11 (b)Deviceoperatorshallbeissuedalicenseasadevicemanufacturer,device 12distributor,ordeviceretailer;and 13 (c)Deviceretailershallbeissuedalicenseasadevicemanufacturer,device 14distributor,ordeviceoperator. 15 (3)Nothinginthissubsectionshallpreventadevicemanufacturerfrom 16obtainingadevicemanufacturer'slicenseandadevicedistributor'slicenseand 17providingandoperatingthecentralizedcomputersystemformonitoringmechanical 18amusementdevices. 19 2.Undernocircumstancesshallthecommission: 20 (1)Authorizeorallowasinglevendororlicenseetoimplementthemechanical 21amusementdeviceprogramcreatedunderthissection;or 22 (2)Allowasinglelicenseddeviceoperatortocontroloroperatemorethan 23twenty-fivepercentofmechanicalamusementdevicesinthestateafterDecember31, 242028. 25 3.(1)Themechanicalamusementdeviceprogramauthorizedundersections 26313.427to313.437shallallowformultipledevicemanufacturers,distributors,and 27operatorstoencourageprivatesectorinvestmentandjobopportunitiesforMissouri 28citizens.Mechanicalamusementdevicesshallbeconnectedtoacentralizedcomputer 29systemdevelopedorprocuredbythecommission.Thecommissionshallprovide 30licenseddeviceoperatorswiththenecessaryprotocolstoconnecttheoperators'device 31ordevicestothecentralizedcomputersystemaftersuchdeviceordeviceshavebeen 32approvedbythecommission.Nomechanicalamusementdeviceshallbeplacedin 33operationwithoutfirstconnectingtothecentralizedcomputersystemaftersuchdevice 34ordeviceshavebeenapprovedbythecommission.Avendorthatprovidesthe 35centralizedcomputersystemauthorizedunderthissubsectionshallnotbeeligibletobe 36licensedasadeviceoperatorordeviceretailer.Thecommissionshallimposeaninitial 37nonrefundablelicenseapplicationfeeasfollows: 38 (a)Fordevicemanufacturers,devicedistributors,anddeviceoperators,nomore 39thantwenty-fivethousanddollars; 40 (b)Fordeviceretailers,nomorethanonethousanddollars;or 41 (c)Fordevicehandlers,nomorethanonehundreddollars. HB2835 4 42 (2)Theinitiallicenseshallbeforaperiodofoneyear.Thereafter,license 43renewalperiodsshallbefouryearswiththeapplicablerenewalfeepaidforeachyearof 44suchlicenserenewalinadvance.Annuallicenserenewalfeesforanyonelicensedunder 45thissubsection,andsubsequenttotheinitialone-yearperiod,shallbeasfollows: 46 (a)Tenthousanddollarsfordevicemanufacturers,devicedistributors,and 47deviceoperators; 48 (b)Onehundreddollarsfordevicehandlers;and 49 (c)Onethousanddollarsforeachdeviceretailer. 50 (3)Inadditiontothelicensefeesrequiredundersubdivisions(1)and(2)ofthis 51subsection,anannualadministrativefeeoffivehundreddollarsshallbepaidforeach 52mechanicalamusementdeviceplacedinservice. 53 (4)Nothinginthissubsectionshallbeconstruedtorelievethelicenseeofthe 54affirmativedutytonotifythecommissionofanychangerelatingtothestatusofthe 55licenseortoanyotherinformationcontainedintheapplicationmaterialsonfilewith 56thecommission. 57 4.(1)Nolicenseshallbeissuedtoanyperson,andnopersonshallbeallowedto 58serveasasalesagent,whohasbeenconvictedofafelony.Salesagentsshallbe 59registeredwiththecommissionbyalicenseddeviceoperatorandshallnotsolicitor 60enterintoanycontractwithadeviceretailerpriortosuchretailerbeinglicensedto 61conductinteractivedigitalgamesonmechanicalamusementdevices. 62 (2)Apersonorsalesagent'soperation,handling,leasing,licensing,servicing,or 63placingofunregulatedcoin-operatedamusementmachinesshallinnowayprohibitor 64prejudicethatpersonorsalesagent'sparticipationinthemechanicalamusementdevice 65programauthorizedundersections313.427to313.437,norshallitconstituteavalid 66reasontorefusetoissueorrenewortorevokeorsuspendanylicenseorpermitissued 67undersections313.427to313.437.Thecommissionoranypoliticalsubdivisionsshallin 68nowayprejudiceorprohibittheparticipationortheissuanceofanylicenserelatingto 69interactivedigitalgamesormechanicalamusementdevicestopersonsorsalesagentson 70thebasisofsuchpersonorsalesagent'soperation,handling,leasing,licensing,servicing, 71orplacingofunregulatedcoin-operatedamusementmachines. 72 5.Nolicenserequirement,stickerfee,ortaxshallbeimposedbyanylocal 73jurisdictionuponadevicemanufacturer,devicedistributor,deviceoperator,device 74retailer,devicehandler,oramechanicalamusementdeviceoradeviceretailer 75establishmentrelatingtotheoperationofinteractivedigitalgames,mechanical 76amusementdevices,orassociatedequipment. 77 6.(1)Mechanicalamusementdevicesshallmeetindependenttestingstandards 78approvedbythecommission,astestedbyoneormorelicensedindependenttestlabs, HB2835 5 79andbecapableofrandomlygeneratingtheoutcomeofinteractivedigitalgames 80approvedbythecommission.Mechanicalamusementdevicesshallbecapableof 81printingaticketredeemableforwinninginteractivedigitalgameplays.Such 82mechanicalamusementdevicesshallbeinspectedandapprovedpriortobeingsold, 83leased,ortransferred. 84 (2)Licenseddevicemanufacturersmaybuy,sell,orleaseneworrefurbished 85mechanicalamusementdevicestoandfromlicenseddevicedistributors. 86 (3)Licenseddevicedistributorsmaybuy,sell,orleaseneworrefurbished 87mechanicalamusementdevicestoorfromlicenseddevicemanufacturersorlicensed 88deviceoperators. 89 7.