313.429.1.(1)Exceptasprovidedinsubdivision(2)ofthissubsection,the
2commissionshallimplementasystemofmechanicalamusementdevicesutilizinga
3licensingstructureforprocessinglicenseapplicationsandissuinglicensestodevice
4manufacturers,distributors,operators,handlers,andretailersfortheconductingof
5interactivedigitalgamesonmechanicalamusementdeviceswithinthestate.This
HB2835	3 6licensingstructureandprocessshallbereferredtoasthemechanicalamusementdevice
7program.
8 (2)Nopersonlicensedasa:
9 (a)Devicemanufacturerordistributorshallbeissuedalicenseasadevice
10operatororadeviceretailer;
11 (b)Deviceoperatorshallbeissuedalicenseasadevicemanufacturer,device
12distributor,ordeviceretailer;and
13 (c)Deviceretailershallbeissuedalicenseasadevicemanufacturer,device
14distributor,ordeviceoperator.
15 (3)Nothinginthissubsectionshallpreventadevicemanufacturerfrom
16obtainingadevicemanufacturer'slicenseandadevicedistributor'slicenseand
17providingandoperatingthecentralizedcomputersystemformonitoringmechanical
18amusementdevices.
19 2.Undernocircumstancesshallthecommission:
20 (1)Authorizeorallowasinglevendororlicenseetoimplementthemechanical
21amusementdeviceprogramcreatedunderthissection;or
22 (2)Allowasinglelicenseddeviceoperatortocontroloroperatemorethan
23twenty-fivepercentofmechanicalamusementdevicesinthestateafterDecember31,
242028.
25 3.(1)Themechanicalamusementdeviceprogramauthorizedundersections
26313.427to313.437shallallowformultipledevicemanufacturers,distributors,and
27operatorstoencourageprivatesectorinvestmentandjobopportunitiesforMissouri
28citizens.Mechanicalamusementdevicesshallbeconnectedtoacentralizedcomputer
29systemdevelopedorprocuredbythecommission.Thecommissionshallprovide
30licenseddeviceoperatorswiththenecessaryprotocolstoconnecttheoperators'device
31ordevicestothecentralizedcomputersystemaftersuchdeviceordeviceshavebeen
32approvedbythecommission.Nomechanicalamusementdeviceshallbeplacedin
33operationwithoutfirstconnectingtothecentralizedcomputersystemaftersuchdevice
34ordeviceshavebeenapprovedbythecommission.Avendorthatprovidesthe
35centralizedcomputersystemauthorizedunderthissubsectionshallnotbeeligibletobe
36licensedasadeviceoperatorordeviceretailer.Thecommissionshallimposeaninitial
37nonrefundablelicenseapplicationfeeasfollows:
38 (a)Fordevicemanufacturers,devicedistributors,anddeviceoperators,nomore
39thantwenty-fivethousanddollars;
40 (b)Fordeviceretailers,nomorethanonethousanddollars;or
41 (c)Fordevicehandlers,nomorethanonehundreddollars.
HB2835	4 42 (2)Theinitiallicenseshallbeforaperiodofoneyear.Thereafter,license
43renewalperiodsshallbefouryearswiththeapplicablerenewalfeepaidforeachyearof
44suchlicenserenewalinadvance.Annuallicenserenewalfeesforanyonelicensedunder
45thissubsection,andsubsequenttotheinitialone-yearperiod,shallbeasfollows:
46 (a)Tenthousanddollarsfordevicemanufacturers,devicedistributors,and
47deviceoperators;
48 (b)Onehundreddollarsfordevicehandlers;and
49 (c)Onethousanddollarsforeachdeviceretailer.
50 (3)Inadditiontothelicensefeesrequiredundersubdivisions(1)and(2)ofthis
51subsection,anannualadministrativefeeoffivehundreddollarsshallbepaidforeach
52mechanicalamusementdeviceplacedinservice.
53 (4)Nothinginthissubsectionshallbeconstruedtorelievethelicenseeofthe
54affirmativedutytonotifythecommissionofanychangerelatingtothestatusofthe
55licenseortoanyotherinformationcontainedintheapplicationmaterialsonfilewith
56thecommission.
57 4.(1)Nolicenseshallbeissuedtoanyperson,andnopersonshallbeallowedto
58serveasasalesagent,whohasbeenconvictedofafelony.Salesagentsshallbe
59registeredwiththecommissionbyalicenseddeviceoperatorandshallnotsolicitor
60enterintoanycontractwithadeviceretailerpriortosuchretailerbeinglicensedto
61conductinteractivedigitalgamesonmechanicalamusementdevices.
62 (2)Apersonorsalesagent'soperation,handling,leasing,licensing,servicing,or
63placingofunregulatedcoin-operatedamusementmachinesshallinnowayprohibitor
64prejudicethatpersonorsalesagent'sparticipationinthemechanicalamusementdevice
65programauthorizedundersections313.427to313.437,norshallitconstituteavalid
66reasontorefusetoissueorrenewortorevokeorsuspendanylicenseorpermitissued
67undersections313.427to313.437.Thecommissionoranypoliticalsubdivisionsshallin
68nowayprejudiceorprohibittheparticipationortheissuanceofanylicenserelatingto
69interactivedigitalgamesormechanicalamusementdevicestopersonsorsalesagentson
70thebasisofsuchpersonorsalesagent'soperation,handling,leasing,licensing,servicing,
71orplacingofunregulatedcoin-operatedamusementmachines.
72 5.Nolicenserequirement,stickerfee,ortaxshallbeimposedbyanylocal
73jurisdictionuponadevicemanufacturer,devicedistributor,deviceoperator,device
74retailer,devicehandler,oramechanicalamusementdeviceoradeviceretailer
75establishmentrelatingtotheoperationofinteractivedigitalgames,mechanical
76amusementdevices,orassociatedequipment.
77 6.(1)Mechanicalamusementdevicesshallmeetindependenttestingstandards
78approvedbythecommission,astestedbyoneormorelicensedindependenttestlabs,

