SectionA.Section193.265,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection193.265,toreadasfollows:
193.265.1.Fortheissuanceofacertificationorcopyofadeathrecord,theapplicant
2shallpayafeeof[fourteen] nineteendollarsforthefirstcertificationorcopyandafeeof
3[eleven] sixteendollarsforeachadditionalcopyorderedatthattime.Fortheissuanceofa
4certificationorcopyofabirth,marriage,divorce,orfetaldeathrecord,theapplicantshallpay
5afeeoffifteendollars.Nofeeshallberequiredorcollectedforacertificationofbirth,death,
6ormarriageiftherequestforcertificationismadebythechildren'sdivision,thedivisionof
7youthservices,aguardianadlitem,orajuvenileofficeronbehalfofachildorpersonunder
8twenty-oneyearsofagewhohascomeunderthejurisdictionofthejuvenilecourtunder
9section211.031.Allfeescollectedunderthissubsectionshallbedepositedtothestate
10departmentofrevenue.BeginningAugust28,2004,foreachvitalrecordsfeecollected,the
11directorofrevenueshallcreditfourdollarstothegeneralrevenuefund,fivedollarstothe
12children'strustfund,onedollarshallbecreditedtotheendowedcarecemeteryauditfund,
13[onedollar] fiftycentsforeachcertificationorcopyofdeathrecordstotheMissouristate
14coroners'trainingfundestablishedinsection58.208,fivedollarsandfiftycentsforeach
15certificationorcopyofdeathrecordstotheMissouriNationalGuardtrustfund
16establishedinsection41.214tobeusedsolelyforthespecificpurposeoffunding
17militaryhonordetailsdescribedinsection41.958,andthreedollarsforthefirstcopyof
18deathrecordsandfivedollarsforbirth,marriage,divorce,andfetaldeathrecordsshallbe

2433.080tothecontrary,moneyplacedintheendowedcarecemeteryauditfundshallnotbe
25transferredandplacedtothecreditofgeneralrevenueuntiltheamountinthefundattheend
26ofthebienniumexceedsthreetimestheamountoftheappropriationfromtheendowedcare
27cemeteryauditfundfortheprecedingfiscalyear.Themoneydepositedinthepublichealth
28servicesfundunderthissectionshallbedepositedinaseparateaccountinthefund,and
29moneysinsuchaccount,uponappropriation,shallbeusedtoautomateandimprovethestate
30vitalrecordssystem,anddevelopandmaintainanelectronicbirthanddeathregistration
31system.Foranysearchofthefilesandrecords,whennorecordisfound,thestateshallbe
32entitledtoafeeequaltotheamountforacertificationofavitalrecordforafive-yearsearch
33tobepaidbytheapplicant.Fortheprocessingofeachlegitimation,adoption,courtorderor
34recordingaftertheregistrant'stwelfthbirthday,thestateshallbeentitledtoafeeequaltothe
35amountforacertificationofavitalrecord.Exceptwheneveracertifiedcopyorcopiesofa
36vitalrecordisrequiredtoperfectanyclaimofanypersononrelief,oranydependentofany
37personwhowasonreliefforanyclaimuponthegovernmentofthestateorUnitedStates,the
38stateregistrarshall,uponrequest,furnishacertifiedcopyorsomanycertifiedcopiesasare
39necessary,withoutanyfeeorcompensationtherefor.
40 2.Fortheissuanceofacertificationofadeathrecordbythelocalregistrar,the
41applicantshallpayafeeof[fourteen] nineteendollarsforthefirstcertificationorcopyanda
42feeof[eleven] sixteendollarsforeachadditionalcopyorderedatthattime.Foreachfee
43collectedunderthissubsection,onedollarshallbedepositedtothestatedepartmentof
44revenueandtheremaindershallbedepositedtotheofficialcityorcountyhealthagency.The

52deathrecord,theapplicantshallpayafeeoffifteendollars;exceptthat,inanycountywitha
53charterformofgovernmentandwithmorethansixhundredthousandbutfewerthanseven
54hundredthousandinhabitants,adonationofonedollarmaybecollectedbythelocalregistrar
55overandaboveanyfeesrequiredbylawwhenacertificationorcopyofanymarriagelicense

57localregistrartothecountytreasurerofsuchcountyandthedonationssoforwardedtobe
58depositedbythecountytreasurerintothehousingresourcecommissionfundtoassist
59homelessfamiliesandprovidefinancialassistancetoorganizationsaddressinghomelessness
60insuchcounty.Thelocalregistrarshallincludeacheck-offboxontheapplicationformfor
61suchcopies.Allfeescollectedunderthissubsection,otherthanthedonationscollectedin
62anycountywithacharterformofgovernmentandwithmorethansixhundredthousandbut
63fewerthansevenhundredthousandinhabitantsformarriagelicensesandbirthcertificates,
64shallbedepositedtotheofficialcityorcountyhealthagency.
65 4.Acertifiedcopyofadeathrecordbythelocalregistrarcanonlybeissuedafter
66acceptanceandregistrationwiththestateregistrar.Thefeespaidtotheofficialcountyhealth
67agencyshallberetainedbythelocalagencyforlocalpublichealthpurposes.
68 5.Nofeeunderthissectionshallberequiredorcollectedfromaparentorguardianof
69ahomelesschildorhomelessyouth,asdefinedinsubsection1ofsection167.020,oran
70unaccompaniedyouth,asdefinedin42U.S.C.Section11434a(6),fortheissuanceofa
71certification,orcopyofsuchcertification,ofbirthofsuchchildoryouth.Anunaccompanied
72youthshallbeeligibletoreceiveacertificationorcopyofhisorherownbirthrecordwithout
73theconsentorsignatureofhisorherparentorguardian;provided,thatonlyonecertificate
74underthisprovisionshallbeprovidedwithoutcosttotheunaccompaniedorhomelessyouth.
75Fortheissuanceofanyadditionalcertificates,thestatutoryfeeshallbepaid.
76 6.(1)Notwithstandinganyprovisionoflawtothecontrary,nofeeshallberequired
77orcollectedforacertificationofbirthiftherequestismadebyavictimofdomesticviolence
78orabuse,asthosetermsaredefinedinsection455.010,andthevictimprovides
79documentationsignedbyanemployee,agent,orvolunteerofavictimserviceprovider,an
80attorney,orahealthcareormentalhealthprofessional,fromwhomthevictimhassought
81assistancerelatingtothedomesticviolenceorabuse.Suchdocumentationshallstatethat,
82underpenaltyofperjury,theemployee,agent,orvolunteerofavictimserviceprovider,the
83attorney,orthehealthcareormentalhealthprofessionalbelievesthevictimhasbeen
84involvedinanincidentofdomesticviolenceorabuse.