(1)Licenseddeviceoperators: 90 (a)Maybuy,lease,orrentmechanicalamusementdevicesfromlicenseddevice 91manufacturers,operators,ordistributors; 92 (b)Mayhandle,place,andservicemechanicalamusementdevices; 93 (c)Shallconnectsuchmechanicalamusementdevicestothecentralized 94computersystemapprovedbythecommission;and 95 (d)Shall,notwithstandingtheprovisionsofsection313.321tothecontrary,pay 96allinteractivedigitalgamewinningsusingaticketredemptionterminal.Suchticket 97redemptionterminalsshallbelocatedwithinthedeviceretailer'sestablishmentindirect 98proximitytosuchmechanicalamusementdevices.Deviceoperatorsshallpaythe 99commissionthirty-twopercentofanyunclaimedcashprizeassociatedwithawinning 100ticketthathasnotbeenredeemedwithinonehundredeightydaysofissue. 101 (2)Rentsorleasesformechanicalamusementdevicesshallbewrittenataflat 102rateandshallnotincluderevenuesplittingasamethodusedinthecalculationofthe 103leaseorrent. 104 (3)Licenseddeviceoperatorsandlicenseddeviceretailersshallenterintoa 105writtenagreementfortheplacementofmechanicalamusementdevices.Theagreement 106shallbeonaformapprovedbythecommissionandshallspecifyanequaldivisionof 107adjustedgrossreceiptsoruponapprovalofthecommission,anegotiateddivisionof 108adjustedgrossreceiptsbetweenthedeviceoperatorandthedeviceretailerafter 109adjustmentsfortaxesandadministrativefeesaremade,shallhaveaminimumtermof 110fiveyearsandamaximumtermoftenyears,andshallberenewableforaminimum 111termoffiveadditionalyears.Adeviceoperatorshallberesponsibleforremittingtothe 112commissionandthedeviceretaileritsshareofadjustedgrossreceipts.Nothinginthis 113subdivisionshallprohibitalicenseddeviceoperatorfromenteringintoanagreement 114withasalesagentfordeviceretaileragreements,providedsuchagreementisinwriting 115andapprovedbythecommissionpriortobeginningsalesactivitiesandpriortothestart HB2835 6 116dateestablishedundersection313.431.Deviceoperatorsandtheirsalesagentsand 117affiliatesanddeviceretailersarespecificallyprohibitedfromofferinganythingofvalue, 118otherthanthepercentageofadjustedgrossreceiptsprovidedunderthissubsection,or 119enteringintoanagreementwithadeviceretailerpriortothestartdatefortheinitialor 120continuedplacementofmechanicalamusementdevices,exceptthatadeviceoperator 121maypayforconstructionofamechanicalamusementdeviceareainsidethepremisesof 124prospectivedeviceretailershallbeinvalid.Apersonorsalesagent'soperation, 125handling,leasing,licensing,servicing,orplacingofunregulatedcoin-operated 126amusementmachinesshallinnowayprohibitorprejudicethatpersonorsales 127agent'sparticipationinthemechanicalamusementdeviceprogramauthorizedunder 128sections313.427to313.437,norshallitconstituteavalidreasontorefusetoissueor 129renewortorevokeorsuspendanylicenseorpermitissuedundersections313.427to 130313.437.Thecommissionoranypoliticalsubdivisionsshallinnowayprejudiceor 131prohibittheparticipationortheissuanceofanylicenserelatingtointeractivedigital 132gamesormechanicalamusementdevicestopersonsorsalesagentsonthebasisofsuch 133personorsalesagent'soperation,handling,leasing,licensing,servicing,orplacingof 134unregulatedcoin-operatedamusementmachines. 135 (4)Tocombatproblemgambling,deviceoperatorsshallallowplayerstobeself- 136excludedfrominteractivedigitalgameplay.Operatorsshallprovidethecommission 137withalistofplayersthathaveelectedtobeexcludedfrominteractivedigitalgameplay 138withinthirtydaysofsuchelectionandshallupdatesuchlistperiodicallyasrequiredby 139thecommission.Suchself-excludedlistshallbeconsideredconfidentialinformationand 140shallnotbereleasedtothepublic.Thecommissionshallissuesuchself-exclusion 141proceduresbyrule. 142 (5)Nothinginthissectionshallbeconstruedtopreventadeviceoperatorora 143deviceretailerfromusingaplayerrewardssystemasapprovedbythecommission.No 144playershallberequiredtoenrollinarewardsprogramofferedbyadeviceoperatoror 145deviceretailerasaconditiontoplayinteractivedigitalgames. 146 8.Nolicenseddeviceoperatorshall: 147 (1)Offermechanicalamusementdevicesthatdirectlydispenseanythingofvalue 148exceptforticketsforwinningplays.Ticketsshallbedispensedbypressingtheticket 149dispensingbuttononthemechanicalamusementdeviceattheendofanyinteractive 150digitalgameplay.Theticketshallindicatethetotalamountofinteractivedigitalgame 151creditsandthecashaward,thetimeofdayinatwenty-four-hourformatshowinghours 152andminutes,thedate,thedeviceserialnumber,thesequentialnumberoftheticket,and HB2835 7 153anencryptedvalidationnumberfromwhichthevalidityoftheprizemaybe 154determined.Thepriceofinteractivedigitalgamecreditsshallbedeterminedbythe 155commission.Themaximumwagerplayedperinteractivedigitalgameshallnotexceed 156fivedollars.Themaximumprizepayoffforawinningmaximumwagerforasingle 157gameplayshallbenomorethanonethousandonehundreddollars,orthemaximum 158amountallowablebyfederallawbeforetaxwithholdingisrequiredforasinglegame- 159winningplay; 160 (2)Operatemorethaneightmechanicalamusementdevicesperlocationonthe 161premisesofafraternalorganization,veteransorganization,ortruckstopthathas 162securedandmaintainsadeviceretailer'slicense; 163 (3)Operatemorethanfivemechanicalamusementdevicesperlocationonthe 164premisesofanybusinessentitylicensedasadeviceretailerthatisnotafraternal 165organization,veteransorganization,ortruckstop; 166 (4)Operateanymechanicalamusementdeviceatanylocationwithinonemileof 167acasinoorwithinonemileofanelementaryorhighschool; 