80approvedbythecommission.Mechanicalamusementdevicesshallbecapableof
81printingaticketredeemableforwinninginteractivedigitalgameplays.Such
82mechanicalamusementdevicesshallbeinspectedandapprovedpriortobeingsold,
83leased,ortransferred.
84 (2)Licenseddevicemanufacturersmaybuy,sell,orleaseneworrefurbished
85mechanicalamusementdevicestoandfromlicenseddevicedistributors.
86 (3)Licenseddevicedistributorsmaybuy,sell,orleaseneworrefurbished
87mechanicalamusementdevicestoorfromlicenseddevicemanufacturersorlicensed
88deviceoperators.
89 7.(1)Licenseddeviceoperators:
90 (a)Maybuy,lease,orrentmechanicalamusementdevicesfromlicenseddevice
91manufacturers,operators,ordistributors;
92 (b)Mayhandle,place,andservicemechanicalamusementdevices;
93 (c)Shallconnectsuchmechanicalamusementdevicestothecentralized
94computersystemapprovedbythecommission;and
95 (d)Shall,notwithstandingtheprovisionsofsection313.321tothecontrary,pay
96allinteractivedigitalgamewinningsusingaticketredemptionterminal.Suchticket
97redemptionterminalsshallbelocatedwithinthedeviceretailer'sestablishmentindirect
98proximitytosuchmechanicalamusementdevices.Deviceoperatorsshallpaythe
99commissionthirty-twopercentofanyunclaimedcashprizeassociatedwithawinning
100ticketthathasnotbeenredeemedwithinonehundredeightydaysofissue.
101 (2)Rentsorleasesformechanicalamusementdevicesshallbewrittenataflat
102rateandshallnotincluderevenuesplittingasamethodusedinthecalculationofthe
103leaseorrent.
104 (3)Licenseddeviceoperatorsandlicenseddeviceretailersshallenterintoa
105writtenagreementfortheplacementofmechanicalamusementdevices.Theagreement
106shallbeonaformapprovedbythecommissionandshallspecifyanequaldivisionof
107adjustedgrossreceiptsoruponapprovalofthecommission,anegotiateddivisionof
108adjustedgrossreceiptsbetweenthedeviceoperatorandthedeviceretailerafter
109adjustmentsfortaxesandadministrativefeesaremade,shallhaveaminimumtermof
110fiveyearsandamaximumtermoftenyears,andshallberenewableforaminimum
111termoffiveadditionalyears.Adeviceoperatorshallberesponsibleforremittingtothe
112commissionandthedeviceretaileritsshareofadjustedgrossreceipts.Nothinginthis
113subdivisionshallprohibitalicenseddeviceoperatorfromenteringintoanagreement
114withasalesagentfordeviceretaileragreements,providedsuchagreementisinwriting
115andapprovedbythecommissionpriortobeginningsalesactivitiesandpriortothestart

