52 (4)(a)Anindividualmaybegrantedmorethanoneexpungementunderthis
53section,providedthatduringhisorherlifetimethetotalnumberofoffenses,violations,

55exceedthefollowinglimits:
56 a.Nomorethanonefelonyoffense;and
57 b.Nomorethantwomisdemeanoroffensesorordinanceviolationsthathavea
58termofimprisonmentauthorizedbystatuteorordinance,respectively.
59 (b)Anindividualmaybegrantedexpungementunderthissectionforany
60numberofinfractions.
61 (c)Ifanindividual'srecordcontainsmorefeloniesormisdemeanorsthancanbe
62expungedduringtheindividual'slifetimeunderparagraph(a)ofthissubdivision,the
63individualshallnotbeeligibleforautomatedexpungementunderthissection.
64 3.(1)BeginningAugust28,2027,onamonthlybasis,theofficeofstatecourts
65administratorshallidentifyandtransmittothecentralrepositoryandevery
66prosecutingagencyinthestateallcleanslateeligibleoffenserecordswithinthirty
67daysoftherecordbecomingeligibleforautomatedexpungement.
68 (2)RecordsthatareeligibleforexpungementonorbeforeAugust28,2024,shall
69beidentifiedandexpungedbeforeAugust28,2029.
70 (3)Delinquentcourtcosts,fines,fees,orothersumsorderedbyacourt,except
71restitutionowedtoavictimofacrime,shallnotbeconsideredbytheofficeofstate
72courtsadministratorwhendeterminingexpungementofarecordwithoutapetition
73undersubsection2ofthissection.Theofficeofstatecourtsadministratorshallseeka
74setoffofanyincometaxrefundandlotteryprizepayoutsundersection488.5028forall
75delinquentcourtcosts,fines,fees,orothersumsorderedbyacourtrelatingto
76convictionsexpungedundersubsection2ofthissection.
77 (4)Eachprosecutingagencyinthisstatehasnolaterthansixtydaysfromthe
78dayonwhichthenoticedescribedinsubdivision(1)ofthissubsectionistransmittedto
79objecttoanautomatedexpungementandtransmitsuchobjectiontoallparties.The
80prosecutingagencymayobjecttotheautomaticexpungementforanyofthefollowing
81reasons:
82 (a)Afterreviewingtheprosecutingagency'srecord,theagencybelievesthe
83recorddoesnotmeetthedefinitionofacleanslateeligiblecase;
84 (b)Thepersonhasnotpaidcourt-orderedrestitutiontothevictim;
85 (c)ThepersonhaschargespendingagainsttheminanothercaseinMissouri;or
86 (d)Theprosecutingagencyhasareasonablebelief,groundedinsupporting
87facts,thatanindividualwithacleanslateeligiblecaseiscontinuingtoengagein
88criminalactivity,regardlessofwhetherchargedwithanoffense,withinoroutsidethe
89state.

