58 (2)Informtherespondentofsuchprohibitioninwritingand,iftherespondentis 59present,orally;and 60 (3)ForwardtheordertotheMissouristatehighwaypatrolsothattheMissouri 61statehighwaypatrolcanupdatetherespondent'srecordintheNationalInstant 62CriminalBackgroundCheckSystem(NICS).Uponreceivinganorderunderthis 63subsection,theMissouristatehighwaypatrolshallnotifytheFederalBureauof 64Investigationwithintwenty-fourhours. 65 5.Averifiedpetitionseekingordersformaintenance,support,custody,visitation, 66paymentofrent,paymentofmonetarycompensation,possessionofpersonalproperty, 67prohibitingthetransfer,encumbrance,ordisposalofproperty,orpaymentforservicesofa 68shelterforvictimsofdomesticviolence,shallcontainallegationsrelatingtothoseordersand 69shallprayfortheordersdesired. 70 [5.]6.Inmakinganawardofcustody,thecourtshallconsiderallrelevantfactors 71includingthepresumptionthatthebestinterestsofthechildwillbeservedbyplacingthe 72childinthecustodyandcareofthenonabusiveparent,unlessthereisevidencethatboth 73parentshaveengagedinabusivebehavior,inwhichcasethecourtshallnotconsiderthis 74presumptionbutmayappointaguardianadlitemoracourt-appointedspecialadvocateto 75representthechildreninaccordancewithchapter452andshallconsiderallotherfactorsin 76accordancewithchapter452. 77 [6.]7.Thecourtshallgranttothenoncustodialparentrightstovisitationwithany 78minorchildborntooradoptedbytheparties,unlessthecourtfinds,afterhearing,that 79visitationwouldendangerthechild'sphysicalhealth,impairthechild'semotional 80developmentorwouldotherwiseconflictwiththebestinterestsofthechild,orthatno 81visitationcanbearrangedwhichwouldsufficientlyprotectthecustodialparentfromfurther 82domesticviolence.Thecourtmayappointaguardianadlitemorcourt-appointedspecial 83advocatetorepresenttheminorchildinaccordancewithchapter452wheneverthecustodial 84parentallegesthatvisitationwiththenoncustodialparentwilldamagetheminorchild. 85 [7.]8.Thecourtshallmakeanorderrequiringthenoncustodialpartytopayan 86amountreasonableandnecessaryforthesupportofanychildtowhomthepartyowesaduty 87ofsupportwhennopriororderofsupportisoutstandingandafterallrelevantfactorshave 88beenconsidered,inaccordancewithMissourisupremecourtrule88.01andchapter452. HB1819 3 89 [8.]9.Thecourtmaygrantamaintenanceordertoapartyforaperiodoftime,notto 90exceedonehundredeightydays.Anymaintenanceorderedbythecourtshallbein 91accordancewithchapter452. 92 [9.]10.(1)Thecourtmay,inordertoensurethatapetitionercanmaintainan 93existingwirelesstelephonenumberornumbers,issueanorder,afternoticeandan 94opportunitytobeheard,directingawirelessserviceprovidertotransferthebilling 95responsibilityforandrightstothewirelesstelephonenumberornumberstothepetitioner,if 96thepetitionerisnotthewirelessserviceaccountholder. 97 (2)(a)Theordertransferringbillingresponsibilityforandrightstothewireless 98telephonenumberornumberstothepetitionershalllistthenameandbillingtelephone 99numberoftheaccountholder,thenameandcontactinformationofthepersontowhomthe 100telephonenumberornumberswillbetransferred,andeachtelephonenumbertobe 101transferredtothatperson.Thecourtshallensurethatthecontactinformationofthepetitioner 102isnotprovidedtotheaccountholderinproceedingsheldunderthischapter. 103 (b)Uponissuance,acopyofthefullorderofprotectionshallbetransmitted,either 104electronicallyorbycertifiedmail,tothewirelessserviceprovider'sregisteredagentlisted 105withthesecretaryofstate,orelectronicallytotheemailaddressprovidedbythewireless 106serviceprovider.Suchtransmittalshallconstituteadequatenoticeforthewirelessservice 107provideractingunderthissectionandsection455.523. 