflivebirth,hasdiedshall 50reportthatfacttotheappropriatemedicalexaminerorcoroner.If,uponreviewofthe 51circumstancesandmedicalinformation,themedicalexaminerorcoronerdeterminesthatthe 52childdiedofnaturalcauseswhileundermedicalcareforanestablishednaturaldisease,the 53coroner,medicalexaminerorphysicianshallnotifythedivisionofthechild'sdeathandthat 54thechild'sattendingphysicianshallbesigningthedeathcertificate.Inallothercases,the 55medicalexaminerorcoronershallacceptthereportforinvestigation,shallimmediatelynotify 56thedivisionofthechild'sdeathasrequiredinsection58.452andshallreportthefindingsto 57thechildfatalityreviewpanelestablishedpursuanttosection210.192. 58 7.Anypersonorindividualrequiredtoreportmayalsoreportthesuspicionofabuse 59orneglecttoanylawenforcementagencyorjuvenileoffice.Suchreportshallnot,however, 60taketheplaceofreportingtothedivision. 61 8.Ifanindividualrequiredtoreportsuspectedinstancesofabuseorneglectpursuant 62tothissectionhasreasontobelievethatthevictimofsuchabuseorneglectisaresidentof 63anotherstateorwasinjuredasaresultofanactwhichoccurredinanotherstate,theperson 64requiredtoreportsuchabuseorneglectmay,inlieuofreportingtotheMissourichildren's 65division,makesuchareporttothechildprotectionagencyoftheotherstatewiththeauthority 66toreceivesuchreportspursuanttothelawsofsuchotherstate.Ifsuchagencyacceptsthe 67report,noreportisrequiredtobemade,butmaybemade,tothechildren'sdivision. 68 9.Forthepurposesofprovidingsupportiveservicesorverifyingthestatusofayouth 69asunaccompaniedorhomelessforthepurposesofaccessingsupportiveservices,thefactthat 70achildisanunaccompaniedyouthasdefinedin42U.S.C.Section11434a(6)isnot,inandof 71itself,asufficientbasisforreportingchildabuseorneglect,unlessthechildisundersixteen 72yearsofageorisanincapacitatedperson,asdefinedinsection475.010.Nothinginthis 73subsectionshalllimitamandatedreporterfrommakingareportunderthissectionifthe HB1695 4 74mandatedreporterknowsorhasreasonablecausetosuspectthatanunaccompaniedyouthhas 75beenormaybeavictimofabuseorneglect. 210.191.1.Allchildren'sdivisionemployees,andcontractorsforchildren's 2services,whohavedirectcontactwithchildrenthroughthestate'schildprotectionand 3welfaresystemshallberequiredtocompleteatleastonehourofcompanionanimal 4abuseorneglecttrainingwithinthefirstsixtydaysofemploymentorcontract.The 5trainingshallincludethefollowing: 6 (1)Requirementstoreportcompanionanimalabuseorneglectundersection 7273.410; 8 (2)Howtoidentifycompanionanimalabuseorneglect; 9 (3)Howtomakeareportofcompanionanimalabuseorneglect;and 10 (4)Therelationshipbetweenchildabuseorneglectandcompanionanimalabuse 11orneglect. 12 2.Thedivision,inconsultationwithanimalwelfareassociations,shalldevelopor 13adaptanduseavailabletrainingmaterialsforthetrainingrequiredunderthissection. 14Personsrequiredtocompletetrainingunderthissectionshallbeprovidedwith 15opportunitiestodosoduringregularworkinghours. 16 3juvenileofficer,probationorparoleofficer,homehealthaide,adultprotectiveservices 4worker,orvolunteerorpersonnelofacommunityserviceprogramthatofferssupport 5oradvocacyservicesforchildreninfostercarehasreasonablecausetosuspectthata 6companionanimalhasbeenormaybesubjectedtoabuseorneglectorobservesa 7companionanimalbeingsubjectedtoconditionsorcircumstancesthatwould 8reasonablyresultinabuseorneglect,thatpersonshallimmediatelymakeareportto 9thehotlineestablishedandoperatedbytheMissouriAnimalControlAssociation 10(MACA). 11 2.Thehotlineworkershallrequestallofthefollowinginformationforthe 12report: 13 (1)Thenameanddescriptionofthecompanionanimalinvolved,ifknown; 14 (2)Theaddressandtelephonenumberoftheownerorotherpersonresponsible 15forthecareofthecompanionanimal,ifknown; 16 (3)Thenatureandextentofthesuspectedabuseorneglect;and HB1695 5 17 (4)Anyotherinformationthatthepersonmakingthereportbelievesmaybe 18usefulinestablishingtheexistenceofthesuspectedabuseorneglectortheidentityofthe 19personcausingtheabuseorneglect. 20 3.Uponreceivingareportofsuspectedabuseorneglect,MACAshallprovide 21thereporttoanydulyauthorizedlawenforcementofficial,countyormunicipalanimal 22controlofficer,oranyMissouripeaceofficerstandardsandtraining(POST)certifiedor 23MACA-certifiedanimalcrueltyinvestigator. 24 4.Anypersonrequiredtoreportcompanionanimalabuseorneglectunderthis 25sectionshallbeimmunefromcivilorcriminalliabilityinconnectionwithmakingany 26requiredreportsifthepersonactedingoodfaithwhenmakingsuchreport. 27 5.Nopersonrequiredtomakeareportofcompanionanimalabuseorneglect 28underthissectionshallknowinglymakeafalsereport.Thepenaltyformakingafalse 29reportandthedefensestoprosecutionshallbethesameasundersection575.080. 30 6.Ifanagencyorpoliticalsubdivisionofthestatedeterminesthatanemployee 31whoisamandatedreporterunderthissectionhasfailedtomakeareportasrequiredby 32thissection,theagencyorpoliticalsubdivisionshallissueawrittennoticetosuch 33employeethatshallincludeafindingoffactsinsupportofthefailuretomakeareport 34andanexplanationofthereportingrequirement.Suchnoticeshallnotberetainedina 35permanentemploymentfileandshallberetainedinaseparatefileordatabase 36maintainedbytheagencyorpoliticalsubdivision.Suchnoticeshallbeconsidereda 37closedrecordundertheprovisionsofchapter610. 38 7.Anypersonrequiredtomakeareportunderthissectionwhoissubjectto 39professionallicensureandwhofailstomakeareportasrequiredbythissectionshallbe 40subjecttodisciplinebyhisorherrespectivelicensingboardasfollows: 41 (1)Forthefirstinstanceofafailuretoreport,thelicensingboardshallissuea 42writtennoticetosuchemployeethatshallincludeafindingoffactsinsupportofthe 43failuretomakeareportandanexplanationofthereportingrequirement; 44 (2)Forasecondinstanceofafailuretoreport,thelicensingboardshallimposea 45fineofonehundreddollars;and 46 (3)Forathirdandeachsubsequentinstanceofafailuretoreport,thelicensing 47boardshallimposeafineoffivehundreddollars. 48 8.Asusedinthissection,theterm"companionanimal"meansalivingcreature
