96 (b)Thepersonhasnotpaidcourt-orderedrestitutiontothevictim; 97 (c)ThepersonhaschargespendingagainsttheminanothercaseinMissouri;or 98 (d)Theprosecutingagencyhasareasonablebelief,groundedinsupporting 99facts,thatanindividualwithacleanslateeligiblecaseiscontinuingtoengagein 100criminalactivity,regardlessofwhetherchargedwithanoffense,withinoroutsidethe 101state. 102 (5)Ifaprosecutingagencyidentifiedinsubdivision(4)ofthissubsectionobjects 103forareasondescribedinsubdivision(4)ofthissubsectionwithinsixtydaysoftheday 104onwhichthenoticedescribedinsubdivision(1)ofthissubsectionistransmitted,the 105recordshallnotbeexpunged. 106 (6)Ifsixtydayshavepassedwithoutanobjectionfromaprosecutingagencyor 107thecentralrepositoryforoneofthereasonssetforthunderthissubsection,theofficeof 108statecourtsadministratorshalltransmitwithinfifteendaysalltherecordstobe 109expunged,sortedbycircuit,tothepresidingjudgesofeverycircuitcourt. 110 (7)(a)Withinthirtydaysofreceivinganoticetoexpunge,thecircuitcourtshall 111issueordersforexpungementofallrecordsmaintainedinthecircuitforwhichno 112notificationofineligibilitywasreceivedbytheofficeofstatecourtsadministratorfrom 113thecentralrepositoryoraprosecutingagencyunlessthecircuitcourtdeterminesthe 114recordisnoteligibleforautomatedexpungement. 115 (b)Ifthecircuitcourtdeterminesarecordisnoteligibleforautomated 116expungement,thecourtshallnotifytheofficeofstatecourtsadministratorinwritingof 117itsdeterminationwithinthirtydaysandshallspecifythereasonsthecourtreliedupon 118inmakingthedetermination. 119 (8)Onamonthlybasis,eachcircuitcourtshallissueordersforexpungementof 120allrecordsofarrest,chargeandconvictionforordinanceviolations,and 121nonfingerprintableoffensesinthecircuitthatthecourtdeterminesareeligiblefor 122automatedexpungement. 123 (9)Onamonthlybasis,eachcircuitcourtshalltransmitcopiesofallordersfor 124expungementthatthecourtissuesunderthissectiontotheofficeofstatecourts 125administrator. 126 (10)Oncethetransmittedrecordsareexpunged,theofficeofstatecourts 127administratorshallprovidenoticetoallstateagenciesmaintainingofficialcopiesofthe 128recordsincluding,butnotlimitedto,theappropriatecircuitcourtclerk,theprosecuting 129attorney,thearrestinglawenforcementagencyoragencies,thedepartmentof 130corrections,thecentralrepository,andthedepartmentofrevenuetoexpungethe HCSHBs2555&2108 4 131recordswithinthirtydays.Withrespecttoanypersonincluding,butnotlimitedto,a 132consumerreportingagencyorresearcher,whopurchasesrecordsforinformation 133pertainingtocriminalmattersofpublicrecordfromtheofficeofstatecourts 134administrator,suchofficeshallmakeavailabletothepersoninformationconcerningthe 135criminalmattersofpublicrecordthathavebeenerasedunderthissection.Such 136informationshallincludedocketnumbersorotherinformationsufficienttopermitthe 137persontoaccuratelyidentifyanddeleterecordsthathavebeenerasedunderthis 138section. 139 (11)(a)Upontheentryofanorderundersection610.140,thecourtshallsenda 140copyoftheordertothearrestinglawenforcementagencyandtheMissouristate 141highwaypatrol. 