91forareasondescribedinsubdivision(4)ofthissubsectionwithinsixtydaysoftheday
92onwhichthenoticedescribedinsubdivision(1)ofthissubsectionistransmitted,the
93recordshallnotbeexpunged.
94 (6)Ifsixtydayshavepassedwithoutanobjectionfromaprosecutingagencyor
95thecentralrepositoryforoneofthereasonssetforthunderthissubsection,theofficeof
96statecourtsadministratorshalltransmitwithinfifteendaysalltherecordstobe
97expunged,sortedbycircuit,tothepresidingjudgesofeverycircuitcourt.
98 (7)(a)Withinthirtydaysofreceivinganoticetoexpunge,thecircuitcourtshall
99issueordersforexpungementofallrecordsmaintainedinthecircuitforwhichno
100notificationofineligibilitywasreceivedbytheofficeofstatecourtsadministratorfrom
101thecentralrepositoryoraprosecutingagencyunlessthecircuitcourtdeterminesthe
102recordisnoteligibleforautomatedexpungement.
103 (b)Ifthecircuitcourtdeterminesarecordisnoteligibleforautomated
104expungement,thecourtshallnotifytheofficeofstatecourtsadministratorinwritingof
105itsdeterminationwithinthirtydaysandshallspecifythereasonsthecourtreliedupon
106inmakingthedetermination.
107 (8)Onamonthlybasis,eachcircuitcourtshallissueordersforexpungementof
108allrecordsofarrest,chargeandconvictionforordinanceviolations,and
109nonfingerprintableoffensesinthecircuitthatthecourtdeterminesareeligiblefor
110automatedexpungement.
111 (9)Onamonthlybasis,eachcircuitcourtshalltransmitcopiesofallordersfor
112expungementthatthecourtissuesunderthissectiontotheofficeofstatecourts
113administrator.
114 (10)Oncethetransmittedrecordsareexpunged,theofficeofstatecourts
115administratorshallprovidenoticetoallstateagenciesmaintainingofficialcopiesofthe
116recordsincluding,butnotlimitedto,theappropriatecircuitcourtclerk,theprosecuting
117attorney,thearrestinglawenforcementagencyoragencies,thedepartmentof
118corrections,thecentralrepository,andthedepartmentofrevenuetoexpungethe
119recordswithinthirtydays.Withrespecttoanypersonincluding,butnotlimitedto,a
120consumerreportingagencyorresearcher,whopurchasesrecordsforinformation
121pertainingtocriminalmattersofpublicrecordfromtheofficeofstatecourts
122administrator,suchofficeshallmakeavailabletothepersoninformationconcerningthe
123criminalmattersofpublicrecordthathavebeenerasedunderthissection.Such
124informationshallincludedocketnumbersorotherinformationsufficienttopermitthe
125persontoaccuratelyidentifyanddeleterecordsthathavebeenerasedunderthis
126section.

130 (b)TheMissouristatehighwaypatrolshallretainanonpublicrecordofthe
131orderexpungingaconvictionorothernotificationregardingaconvictionthatwas
132automaticallyexpungedunderthissectionandoftherecordofthearrest,fingerprints,
133conviction,andsentenceofthepersoninthecasetowhichtheorderorother
134notificationapplies.Exceptasprovidedinparagraph(c)ofthissubdivision,the
135nonpublicrecordshallbemadeavailableonlytoacourtofcompetentjurisdiction,an
136independentdepartmentofthejudicialbranchofstategovernment,thedepartmentof
137corrections,alawenforcementagency,aprosecutingattorney,theattorneygeneral,or

170name.Theportalshallemploymeasurestopreventdisclosureofanyordertoanyone
171otherthantheindividualforwhomtheorderwasissued.
172 4.Anycourtsentencinganindividualforacleanslateeligibleoffenseshallnotify
173theindividualatthetimeofsentencingofthedatewhentheindividual'sconvictionmay
174becomeeligibleforautomatedexpungementprovidedtheindividualisnotconvictedof
175anymisdemeanororfelony,notincludingaviolationofatrafficviolationwithno
176authorizedtermofimprisonment,duringthetimeperiodspecifiedfortheunderlying
177offenseoroffenses.
178 5.Anyprobationorparoleofficereleasinganindividualfromsupervisionfora
179cleanslateeligibleoffenseshallnotifytheindividualatthetimesupervisionis
180dischargedofthedatewhentheindividual'srecordorrecordsmaybecomeeligiblefor
181automatedexpungementprovidedtheindividualisnotconvictedofanymisdemeanor
182orfelony,notincludingaviolationofatrafficviolationwithnoauthorizedtermof
183imprisonment,duringthetimeperiodspecifiedfortheunderlyingoffenseoroffenses.
184 6.Theprovisionsofthissectionshallapplyretroactivelytoanyarrest,charge,
185trial,andconvictionforwhichthereisadigitalrecordregardlessofthedatethatthe
186arrestwasmade,thechargeorchargeswerebrought,thetrialoccurred,orthe
187convictionwasentered.
188 7.Nothinginthissectionprecludesanindividualfromfilingapetitionfor
189expungementofrecordsundersection610.140ifanindividualiseligibleforautomated
190expungementunderthissectionbutsuchautomatedexpungementhasnotyetoccurred
191orcannotoccur.
192 8.(1)Upontheoccurrenceofoneofthecircumstancesprovidedunder
193subdivision(2)or(3)ofthissubsection,aconvictionthatwasexpungedunderthis
194sectionshallbereinstatedbythecourtasprovidedinthissubsection.
195 (2)Ifitisdeterminedthataconvictionwasimproperlyorerroneouslyexpunged
196underthissectionbecausetheconvictionwasnoteligibletobeexpungedunderthis
197section,thecourtshall,onitsownmotion,reinstatetheconviction.
198 (3)Uponamotionbyapersonowedrestitutionoronitsownmotion,thecourt
199shallreinstateaconvictionthatwasexpungedunderthissectionforwhichtheperson

