BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter67,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection67.477,toreadasfollows: 67.477.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"City",acity,town,orvillagethatisincorporatedinaccordancewiththe 3lawsofthisstate; 4 (2)"County",acountyinthisstate; 5 (3)"Department",theMissouridepartmentofeconomicdevelopment; 6 (4)"Neighborhoodimprovementdistrict",adistrictformedundersections 767.453to67.475to: 8 (a)Payforthecostsofengineering,installing,maintaining,repairing,and 9replacingofsuchstreetlightsinsuchdistrict; 10 (b)Payfortheongoingcostsforelectricservicetosuchstreetlightsinsuch 11district;or 12 (c)Bothpurposesdescribedinparagraphs(a)and(b)ofthissubdivision; 13 (5)"Streetlight",anapprovedpole-mountedlightthat: 14 (a)Isdesignedandlocatedtoilluminateapubliclyorprivatelyownedstreetina 15residentialarea; 16 (b)Ispoweredby: EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 a.Electricityprovidedbyapublicentityorprivatecompanyregulatedbythe 18Missouripublicservicecommission;or 19 b.Solarpower;and 20 (c)Isoneofthefollowing: 21 a.Alight-emittingdiode(LED);or 22 b.Adifferentlightsourcethathasbeendocumentedanddemonstratedtouse 23lesspowerthananequivalentLED. 24 2.(1)Acityorcountymaycreateaneighborhoodimprovementdistrictunder 25thissection.Thetermforsuchdistrictshallnotexceedtwentyyears.Aneighborhood 26improvementdistrict'stermmaybeextendedforanadditionaltermofuptotwenty 27yearsbythepetitionprocessprovidedinsection67.457. 28 (2)Aspecialassessmentleviedandcollectedforaneighborhoodimprovement 29districtunderthissectionshallbeheldseparatelybythecityorcountyandusedforthe 30solepurposeofpayingtheobligationsofsuchdistrictunderthissection. 31 (3)Acityorcountyshallprovideitsportionofmoneysformatchinggrants 32providedbythedepartmentunderthissectionfromspecialassessmentsleviedand 33collectedundersubdivision(2)ofthissubsection. 34 3.(1)Thereisherebycreatedinthestatetreasurythe"NeighborhoodSafety 35andCrimePreventionStreetLightingFund",whichshallconsistofmoneys 36appropriatedbythegeneralassemblyorreceivedfromothersourcesunderthis 37section.Thedepartmentshalladministerthefund.Thestatetreasurershallbe 38custodianofthefund.Inaccordancewithsections30.170and30.180,thestatetreasurer 39mayapprovedisbursements.Thefundshallbeadedicatedfundand,upon 40appropriation,moneysinthisfundshallbeusedsolelyasprovidedinthissection. 41 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 42remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 43generalrevenuefund. 44 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 45otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 46creditedtothefund. 47 4.Thedepartmentmayapplyforfederalgrantstoprovideadditionalmoneys 48forthestate'sportionofthematchinggrantsprovidedunderthissection. 49 5.Uponappropriation,thedepartmentshall: 50 (1)Usemoneysintheneighborhoodsafetyandcrimepreventionstreetlighting 51fundtopaythestate'sportionofmoneysformatchinggrantsasprovidedunderthis 52section; HB2828 2 53 (2)Makeannualmatchinggrantsavailableunderthissectiontocitiesand 54countiesonafirst-come,first-servedbasis; 55 (3)Providesuchmatchinggrantsunderthissectiontoacityorcountyonaper- 56lightbasis;and 57 (4)Distributemoneysformatchinggrantsunderthissectiononthebasisoftwo- 58thirdsofthecosttobepaidbythestateandone-thirdofthecosttobepaidbythecityor 59county. 60 6.Innoinstanceshallthestate'sportionofamatchinggrantmadeunderthis 61sectionexceedtwothousanddollarsperstreetlightinstalledwithinacity'sorcounty's 62neighborhoodimprovementdistrictcreatedunderthissection. 63 7.Thedepartmentmaypromulgateallnecessaryrulesandregulationsforthe 64administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin 65section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 66becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 67536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable 68andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 69review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 70heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 71adoptedaftertheeffectivedateofthisactshallbeinvalidandvoid. ✔ HB2828 3