142 (b)TheMissouristatehighwaypatrolshallretainanonpublicrecordofthe 143orderexpungingaconvictionorothernotificationregardingaconvictionthatwas 144automaticallyexpungedunderthissectionandoftherecordofthearrest,fingerprints, 145conviction,andsentenceofthepersoninthecasetowhichtheorderorother 146notificationapplies.Exceptasprovidedinparagraph(c)ofthissubdivision,the 147nonpublicrecordshallbemadeavailableonlytoacourtofcompetentjurisdiction,an 148independentdepartmentofthejudicialbranchofstategovernment,thedepartmentof 149corrections,alawenforcementagency,aprosecutingattorney,theattorneygeneral,or 150thegovernor,uponrequestandonlyforthefollowingpurposes: 151 a.Toshowthatapersonwhohasfiledapetitiontoexpungeaconvictionhas 152previouslyhadaconvictionexpungedunderthissection; 158 d.Considerationbythedepartmentofcorrectionsoralawenforcementagency 159ifapersonwhoseconvictionhasbeenexpungedappliesforemploymentwiththe 160departmentofcorrectionsoralawenforcementagency; 161 e.Considerationbyacourt,lawenforcementagency,prosecutingattorney,or 162theattorneygeneralindeterminingwhetherapersonrequiredtoregisterunder 163sections589.400to589.425hascommittedanoffensethatrequiresregistrationunder 164sections589.400to589.425,orinprosecutingapersonforcommittinganoffense 165requiringregistrationundersections589.400to589.425;or HCSHBs2555&2108 5 166 f.Considerationbyacourt,lawenforcementagency,prosecutingattorney,or 167theattorneygeneralforuseinmakingdeterminationsregardingcharges,pleaoffers, 168andsentencing,asapplicable. 169 (c)Acopyofthenonpublicrecordcreatedunderparagraph(b)ofthis 170subdivisionshallbeprovidedtothepersonwhoseconvictionisexpungedunderthis 171sectionuponpaymentofafeedeterminedandchargedbytheMissouristatehighway 172patrol. 173 (d)Thenonpublicrecordmaintainedunderparagraph(b)ofthissubdivisionis 174exemptfromdisclosureunderthischapter. 175 (e)Anentityshallnotbeliablefordamagesorsubjecttocriminalpenaltiesfor 176reportingapublicrecordofconvictionthathasbeenexpungedbycourtorderor 177operationoflawpriortoAugust28,2027,ifthatrecordwasavailableasapublicrecord 178onthedateofthereport. 179 4.Anycourtsentencinganindividualforacleanslateeligibleoffenseshallnotify 180theindividualatthetimeofsentencingofthedatewhentheindividual'sconvictionmay 181becomeeligibleforautomatedexpungementprovidedtheindividualisnotconvictedof 182anymisdemeanororfelony,notincludingaviolationofatrafficviolationwithno 183authorizedtermofimprisonment,duringthetimeperiodspecifiedfortheunderlying 184offenseoroffenses. 185 5.Anyprobationorparoleofficereleasinganindividualfromsupervisionfora 186cleanslateeligibleoffenseshallnotifytheindividualatthetimesupervisionis 187dischargedofthedatewhentheindividual'srecordorrecordsmaybecomeeligiblefor 188automatedexpungementprovidedtheindividualisnotconvictedofanymisdemeanor 189orfelony,notincludingaviolationofatrafficviolationwithnoauthorizedtermof 190imprisonment,duringthetimeperiodspecifiedfortheunderlyingoffenseoroffenses. 191 6.Theprovisionsofthissectionshallapplyretroactivelytoanyarrest,charge, 192trial,andconvictionforwhichthereisadigitalrecordregardlessofthedatethatthe 193arrestwasmade,thechargeorchargeswerebrought,thetrialoccurred,orthe 194convictionwasentered. 195 7.Nothinginthissectionprecludesanindividualfromfilingapetitionfor 196expungementofrecordsundersection610.140ifanindividualiseligibleforautomated 197expungementunderthissectionbutsuchautomatedexpungementhasnotyetoccurred 198orcannotoccur. 199 8.(1)Upontheoccurrenceofoneofthecircumstancesprovidedunder 200subdivision(2)or(3)ofthissubsection,aconvictionthatwasexpungedunderthis 201sectionshallbereinstatedbythecourtasprovidedinthissubsection.