168 (5)Advertiseinteractivedigitalgamesormechanicalamusementdevicesoutside 169ofalicenseddeviceretailer'sestablishmentthroughanymediaoutletsordirectmailor 170telephonesolicitations.Theadvertisingprohibitioncontainedinthissubdivisionshall 171applytoalllicenseesincluding,butnotlimitedto,devicemanufacturers,device 172distributors,deviceoperators,deviceretailers,anddevicehandlers;exceptthat,a 180games,andsuchmechanicalamusementdevicesshallbeunderthesupervisionofa 181personthatistwenty-oneyearsofageoroldertopreventpersonsundertwenty-one 182yearsofagefromplayinginteractivedigitalgames.Mechanicalamusementdevices 183shallbeplacedinafullyenclosedroomthatiscontinuallymonitoredbyvideo 184surveillanceandwhereaccesstopersonsundertwenty-oneyearsofageisdeniedbya 185procedureapprovedbythecommission.Awarningsignshallbepostedina 186conspicuouslocationwheresuchmechanicalamusementdevicesarelocated,containing 187inredletteringatleastone-halfinchhighonawhitebackgroundthefollowing: 188 HB2835 8 192videosurveillancefootageintheimmediateareaofthedeviceretailer'sestablishment 193wheremechanicalamusementdevicesarelocatedshallbereviewedbydeviceoperators 194asrequiredbythecommissionforanyviolationoflaw,rules,orregulationsgoverning 195theconductofinteractivedigitalgamesonmechanicalamusementdevicesandshallbe 196madeavailabletothecommissionuponrequest. 197 (3)Deviceretailersshallprovideanintrusiondetectionsystemcapableof 198detectingunauthorizedentranceofthedeviceretailer'sestablishmentduring 199nonbusinesshoursandshallreporttothecommissionanyunauthorizedentranceof 200thedeviceretailer'sestablishment.Suchsurveillanceandintrusiondetectionsystem 201shallmeetspecificationsasdefinedbythecommission. 202 (4)Adeviceoperatorshallpostasigninaconspicuouslocationwheresuch 203mechanicalamusementdevicesarelocated,containinginredletteringatleastone-half 204inchhighonawhitebackgroundatelephonecontactnumber(1-888-BETSOFF)forthe 205problemgamblinghelpline. 206 (5)Adeviceoperatorordeviceretailerthatfailstoreportanyknownviolation 207oflaw,rules,orregulationsgoverningtheconductofinteractivedigitalgameson 208mechanicalamusementdevicesinconformancewithestablishedcommissionprocedures 209maybesubjecttoanadministrativefinenottoexceedfivethousanddollars.Inthe 210eventadeviceoperatorordeviceretailerisfoundtohaveknowinglycommitteda 211violationgoverningtheconductofinteractivedigitalgamesonmechanicalamusement 212devices,thecommissionmayimposeanadministrativefinenottoexceedtenthousand 213dollars,suspendsuchoperator'sorretailer'slicenseforuptothirtydays,orinthecase 214ofrepeatedviolations,revokesuchdeviceoperator'sordeviceretailer'slicensefora 215periodofoneyear.Anydeviceoperatorordeviceretaileraggrievedbythe 216commission'sdecisioninanydisciplinaryactionthatresultsinthesuspensionor 217revocationofsuchdeviceoperator'sordeviceretailer'slicensemayappealsuchdecision 218byfilinganactionincircuitcourt. 219 10.(1)Deviceoperatorsshallpaythecommissionthirty-threepercentofthe 220adjustedgrossreceipts,whichshallbedepositedintothestatelotteryfund.The 221commissionshalltransfer,subjecttoappropriation,theamountreceivedfromthe 222commissiondirectortothestatelotteryfundafteradministrativeexpensesequaltofour 223percentoftheadjustedgrossreceiptsarepaidtothemunicipalitywherealicensed 228administrativeexpensesforthecommissionthatarenotcoveredbyreimbursements 229fromoperatorsarededucted.Netproceedstransferredtothestatelotteryfundshallbe 230appropriatedtopublicelementaryandsecondaryeducationinstitutionswithan 231emphasisonfundingstudent,teacher,andcommunityhealthandsafety. 232 (2)Deviceoperatorsshallretaintheremainderoftheadjustedgrossreceipts,a 233portionofwhichshallbeutilizedtopayforadministrativeexpenses,whichshallinclude 234thecostofthecentralizedcomputersystem,whichcostshallbepaidbydeviceoperators 235inproportiontothenumberofmechanicalamusementdevicesoperated.Fiftypercent 236ofthecostsofthecentralizedcomputersystemshallbeapportionedbythedevice 237operatoramongdeviceretailerstowhichitprovidesoperationsbasedonthenumberof 238mechanicalamusementdeviceslocatedatthedeviceretailer'sestablishment.The 239remainderofadjustedgrossreceiptsretainedbythedeviceoperator,afterthecostofthe 240centralizedcomputersystemandadministrativecostsarepaidandapportioned,shall 241bedividedequallybetweenthedeviceoperatoranddeviceretailerasagreedunder 242subsection7ofthissection. 243 11.Allrevenuesreceivedbythecommissionfromlicenseapplicationfees,license 244fees,administrativefines,andanyreimbursementsassociatedwiththeadministrationof 245theprovisionsofsections313.427to313.437,andallinterestearnedthereon,shallbe 246consideredadministrativeexpensesandshallbedepositedinthegeneralrevenuefund. 12provided,however,thatnosuchapprovalshallberequiredforthesoleactivityof 13offeringsportswageringovertheinternetviaaninteractivesportswageringplatform 14thatisaccessibletopersonsphysicallylocatedwithinsuchdesignatedsportsdistrict. 