SectionA.Chapter42,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection42.018,toreadasfollows:
42.018.1.Thissectionshallbeknownandmaybecitedasthe"Veterans
2TraumaticBrainInjuryTreatmentAct".
3 2.Asusedinthissection,thefollowingtermsmean:
4 (1)"Eligiblepatient",amilitaryveteranwhomeetstherequirementsofthis
5section;
6 (2)"Healthcarefacility",thesamemeaninggiventotheterminsection190.100.
7Theterm"healthcarefacility"shallalsoincludeanyoutpatientorinpatientfacility
8utilizinghyperbaricoxygentherapyandanyprivatehyperbaricoxygentreatment
9centerlicensedinthisstate;
10 (3)"Healthcareprovider",alicensedphysician,chiropractor,oracertified
11hyperbaricoxygentechnician;
12 (4)"Posttraumaticstressdisorder"or"PTSD",amentalhealthdisorderthatis
13developedafterhavingexperiencedorwitnessedalife-threateningeventincluding,but
14notlimitedto,militarysexualtrauma;
15 (5)"Traumaticbraininjury"or"TBI",anacquiredinjurytothebrain.The
16term"traumaticbraininjury"shallnotincludebraindysfunctioncausedbycongenital
17ordegenerativedisordersorbirthtrauma.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 3.Theveteranscommissionmaycontractwithpublicorprivateinstitutionsof
19highereducationinthisstate,orpublicorprivateclinicsorhospitals,tofurnish
20alternativetreatmentoptionsforveteranswhohavebeencertifiedbytheUnitedStates
21DepartmentofVeteransAffairs,anybranchoftheUnitedStatesArmedForces,orany
22state-licensedphysicianashavingatraumaticbraininjuryorposttraumaticstress
23disorder.Theinstitutionofhighereducationshallmanage,monitor,andensurethe
24complianceofcontractedprovidersofanyofthefollowingalternativetreatment
25options:
26 (1)Acceleratedresolutiontherapy;
27 (2)Equinetherapy;
28 (3)Hyperbaricoxygentherapy,whichshallbeprovidedataregisteredand
29licensedhyperbaricoxygenfacility;
30 (4)Musictherapy;or
31 (5)Serviceanimaltrainingtherapy.
32 4.Aveteranqualifiestoreceivealternativetreatmentunderthissectionifheor
33she:
34 (1)Hasbeendiagnosed,byahealthcarepractitioner,withservice-connected
35posttraumaticstressdisorderoraservice-connectedtraumaticbraininjury;and
36 (2)Voluntarilyagreestosuchalternativetreatment.
37 5.(1)Theprovisionofalternativetreatmentshallbeunderthedirectionand
38supervisionofanindividuallicensedinthisstatetoperformsuchalternativetreatment.
39 (2)Thesupervisinglicensedprovidershallagreetocooperatewiththeveterans
40commissiontoprovidedatasufficienttoassesstheefficacyofalternativetreatment
41modalities.Acceptabledatamayinclude,butshallnotbelimitedto,institutionalreview
42boardclinicaltrialdata,pretreatmentandposttreatmentMRIbrainscans,cognitive
43testingsuchastheRightEyetestingapprovedbytheUnitedStatesFoodandDrug
44Administration,AutomatedNeuropsychologicalAssessmentMetrics(ANAM)approved
45bytheUnitedStatesDepartmentofDefense,andCNSVitalSigns(CNSVS)metrics.
46 6.(1)Ahealthcareproviderorhealthcarefacilityshallmakehyperbaric
47oxygentherapyavailabletoaneligiblepatientwhohasrequestedsuchtherapyunder
48theprovisionsofthissubsection.
49 (2)Suchahealthcareproviderorhealthcarefacilitymay:
50 (a)Providethehyperbaricoxygentherapywithoutreceivingcompensation;
51 (b)Requireaneligiblepatienttopayforthecostofthehyperbaricoxygen
52therapyandanyassociatedcosts,ataratethatshallnotexceedthemaximumrate
53allowedbyMedicare;or
HB2883	2 54 (c)Allowaneligiblepatienttoutilizealternativesourcesoffundingtocoverthe
55costofthehyperbaricoxygentherapyandanyassociatedcosts.Suchalternative
56sourcesoffundingmayinclude,butshallnotbelimitedto,gifts,grants,donations,
57reimbursementsfromfederalprograms,andcontributionsfromthirdparties.The
58eligiblepatientshallremainliabletothehealthcareproviderorhealthcarefacilityfor
59anyportionofcostsnotcoveredbyalternativesourcesoffunding.
60 (3)Notwithstandinganyprovisionoflawtothecontrary,aneligiblepatientshall
61beentitledtoreceivehyperbaricoxygentherapyunderthissubsectioniftheeligible
62patient:
63 (a)HasreceivedadiagnosisofPTSDorTBI;
64 (b)Hasreceivedanofficialrecommendationforhyperbaricoxygentherapy
65fromthehealthcareproviderwhotreatstheeligiblepatient;and
66 (c)Residesinthisstate.
67 7.Alicensingboardshallnotrevoke,suspend,orfailtorenewthelicenseofa
68healthcareprovider,ortakeanyotherpunitiveactionagainstahealthcareprovider,
69basedonarecommendationorcounselingbythehealthcareproviderrelatingtoaccess
70toortreatmentwithahyperbaricoxygenchamberforaneligiblepatient.
71 8.Nopersonactingonbehalfofthisstateshallblockorattempttoblockan
72eligiblepatientfromreceivingaccesstohyperbaricoxygentreatment.
73 9.Thedepartmentofpublicsafetymaypromulgateallnecessaryrulesand
74regulationsfortheimplementationofthissection.Anyruleorportionofarule,asthat
75termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis
76sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
77provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
78536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
79pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
80arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
81andanyruleproposedoradoptedafterAugust28,2024,shallbeinvalidandvoid.