202 9.(1)Upontheentryofanorderundersection610.140,orupontheautomated

204considerednottohavebeenpreviouslyconvicted,exceptasprovidedunderthis
205subsectionandsubsection10ofsection610.140.
206 (2)Thepetitionershallnotbeentitledtotheremissionofanyfine,costs,orother
207moneyspaidasaconsequenceofaconvictionthatisexpunged.

5judicialcircuit,withdataaggregatedbyrace,sex,age,circuit,county,andoffensetype
6andlevel;and

8prosecutingagency,oracircuitcourtbacktotheofficeofstatecourtsadministratoron
9objectionthattherecordisnoteligibleforautomatedexpungementorthattherecord
10doesmatchdataheldinthecentralrepository,byjudicialcircuit,withdataaggregated
11byrace,sex,age,county,andoffensetypeandlevel.
610.143.1.Acreditbureaumayreportrecordsofarrests,indictmentspending
2trial,andconvictionsofcrimesfornolongerthansevenyearsfromfinaldisposition.
3Recordsofarrests,indictmentspendingtrial,andconvictionsofcrimesshallnolonger
4bereportedifatanytimeafteraconvictionitislearnedthatafullpardonor
5expungementhasbeengrantedforthatconviction,oratanytimeafteranarrestor
6indictmentitislearnedthataconvictiondidnotresult.
7 2.Anycreditbureauoruserofinformationthatwillfullyfailstocomplywith
8anyrequirementofthissectionwithrespecttoanyconsumerisliabletothatconsumer
9inanamountequalto:
10 (1)Anyactualdamagessustainedbytheconsumerasaresultofthefailure;
11 (2)Punitivedamagesasthecourtmayallow;and
12 (3)Inthecaseofanysuccessfulactionunderthissection,costsoftheactionand
13reasonableattorney'sfeesasdeterminedbythecourt.
14 3.Anycreditbureauoruserofinformationthatisnegligentinfailingtocomply
15withanyrequirementofthissectionwithrespecttoanyconsumerisliabletothat
16consumerinanamountequalto:
17 (1)Anyactualdamagessustainedbytheconsumerasaresultofthefailure;and
18 (2)Inthecaseofanysuccessfulactionunderthissection,costsoftheactionand
19reasonableattorney'sfeesasdeterminedbythecourt.
20 4.Injunctivereliefshallbeavailabletoanyconsumeraggrievedbyaviolationor
21athreatenedviolationofthissectionregardlessofwhethertheconsumerseeksanyother
22remedyunderthissection.
23 5.Anemployer,volunteer,organization,orlandlordwhoemploys,qualifies,or
24otherwiseengagesanindividualwhosecriminalhistoryrecordhasbeenexpungedshall
25beimmunefromliabilityforanyclaimarisingoutofthemisconductoftheindividualif
26themisconductrelatestotheportionofthecriminalhistoryrecordthathasbeen
27expunged.
610.144.1.(1)Thereisherebycreatedinthestatetreasurythe"Missouri
2ExpungementFund",whichshallconsistofmoneysdepositedintothefundfromany
3sourceincluding,butnotlimitedto,gifts,donations,grants,andbequests.Thestate
4treasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180,
5thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,
HB2555	8 6uponappropriation,moneysinthisfundshallbeusedsolelyasprovidedinsubsection2
7ofthissection.
8 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
9remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
10generalrevenuefund.
11 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
12otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
13creditedtothefund.
14 2.Thedepartmentofpublicsafety,theinformationtechnologyservicesdivision
15withintheofficeofadministration,andtheofficeofstatecourtsadministratorshall
16expendmoneysfromthefund,uponappropriation,onlyforoneormoreofthe
17followingpurposes:
18 (1)Implementationcostsincurredundersections610.141to610.143;
