SectionA.Sections41.890and173.1153,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections41.890and173.1153,toreadasfollows:
41.890.Forthepurposesofstudentresidentstatus,militarypersonnel,whenstationed
2withinthestateundermilitaryorders,theirspouses,andtheirunemancipatedchildrenunder
3twenty-fouryearsofagewhoenrollinaMissouricommunitycollege,Missouricollege,or
4MissouristateuniversityshallberegardedasholdingMissouriresidentstatusfor
5undergraduateandgraduatedegreeprograms.
173.1153.1.Notwithstandinganyprovisionoflawtothecontrary,anyindividual
2whoiscurrentlyservingintheMissouriNationalGuardorinareservecomponentofthe
3ArmedForcesoftheUnitedStatesshallbedeemedtobedomiciledinthisstateforpurposes
4ofeligibilityforin-statetuitionatanyapprovedpublicinstitutioninMissourifor
5undergraduateandgraduatedegreeprograms.
6 2.Tobeeligibleforin-statetuitionunderthissection,anysuchindividualshall
7demonstratepresencewithinthestateofMissouri.Forpurposesofattendingacommunity
8college,anindividualshalldemonstratepresencewithinthetaxingdistrictofthecommunity
9collegeheorsheattends.
10 3.Ifanysuchindividualiseligibletoreceivefinancialassistanceunderanyother
11federalorstatestudentaidprogram,publicorprivate,thefullamountofsuchaidshallbe
12reportedtothecoordinatingboardforhighereducationbytheinstitutionandtheindividual.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 13Thetuitionlimitationunderthissectionshallbeprovidedafterallotherfederalandstateaid
14forwhichtheindividualiseligiblehasbeenapplied,andnoindividualshallreceivemore
15thantheactualcostofattendancewhenthelimitationiscombinedwithotheraidmade
16availabletosuchindividual.
17 4.Thecoordinatingboardforhighereducationshallpromulgaterulestoimplement
18thissection.
19 5.Forpurposesofthissection,"approvedpublicinstitution"shallhavethesame
20meaningasprovidedinsubdivision(3)ofsubsection1ofsection173.1102.
21 6.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
22createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
23withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
24Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
25generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
26disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
27rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2016,shallbeinvalid
28andvoid.
