| 8 | 8 | | To amend chapter 72, RSMo, by adding thereto one new section relating to fire protection services |

| 11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 12 | 12 | | Section A. Chapter 72, RS Mo, is amended by adding thereto 1 |
|---|
| 13 | 13 | | one new section, to be known as section 72.440, to read as 2 |
|---|
| 14 | 14 | | follows:3 |
|---|
| 15 | 15 | | 72.440. Notwithstanding any other provision of law to 1 |
|---|
| 16 | 16 | | the contrary, any fire protection district serving an area 2 |
|---|
| 17 | 17 | | included within any annexation by a city located in a first 3 |
|---|
| 18 | 18 | | or second class county shall continue to provide fire 4 |
|---|
| 19 | 19 | | protection services to such area. The annexing city shall 5 |
|---|
| 20 | 20 | | pay annually to the fire protection district an amount equal 6 |
|---|
| 21 | 21 | | to that which the fire protection district would ha ve levied 7 |
|---|
| 22 | 22 | | on all taxable property within the annexed area. Such 8 |
|---|
| 23 | 23 | | annexed area shall not be subject to taxation for any 9 |
|---|
| 24 | 24 | | purpose thereafter by the fire protection district except 10 |
|---|
| 25 | 25 | | for bonded indebtedness by the fire protection district 11 |
|---|
| 26 | 26 | | which existed prior to the annexation. The amount to be 12 |
|---|
| 27 | 27 | | paid annually by the municipality to the fire protection 13 |
|---|
| 28 | 28 | | district shall be a sum equal to the annual assessed value 14 |
|---|
| 29 | 29 | | multiplied by the annual tax rate as certified by the fire 15 |
|---|
| 30 | 30 | | protection district to the municipalit y, per one hundred 16 |
|---|
| 31 | 31 | | dollars of assessed value in such area. The tax rate shall 17 |
|---|
| 32 | 32 | | include any tax on bonded indebtedness incurred subsequent 18 SB 1291 2 |
|---|
| 33 | 33 | | to such annexation, but shall not include any portion of the 19 |
|---|
| 34 | 34 | | tax rate for bonded indebtedness incurred prior to su ch 20 |
|---|
| 35 | 35 | | annexation. Notwithstanding any other provision of law to 21 |
|---|
| 36 | 36 | | the contrary, the residents of an area annexed may vote in 22 |
|---|
| 37 | 37 | | all fire protection district elections and may be elected to 23 |
|---|
| 38 | 38 | | the fire protection district board of directors. 24 |
