BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapters161and660,RSMo,areamendedbyaddingtheretotwonew
2sections,tobeknownassections161.1150and660.830,toreadasfollows:
161.1150.1.Notwithstandingtheprovisionsof205.565,thedepartmentmay
2purchaseservicesdirectlyfromprivateandpublicvendorsinthisstatewithfunds
3appropriatedforsuchpurpose.
4 2.Servicesthatmaybepurchasedincludeprevention,diagnosis,evaluation,
5treatment,habilitation,rehabilitation,transportationandotherspecialservicesfor
6personsaffectedbymentaldisorders,mentalillness,intellectualdisabilities,
7developmentaldisabilities,oralcoholordrugabuse.
8 3.Thecommissionerofadministration,inconsultationwiththedirector,shall
9promulgaterulesestablishingproceduresconsistentwiththeusualstatepurchasing
10proceduresunderchapter34forthepurchaseofservicesasprovidedinthis
11section.Thecommissionermayauthorizethedepartmenttopurchaseanytechnical
12servicewhich,inhisorherjudgment,canbestbepurchaseddirectlyunderchapter
1334.Thecommissionershallcooperatewiththedepartmenttopurchasetimelyservices
14appropriatetotheneedsofindividualsandentitiesservedbythedepartment.
15 4.Thecommissionerofadministrationmaypromulgaterulesauthorizingthe
16departmenttoreview,suspend,terminate,orotherwisetakeremedialmeasureswith

19 5.Thecommissionerofadministrationmaypromulgaterulesforawaiverof
20chapter34biddingproceduresforthepurchaseofserviceswithfundsappropriatedfor
21thatpurposeif,inthecommissioner'sjudgment,suchservicescanbestbepurchased
22directlybythedepartment.
23 6.Anyentitythatcontractswiththedepartmentforthepurposeofdisbursing
24fundsthroughpartnershipstocommunityprogramsthatprovidehumanservicesshall
25notcollectfeesinexcessof:
26 (1)Fivepercentiftheamountoffundsreceivedfromthedepartmentisunder
27onemilliondollars;or
28 (2)Threepercentiftheamountoffundsreceivedfromthedepartmentisone
29milliondollarsormore.
30 7.Thecommissionerofadministrationmaypromulgateallnecessaryrulesand
31regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
32termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
33sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
34provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
35536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
36pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
37arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
38andanyruleproposedoradoptedafterAugust28,2024,shallbeinvalidandvoid.
660.830.1.Notwithstandingtheprovisionsof205.565,thedepartmentmay

11Thecommissionermayauthorizethedepartmenttopurchaseanytechnicalservice
12which,inhisorherjudgment,canbestbepurchaseddirectlyunderchapter34.The
13commissionershallcooperatewiththedepartmenttopurchasetimelyservices
14appropriatetotheneedsofindividualsandentitiesservedbythedepartment.

21thatpurposeif,inthecommissioner'sjudgment,suchservicescanbestbepurchased
22directlybythedepartment.
23 6.Anyentitythatcontractswiththedepartmentforthepurposeofdisbursing
24fundsthroughpartnershipstocommunityprogramsthatprovidehumanservicesshall
25notcollectfeesinexcessof:
26 (1)Fivepercentiftheamountoffundsreceivedfromthedepartmentisunder
27onemilliondollars;or

30 7.Thecommissionerofadministrationmaypromulgateallnecessaryrulesand
31regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat
32termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
33sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
34provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
35536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
36pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
