1113 Be it enacted by the General Assembly of the State of Missouri, as follows:
12- Section A. Sections 43.546, 210.482, and 210.487, RSMo,
13-are repealed and forty-one new sections enacted in lieu thereof,
14-to be known as sections 43.546, 168.014, 190.106, 208.222,
15-209.324, 210.482, 210.487, 301.551, 311.661, 324.055, 324.129,
16-324.246, 324.488, 324.1105, 326.257, 330.025, 331.025, 332.015,
17-334.015, 334.403, 334.501, 334.701, 334.739, 334.805, 335.022,
18-335.042, 336.025, 337.018, 337.308, 337.501, 337.605, 337.702,
19-338.052, 339.015, 339.510, 345.016, 374.711, 436.225, 443.702,
20-484.125, and 640.011, to read as follows:
21- 43.546. 1. Any state agency, board, or commission may
22-require the fingerprinting of applicants in specified
23-occupations or appointments within the state agency, board,
24-or commission for the purpose of positive ide ntification and
25-receiving criminal history record information when
26-determining an applicant's ability or fitness to serve in
27-such occupation or appointment.
28- 2. In order to facilitate the criminal background
29-check under subsection 1 of this sectio n on any person
30-employed or appointed by a state agency, board, or
31-commission, [and in accordance with section 43.543, ] the
32-applicant or employee shall submit a set of fingerprints
33-collected under the standards determined by the Missouri
34-highway patrol. The fingerprints and accompanying fees,
35-unless otherwise arranged, shall be forwarded to the highway
36- 2
37-patrol to be used to search the state criminal history
38-repository and the fingerprints shall be forwarded to the
39-Federal Bureau of Investigation fo r a national criminal
40-background check under section 43.540. Notwithstanding the
41-provisions of section 610.120 to the contrary, all records
42-related to any criminal history information discovered shall
43-be accessible and available to the state agency ma king the
44-request.
45- 168.014. 1. The state board of education shall
46-require applicants to submit fingerprints to the Missouri
47-state highway patrol for the purpose of conducting a state
48-and federal fingerprint -based criminal history backg round
49-check.
50- 2. The state board of education may require that such
51-fingerprint submissions be made as part of an application
52-seeking a certificate of license to teach or substitute
53-teach in public schools, as provided in sections 168.011,
54-168.021, and 168.036 and as required by section 168.133.
55- 3. The fingerprints and any required fees shall be
56-sent to the Missouri state highway patrol's central
57-repository. The fingerprints shall be used for searching
58-the state criminal records repositor y and shall also be
59-forwarded to the Federal Bureau of Investigation for a
60-federal criminal records search under section 43.540. The
61-Missouri state highway patrol shall notify the state board
62-of education of any criminal history record information or
63-lack of criminal history record information discovered on
64-the individual. Notwithstanding the provisions of section
65-610.120 to the contrary, all records related to any criminal
66-history information discovered shall be accessible and
67-available to the state board of education.
68- 190.106. 1. The department of health and senior
69-services shall require applicants to submit fingerprints to
70- 3
71-the Missouri state highway patrol for the purpose of
72-conducting a state and federal fingerprint -based criminal
73-history background check.
74- 2. The department of health and senior services may
75-require that such fingerprint submissions be made as part of
76-an application seeking licensure as an emergency medical
77-technician or "EMT", an advanced emergenc y medical
78-technician or "AEMT", or a paramedic, and an application
79-seeking certification as an emergency medical technician -
80-community paramedic or "EMT -CP", as such terms are defined
81-in section 190.100.
82- 3. The fingerprints and any required fees s hall be
83-sent to the Missouri state highway patrol's central
84-repository. The fingerprints shall be used for searching
85-the state criminal records repository and shall also be
86-forwarded to the Federal Bureau of Investigation for a
87-federal criminal recor ds search under section 43.540. The
88-Missouri state highway patrol shall notify the department of
89-health and senior services of any criminal history record
90-information or lack of criminal history record information
91-discovered on the individual. Notwithstanding the
92-provisions of section 610.120 to the contrary, all records
93-related to any criminal history information discovered shall
94-be accessible and available to the department of health and
95-senior services.
96- 208.222. 1. The Missouri Medicaid audit and
97-compliance unit within the department of social services
98-shall require applicants to submit fingerprints to the
99-Missouri state highway patrol for the purpose of conducting
100-a state and federal fingerprint -based criminal history
101-background check.