313.1004.1.Thecommissionshallhavefulljurisdictiontosuperviseall 2gamblingoperatorsgovernedbysections313.1000to313.1022andshalladoptrulesand 3regulationstoimplementtheprovisionsofsections313.1000to313.1022.Anyruleor 4portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe 5authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis 6subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This 7sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 8generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 9disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 10rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2024,shallbe 11invalidandvoid. 12 2.Rulesadoptedunderthissectionshallinclude,butnotbelimitedto,the 13following: 14 (1)Standardsandprocedurestogoverntheconductofsportswagering, 15includingthemannerinwhich: 16 (a)Wagersarereceived; 22 (3)Themannerinwhichasportswageringoperator'sbooksandfinancial 23recordsrelatingtosportswageringaremaintainedandaudited,includingstandardsfor 24thedailycountingofasportswageringoperator'sgrossreceiptsfromsportswagering 25andstandardstoensurethatinternalcontrolsarefollowed;and 26 (4)Standardsconcerningthedetectionandpreventionofcompulsivegambling 27including,butnotlimitedto,requirementstouseanationallyrecognizedproblem 28gamblinghelplinephonenumberinallpromotionalactivity. 29 3.Rulesadoptedunderthissectionshallrequireasportswageringoperatorto 30makecommerciallyreasonableeffortstodothefollowing: 31 (1)Designateoneormoreareaswithinthelicensedfacilityoperatedbythe 32sportswageringoperatorifthesportswageringoperatorisalicensedfacilitythatisan 33excursiongamblingboat; 34 (2)Ensurethesecurityandintegrityofsportswagersacceptedthroughany 35interactivesportswageringplatformoperatedorauthorizedbysuchsportswagering 36operator; 37 (3)Ensurethatthesportswageringoperator'ssurveillancesystemcoversall 38areasofthein-personsportswageringactivityconductedwithinalicensedfacilitythat 39isanexcursiongamblingboat; 40 (4)Allowthecommissiontobepresentthroughthecommission'sgamingagents 41whensportswageringisconductedinallareasofthesportswageringoperator's 42licensedfacilitythatisanexcursiongamblingboatinwhichsportswageringis 43conducted,todothefollowing: 44 (a)Ensuremaximumsecurityofthecountingandstorageofthesportswagering 45revenuereceivedbythesportswageringoperator; 46 (b)Certifythesportswageringrevenuereceivedbythesportswagering 47operator;and 48 (c)Receivecomplaintsfromthepublic; 49 (5)Ensurethatwagerresultsaredeterminedonlyfromdatathatisprovidedby 50theapplicablesportsgoverningbodyorthelicensedsportswageringsuppliers; 51 (6)Ensurethatpersonswhoareundertwenty-oneyearsofagedonotmake 52sportswagers; 53 (7)Establishhouserulesspecifyingtheamountstobepaidonwinningwagers 54andtheeffectofschedulechanges.Thehouserulesshallbedisplayedinthesports 55wageringoperator'ssportswageringareaorpostedonthesportswageringoperator's HB2835 23 56internetsiteormobileapplicationandincludedinthetermsandconditionsthereofor 57anotherapprovedarea;and 58 (8)Establishindustry-standardproceduresregardingthevoidingorcancelling 59ofwagersinthesportswageringoperator'sinternalcontrolsandhouserules. 60 4.(1)Asportsgoverningbodyorotherauthorizedentitythatmaintainsofficial 61leaguedatamaynotifythecommissionthatofficialleaguedataforsettlingtier2betsis 62availableforsportswageringoperators. 63 (2)Thecommissionshallnotifysportswageringoperatorswithinsevendaysof 64receiptofthenotificationfromthesportsgoverningbodyorotherauthorizedentitythat 65maintainsofficialleaguedataoftheavailabilityofofficialleaguedata.Withinsixty 66daysfollowingsuchnotificationbythecommission,eachsportswageringoperatorshall 67useonlyofficialleaguedatatosettletier2betsonathleticeventssanctionedbythe 68applicablesportsgoverningbody,except: 69 (a)Duringthependencyofarequestbysuchsportswageringoperatortothe 70commission,underthissection,tousealternativedatasourcesapprovedbythe 71commissiontosettlesuchtier2bets;or 72 (b)Followingapprovalbythecommissionofarequestbysuchsportswagering 73operatortousealternativedatasourcesapprovedbythecommissioninaccordancewith 74thissection. 75 (3)Officialleaguedatamadeavailabletosportswageringoperatorsbythe 76sportsgoverningbodyorotherauthorizedentitythatmaintainsofficialleaguedata 77shallbeofferedoncommerciallyreasonableterms. 78 (4)Asportswageringoperatormaysubmitawrittenrequesttothecommission 79fortheuse,orcontinueduse,ofalternativedatasourcesapprovedbythecommission 80withinsixtydaysofreceivingthenotificationfromthecommissionregardingthe 81availabilityofofficialleaguedata.Therequestshalldemonstrateindetailthatthe 82sportsgoverningbodyorotherauthorizedentitythatmaintainsofficialleaguedatais 83unableorunwillingtoofferofficialleaguedataoncommerciallyreasonableterms. 84Withinsixtydaysofreceiptofthewrittenrequestfromasportswageringoperatorto 85useanalternativedatasource,thecommissionshallissueawrittenapprovalor 86disapprovalofsucharequest. 87 (5)Thecommissionshallpublishalistofofficialleaguedataprovidersonits 88website. 89 5.Thecommissionmayenterintoagreementswithotherjurisdictionsto 90facilitate,administer,andregulatemulti-jurisdictionalsportsbettingbysportsbetting 91operatorstotheextentthatenteringintotheagreementisconsistentwithstateand 92federallawsandthesportsbettingagreementisconductedonlyintheUnitedStates. HB2835 24 93 6.(1)Thecommissionshallestablishahotlineorothermethodof 94communicationthatallowsanypersontoconfidentiallyreportinformationabout 95prohibitedconducttothecommission. 