25classificationorcountieswithacharterformofgovernment. 56.060.1.Ineachcountyaprosecutingattorneyserves,theprosecutingattorney 2shallcommenceandprosecuteallcivilandcriminalactions[intheprosecutingattorney's 3county] inwhichthecountyorstateisconcerned,defendallsuitsagainstthestateorcounty, 4andprosecuteforfeitedrecognizancesandactionsfortherecoveryofdebts,fines,penalties 5andforfeituresaccruingtothestateorcounty.Inallcases,civilandcriminal,inwhich 6changesofvenuearegranted,theprosecutingattorneyshallfollowandprosecuteordefend, 7asthecasemaybe,allthecauses,forwhich,inadditiontothefeesnowallowedbylaw,the 8prosecutingattorneyshallreceivehisorheractualexpenses.Ifanymisdemeanorcaseis 9takentothecourtofappealsbyappealtheprosecutingattorneyshallrepresentthestateinthe officeofprosecutingattorneyafull-time 25positionwassubmittedtothevotersatageneralelectionin1998andwhereamajorityofthe 26votersvotingonthepropositionvotedinfavorofmakingthecountyprosecutorafull-time 27position,thepropositionshallbecomeeffectiveonMay1,1999.Anyprosecutingattorney 28whosepositionbecomesfulltimeonMay1,1999,undertheprovisionsofthissubsection 29shallhavetheadditionaldutyofprovidingnotlessthanthreehoursofcontinuingeducationto 30peaceofficersinthecountyservedbytheprosecutingattorneyineachyearoftheterm 31beginningJanuary1,1999. 32 3.Incountiesthat,priortoAugust28,2001,haveelectedpursuanttothissectionto 33makethepositionofprosecutingattorneyafull-timeposition,thecountycommissionmayat 34anytimeelecttohavethatpositionalsoqualifyfortheretirementbenefitavailableforafull- 35time[prosecutor] prosecutingattorneyofacountyofthefirstclassification.Suchelection 36shallbemadebyamajorityvoteofthecountycommissionandoncemadeshallbe 37irrevocable,unlessthevotersofthecountyelecttochangethepositionofprosecuting 38attorneybacktoapart-timepositionundersubsection4ofthissection.Whensuchan 39electionismade,theresultsshallbetransmittedtotheMissouriprosecutingattorneysand 40circuitattorneys'retirementsystemfund,andtheelectionshallbeeffectiveonthefirstdayof 41Januaryfollowingsuchelection.Suchelectionshallalsoobligatethecountytopayintothe 42Missouriprosecutingattorneysandcircuitattorneys'systemretirementfundthesame 43retirementcontributionsforfull-time[prosecutors] prosecutingattorneysasarepaidby 44countiesofthefirstclassification. 45 4.Inanycountyofthethirdclassificationwithoutatownshipformofgovernment 46andwithmorethantwelvethousandbutfewerthanfourteenthousandinhabitantsandwitha 47cityofthefourthclassificationwithmorethanonethousandsevenhundredbutfewerthan 48onethousandninehundredinhabitantsasthecountyseatthathaselectedtomakethe[county 49prosecutor] officeofprosecutingattorneyafull-timepositionunderthissectionafter 50August28,2014,thecountycommissionmayonitsownmotionandshalluponthepetition 51oftenpercentofthetotalnumberofpeoplewhovotedinthepreviousgeneralelectioninthe 52countysubmittothevotersatageneralorspecialelectionthepropositionofchangingthe 53full-timeprosecutorpositiontoapart-timeposition.Thecommissionshallcausenoticeof HB2855 10 54theelectiontobepublishedinanewspaperpublishedwithinthecounty,orifnonewspaperis 55publishedwithinthecounty,inanewspaperpublishedinanadjoiningcounty,forthreeweeks 56consecutively,thelastinsertionofwhichshallbeatleasttendaysandnotmorethanthirty 57daysbeforethedayoftheelection,andbypostingprintednoticesthereofatthreeofthemost 58publicplacesineachtownshipinthecounty.Thepropositionshallbeputbeforethevoters 59substantiallyinthefollowingform: 60 67passageofsuchproposalisswornintooffice. 