Thisbillspecifiesthat,subjecttoexceptionsexpressedinthe
bill,foracriminalinvestigationorprosecution,alaw
enforcementagencycannotobtainreverselocationinformationfor
electronicdeviceswithinageofenceorbasedoncellsiterecords
unlessitmeetscertaincriteriaspecifiedinthebill.Thebill
describeswhatalawenforcementagencymustdoif,afterexecuting
awarrant,theagencyseekstoobtainreverselocationinformation
beyondtheparametersofawarrant. Toobtainidentifying
informationforanelectronicdeviceidentifiedunderthewarrant,
theagencymustestablishinaswornwarrantapplicationprobable
causetobelievetheelectronicdevicewasusedorotherwise
implicatedinacrime.Thebilldescribescertaincircumstances
underwhichalawenforcementagencycanobtainreverselocation
informationwithoutawarrant. Alawenforcementagencythat
executesawarranttoobtainidentifyinginformationforan
electronicdevicemustserveanoticeontheownerofthe
electronicdevicewithin90daysafterthedayonwhichthe
identifyinginformationwasobtainedbutinnocasemorethanthree
daysafterthedayonwhichtheinvestigationwasconcluded,or,if
theownerofthedeviceisunknowntotheagency,within90days
afterthedayonwhichtheagencyidentifiesorreasonablycould
identifytheowner.Theagencywillnotberequiredtoserve
noticeonadeviceowneriftheownerresidesoutsideoftheUnited
States.Theagencymaysubmitarequesttodelayserviceofthe
noticeundercertaincircumstances, expressedinthebill.
BeginningJanuary1,2025,alawenforcementagencyorany
governmententitythatobtainedareverselocationwarrantmust
annuallysubmitareportcontaininginformationrequiredunderthe
billonorbeforeApril30totheCrimePreventioncommitteesof
theHouseofRepresentatives andtheSenate.TheCrimePrevention
committeesintheHouseandtheSenatewilldevelopastandardized
formatforreportingthedata,compilethedata,and,onorbefore
August1ofeachyear,makeareportofthedatapublicly
available.
