Asspecifiedinthisbill,anypersonwhoacquires,uses,produces, possesses,transfers,oradministerspsilocybinfortheperson's owntherapeuticusewillnotbeinviolationofStateorlocallaw andwillnotbesubjecttoacivilfine,penalty,orsanctionso longasthepersonmeetsthefollowingconditions: (1)Isaveteran; (2)Is21yearsofageorolder; (3)Suffersfromposttraumaticstressdisorder,majordepressive disorder,orasubstanceusedisorderorrequiresend-of-lifecare; (4)Hasenrolledinastudytostudytheuseofpsilocybinto treatposttraumaticstressdisorder,majordepressivedisorder,or substanceusedisordersorforend-of-lifecare; (5)InformstheDepartmentofMentalHealththatthepersonplans toacquire,use,produce,possess,transfer,oradminister psilocybininaccordancewiththissection; (6)ProvidestheDepartmentwithdocumentsspecifiedinthebill. TheDepartmentmustmaintaintheconfidentiality ofanypersonally identifiableprotectedinformationcollectedfromanyonewho providesinformationtotheDepartment; (7)Useofpsilocybinoccursonlyinthepresenceofafacilitator whomeetsrequirementsoutlinedinthebill; (8)EnsuresthatalaboratorylicensedbytheStatetotest controlledsubstancesteststhepsilocybinthepersonintendsto ingest;and (9)Thepersonlimitstheuseofpsilocybintonomorethan150 milligramsofpsilocybinanalyte(4-phosphoryloxy-N, Ndimethyltryptamine) duringany12monthperiod. TheDepartmentmustprepareandsubmittotheGovernor,Lieutenant Governor,andtheGeneralAssemblyannualreportsonany informationcollectedbytheDepartmentontheimplementation and outcomesoftheuseofpsilocybin. Thisbillspecifiesthat,aphysicianwillnotbesubjectto criminalorcivilliabilityorsanctionunderthelawsofthis Stateforprovidingdocumentationthatapersonsuffersfrom posttraumaticstressdisorder,majordepressivedisorder,ora substanceusedisorderorrequiresend-of-lifecare,andnoState agencyorregulatoryboardshallrevoke,failtorenew,ortakeany otheractionagainstaphysician'slicenseissuedunderChapter 334,RSMobasedsolelyonthephysician'sprovisionof documentationthatapersonsuffersfromposttraumaticstress disorder,majordepressivedisorder,orasubstanceusedisorderor requiresend-of-lifecare. ThisbillalsorequirestheDepartment,incollaborationwitha hospitaloperatedbytheaninstitutionofhighereducationinthis stateorcontractresearchorganizationsconductingtrialsapproved bytheUnitedStatesFoodandDrugAdministration inMissouri,to conductastudyontheefficacyofusingalternativemedicinesand therapies,including,butnotlimitedto,theuseofpsilocybinfor thetreatmentofpatientssufferingfrompost-traumaticstress disorder,majordepressivedisorder,substanceusedisorders,or whorequireend-of-lifecare. Thebillspecifiesthatsuchstudyshallincludeastudyonthe therapeuticefficacyofusingpsilocybininthetreatmentof veteranswhosufferfromposttraumaticstressdisorder,major depressivedisorder,orsubstanceusedisordersorwhorequireend- of-lifecare,aswellasaliteraturereviewandthesubmissionof variousreports. TheDepartmentofMentalHealth,anyhealthcare providers,andanypersonparticipatinginthestudywillnotbe subjectedtocriminalorcivilliabilityorsanctionforthe participationinthestudy,exceptincasesofgrossnegligenceor willfulmisconduct. TheDepartmentshallprepareandsubmittotheGovernor,Lieutenant GovernorandtheGeneralAssembly: (1)Quarterlyreportsontheprogressofthestudy;and (2)Awrittenreport,submittedoneyearfollowingthe commencementofthestudy,whichmust: (a)Containtheresultsofthestudyandanyrecommendations for legislativeorregulatoryaction;and (b)Highlightthoseclinicalpracticesthatappeartobemost successfulaswellasanysafetyorhealthconcerns. TheDepartmentmustmaintaintheconfidentiality ofanypersonally identifiableprotectedinformationcollectedduringthestudy.The DepartmentofMentalHealth,anyhealthcareproviders,andany otherpersoninvolvedinthestudyunderthissectionshallnotbe subjecttocriminalorcivilliabilityorsanctionunderthelaws ofthisstateforparticipatinginthestudy,exceptincasesof grossnegligenceorwillfulmisconduct.Nohealthcareprovider shallbesubjecttodisciplineagainsthisorherprofessional licenseforparticipationinthestudy. Aphysicianwillnotbesubjecttocriminalorcivilliabilityor sanctionunderthelawsofthisstateforreferringapatientto thestudyunderthissection,andnostateagencyorregulatory boardshallrevoke,failtorenew,ortakeanyotheractionagainst aphysician'slicensebasedsolelyonthephysician'sreferralofa patienttothestudyunderthissection.