68 5.Inanycountythathaselectedtomakethefull-timepositionof[countyprosecutor] 69prosecutingattorneyapart-timepositionundersubsection4ofthissection,thecounty's 70retirementcontributiontotheretirementsystemandtheretirementbenefitearnedbythe 71membershallprospectivelybethatofapart-time[prosecutor] prosecutingattorneyas 72establishedinthischapter.Anyretirementcontributionmadeandretirementbenefitearned 73priortotheeffectivedateofthevoter-approvedpropositionundersubsection4ofthissection 74shallbemaintainedbytheretirementsystemandusedtocalculatetheretirementbenefitfor 75suchpriorfull-timepositionservice.Undernocircumstancesshallamemberinapart-time 76[prosecutor] prosecutingattorneypositionearnfull-timepositionretirementbenefitservice 77accrualsfortimeperiodsaftertheeffectivedateofthepropositionchangingthe[county 78prosecutor] officeofprosecutingattorneybacktoapart-timeposition. 56.640.1.Ifacountycounselorisappointed,thecountycounselorandthecounty 2counselor'sassistantsunderthecountycounselor'sdirectionshallrepresentthecountyandall 3departments,officers,institutionsandagenciesthereof,exceptasotherwiseprovidedbylaw 4andshalluponrequestofanycountydepartment,officer,institutionoragencyforwhichlegal 5counselisotherwiseprovidedbylaw,andupontheapprovalofthecountycommissionor 6governingbody,representsuchdepartment,officer,institutionoragency.Thecounty 7counselorshallcommence,prosecuteordefend,asthecasemayrequire,andexercise 8exclusiveauthorityinallcivilsuitsoractionsinwhichthecountyoranycountyofficer, 9commission,governingbody,oragencyisaparty,inthecountycounselor'soritsofficial 10capacity,thecountycounselorshalldrawallcontractsrelatingtothebusinessofthecounty, 11thecountycounselorshallrepresentthecountygenerallyinallmattersofcivillaw,andthe HB2855 11 12countycounselorshalluponrequestfurnishwrittenopinionstoanycountyofficeror 13department. 14 2.Inallcasesinwhichacivilfinemaybeimposedpursuanttosection49.272,itshall 15bethedutyofthecountycounselor,ratherthanthe[county] prosecutingattorney,toprosecute 16suchviolationsintheassociatedivisionofthecircuitcourtinthecountywheretheviolation 17occurred. 18 3.Notwithstandinganylawtothecontrary,thecountycounselorinanycountyofthe 19firstclassificationandtheprosecutingattorneyofsuchcountymaybymutualcooperation 20agreementprosecuteordefendanycivilactionwhichtheprosecutingattorneyorcounty 21counselorofthecountyisauthorizedorrequiredbylawtoprosecuteordefend. 56.700.1.Theprosecutingattorney[in]ofeachjurisdictionincludingacountyof 2thesecond,third,orfourthclass[which] thatcontainsamentalhealthfacilityabletoserveat 3leasteightypersonsonanovernight,inpatientbasisatanyonetime,and[which] thatis 4operatedbythestatedepartmentofmentalhealth,divisionofpsychiatricservices,may 5employanassistantprosecutingattorneytoassistincarryingoutthedutiesoftheofficeof 6prosecutingattorneyrelatingtomentalhealthandmentalhealthfacilities.Theassistant 7prosecutingattorneyauthorizedbythissubsectionshallbeinadditiontoanyotherassistant 8prosecutingattorneyauthorizedbylaw.Theassistantprosecutingattorneyemployedunder 9thissubsectionshallreceiveanannualcompensationoffifteenthousanddollarspayableout 10ofthestatetreasuryfromfundsappropriatedforthatpurpose. 