BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter196,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection196.1202,toreadasfollows: 196.1202.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"Department",theMissouridepartmentofrevenue; 3 (2)"Director",thedirectoroftheMissouridepartmentofrevenue; 4 (3)"Vaporproduct",thesamemeaningasdefinedundersection407.925. 5 2.OnorbeforeJanuary1,2025,andannuallyonorbeforeeachJanuaryfirst 6thereafter,everymanufacturerofvaporproductsthataresoldinthisstate,whether 7directlyorthroughadistributor,wholesaler,retailer,orsimilarintermediaryor 8intermediaries,shallcertifyunderpenaltyofperjuryonaformandinthemanner 9prescribedbythedirectorthatthemanufactureragreestocomplywiththischapterand 10that: 11 (1)Themanufacturerhasreceivedamarketingauthorizationorsimilarorder 12forthevaporproductfromtheUnitedStatesFoodandDrugAdministrationunder21 13U.S.C.Section387j;or 14 (2)ThevaporproductwasmarketedintheUnitedStatesasofAugust8,2016, 15themanufacturersubmittedapremarkettobaccoproductapplicationforthevapor 16producttotheUnitedStatesFoodandDrugAdministrationunder21U.S.C.Section 17387jonorbeforeSeptember9,2020,andtheapplicationeitherremainsunderreview EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18bytheUnitedStatesFoodandDrugAdministrationorafinaldecisiononthe 19applicationhasnototherwisetakeneffect. 20 3.Amanufacturershallsubmitacertificationformthatseparatelylistseach 21vaporproductthatissoldinthisstate. 22 4.Eachannualcertificationformrequiredbysubsections2and3ofthissection 23shallbeaccompaniedby: 24 (1)Acopyofthemarketingauthorizationorotherorderforthevaporproduct 25issuedbytheUnitedStatesFoodandDrugAdministrationunder21U.S.C.Section 26387j,orevidencethatthepremarkettobaccoproductapplicationforthevaporproduct 27wassubmittedtotheUnitedStatesFoodandDrugAdministrationandafinal 28authorizationororderhasnotyettakeneffect;and 29 (2)Apaymentoftwohundreddollarsforeachvaporproductthefirsttimea 30vaporproductmanufacturersubmitsacertificationformforthatproductanda 31paymentoftwohundreddollarsannuallythereafterforeachvaporproduct. 32 5.Amanufacturerrequiredtosubmitacertificationformundersubsections2 33and3ofthissectionshallnotifythedirectorwithinthirtydaysofanymaterialchangeto 34thecertificationform,includingtheissuanceordenialofamarketingauthorizationor 35otherorderbytheUnitedStatesFoodandDrugAdministrationunder21U.S.C.Section 36387j,oranyotherorderoractionbytheUnitedStatesFoodandDrug 37Administrationoranycourtthataffectstheabilityofthevaporproducttobe 38introducedordeliveredintointerstatecommerceforcommercialdistributioninthe 39UnitedStates. 40 6.OnorbeforeJune1,2025,thedirectorshallmaintainandmakepublicly 41availableonthedepartment'swebsiteadirectorythatlistsallvaporproduct 42manufacturersandvaporproductsforwhichcertificationformshavebeensubmitted 43andshallupdatethedirectoryasnecessarytoensureaccuracy. 44 7.Thedirectorshallprovidemanufacturersnoticeandanopportunitytocure 45deficienciesbeforeremovingmanufacturersorproductsfromthedirectory. 46 (1)Thedirectorshallnotremovethemanufactureroritsproductsfromthe 47directoryuntilatleastfifteendaysafterthemanufacturerhasbeengivennoticeofan 48intendedaction.Noticeshallbesufficientandbedeemedimmediatelyreceivedbya 49manufacturerifthenoticeissenteitherelectronicallyorbyfacsimiletoanelectronic 50mailaddressorfacsimilenumber,asthecasemaybe,providedbythemanufacturerin 51itsmostrecentcertificationfiledundersubsections2and3ofthissection. 