108 (c)Ifthewirelessserviceprovidercannotoperationallyortechnicallyeffectuatethe 109orderduetocertaincircumstances,thewirelessserviceprovidershallnotifythepetitioner 110withinthreebusinessdays.Suchcircumstancesshallinclude,butnotbelimitedto,the 111following: 112 a.Theaccountholderhasalreadyterminatedtheaccount; 113 b.Thedifferencesinnetworktechnologypreventthefunctionalityofadeviceonthe 114network;or 115 c.Therearegeographicorotherlimitationsonnetworkorserviceavailability. 116 (3)(a)Upontransferofbillingresponsibilityforandrightstoawirelesstelephone 117numberornumberstothepetitionerunderthissubsectionbyawirelessserviceprovider,the 118petitionershallassumeallfinancialresponsibilityforthetransferredwirelesstelephone 119numberornumbers,monthlyservicecosts,andcostsforanymobiledeviceassociatedwith 120thewirelesstelephonenumberornumbers. 121 (b)Thissectionshallnotprecludeawirelessserviceproviderfromapplyingany 122routineandcustomaryrequirementsforaccountestablishmenttothepetitioneraspartofthis 123transferofbillingresponsibilityforawirelesstelephonenumberornumbersandanydevices 124attachedtothatnumberornumbersincluding,butnotlimitedto,identification,financial 125information,andcustomerpreferences. HB1819 4 126 (4)Thissectionshallnotaffecttheabilityofthecourttoapportiontheassetsand 127debtsofthepartiesasprovidedforinlaw,ortheabilitytodeterminethetemporaryuse, 128possession,andcontrolofpersonalproperty. 129 (5)Nocauseofactionshalllieagainstanywirelessserviceprovider,itsofficers, 130employees,oragents,foractionstakeninaccordancewiththetermsofacourtorderissued 131underthissection. 132 (6)Asusedinthissectionandsection455.523,a"wirelessserviceprovider"meansa 133providerofcommercialmobileserviceunderSection332(d)ofthefederal 134[Telecommunications] CommunicationsActof[1996] 1934(47U.S.C.Section[151,et 135seq.]332). 455.523.1.Anyfullorderofprotectiongrantedundersections455.500to455.538 2shallbetoprotectthevictimfromdomesticviolence,includingdangertothechild'spet, 3stalking,andsexualassaultmayincludesuchtermsasthecourtreasonablydeemsnecessary 4toensurethepetitioner'ssafety,includingbutnotlimitedto: 5 (1)Temporarilyenjoiningtherespondentfromcommittingdomesticviolenceor 6sexualassault,threateningtocommitdomesticviolenceorsexualassault,stalking,molesting, 7ordisturbingthepeaceofthevictim; 8 (2)Temporarilyenjoiningtherespondentfromenteringthefamilyhomeofthe 9victim,exceptasspecificallyauthorizedbythecourt; 10 (3)Temporarilyenjoiningtherespondentfromcommunicatingwiththevictiminany 11mannerorthroughanymedium,exceptasspecificallyauthorizedbythecourt. 12 2.If,afterahearingforanyfullorderofprotection,thecourtissuesanorderof 13protection,thecourtmayalso: 14 (1)Prohibittherespondentfromknowinglypossessingorpurchasingany 15firearmwhiletheorderisineffect; 48 (10)Awardpossessionandcareofanypet,alongwithanymoneysnecessarytocover 49medicalcoststhatmayhaveresultedfromabuseofthepet. 565.076.1.Apersoncommitstheoffenseofdomesticassaultinthefourthdegreeif 2theactinvolvesadomesticvictim,astheterm"domesticvictim"isdefinedundersection 3565.002,and: 4 (1)Thepersonattemptstocauseorrecklesslycausesphysicalinjury,physicalpain, 5orillnesstosuchdomesticvictim; 6 (2)Withcriminalnegligencethepersoncausesphysicalinjurytosuchdomestic 7victimbymeansofadeadlyweaponordangerousinstrument; 8 (3)Thepersonpurposelyplacessuchdomesticvictiminapprehensionofimmediate 9physicalinjurybyanymeans; 10 (4)Thepersonrecklesslyengagesinconductwhichcreatesasubstantialriskofdeath 11orseriousphysicalinjurytosuchdomesticvictim; 12 (5)Thepersonknowinglycausesphysicalcontactwithsuchdomesticvictim 13knowingheorshewillregardthecontactasoffensive;or HB1819 6 14 (6)Thepersonknowinglyattemptstocauseorcausestheisolationofsuchdomestic 15victimbyunreasonablyandsubstantiallyrestrictingorlimitinghisorheraccesstoother 16persons,telecommunicationdevicesortransportationforthepurposeofisolation. 