11 2.Thecountycounselororcircuitattorneyineachcounty[ofthefirstclass] witha 12charterformofgovernmentcontainingpartofacitywithapopulationofoverfourhundred 13fiftythousandandineachcitynotwithinacountymayemployanassistantcountycounselor 14orcircuitattorneytoassistincarryingoutthedutiesoftheofficeofthecountycounseloror 15circuitattorneyrelatingtomentalhealthandmentalhealthfacilities.Theassistantauthorized 16bythissubsectionshallbeinadditiontoanyotherassistantsauthorizedbylaw.Theassistant 17countycounselororcircuitattorneyemployedunderthissubsectionshallreceiveanannual 18compensationoffifteenthousanddollarspayableoutofthestatetreasuryfromfunds 19appropriatedforthatpurpose. 20 3.Theprosecutingattorney[in]ofeachjurisdictionincludingacountyofthe 21second,third,orfourthclass[which] thatcontainsamentalhealthfacilityabletoserveat 22leasteightypersonsonanovernight,inpatientbasisatanyonetime,and[which] thatis 23operatedbythestatedepartmentofmentalhealth,divisionofpsychiatricservices,may 24employadditionalinvestigativeandclericalpersonneltoassistincarryingoutthedutiesof 25theofficeofprosecutingattorneyrelatingtomentalhealthandmentalhealthfacilities.The 26investigativeandclericalpersonnelauthorizedbythissubsectionshallbeinadditiontoany 27otherpersonnelauthorizedbylaw.Thecompensationforsuchadditionalinvestigativeand HB2855 12 28clericalpersonnel,nottoexceedatotaloffifteenthousanddollarsannuallyforeacheligible 29county,shallbepaidoutofthestatetreasuryfromfundsappropriatedforthatpurpose. 30 4.Thecountycounselororcircuitattorneyineachcounty[ofthefirstclass] witha 31charterformofgovernmentcontainingpartofacitywithapopulationofoverfourhundred 32fiftythousandandineachcitynotwithinacountymayemployadditionalinvestigativeand 33clericalpersonneltoassistincarryingoutthedutiesoftheofficeofthecountycounseloror 34circuitattorneyrelatingtomentalhealthandmentalhealthfacilities.Theinvestigativeand 35clericalpersonnelauthorizedbythissubsectionshallbeinadditiontoanyotherpersonnel 36authorizedbylaw.Thecompensationforsuchadditionalinvestigativeandclericalpersonnel, 37nottoexceedatotaloffifteenthousanddollarsannuallyforeacheligiblecountyorcitynot 46 (b)Morethanonehundredtenpercentbutlessthanonehundredtwentypercent,the 47monthlysumtransmittedshallbereducedfiftypercent; 48 (c)Atleastninetypercentanduptoandincludingonehundredtenpercent,the 49monthlysumtransmittedshallremainthesame; 50 (d)Atleasteightypercentandlessthanninetypercent,themonthlysumtransmitted 51shallbeincreasedfiftypercent;and 52 (e)Lessthaneightypercent,themonthlysumtransmittedshallbeincreasedone 53hundredpercent. 54 6.BeginningAugust28,2003,thecountytreasurershallatleastmonthlytransmitthe 55sumsspecifiedinsubsection5ofthissectiontotheMissouriofficeofprosecutionservices 56fordeposittothecreditoftheMissouriprosecutingattorneysandcircuitattorneys'retirement 57systemfund.MoneysintheMissouriprosecutingattorneysandcircuitattorneys'retirement 58systemfundshallbeusedonlyforthepurposesprovidedinsections56.800to56.840,andfor 59nootherpurpose. 