52 (2)Thevaporproductmanufacturershallhavefifteenbusinessdaysfromthe 53dateofserviceofthenoticeofthedirector’sintendedactiontoestablishthatthevapor 54productmanufactureroritsproductsshouldbeincludedinthedirectory. HB2211 2 55 (3)Adeterminationbythedirectortonotincludeortoremovefromthe 56directoryamanufactureroravaporproductshallbesubjecttoreviewbythefilingofa 57civilactionforprospectivedeclaratoryorinjunctiverelief. 58 8.Ifaproductisremovedfromthedirectory,eachretailer,distributor,and 59wholesalershallhavetwenty-onedaysfromthedaysuchproductisremovedfromthe 60directorytoremovetheproductfromitsinventoryandreturntheproducttothe 61manufacturerfordisposal.Aftertwenty-onedaysfollowingremovalfromthedirectory, 62thevaporproductsofamanufactureridentifiedinthenoticeofremovalarecontraband 63andaresubjecttopenaltiesundersubsection10ofthissectionandseizure,forfeiture, 64anddestructionundersubdivision(2)ofsubsection11ofthissection. 65 9.BeginningJune1,2025,oronthedatethatthedirectorfirstmakesthe 66directoryavailableforpublicinspectiononthedepartmentofrevenuewebsite,aperson 67shallnotsellorofferforsaleavaporproductinthisstatethatisnotincludedinthe 68directorydescribedbysubsections2and3ofthissection,andavaporproduct 69manufacturershallnotsell,eitherdirectlyorthroughadistributororwholesaler, 70retailer,orsimilarintermediaryorintermediaries,avaporproductinthisstatethatis 71notincludedinthedirectorydescribedbysubsections2and3ofthissection. 72 10.Thefollowingpenaltiesshallapplytoviolationsofthissection: 73 (1)Awholesaler,distributor,orretailerofvaporproductswhosellsoroffersfor 74saleavaporproductinthisstatethatisnotincludedinthedirectory: 75 (a)Forafirstviolationofthissection,shallbesubjecttoacivilpenaltyoffive 76hundreddollarsperdayforeachproductofferedforsaleinviolationofthissection 77untiltheoffendingproductisremovedfromthemarketoruntiltheoffendingproductis 78properlylistedinthedirectory; 79 (b)Forasecondviolationwithinatwelve-monthperiod,thelicenseofthe 80licenseeshallbesuspendedforatleastfourteendays; 81 (c)Forathirdviolationwithinatwelve-monthperiod,thelicenseofthelicensee 82shallbesuspendedforatleastsixtydays;and 83 (d)Forafourthorsubsequentviolationwithinatwelve-monthperiod,the 84licenseofthelicenseeshallbesuspendedforatleastoneyear; 85 (2)Amanufacturerofvaporproductswhosevaporproductsarenotlistedinthe 86directoryandaresoldinthisstate,whetherdirectlyorthroughadistributor, 87wholesaler,retailer,orsimilarintermediaryorintermediaries,issubjecttoacivil 88penaltyoffivehundreddollarsperdayforeachproductofferedforsaleinviolationof 89thissectionuntiltheoffendingproductisremovedfromthemarketoruntilthe 90offendingproductisproperlylistedinthedirectory.Inaddition,anymanufacturerof 91vaporproductsthatfalselyrepresentsanyoftheinformationrequiredbysubsection2 HB2211 3 92or3ofthissectionshallbeguiltyofaclassCmisdemeanorforeachfalserepresentation; 93and 94 (3)Arepeatedviolationofthissectionshallconstituteanunfairtradepractice 95undertheprovisionsofsections375.930to375.948.Nothinginthissectionshallbe 96construedtocreateorimplyaprivatecauseofactionforaviolationofsections376.2050 97to376.2053. 98 11.(1)Thedirectorortheattorneygeneralmayexaminethebooks,papers,and 99recordsofanydistributor,wholesaler,orretailerinthisstateforthepurposeof 100determiningcompliancewiththissection.Thedirectorortheattorneygeneralmay 101makeinspectionsandexaminationsatanytimeduringordinarybusinesshours,and 102mayinspectthepremisesandalldesks,safes,vaults,andotherfixturesandfurniture 103containedinoruponthepremisesforthepurposeofascertainingwhether 104noncompliantvaporproductsareheldorpossessedinviolationofthissection. 105Unannouncedfollow-upinspectionsandexaminationsofallnoncompliantdistributors, 106wholesalers,andretailersarerequiredwithinthirtydaysafteranyviolationofthis 107section.Thedirectorshallpublishtheresultsofallinspectionsandexaminationsat 108leastannuallyandshallmaketheresultsavailabletothepublicuponrequest. 