1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
12- Section A. Section 115.085, RSMo, is repealed and one new
13-section enacted in lieu thereof, to be known as section 115.085,
14-to read as follows:
15- 115.085. 1. For purposes of this section, the
16-following terms mean:
17- (1) "Military", the Armed Forces of the United States,
18-including the Air Force, Army, Coast Guard, Marine Corps,
19-Navy, Space Force, National Guard, and any other military
20-branch that is designated by Congress as part of the Armed
21-Forces of the United States, and all reserve co mponents and
22-auxiliaries. The term "military" also includes the military
23-reserves and militia of any United States territory or state;
24- (2) "Nonresident military spouse", a nonresident
25-spouse of an active duty member of the Armed Forces of the
26-United States who has been transferred to the state of
27-Missouri, or who has been transferred to an adjacent state
28-and is or will be domiciled in the state of Missouri, or has
29-moved to the state of Missouri on a permanent change -of-
30-station basis.
31- 2. No person shall be appointed to serve as an
32-election judge who is not a registered voter in this state
33-or a military service member on active duty in this state or
34-a nonresident military spouse . Each election judge shall be
35-a person of good repute an d character who can speak, read,
36- 2
37-and write the English language. No person shall serve as an
38-election judge at any polling place in which his or her name
39-or the name of a relative within the second degree, by
40-consanguinity or affinity, appears on the ballot. However,
41-no relative of any unopposed candidate shall be disqualified
42-from serving as an election judge in any election
43-jurisdiction of the state. No election judge shall, during
44-his or her term of office, hold any other elective public
45-office, other than as a member of a political party
46-committee or township office, except any person who is
47-elected to a board or commission of a political subdivision
48-or special district may serve as an election judge except at
49-a polling place where such p olitical subdivision or special
50-district has an issue or candidate on the ballot. In any
51-county having a population of less than two hundred fifty
52-thousand inhabitants, any candidate for the county committee
53-of a political party who is not a candidate for any other
54-office and who is unopposed for election as a member of the
55-committee shall not be disqualified from serving as an
56-election judge.
57- Section B. Section A of this act shall become
58-effective on January 1, 2025.