60 7.BeginningAugust28,2003,thefollowingsurchargeforprosecutingattorneysand 61circuitattorneysshallbecollectedandpaidasfollows: 62 (1)Thereshallbeassessedandcollectedasurchargeoffourdollarsinallcriminal 63casesfiledinthecourtsofthisstateincludingviolationofanycountyordinance,any 64violationofcriminalortrafficlawsofthisstate,includinginfractions,andagainstanyperson 65whohaspledguiltyforanyviolationandpaidafinethroughafinecollectioncenter,butno 66suchsurchargeshallbeassessedwhenthecostsarewaivedoraretobepaidbythestate, 67county,ormunicipalityorwhenacriminalproceedingorthedefendanthasbeendismissedby HB2855 15 68thecourt.Forpurposesofthissection,theterm"countyordinance"shallincludeany 69ordinanceoftheCityofSt.Louis; 70 (2)Theclerkresponsibleforcollectingcourtcostsincriminalcasesshallcollectand 71disbursesuchamountsasprovidedbysections488.010to488.026.Suchfundsshallbe 72payabletotheprosecutingattorneysandcircuitattorneys'retirementfund.Moneyscredited 73totheprosecutingattorneysandcircuitattorneys'retirementfundshallbeusedonlyforthe 74purposesprovidedforinsections56.800to56.840andfornootherpurpose. 75 8.Theboardmayacceptgifts,donations,grantsandbequestsfromprivateorpublic 76sourcestotheMissouriprosecutingattorneysandcircuitattorneys'retirementsystemfund. 77 9.Nostatemoneysshallbeusedtofundsection56.700andsections56.800to56.840 78unlessprovidedforbylaw. 79 10.BeginningJanuary1,2019,allmembers,whouponvestingandretiringare 80eligibletoreceiveanormalannuityequaltofiftypercentofthefinalaveragecompensation, 81shall,asaconditionofparticipation,contributetwopercentoftheirgrosssalarytothefund. 82BeginningonJanuary1,2020,eachsuchmembershallcontributefourpercentofthe 83member'sgrosssalarytothefund.Eachcountytreasurershalldeducttheappropriateamount 84fromthegrosssalaryoftheprosecutingattorneyorcircuitattorneyand,atleastmonthly,shall 85transmitthesumtotheprosecutingattorneyandcircuitattorneyretirementsystemfordeposit 86intheprosecutingattorneysandcircuitattorneys'retirementfund. 87 11.Uponseparationfromthesystem,anonvestedmembershallreceivealumpsum 88paymentequaltothetotalcontributionofthememberwithoutinterestorotherincreasesin 89value. 90 12.Uponretirementandinthesolediscretionoftheboardontheadviceofthe 91actuary,amembershallreceivealumpsumpaymentequaltothetotalcontributionofthe 92memberwithoutinterestorotherincreasesinvalue,butsuchlumpsumshallnotexceed 93twenty-fivepercentofthefinalaveragecompensationofthemember.Thisamountshallbe 94inadditiontoanyretirementbenefitstowhichthememberisentitled. 95 13.Uponthedeathofanonvestedmemberorthedeathofavestedmemberpriorto 96retirement,thelumpsumpaymentinsubsection11or12ofthissectionshallbemadetothe 97designatedbeneficiaryofthememberor,ifnobeneficiaryhasbeendesignated,tothe 98member'sestate. 56.816.1.Thenormalannuityofaretiredmemberwhoservedasprosecuting 2attorneyofacountyofthethirdorfourthclassshall,exceptasprovidedinsubsection3of 3thissection,beequalto: 4 (1)Anymemberwhohasservedtwelveormoreyearsasaprosecutingattorneyand 5whomeetstheconditionsofretirementatorafterthemember'snormalretirementageshallbe 6entitledtoanormalannuityinamonthlyamountequaltoonehundredfivedollarsmultiplied HB2855 16 7bythenumberoftwo-yearperiodsandpartialtwo-yearperiodsservedasaprosecuting 8attorney; 9 (2)Anymemberwhohasservedtwentyormoreyearsasaprosecutingattorneyand 10whomeetstheconditionsofretirementatorafterthemember'snormalretirementageshallbe 11entitledtoanormalannuityinamonthlyamountequaltoonehundredthirtydollars 12multipliedbythenumberoftwo-yearperiodsandpartialtwo-yearperiodsasaprosecuting 13attorney. 