88 To amend chapters 34, 347, and 351, RSMo, by adding thereto three new sections relating to

1212 Be it enacted by the General Assembly of the State of Missouri, as follows:
1313 Section A. Chapters 34, 347, and 351, RSMo, are amended 1
1414 by adding thereto three new sections, to be known as sections 2
1515 34.710, 347.800, and 351.018, to read as follows:3
1616 34.710. 1. The state, any agency of the state, an y 1
1717 political subdivision of the state, or any instrumentality 2
1818 thereof, when engaged in procuring or letting contracts for 3
1919 any purpose shall ensure that bidders, offerors, 4
2020 contractors, or subcontractors are not discriminated against 5
2121 or given preferentia l treatment based on an environmental, 6
2222 social, and governance score. 7
2323 2. For purposes of this section, the term 8
2424 "environmental, social, and governance score" means an 9
2525 evaluation conducted by an entity that takes into 10
2626 consideration one or more of t he following: 11
2727 (1) The use of energy and raw materials by the bidder, 12
2828 offeror, contractor, or subcontractor; 13
2929 (2) Whether the bidder, offeror, contractor, or 14
3030 subcontractor spends funds on social welfare or makes 15

3232 (3) The wages and working hours of the employees of 17
3333 the bidder, offeror, contractor, or subcontractor; 18
3434 (4) The environmental policies of the bidder, offeror, 19
3535 contractor, or subcontractor; 20
3636 (5) The bribery and corruption policies of the bidder, 21
3737 offeror, contractor, or subcontractor; and 22
3838 (6) The information transparency of the bidder, 23
3939 offeror, contractor, or subcontractor. 24
4040 347.800. 1. No limited liability company registered 1
4141 pursuant to this chapter shall be discriminate d against or 2
4242 given preferential treatment based on an environmental, 3
4343 social, and governance score. 4
4444 2. For purposes of this section, the term 5
4545 "environmental, social, and governance score" means an 6
4646 evaluation conducted by an entity that takes into 7
4747 consideration one or more of the following: 8
4848 (1) The use of energy and raw materials by the limited 9
4949 liability company; 10
5050 (2) Whether the limited liability company spends funds 11
5151 on social welfare or makes charitable donations; 12
5252 (3) The wages and working hours of the employees of 13
5353 the limited liability company; 14
5454 (4) The environmental policies of the limited 15
5555 liability company; 16
5656 (5) The bribery and corruption policies of the limited 17
5757 liability company; and 18
5858 (6) The information transparency of the limited 19
5959 liability company. 20

7070 (2) Whether the corporation spends funds on social 11

7474 (4) The environmental policies of the corporation; 15
7575 (5) The bribery and corruption policies of the 16
7676 corporation; and 17
7777 (6) The information transparency of the corporation. 18
