HB1830--ALTERNATIVETHERAPIES SPONSOR: McMullen Asspecifiedinthisbill,anypersonwhoacquires,uses,produces, possesses,transfers,oradministerspsilocybinfortheperson's owntherapeuticusewillnotbeinviolationofstateorlocallaw andwillnotbesubjecttoacivilfine,penalty,orsanctionso longasthepersonmeetsthefollowingconditions: (1)Is21yearsofageorolder; (2)Suffersfromposttraumaticstressdisorder,majordepressive disorder,orasubstanceusedisorderorrequiresend-of-lifecare; (3)Hasenrolledinaclinicaltrialtostudytheuseof psilocybintotreatposttraumaticstressdisorder,majordepressive disorder,orsubstanceusedisordersorforend-of-lifecareor soughttoenrollinaclinicaltrialbutwasdeclinedduetolack ofspaceorlackofexistingclinicaltrialsforwhichtheperson waseligible; (4)InformstheDepartmentofHealthandSeniorServicesthatthe personplanstoacquire,use,produce,possess,transfer,or administerpsilocybininaccordancewiththissection; (5)ProvidestheDepartmentwithdocumentsoutlinedinthebill. TheDepartmentmustmaintaintheconfidentiality ofanypersonally identifiableprotectedinformationcollectedfromanypersonswho provideinformationtotheDepartment; (6)EnsuresthatalaboratorylicensedbytheStatetotest controlledsubstancesteststhepsilocybinthepersonintendsto ingest.AnylaboratorylicensedbytheStatetotestcontrolled substancesorcannabisthattestspsilocybinshallnotbein violationofstateorlocallawandshallnotbesubjecttoacivil fine,penalty,orsanction;and (7)Limitstheuseofpsilocybintonomorethan150milligramsof psilocybinanalyte(4-phosphoryloxy-N,Ndimethyltryptamine) during any12monthperiod. TheDepartmentmustprepareandsubmittotheGovernor,Lieutenant Governor,andtheGeneralAssemblyannualreportsonany informationcollectedbytheDepartmentontheimplementation and outcomesoftheuseofpsilocybin. Thisbillspecifiesthat,aphysicianwillnotbesubjectto criminalorcivilliabilityorsanctionunderthelawsofthis Stateforprovidingdocumentationthatapersonsuffersfrom posttraumaticstressdisorder,majordepressivedisorder,ora substanceusedisorderorrequiresend-of-lifecare,andnoState agencyorregulatoryboardshallrevoke,failtorenew,ortakeany otheractionagainstaphysician'slicenseissuedunderChapter 334,RSMobasedsolelyonthephysician'sprovisionof documentationthatapersonsuffersfromposttraumaticstress disorder,majordepressivedisorder,orasubstanceusedisorderor requiresend-of-lifecare. ThisbillalsorequirestheDepartment,incollaborationwitha hospitaloperatedbytheaninstitutionofhighereducationinthis stateorcontractresearchorganizationsconductingtrialsapproved bytheUnitedStatesFoodandDrugAdministration inMissouri,to conductastudyontheefficacyofusingalternativemedicinesand therapies,including,butnotlimitedto,theuseofpsilocybinfor thetreatmentofpatientssufferingfrompost-traumaticstress disorder,majordepressivedisorder,substanceusedisorders,or whorequireendof-lifecare. Thebillspecifiesthatsuchstudyshallincludeaclinicaltrial ofpsilocybin,aswellasaliteraturereviewandthesubmissionof variousreports. Nopersonparticipatingintheclinicaltrial shallbesubjectedtocriminalorcivilliabilityorsanctionfor theparticipationintheclinicaltrial,exceptincasesofgross negligenceorwillfulmisconduct. TheDepartmentofHealthandSeniorServicesshallprepareand submittotheGovernor,LieutenantGovernorandtheGeneral Assembly: (1)Quarterlyreportsontheprogressofthestudy;and (2)Awrittenreport,submittedoneyearfollowingthe commencementofthestudy,whichshall: (a)Containtheresultsofthestudyandanyrecommendations for legislativeorregulatoryaction;and (b)Highlightthoseclinicalpracticesthatappeartobemost successfulaswellasanysafetyorhealthconcerns. TheDepartmentmustmaintaintheconfidentiality ofanypersonally identifiableprotectedinformationcollectedduringtheclinical trial.Aphysicianwillnotbesubjecttocriminalorcivil liabilityorsanctionunderthelawsofthisstateforreferringa patienttotheclinicaltrialunderthissection,andnostate agencyorregulatoryboardshallrevoke,failtorenew,ortakeany otheractionagainstaphysician'slicensebasedsolelyonthe physician'sreferralofapatienttotheclinicaltrialunderthis section.