14 2.Thenormalannuityofaretiredmemberwhoservedasprosecutingattorneyofa 15firstorsecondclasscounty[or],ascircuitattorneyofacitynotwithinacounty, oras 16prosecutingattorneyofamulticountyjurisdictionshallbeequaltofiftypercentofthe 17finalaveragecompensation. 18 3.Exceptasotherwiseprovidedundersection56.363,thenormalannuityofaretired 19memberwhoservedasaprosecutingattorneyofacountywhichafterAugust28,2001, 20electedtomakethepositionofprosecutingattorneyfulltimepursuanttosection56.363shall 21beequaltofiftypercentofthefinalaveragecompensation. 22 4.Theactuarialpresentvalueofaretiredmember'sbenefitsshallbeplacedina 23reserveaccountdesignatedasa"RetiredLivesReserve".Thevalueoftheretiredlives 24reserveshallbeincreasedbytheactuarialpresentvalueofretiringmembers'benefits,andby 25theinterestearningofthetotalfundonaproratabasisanditshallbedecreasedbypayments 26toretiredmembersandtheirsurvivors.Eachyeartheactuaryshallcomparetheactuarial 27presentvalueofretiredmembers'benefitswiththeretiredlivesreserve.Ifthevalueofthe 28retiredlivesreserveplusoneyear'sinterestattheassumedrateofinterestexceedsthe 29actuarialpresentvalueofretiredlives,thendistributionofthisexcessmaybemadeequallyto 30allretiredmembers,ortheireligiblesurvivors.Thedistributionmaybeinasinglesumorin 31monthlypaymentsatthediscretionoftheboardontheadviceoftheactuary. 9 (2)Anymemberwhohasservedtwentyormoreyearsasa 10 prosecutingattorneyandwhomeetstheconditionsofretirementatorafterthe 11 member'snormalretirementageshallbeentitledtoanormalannuityina 12 monthlyamountequaltoonehundredthirtydollarsmultipliedbythenumber 13 oftwo-yearperiodsandpartialtwo-yearperiodsasaprosecutingattorney. 14 2.Thenormalannuityofaretiredmemberwhoservedasprosecuting 15 attorneyofafirstorsecondclasscountyorascircuitattorneyofacitynot HB2855 17 16 withinacountyshallbeequaltofiftypercentofthefinalaverage 17 compensation. 18 3.Thenormalannuityofaretiredmemberwhoservedasa 19 prosecutingattorneyofacountywhichafterAugust28,2001,electedtomake 20 thepositionofprosecutingattorneyfulltimepursuanttosection56.363shall 21 beequaltofiftypercentofthefinalaveragecompensation. 22 4.Theactuarialpresentvalueofaretiredmember'sbenefitsshallbe 23 placedinareserveaccountdesignatedasa"RetiredLivesReserve".The 24 valueoftheretiredlivesreserveshallbeincreasedbytheactuarialpresent 25 valueofretiringmembers'benefits,andbytheinterestearningofthetotal 26 fundonaproratabasisanditshallbedecreasedbypaymentstoretired 27 membersandtheirsurvivors.Eachyeartheactuaryshallcomparethe 28 actuarialpresentvalueofretiredmembers'benefitswiththeretiredlives 29 reserve.Ifthevalueoftheretiredlivesreserveplusoneyear'sinterestatthe 30 assumedrateofinterestexceedstheactuarialpresentvalueofretiredlives, 31 thendistributionofthisexcessmaybemadeequallytoallretiredmembers,or 32 theireligiblesurvivors.Thedistributionmaybeinasinglesumorinmonthly 33 paymentsatthediscretionoftheboardontheadviceoftheactuary.] 70.010.1.Twoormore,notexceedingten,contiguouscountiesmayjoinin 2performinganycommonfunctionorservice,includingthepurchase,constructionand 3maintenanceofhospitals,almshouses,roadmachineryandanyothercountypropertyand 4mayjoininthecommonemploymentofanycountyofficeroremployeecommontoeachof 5thecounties.Thecountycommissionsshalladministerthedelegatedpowersandallocatethe 6costsamongthecounties. 