| 12 | 12 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |

| 13 | 13 | | Section A. Chapters 34, 347, and 351, RSMo, are amended 1 |
|---|
| 14 | 14 | | by adding thereto three new sections, to be known as sections 2 |
|---|
| 15 | 15 | | 34.710, 347.800, and 351.018, to read as follows:3 |
|---|
| 16 | 16 | | 34.710. 1. The state, any agency of the state, an y 1 |
|---|
| 17 | 17 | | political subdivision of the state, or any instrumentality 2 |
|---|
| 18 | 18 | | thereof, when engaged in procuring or letting contracts for 3 |
|---|
| 19 | 19 | | any purpose shall ensure that bidders, offerors, 4 |
|---|
| 20 | 20 | | contractors, or subcontractors are not discriminated against 5 |
|---|
| 21 | 21 | | or given preferentia l treatment based on an environmental, 6 |
|---|
| 22 | 22 | | social, and governance score. 7 |
|---|
| 23 | 23 | | 2. For purposes of this section, the term 8 |
|---|
| 24 | 24 | | "environmental, social, and governance score" means an 9 |
|---|
| 25 | 25 | | evaluation conducted by an entity that takes into 10 |
|---|
| 26 | 26 | | consideration one or more of t he following: 11 |
|---|
| 27 | 27 | | (1) The use of energy and raw materials by the bidder, 12 |
|---|
| 28 | 28 | | offeror, contractor, or subcontractor; 13 |
|---|
| 29 | 29 | | (2) Whether the bidder, offeror, contractor, or 14 |
|---|
| 30 | 30 | | subcontractor spends funds on social welfare or makes 15 |
|---|