96 (2)Thecommissionshallinvestigateallreasonableallegationsofprohibited 97conductandreferanyallegationsitdeemscredibletotheappropriatelawenforcement 98entity. 99 (3)Theidentityofanyreportingpersonshallremainconfidentialunlessthat 100personauthorizesdisclosureofhisorheridentityoruntilsuchtimeastheallegationof 101prohibitedconductisreferredtolawenforcement. 102 (4)Ifthecommissionreceivesacomplaintofprohibitedconductbyanathlete, 103thecommissionshallnotifytheappropriatesportsgoverningbodyandplayers 104associationoftheathletetoreviewthecomplaintasprovidedbyrule. 105 (5)Thecommissionshalladoptrulesgoverninginvestigationsofprohibited 106conductandreferralstolawenforcemententities. 313.1006.1.Alicensedapplicantholdingalicenseissuedundersection313.807 2tooperateanexcursiongamblingboatwhowishestooffersportswageringunder 3sections313.1000to313.1022shall: 4 (1)Submitanapplicationtothecommissioninthemannerprescribedbythe 5commissionforeachlicensedfacilityinwhichthelicensedapplicantwishestoconduct 6sportswagering; 7 (2)Payaninitialapplicationfee,nottoexceedonehundredthousanddollars, 8whichshallbedepositedinthegamingcommissionfundanddistributedaccordingto 9section313.835;and 10 (3)Submittothecommissionaresponsiblegamblingplanthatshallinclude,but 11isnotlimitedto: 12 (a)Annualtrainingforallstaffregardingthepracticeofresponsiblegambling 13andidentifyingcompulsiveorproblemgamblers; 14 (b)Policiesandstrategiesforhandlingsituationsinwhichplayersindicatethey 15areindistressorexperiencingaproblem;and 16 (c)Policiesandstrategiestoaddressthird-partyconcernsaboutplayers' 17gamblingbehavior. 18 2.Uponreceiptoftheapplicationandfeerequiredundersubsection1ofthis 19section,thecommissionshallissueacertificateofauthoritytoalicensedapplicant 20authorizingthelicensedapplicanttoconductsportswageringundersections313.1000to 21313.1022inalicensedfacilityorthroughaninteractivesportswageringplatform. 313.1008.1.Thecommissionshallensurethatnewsportswageringdevicesand 2newforms,variations,orcompositesofsportswageringaretestedunderthetermsand HB2835 25 3conditionsthatthecommissionconsidersappropriatepriortoauthorizingasports 4wageringoperatortoofferanewsportswageringdeviceoranewform,variation,or 5compositeofsportswagering.Thecommissionmayutilizeanapprovedindependent 6testinglaboratorytoassistwithanyrequirementsofthissection.Thecommissionshall 7acceptsuchtestingofanothersportswageringgoverningbodyintheUnitedStatesifthe 8commissiondeterminesthetestingofthatgoverningbodyissubstantiallysimilartothe 9testingthatwouldotherwiseberequiredbythecommissionandthesportswagering 10operatorverifiesthatitssportswageringdevicesandformshavenotmateriallychanged 11sincesuchtesting. 12 2.Alicensedfacilitythatisanexcursiongamblingboatmayalsooffersports 13wageringthroughuptothreeindividuallybrandedinteractivesportswagering 14platformsunderthebrand,tradename,oranothernameitisdoingbusinessas(d/b/ 15a)selectedbythesportswageringoperatoror,asapplicable,theinteractivesports 16wageringplatformoperator.Asportswageringoperatormayoperateeachinteractive 17sportswageringplatformorcontractwithoneormoreinteractivesportswagering 18platformoperatorstoadministeranyoralloftheinteractivesportswageringplatforms 19onthelicensedfacility'sbehalf.Notwithstandinganyprovisionofthissectionand 20anythingtothecontrarysetforthundersections313.1000through313.1022,innoevent 21shallsportswageringbeofferedthroughmorethansixsportswageringplatforms 22contractingwithanyoneownerofalicensedfacility,directlyorindirectlythroughany 23parentcompany,subsidiary,oraffiliateofsuchowner. 24 3.Eachdesignatedsportsdistrictmobilelicenseemayoffersportswagering 25withinthestatethroughoneinteractivesportswageringplatform.Eachdesignated 26sportsdistrictmobilelicenseeshallberequiredtobelicensedbythecommissionasan 27interactivesportswageringplatformoperator.Sportswageringovertheinternet 28throughanyinteractivesportswageringplatformmaybeofferedbyanylicensedsports 29wageringoperatorwithinanydesignatedsportsdistrict. 30 4.Notwithstandinganythingtothecontrarysetforthundersections313.1000 31through313.1022,nosportswageringoperatormayoffersportswageringinpersonor 32throughanysportswageringkiosk,exceptwithinalicensedfacilitythatisanexcursion 33gamblingboat. 34 5.(1)Sportswageringmaybeconductedwithchips,tokens,electroniccards, 35cash,cashequivalents,debitorcreditcards,othernegotiablecurrency,onlinepayment 36services,automatedclearinghouses,promotionalfunds,oranyothermeansapproved 37bythecommission. HB2835 26 38 (2)Asportswageringoperatorshall,initsinternalcontrolsorhouserules, 39determineaminimumwageramountinsportswageringconductedbythesports 40wageringoperatorandmaydetermineamaximumwageramount. 41 6.Asportswageringoperatorshallnotpermitanysportswageringonthe 42premisesofthelicensedfacilityexceptasprovidedunderthischapter. 43 7.Asportswageringdevice,point-of-contactsportswageringdevice,orsports 44wageringkioskshallbeapprovedbythecommissionandacquiredbyasportswagering 45operatorfromalicensedsupplier. 46 8.Thecommissionshalldeterminetheoccupationsrelatedtosportswagering 47thatrequireanoccupationallicense,whichshallnotincludeemployeeswhodonot 48possesstheauthorityorabilitytoaltermaterialsystemsrequiredforsportswageringin 49thisstate. 