61 (c)Ifanindividual'srecordcontainsmorefeloniesormisdemeanorsthancanbe
62expungedduringtheindividual'slifetimeunderparagraph(a)ofthissubdivision,the
63individualshallnotbeeligibleforautomatedexpungementunderthissection.
64 (d)Forpurposesofdetermininglifetimelimitsonexpungementunderthis
65sectionandsection610.140,iftheoffensesorviolationswerechargedascountsinthe
66samecase,allsuchoffensesandviolationsshallcountasonlythehighestleveloffenseor
67violationinthatcase.However,ifoneormorecountsinthesameindictmentor
68informationorconductcommittedwereapartofthesamecourseofcriminalconductas
69anoffenselistedinsubsection2ofsection610.140,theentirerecordsshallnotbe
70expungedunderthissection.
71 (e)Thecourtshallmaintainrecordstoensurethatapersonhasnotexceededthe
72limitationsprovidedunderthissubsection.Nothinginthissectionshallbeconstruedto
73limitorimpairthesubsequentuseofanyrecordmaintainedbythecourtforthe
74purposeofanylawenforcementorprosecutorialinvestigationoractivityincludingany
75arrestorfindingofguiltexpungedunderthissectionbyalawenforcementagency,
76criminaljusticeagency,prosecutingattorney,ormunicipalprosecutingattorney,
77includingitsuseasaprioroffense,violation,orinfractioninasubsequentcriminalor
78civilinvestigationorprosecution.
79 3.(1)BeginningAugust28,2027,onamonthlybasis,theofficeofstatecourts
80administratorshallidentifyandtransmittothecentralrepositoryandevery
81prosecutingagencyinthestateallcleanslateeligibleoffenserecordswithinthirty
82daysoftherecordbecomingeligibleforautomatedexpungement.
83 (2)RecordsthatareeligibleforexpungementonorbeforeAugust28,2024,shall
84beidentifiedandexpungedbeforeAugust28,2029.
85 (3)Delinquentcourtcosts,fines,fees,orothersumsorderedbyacourt,except
86restitutionowedtoavictimofacrime,shallnotbeconsideredbytheofficeofstate
87courtsadministratorwhendeterminingexpungementofarecordwithoutapetition
88undersubsection2ofthissection.
89 (4)Eachprosecutingagencyinthisstatehasnolaterthansixtydaysfromthe
90dayonwhichthenoticedescribedinsubdivision(1)ofthissubsectionistransmittedto
91objecttoanautomatedexpungementandtransmitsuchobjectiontoallparties.The
92prosecutingagencymayobjecttotheautomaticexpungementforanyofthefollowing
93reasons:
HCSHBs2555&2108	3 94 (a)Afterreviewingtheprosecutingagency'srecord,theagencybelievesthe
95recorddoesnotmeetthedefinitionofacleanslateeligiblecase;
96 (b)Thepersonhasnotpaidcourt-orderedrestitutiontothevictim;
97 (c)ThepersonhaschargespendingagainsttheminanothercaseinMissouri;or
98 (d)Theprosecutingagencyhasareasonablebelief,groundedinsupporting
99facts,thatanindividualwithacleanslateeligiblecaseiscontinuingtoengagein
100criminalactivity,regardlessofwhetherchargedwithanoffense,withinoroutsidethe
101state.
102 (5)Ifaprosecutingagencyidentifiedinsubdivision(4)ofthissubsectionobjects
103forareasondescribedinsubdivision(4)ofthissubsectionwithinsixtydaysoftheday
104onwhichthenoticedescribedinsubdivision(1)ofthissubsectionistransmitted,the