109 (2)Anyvaporproductsofferedforsaleinviolationofthissectionaredeclaredto 110becontrabandgoodsandmaybeseizedbythedirectororattorneygeneral,the 111director'sagentsortheattorneygeneral’sagents,oremployees,orbyanylaw 112enforcementofthisstateifdirectedbythedirectororattorneygeneraltodoso,without 113awarrant.Thecostofsuchseizure,forfeiture,anddestructionshallbebornebythe 114personfromwhomtheproductsareconfiscated. 115 (3)Inanactionbroughtunderthissection,thedirectororattorneygeneralmay 116recoverreasonableexpensesincurredininvestigatingandpreparingthecase,and 117attorney'sfees. 118 12.Thedirectorshalldisclosetotheattorneygeneralanyinformationreceived 119underthissectionthatisrequestedbytheattorneygeneralforpurposesofdetermining 120compliancewithandenforcingtheprovisionsofthissection.Thedirectorandattorney 121generalshallsharewitheachotherinformationreceivedunderthissection,or 122correspondinglawsofotherstates. 123 13.(1)Anynonresidentmanufacturerofvaporproductsthathasnotregistered 124todobusinessinthestateasaforeigncorporationorbusinessentityshall,asacondition 125precedenttobeingincludedinthedirectorycreatedinthissection,appointand 126continuallyengagewithoutinterruptiontheservicesofanagentinthisstatetoactas 127agentfortheserviceofprocessonwhomallprocessshallbeserved,andanyactionor 128proceedingagainstitconcerningorarisingoutoftheenforcementofthissection,may HB2211 4 129beservedinanymannerauthorizedbylaw.Suchserviceshallconstitutelegalandvalid 130serviceofprocessonthemanufacturer.Themanufacturershallprovidethename, 131address,telephonenumber,andproofoftheappointmentandavailabilityofsuchagent 132tothedepartment. 133 (2)Themanufacturershallprovidenoticetothedepartmentthirtycalendar 134dayspriortoterminationoftheauthorityofanagentandshallfurtherprovideproofto 135thesatisfactionofthedepartmentoftheappointmentofanewagentnolessthanfive 136calendardayspriortotheterminationofanexistingagent'sappointment.Intheevent 137anagentterminatesanagencyappointment,themanufacturershallnotifythe 138departmentoftheterminationwithinfivecalendardaysandshallincludeproofto 139thesatisfactionofthedepartmentoftheappointmentofanewagent. 140 (3)Anymanufacturerwhosevaporproductsaresoldinthisstatewhohasnot 141appointedandengagedtheservicesofanagentasrequiredbythissectionshallbe 142deemedtohaveappointedthesecretaryofstateasitsagentforserviceofprocess.The 143appointmentofthesecretaryofstateasagentshallnotsatisfytheconditionprecedent 144requiredinsubdivision(1)ofthissubsectiontobeincludedorretainedinthedirectory. 145 14.OnorbeforeDecember31,2025,andannuallyonorbeforeeachDecember 146thirty-firstthereafter,thedirectorshallprovideareporttothegeneralassembly 147regardingthestatusofthedirectory,manufacturersandproductsincludedinthe 148directory,revenueandexpendituresrelatedtotheadministrationofthissection,and 149enforcementactivitiesundertakenpursuanttothissection. 150 15.Allfeesandpenaltiescollectedunderthissectionshallbeusedforthe 151administrationandenforcementofthissection. 152 16.Thedepartment,inconjunctionwiththeattorneygeneral,maypromulgate 153allnecessaryrulesandregulationsfortheadministrationofthissection.Anyruleor 154portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe 155authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 156subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This 157sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 158generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 159disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 160rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2024,shallbe 161invalidandvoid. ✔ HB2211 5