17 2.TheoffenseofdomesticassaultinthefourthdegreeisaclassAmisdemeanor, 18unlessthepersonhaspreviouslybeenfoundguiltyoftheoffenseofdomesticassault,ofany 19assaultoffenseunderthischapter,orofanyoffenseagainstadomesticvictimcommittedin 20violationofanycountyormunicipalordinanceinanystate,anystatelaw,anyfederallaw,or 21anymilitarylawwhichifcommittedinthisstatetwoormoretimeswouldbeaviolationof 22thissection,inwhichcaseitisaclassEfelony.Theoffensesdescribedinthissubsection 23maybeagainstthesamedomesticvictimoragainstdifferentdomesticvictims. 24 3.Uponaperson'sconvictionfortheoffenseofdomesticassaultinthefourth 25degree,thecourtshallforwardtherecordofconvictiontotheMissouristatehighway 26patrolsothattheMissouristatehighwaypatrolcanupdatetherespondent'srecordin 27theNationalInstantCriminalBackgroundCheckSystem(NICS).Uponreceivinga 28recordunderthissubsection,theMissouristatehighwaypatrolshallnotifytheFederal 29BureauofInvestigationwithintwenty-fourhours. 565.227.1.Apersoncommitstheoffenseofstalkingintheseconddegreeifheor 2shepurposely,throughhisorhercourseofconduct,disturbs,orfollowswiththeintentto 3disturbanotherperson. 4 2.Thissectionshallnotapplytoactivitiesoffederal,state,county,ormunicipallaw 5enforcementofficersconductinginvestigationsofanyviolationoffederal,state,county,or 6municipallaw. 7 3.Anylawenforcementofficermayarrest,withoutawarrant,anypersonheorshe 8hasprobablecausetobelievehasviolatedtheprovisionsofthissection. 9 4.TheoffenseofstalkingintheseconddegreeisaclassAmisdemeanor,unlessthe 10defendanthaspreviouslybeenfoundguiltyofaviolationofthissectionorsection565.225,or 11ofanyoffensecommittedinanotherjurisdictionwhich,ifcommittedinthisstate,wouldbe 12chargeableorindictableasaviolationofanyoffenselistedinthissectionorsection565.225, 13orunlessthevictimisintentionallytargetedasalawenforcementofficer,asdefinedin 14section556.061,orthevictimistargetedbecauseheorsheisarelativewithinthesecond 15degreeofconsanguinityoraffinitytoalawenforcementofficer,inwhichcasestalkinginthe 16seconddegreeisaclassEfelony. 17 5.Uponaperson'sconvictionfortheoffenseofstalkingintheseconddegree,the 18courtshallforwardtherecordofconvictiontotheMissouristatehighwaypatrolsothat 19theMissouristatehighwaypatrolcanupdatetherespondent'srecordintheNational 20InstantCriminalBackgroundCheckSystem(NICS).Uponreceivingarecordunder HB1819 7 21thissubsection,theMissouristatehighwaypatrolshallnotifytheFederalBureauof 22Investigationwithintwenty-fourhours. 571.070.1.Apersoncommitstheoffenseofunlawfulpossessionofafirearmifsuch 2personknowinglyhasanyfirearminhisorherpossessionand: 3 (1)Suchpersonhasbeenconvictedofafelonyunderthelawsofthisstate,orofa 4crimeunderthelawsofanystateoroftheUnitedStateswhich,ifcommittedwithinthisstate, 5wouldbeafelony;[or] 6 (2)Suchpersonisafugitivefromjustice,ishabituallyinanintoxicatedordrugged 7condition,oriscurrentlyadjudgedmentallyincompetent; 8 (3)Suchpersonhasbeenconvictedofamisdemeanoroffenseofdomestic 9violenceunderthelawsofthisstate,orofacrimeunderthelawsofanystateorofthe 10UnitedStatesthatifcommittedinthisstatewouldbeamisdemeanoroffenseofdomestic 11violence;or 12 (4)Suchpersonissubjecttoanorderofprotectiongrantedundersections 13455.010to455.095orsections455.500to455.538thatwasissuedafterahearingof 14whichthepersonhadactualnoticeandatwhichthepersonhadanopportunityto 15participateorsuchpersonissubjecttoanequivalentorderissuedunderthelawsof 16anotherstateortheUnitedStates. 17 2.UnlawfulpossessionofafirearmisaclassDfelony,unlessapersonhasbeen 18convictedofadangerousfelonyasdefinedinsection556.061,inwhichcaseitisaclassC 19felony. 20 3.Theprovisionsofsubdivision(1)ofsubsection1ofthissectionshallnotapplyto 21thepossessionofanantiquefirearm. 22 4.Asusedinthissection,thefollowingtermsmean: 23 (1)"Family"or"householdmember",thesamemeaninggiventothetermsin 24section455.010;