117affiliatesanddeviceretailersarespecificallyprohibitedfromofferinganythingofvalue,
118otherthanthepercentageofadjustedgrossreceiptsprovidedunderthissubsection,or
119enteringintoanagreementwithadeviceretailerpriortothestartdatefortheinitialor
120continuedplacementofmechanicalamusementdevices,exceptthatadeviceoperator
121maypayforconstructionofamechanicalamusementdeviceareainsidethepremisesof
122adeviceretailer.Contractagreementsenteredintopriortothestartdateestablished
123undersection313.431betweenaprospectivedeviceoperatororsalesagentwitha
124prospectivedeviceretailershallbeinvalid.Apersonorsalesagent'soperation,
125handling,leasing,licensing,servicing,orplacingofunregulatedcoin-operated
126amusementmachinesshallinnowayprohibitorprejudicethatpersonorsales
127agent'sparticipationinthemechanicalamusementdeviceprogramauthorizedunder
128sections313.427to313.437,norshallitconstituteavalidreasontorefusetoissueor
129renewortorevokeorsuspendanylicenseorpermitissuedundersections313.427to
130313.437.Thecommissionoranypoliticalsubdivisionsshallinnowayprejudiceor
131prohibittheparticipationortheissuanceofanylicenserelatingtointeractivedigital
132gamesormechanicalamusementdevicestopersonsorsalesagentsonthebasisofsuch
133personorsalesagent'soperation,handling,leasing,licensing,servicing,orplacingof
134unregulatedcoin-operatedamusementmachines.
135 (4)Tocombatproblemgambling,deviceoperatorsshallallowplayerstobeself-
136excludedfrominteractivedigitalgameplay.Operatorsshallprovidethecommission
137withalistofplayersthathaveelectedtobeexcludedfrominteractivedigitalgameplay
138withinthirtydaysofsuchelectionandshallupdatesuchlistperiodicallyasrequiredby
139thecommission.Suchself-excludedlistshallbeconsideredconfidentialinformationand
140shallnotbereleasedtothepublic.Thecommissionshallissuesuchself-exclusion
141proceduresbyrule.
142 (5)Nothinginthissectionshallbeconstruedtopreventadeviceoperatorora
143deviceretailerfromusingaplayerrewardssystemasapprovedbythecommission.No
144playershallberequiredtoenrollinarewardsprogramofferedbyadeviceoperatoror
145deviceretailerasaconditiontoplayinteractivedigitalgames.
146 8.Nolicenseddeviceoperatorshall:
147 (1)Offermechanicalamusementdevicesthatdirectlydispenseanythingofvalue
148exceptforticketsforwinningplays.Ticketsshallbedispensedbypressingtheticket
149dispensingbuttononthemechanicalamusementdeviceattheendofanyinteractive
150digitalgameplay.Theticketshallindicatethetotalamountofinteractivedigitalgame
151creditsandthecashaward,thetimeofdayinatwenty-four-hourformatshowinghours
152andminutes,thedate,thedeviceserialnumber,thesequentialnumberoftheticket,and

154determined.Thepriceofinteractivedigitalgamecreditsshallbedeterminedbythe
155commission.Themaximumwagerplayedperinteractivedigitalgameshallnotexceed
156fivedollars.Themaximumprizepayoffforawinningmaximumwagerforasingle
157gameplayshallbenomorethanonethousandonehundreddollars,orthemaximum
158amountallowablebyfederallawbeforetaxwithholdingisrequiredforasinglegame-
159winningplay;
160 (2)Operatemorethaneightmechanicalamusementdevicesperlocationonthe
161premisesofafraternalorganization,veteransorganization,ortruckstopthathas
162securedandmaintainsadeviceretailer'slicense;
163 (3)Operatemorethanfivemechanicalamusementdevicesperlocationonthe
164premisesofanybusinessentitylicensedasadeviceretailerthatisnotafraternal
165organization,veteransorganization,ortruckstop;
166 (4)Operateanymechanicalamusementdeviceatanylocationwithinonemileof
167acasinoorwithinonemileofanelementaryorhighschool;
168 (5)Advertiseinteractivedigitalgamesormechanicalamusementdevicesoutside
169ofalicenseddeviceretailer'sestablishmentthroughanymediaoutletsordirectmailor
170telephonesolicitations.Theadvertisingprohibitioncontainedinthissubdivisionshall
171applytoalllicenseesincluding,butnotlimitedto,devicemanufacturers,device
172distributors,deviceoperators,deviceretailers,anddevicehandlers;exceptthat,a
173deviceretailermayparticipateinanadvertisingprogramthatispromotedthroughand
174sponsoredbythestatelotteryandmayadvertiseinorontheoutsideofthedevice