50 9.Asportswageringoperatormaylayoffoneormoresportswagers.The 51commissionmaypromulgaterulespermittingsportswageringoperatorsorplatformsto 52employsystemsthatoffsetlossormanageriskintheoperationofsportswageringunder 53sections313.1000to313.1022throughtheuseofliquiditypoolsinotherjurisdictionsin 54whichthesportswageringoperator,platform,anaffiliateofthesportswagering 55operatororplatform,orathirdpartyalsoholdslicensestoconductsportswagering, 56providedthatatalltimesadequateprotectionsaremaintainedtoensuresufficientfunds 57areavailabletopaywinningstopatrons. 58 10.Asportswageringoperatorshallincludeinformationandtoolstoassist 59playersinmakingresponsibledecisions.Thesportswageringoperatorshallprovideat 60aminimum: 61 (1)Prominentlydisplayedtoolstosetlimitsontheamountoftimeandmoneya 62playerspendsonanyinteractivesportswageringplatform; HB2835 27 8 (2)Payaninitialapplicationfee,nottoexceedonehundredfiftythousand 9dollars;and 10 (3)Submittothecommissionaresponsiblegamblingplanthatshallinclude,but 11isnotlimitedto: 12 (a)Annualtrainingforallstaffregardingthepracticeofresponsiblegambling 13andidentifyingcompulsiveorproblemgamblers; 14 (b)Policiesandstrategiesforhandlingsituationsinwhichplayersindicatethey 15areindistressorexperiencingaproblem;and 16 (c)Policiesandstrategiestoaddressthird-partyconcernsaboutplayers' 17gamblingbehavior. 18 3.Onorbeforetheanniversarydateofthepaymentoftheinitialapplicationfee 19underthissection,aninteractivesportswageringplatformproviderholdingalicense 20issuedunderthissectionshallpaytothecommissionalicenserenewalfee,nottoexceed 21threehundredtwenty-fivethousanddollars.Suchfundsshallbedepositedintothe 22gamingcommissionfundestablishedundersection313.835. 23 4.Notwithstandinganyotherprovisionoflawtothecontrary,thefollowing 24informationshallbeconfidentialandshallnotbedisclosedtothepublicunlessrequired 25bycourtorderorbyanyotherprovisionofsections313.1000to313.1022: 26 (1)Anyapplicationsubmittedtothecommissionrelatingtosportswageringin 27thisstate;and 28 (2)Alldocuments,reports,anddatasubmittedbyanapplicantrelatingtosports 29wageringinthisstatetothecommissioncontainingproprietaryinformation,trade 30secrets,financialinformation,orpersonallyidentifiableinformationaboutanyperson. 313.1011.1.Thecommissionmayissueasupplier'slicensetoasportswagering 2supplier. 3 2.Asportswageringsuppliermayprovideitsservicestolicenseesunderafixed- 4feeorrevenue-sharingagreementonlyifthesupplierisproperlylicensedbythe 5commission. 6 3.Attherequestofanapplicantforasportswageringsupplier'slicense,the 7commissionmayissueaprovisionallicensetotheapplicant,aslongastheapplicanthas 8submittedacompletedapplicationforthelicense,includingpayingtherequired 9applicationfee.Thecommissionmayprescribebyruletherequirementstoreceivea 10provisionallicense. 11 4.Anapplicantforasportswageringsupplier'slicenseshalldisclosetheidentity 12of: 13 (1)Theapplicant'sprincipalownerswhodirectlyowntenpercentormoreofthe 14applicant; 25 (5)Arenotincludedoninternetsitesorpagesdedicatedtocompulsiveor 26problemgambling;and 27 (6)Includeresponsiblegamblingmessagesandanationallyrecognizedproblem 28gamblinghelplinenumberinallpromotionalactivity. 29 5.Thecommissionshallestablishpenaltiesofnotlessthantenthousanddollars 30butnotmorethanonehundredthousanddollarsforanysportswageringoperatorwho 31violatestherestrictionsplacedonadvertisingtopersonslistedinsubdivision(1)of 32subsection4ofthissection. 313.1014.1.Thecommissionshallconductbackgroundchecksonindividuals 2seekinglicensesundersections313.1000to313.1022.Abackgroundcheckconducted 3underthissectionshallincludeasearchforcriminalhistoryandanychargesor 4convictionsinvolvingcorruptionormanipulationofsportingevents.Abackground 5checkunderthissectionshallbeconsistentwiththeprovisionsofsection313.810. 6 2.(1)Asportswageringoperatorshallemploycommerciallyreasonable 7methodsto: 8 (a)Prohibitthesportswageringoperator;directors,officers,andemployeesof 9thesportswageringoperator;andanyrelativeofanoperator,director,orofficerliving 10inthesamehouseholdfromplacingsportswagerswiththesportswageringoperator; 11 (b)Prohibitanypersonwithaccesstononpublicconfidentialinformationheld 12bythesportswageringoperatorfromplacingsportswagerswiththesportswagering 13operator; 14 (c)Preventthesharingofconfidentialinformationthatcouldaffectsports 15wageringofferedbythesportswageringoperatororbythirdpartiesuntilthe 16informationismadepubliclyavailable; 17 (d)Prohibitpersonsfromplacingsportswagersasagentsorproxiesforother 18persons;and 19 (e)Prohibitthepurchaseorusebythesportswageringoperatorofanypersonal 20biometricdataofanathlete,unlessthesportswageringoperatorhasreceivedwritten 21permissionfromtheathleteortheathlete'srepresentative. 22 (2)Nothinginthissectionshallprecludetheuseofinternet-basedhostingor 23cloud-basedhostingofdataoranydisclosureofinformationrequiredbycourtorderor 24otherprovisionsoflaw. 25 3.