106 (6)Ifsixtydayshavepassedwithoutanobjectionfromaprosecutingagencyor
107thecentralrepositoryforoneofthereasonssetforthunderthissubsection,theofficeof
108statecourtsadministratorshalltransmitwithinfifteendaysalltherecordstobe
109expunged,sortedbycircuit,tothepresidingjudgesofeverycircuitcourt.
110 (7)(a)Withinthirtydaysofreceivinganoticetoexpunge,thecircuitcourtshall
111issueordersforexpungementofallrecordsmaintainedinthecircuitforwhichno
112notificationofineligibilitywasreceivedbytheofficeofstatecourtsadministratorfrom
113thecentralrepositoryoraprosecutingagencyunlessthecircuitcourtdeterminesthe
114recordisnoteligibleforautomatedexpungement.
115 (b)Ifthecircuitcourtdeterminesarecordisnoteligibleforautomated
116expungement,thecourtshallnotifytheofficeofstatecourtsadministratorinwritingof
117itsdeterminationwithinthirtydaysandshallspecifythereasonsthecourtreliedupon

119 (8)Onamonthlybasis,eachcircuitcourtshallissueordersforexpungementof
120allrecordsofarrest,chargeandconvictionforordinanceviolations,and
121nonfingerprintableoffensesinthecircuitthatthecourtdeterminesareeligiblefor

123 (9)Onamonthlybasis,eachcircuitcourtshalltransmitcopiesofallordersfor

135criminalmattersofpublicrecordthathavebeenerasedunderthissection.Such
136informationshallincludedocketnumbersorotherinformationsufficienttopermitthe
137persontoaccuratelyidentifyanddeleterecordsthathavebeenerasedunderthis
138section.
139 (11)(a)Upontheentryofanorderundersection610.140,thecourtshallsenda

188automatedexpungementprovidedtheindividualisnotconvictedofanymisdemeanor

191 6.Theprovisionsofthissectionshallapplyretroactivelytoanyarrest,charge,
192trial,andconvictionforwhichthereisadigitalrecordregardlessofthedatethatthe
193arrestwasmade,thechargeorchargeswerebrought,thetrialoccurred,orthe
194convictionwasentered.
195 7.Nothinginthissectionprecludesanindividualfromfilingapetitionfor
196expungementofrecordsundersection610.140ifanindividualiseligibleforautomated
197expungementunderthissectionbutsuchautomatedexpungementhasnotyetoccurred
198orcannotoccur.
199 8.(1)Upontheoccurrenceofoneofthecircumstancesprovidedunder
200subdivision(2)or(3)ofthissubsection,aconvictionthatwasexpungedunderthis
201sectionshallbereinstatedbythecourtasprovidedinthissubsection.

209 9.(1)Upontheentryofanorderundersection610.140,orupontheautomated
210expungementofaconvictionunderthissection,thepetitioner,forpurposesofthelaw,is
211considerednottohavebeenpreviouslyconvicted,exceptasprovidedunderthis

213 (2)Thepetitionershallnotbeentitledtotheremissionofanyfine,costs,orother

7 2.Anycreditbureauoruserofinformationthatwillfullyfailstocomplywith
8anyrequirementofthissectionwithrespecttoanyconsumerisliabletothatconsumer
9inanamountequalto:
10 (1)Anyactualdamagessustainedbytheconsumerasaresultofthefailure;
11 (2)Punitivedamagesasthecourtmayallow;and
12 (3)Inthecaseofanysuccessfulactionunderthissection,costsoftheactionand
13reasonableattorney'sfeesasdeterminedbythecourt.
14 3.Anycreditbureauoruserofinformationthatisnegligentinfailingtocomply
15withanyrequirementofthissectionwithrespecttoanyconsumerisliabletothat
16consumerinanamountequalto:

610.144.1.(1)Thereisherebycreatedinthestatetreasurythe"Missouri
2ExpungementFund",whichshallconsistofmoneysdepositedintothefundfromany
3sourceincluding,butnotlimitedto,gifts,donations,grants,andbequests.Thestate
4treasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180,
5thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,
6uponappropriation,moneysinthisfundshallbeusedsolelyasprovidedinsubsection2
7ofthissection.
8 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
9remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
10generalrevenuefund.
11 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
12otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
13creditedtothefund.
14 2.Thedepartmentofpublicsafety,theinformationtechnologyservicesdivision
15withintheofficeofadministration,andtheofficeofstatecourtsadministratorshall
16expendmoneysfromthefund,uponappropriation,onlyforoneormoreofthe