179 9.(1)Nopersonundertwenty-oneyearsofageshallplayinteractivedigital
180games,andsuchmechanicalamusementdevicesshallbeunderthesupervisionofa
181personthatistwenty-oneyearsofageoroldertopreventpersonsundertwenty-one
182yearsofagefromplayinginteractivedigitalgames.Mechanicalamusementdevices
183shallbeplacedinafullyenclosedroomthatiscontinuallymonitoredbyvideo
184surveillanceandwhereaccesstopersonsundertwenty-oneyearsofageisdeniedbya
185procedureapprovedbythecommission.Awarningsignshallbepostedina
186conspicuouslocationwheresuchmechanicalamusementdevicesarelocated,containing

199nonbusinesshoursandshallreporttothecommissionanyunauthorizedentranceof
200thedeviceretailer'sestablishment.Suchsurveillanceandintrusiondetectionsystem
201shallmeetspecificationsasdefinedbythecommission.
202 (4)Adeviceoperatorshallpostasigninaconspicuouslocationwheresuch
203mechanicalamusementdevicesarelocated,containinginredletteringatleastone-half
204inchhighonawhitebackgroundatelephonecontactnumber(1-888-BETSOFF)forthe
205problemgamblinghelpline.
206 (5)Adeviceoperatorordeviceretailerthatfailstoreportanyknownviolation
207oflaw,rules,orregulationsgoverningtheconductofinteractivedigitalgameson
208mechanicalamusementdevicesinconformancewithestablishedcommissionprocedures
209maybesubjecttoanadministrativefinenottoexceedfivethousanddollars.Inthe
210eventadeviceoperatorordeviceretailerisfoundtohaveknowinglycommitteda
211violationgoverningtheconductofinteractivedigitalgamesonmechanicalamusement
212devices,thecommissionmayimposeanadministrativefinenottoexceedtenthousand
213dollars,suspendsuchoperator'sorretailer'slicenseforuptothirtydays,orinthecase
214ofrepeatedviolations,revokesuchdeviceoperator'sordeviceretailer'slicensefora
215periodofoneyear.Anydeviceoperatorordeviceretaileraggrievedbythe
216commission'sdecisioninanydisciplinaryactionthatresultsinthesuspensionor
217revocationofsuchdeviceoperator'sordeviceretailer'slicensemayappealsuchdecision
218byfilinganactionincircuitcourt.
219 10.(1)Deviceoperatorsshallpaythecommissionthirty-threepercentofthe
220adjustedgrossreceipts,whichshallbedepositedintothestatelotteryfund.The
221commissionshalltransfer,subjecttoappropriation,theamountreceivedfromthe

18 3.Onorbeforetheanniversarydateofthepaymentoftheinitialapplicationfee
19underthissection,aninteractivesportswageringplatformproviderholdingalicense
20issuedunderthissectionshallpaytothecommissionalicenserenewalfee,nottoexceed
21threehundredtwenty-fivethousanddollars.Suchfundsshallbedepositedintothe
22gamingcommissionfundestablishedundersection313.835.
23 4.Notwithstandinganyotherprovisionoflawtothecontrary,thefollowing

3 2.Asportswageringsuppliermayprovideitsservicestolicenseesunderafixed-
4feeorrevenue-sharingagreementonlyifthesupplierisproperlylicensedbythe
5commission.
6 3.Attherequestofanapplicantforasportswageringsupplier'slicense,the
7commissionmayissueaprovisionallicensetotheapplicant,aslongastheapplicanthas
8submittedacompletedapplicationforthelicense,includingpayingtherequired
9applicationfee.Thecommissionmayprescribebyruletherequirementstoreceivea
10provisionallicense.
11 4.Anapplicantforasportswageringsupplier'slicenseshalldisclosetheidentity
12of:
13 (1)Theapplicant'sprincipalownerswhodirectlyowntenpercentormoreofthe
14applicant;

5placementintheself-exclusionprogram.Eachsportswageringoperatorshallincludea
6linktosuchapplicationonallsportswageringplatforms.
7 3.Thecommissionshalladoptrulesandregulationsthatincorporateasports
8wageringself-exclusionprogramintotheprogramadoptedundersections313.800to
9313.850.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
10createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
11complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
12section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
13vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
14effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
15thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust

14amountforaperiodoftwelvemonths.
15 3.Thepaymentofthetaxunderthissectionshallbebyanelectronicfunds
16transferbyanautomatedclearinghouse.
17 4.Revenuesreceivedfromthetaximposedundersubsection1ofthissection
18shallbedepositedinthestatetreasurytothecreditofthegamingproceedsfor
19educationfund,whichshallbedistributedasprovidedundersection313.822.
20 5.(1)Alicensedfacilitythatisanexcursiongamblingboatshallpaytothe