7 2.Countycoronersofanynumberofcontiguouscountiesmayestablishacooperative 8districtandappointadistrictcoroneranddeputydistrictcoronerforsuchdistrict.District 9coronersanddeputydistrictcoronersshallbecountycoronersselectedbyamajorityvoteof 10coronersofcountieswithinthedistrictandcertifiedasmasterdeathinvestigatorsbya 11professionalassociationofthecountycoronersofMissouri.Thedistrictanddeputydistrict 12coronersshallreceiveremunerationonlyfornecessaryexpensesincurredforproviding 13assistanceintheinvestigationofadeathattherequestofacountycoronerwhichshallbepaid 14inthemannerprovidedundertheprovisionsofsection58.570. 15 3.Beginningwiththeprosecutingattorneyelectedatthe2026generalelection, 16twoormorecontiguouscountiesofthesecond,third,orfourthclassificationwithina 17singlejudicialcircuitmayactcooperativelyinthecommonemploymentofaprosecuting 18attorney. 70.060.1.Uponthereceiptofanoticethat[the]apropositionforanypurpose 2otherthanthecommonemploymentofaprosecutingattorneyhasbeenadoptedas 3providedinsection70.050,thepresidingcommissionerofthemostpopulouscounty,as 4determinedbythelastfederaldecennialcensus,shallcallameetingofthecounty HB2855 18 5commissionsofallthecountiesvotingontheproposition,atsuchplaceandtimeas[he]such 6presidingcommissionermaydesignate.Unlessotherwiseprovidedbylaw,therespective 7countycommissionssittingasabody,witheachcountycommissionerhavingonevote,shall 8proceedtoadministerthefunction,serviceorcommonemploymentofthecountyofficeror 9employeeandallocatethecostsamongthecounties.Anycountythathasvotedtoparticipate 10inajointundertakingasprovidedinsections70.010to70.090isherebyauthorizedtoissue 11bonds,asprovidedbylawfortheissuanceofcountybonds,forsuchpurposes. 12 2.Uponthereceiptofanoticethatapropositionforthecommonemploymentof 13aprosecutingattorneyhasbeenadoptedasprovidedinsection70.050,thepresiding 14commissionerofthemostpopulouscounty,asdeterminedbythelastfederaldecennial 15census,shallcallameetingofthecountycommissionsofallthecountiesvotingonthe 16proposition,atsuchplaceandtimeassuchpresidingcommissionermaydesignate.The 17respectivecountycommissionssittingasabody,witheachcountycommissionerhaving 18onevote,shallproceedtoapproveajointagreementthatspecifiesthedutiesofeach 19county.Theagreementshallcontainthefollowing: 20 (1)Thenamesofthecountiesengaginginthecommonemploymentofthe 21prosecutingattorney; 22 (2)Theformulaforcalculatingeachcounty'scontributiontothecostsofthe 23prosecutingattorney'soffice; 24 (3)Theformulaforcalculatingeachcounty'sportionofthefeecollectedunder 25subsection3ofsection56.060;and 26 (4)Thetimingandproceduresforapprovaloftheannualbudgetforthe 27prosecutingattorney'sofficebythegoverningbodiesoftheemployingcounties. 70.090.Whentwoormorecountiesmayhavejoinedtogetherforthepurposesof 2sections70.010to70.090,additionalcounties,untilthetotalshallhavereached[ten]the 3limitsspecifiedinsection70.010, maybeadmittedtoparticipationbyallsuchcounties, 4includingthosealreadyparticipatingandthosedesiringtoparticipate,proceedingasis 5providedforinsections70.010to70.090fortheformationofanewagreement.Ifthe 6propositiontoadmitadditionalcountiesshallfailtoreceiveamajorityvoteofthosevoting 7thereoninanyoneofsuchcounties,includingthosealreadyparticipatingandthosedesiring 8toparticipate,thepropositionshallbedeemedtohavefailedandthecountiesalready 9participatingbeforesuchpropositionwassubmittedshallcarryoninthesamemanneras 10before. ✔ HB2855 19