(1)Thefollowingindividualsareprohibitedfromengaginginsportswagering 26undersections313.1000to313.1022: HB2835 30 27 (a)Anypersonwhoseparticipationmayunderminetheintegrityofthebetting 28orsportsevent;or 29 (b)Anypersonwhoisprohibitedforothergoodcauseincluding,butnotlimited 30to: 31 a.Anypersonplacingawagerasanagentorproxy; 32 b.Anypersonwhoisanathlete,coach,referee,player,orrefereepersonnel 33memberinoronanysportseventoverseenbythatperson'ssportsgoverningbody 34basedonpubliclyavailableinformation; 35 c.Anypersonwhoholdsapositionofauthorityorinfluencesufficienttoexert 36influenceovertheparticipantsinasportingcontestincluding,butnotlimitedto, 37coaches,managers,handlers,orathletictrainers; 38 d.Anypersonundertwenty-oneyearsofage; 39 e.Anypersonwithaccesstocertaintypesofexclusiveinformationonanysports 40eventoverseenbythatperson'ssportsgoverningbodybasedonpubliclyavailable 41information;or 42 f.Anypersonidentifiedbyanylistsprovidedbythecommission. 43 (2)Thedirectorindirectlegalorbeneficialowneroffivepercentormoreofa 44sportsgoverningbodyoranyofitsmemberteamsshallnotplaceoracceptanywager 45onasportseventinwhichanymemberteamofthatsportsgoverningbodyparticipates. 46Anyviolationofthissubdivisionshallconstitutedisorderlyconduct.Disorderlyconduct 47underthissubdivisionshallbeaclassCmisdemeanor. 48 (3)Theprovisionsofsubdivision(1)ofthissubsectionshallnotapplytoany 49personwhoisadirectorindirectownerofaspecificsportsgoverningbodymember 50teamand: 51 (a)Haslessthanfivepercentdirectorindirectownershipinterestinacasinoor 52sportswageringoperator;or 53 (b)Thevalueoftheownershipofsuchteamrepresentslessthanonepercentof 54theperson'stotalenterprisevalueandsuchsharesofsuchpersonareregisteredunder 55section12oftheSecuritiesExchangeActof1934,15U.S.C.Section78l,asamended. 56 (4)(a)Asportswageringoperatorshalladoptprocedurestopreventwagering 57onsportseventsbypersonswhoareprohibitedfromplacingsportswagers. 58 (b)Asportswageringoperatorshallnotknowinglyacceptwagersfromany 59personwhoseidentityisknowntotheoperatorand: 60 a.Whosenameappearsontheexclusionlistmaintainedbythecommission; 61 b.Whoistheoperator,director,officer,owner,oremployeeoftheoperator; 62 c.Whohasaccesstononpublicconfidentialinformationheldbytheoperator;or 63 d.Whoisanagentorproxyforanyotherperson. HB2835 31 64 (5)Anoperatorshalladoptprocedurestoobtainpersonallyidentifiable 65informationfromanyindividualwhoplacesanysinglewageroftenthousanddollarsor 66moreonasportseventwhilephysicallypresentatacasino. 67 4.Givengoodandsufficientreason,eachofthecommissionandsportswagering 68operatorsshallcooperatewithinvestigationsconductedbylawenforcementagenciesor 69sportsgoverningbodies,includingprovidingorfacilitatingtheprovisionofrelevant 70bettinginformationandaudioorvideofilesrelatingtopersonsplacingsportswagers; 71exceptthat,withrespecttoanysuchinformationorfilesdisclosedbyasportswagering 72operatortoasportsgoverningbody,thesportsgoverningbodyshall: 73 (1)Maintaintheconfidentialityofsuchinformationorfiles; 74 (2)Complywithallprivacylawsapplicabletosuchinformationorfiles;and 75 (3)Usetheinformationorfilessolelyinconnectionwiththesportsgoverning 76body'sinvestigation. 77 5.Asportswageringoperatorshallimmediatelyreporttothecommissionany 78informationrelatingto: 79 (1)Criminalordisciplinaryproceedingscommencedagainstthesportswagering 80operatorinconnectionwithitsoperations; 81 (2)Betsorwagersthatviolatestateorfederallaw; 82 (3)Abnormalwageringactivityorpatternsthatmayindicateaconcern 83regardingtheintegrityofasportingeventorevents; 84 (4)Anyotherconductthatcorruptsthewageringoutcomeofasportingeventor 85eventsforpurposesoffinancialgain,includingprohibitedconductasdefinedunder 86section313.1000;and 87 (5)Suspiciousorillegalwageringactivities. 88 89Asportswageringoperatorshallalsoimmediatelyreportanyinformationrelatingto 90conductdescribedinsubdivision(3)or(4)ofthissubsectiontotheapplicablesports 91governingbodyandplayersassociation. 92 6.Asportswageringoperatorshallmaintaintheconfidentialityofinformation 93providedbyasportsgoverningbodytothesportswageringoperatorunlessdisclosureis 94requiredbycourtorder,thecommission,oranyotherprovisionoflaw. 95 7.Asportsgoverningbodyorplayersassociationmaysubmittothecommission 96arequestinwritingtorestrict,limit,orexcludeatypeorformofsportswageringonits 97sportingeventsifsuchbodyorassociationbelievesthatsuchsportswageringaffectsthe 98integrityorperceivedintegrityofitssport.Thecommissionmaygranttherequestupon 99ashowingofgoodcausebytheapplicablesportsgoverningbodyorplayersassociation. 100Thecommissionshallpromptlyreviewanyinformationprovidedandrespondas HB2835 32 101expeditiouslyaspracticabletotherequest.Priortomakingadetermination,the 102commissionshallnotifyandconsultwithsportswageringoperators.Ifthecommission 103deemsitrelevant,itmayalsoconsultwithanyapplicableindependentmonitoring 104providersorotherjurisdictions.Norestrictions,limitations,orexclusionsofwagers 105shallbeconductedwithouttheexpresswrittenapprovalofthecommission.Sports 106wageringoperatorsshallbenotifiedofanyrestrictions,limitations,orexclusions 107grantedbythecommission. 108 8.(1)Nosportswageringoperatorshallofferanysportswagersonan 109elementaryorsecondaryschoolathleticorsportingeventinwhichaschoolteamfrom 110thisstateisaparticipant,orontheindividualperformancestatisticsofanathleteinan 111elementaryorsecondaryschoolathleticorsportingeventinwhichaschoolteamfrom 112thisstateisaparticipant. 113 (2)Nosportswagershallbeplacedontheperformanceornonperformanceof 114anyindividualathleteparticipatinginasinglegameormatchofacollegiatesporting 115eventinwhichacollegiateteamfromthisstateisaparticipant. 313.1016.1.Asportswageringoperatorshall,forawagerthatexceedsten 2thousanddollarsandthatisplacedinpersonbyapatron,maintainthefollowing 3recordsforaperiodofatleastthreeyearsafterthesportingeventoccurs: 4 (1)Personallyidentifiableinformationofthepatron; 5 (2)Theamountandtypeofbetplaced; 6 (3)Thetimeanddatethebetwasplaced; 7 (4)Thelocation,includingspecificinformationpertainingtothebettingwindow 8orsportswageringdevice,wherethebetwasplaced; 9 (5)Theoutcomeofthebet;and 10 (6)Anydiscerniblepatternofabnormalbettingactivitybythepatron. 11 2.Alicensedfacility,interactivesportswageringplatformoperator,orsports 12wageringsupplierwhereapplicable,forallbetsandwagersplacedthroughan 13interactivesportswageringplatform,shallmaintainthefollowingrecordsforaperiod 14ofatleastthreeyearsafterthesportingeventoccurs: 15 (1)Personallyidentifiableinformationofthepatron; 16 (2)Theamountandtypeofbetplaced; 17 (3)Thetimeanddatethebetwasplaced; 18 (4)Thelocation,includingspecificinformationpertainingtotheinternet 19protocoladdress,wherethebetwasplaced; 20 (5)Theoutcomeofthebet;and 21 (6)Anydiscerniblepatternofabnormalbettingactivitybythepatron. HB2835 33 22 3.Asportswageringoperatorshallmaketherecordsanddatathatitisrequired 23tomaintainunderthissectionavailableforinspectionuponrequestofthecommission 24orasrequiredbycourtorder. 313.1018.Asportswageringoperatorisnotliableunderthelawsofthisstateto 2anyparty,includingpatrons,fordisclosinginformationasrequiredundersections 3313.1000to313.1022andisnotliableforrefusingtodiscloseinformationunless 4requiredundersections313.1000to313.1022. 313.1021.1.Awageringtaxoftenpercentisimposedontheadjustedgross 2receiptsreceivedfromsportswageringconductedbyasportswageringoperatorunder 3sections313.1000to313.1022.Ifaninteractivesportswageringplatformoperatoris 4contractedtoconductsportswageringatacertificateholder'slicensedfacilitythatisan 5excursiongamblingboat,orthroughaninteractivesportswageringplatform,the 6licensedinteractivesportswageringplatformoperatormayfulfillthecertificate 7holder'sdutiesunderthissection. 8 2.Acertificateholderorinteractivesportswageringplatformoperatorshall 9remitthetaximposedbysubsection1ofthissectiontothedepartmentnolaterthanone 10daypriortothelastbusinessdayofthemonthfollowingthemonthinwhichthetaxes 11weregenerated.Inamonthwhentheadjustedgrossreceiptsofacertificateholderor 12interactivesportswageringplatformoperatorisanegativenumber,thecertificate 13holderorinteractivesportswageringplatformoperatormaycarryoverthenegative 14amountforaperiodoftwelvemonths. 15 3.Thepaymentofthetaxunderthissectionshallbebyanelectronicfunds 16transferbyanautomatedclearinghouse. 17 4.Revenuesreceivedfromthetaximposedundersubsection1ofthissection 18shallbedepositedinthestatetreasurytothecreditofthegamingproceedsfor 19educationfund,whichshallbedistributedasprovidedundersection313.822. 20 5.(1)Alicensedfacilitythatisanexcursiongamblingboatshallpaytothe 21commissionanannuallicenserenewalfee,nottoexceedfiftythousanddollars.Thefee 22imposedshallbedueontheanniversarydateoftheissuanceofthelicenseandoneach 23anniversarydatethereafter.Thecommissionshalldeposittheannuallicenserenewal 24feesreceivedunderthissubdivisioninthegamingcommissionfundestablishedunder 25section313.835. 26 (2)Inadditiontotheannuallicenserenewalfee,requiredinthissubsection,a 27certificateholdershallpaytothecommissionafeeoftenthousanddollarstocoverthe 28costsofafullreinvestigationofthecertificateholderinthefourthyearafterthedateon 29whichthecertificateholdercommencessportswageringoperationsundersections 30313.1000to313.1022andoneachfourthyearthereafter.Thecommissionshalldeposit HB2835 34 31thefeesreceivedunderthissubdivisioninthegamingcommissionfundestablished 32undersection313.835. 33 6.Subjecttoappropriation,fivehundredthousanddollarsshallbeappropriated 34fromthegamingcommissionfundcreatedundersection313.835andcreditedannually 35tothecompulsivegamblersfundcreatedundersection313.842.Whenconsideringthe 36amountoffundstoappropriatetothecompulsivegamblersfund,thegeneralassembly 37shallconsiderthefindingsandrecommendationscontainedintheresearchreport 38requiredundersubsection2ofsection313.842forincreasedfundinginexcessofthefive 39hundredthousanddollars. 313.1022.1.Allsportswagersauthorizedundersections313.1000to313.1022 2shallbedeemedinitiated,received,andotherwisemadeonthepropertyofanexcursion 3gamblingboatwithinthisstate. 4 2.Onlytotheextentrequiredbyfederallaw,allserversnecessarytothe 5placementorresolutionofwagers,otherthanbackupservers,shallbephysically 6locatedwithinacertificateholder'slicensedfacilitythatisanexcursiongamblingboat 7inthestate.ConsistentwiththeintentoftheUnitedStatesCongressasarticulatedin 8theUnlawfulInternetGamblingEnforcementActof2006,31U.S.C.Sections5361to 95367,asamended,theintermediateroutingofelectronicdatarelatingtolawful 10intrastatesportswagersauthorizedundersections313.1000to313.1022shallnot 11determinethelocationorlocationsinwhichsuchwagerisinitiated,received,or 12otherwisemade.Thissubsectionshallapplyonlytotheextentrequiredbyfederallaw. ✔ HB2835 35