102- 2. The Missouri Medicaid audit and compliance unit
103-within the department of social services may require that
104- 4
105-such fingerprint submissions be made as part of an
106-application seeking to be licensed as a MO HealthNet
107-provider for the purpose of providing MO HealthNet services
108-to eligible persons and obtaining from the department of
109-social services or its divisions reimbursement for eligible
110-services.
111- 3. The fingerprints and any required fees shall be
112-sent to the Missouri state highway patrol's central
113-repository. The fingerprints shall be used for searching
114-the state criminal records repository and shall also be
115-forwarded to the Federal Bureau of Investigation for a
116-federal criminal records search under section 43.540. The
117-Missouri state highway patrol shall notify the Missouri
118-Medicaid audit and compliance unit within the department of
119-social services of any criminal history record information
120-or lack of criminal history record information discovered on
121-the individual. Notwithstanding the provisions of section
122-610.120 to the contrary, all records related to any criminal
123-history information discovered shall be accessible and
124-available to the Missouri Medicaid audit and compliance unit
125-within the department of soci al services.
126- 4. For purposes of this section, the following terms
127-mean:
128- (1) "Eligible persons", individuals or families in the
129-categories provided in section 208.151 and in Section 36(c)
130-of Article IV of the Constitution of the state of Miss ouri
131-to receive medical assistance benefits Title XIX, P.L. 89 -
132-97, 1965 amendments to the federal Social Security Act, 42
133-U.S.C. Section 301 et seq., known in this state as the
134-Missouri Medicaid Program or MO HealthNet;
135- (2) "MO HealthNet provider ", any person, partnership,
136-corporation, not-for-profit corporation, professional
137-corporation, or business entity that enters into a contract
138- 5
139-or provider agreement with the department of social services
140-or its divisions for the purpose of providing ser vices to
141-eligible persons and obtaining from the department of social
142-services or its divisions reimbursement for such services;
143- (3) "MO HealthNet services", medical services defined
144-and determined by the department of social services or
145-listed specifically in section 208.152 in which eligible
146-persons receive as part of their Missouri Medicaid coverage.
147- 209.324. 1. The state committee of interpreters shall
148-require applicants to submit fingerprints to the Missouri
149-state highway patrol for the purpose of conducting a state
150-and federal fingerprint -based criminal history background
151-check.
152- 2. The state committee of interpreters may require
153-that such fingerprint submissions be made as part of an
154-application seeking licensur e as an interpreter, as such
155-term is defined in section 209.285, and temporary
156-interpreter, as provided in section 209.326.
157- 3. The fingerprints and any required fees shall be
158-sent to the Missouri state highway patrol's central
159-repository. The fingerprints shall be used for searching
160-the state criminal records repository and shall also be
161-forwarded to the Federal Bureau of Investigation for a
162-federal criminal records search under section 43.540. The
163-Missouri state highway patrol shall notify the committee of
164-any criminal history record information or lack of criminal
165-history record information discovered on the individual.
166-Notwithstanding the provisions of section 610.120 to the
167-contrary, all records related to any criminal history
168-information discovered shall be accessible and available to
169-the committee.
170- 210.482. 1. If the emergency placement of a child in
171-a private home is necessary due to the unexpected absence of
172- 6
173-the child's parents, legal guardian, or custodian, the
174-juvenile court or children's division of the department of
175-social services:
176- (1) May request that a local or state law enforcement
177-agency or juvenile officer, subject to any required federal
178-authorization, immediately conduct a name -based criminal
179-history record check to include full orders of protection
180-and outstanding warrants of each person over the age of
181-[seventeen] eighteen residing in the home by using the
182-Missouri uniform law enforcement system (MULES) and the
183-National Crime Inform ation Center to access the Interstate
184-Identification Index (III) maintained by the Federal Bureau
185-of Investigation; and
186- (2) Shall determine or, in the case of the juvenile
187-court, shall request the division to determine whether any
188-person over the age of [seventeen] eighteen years residing
189-in the home is listed on the child abuse and neglect
190-registry. For any children less than [seventeen] eighteen
191-years of age residing in the home, the children's division
192-shall inquire of the person with whom an emergency placement
193-of a child will be made whether any children less than
194-[seventeen] eighteen years of age residing in the home have
195-ever been certified as an adult and convicted of or pled
196-guilty or nolo contendere to any crime.
197- 2. If a name-based search has been conducted pursuant
198-to subsection 1 of this section, within fifteen calendar
199-days of the Interstate Identification Index (III) name -based
200-check, after the emergency placement of the child in the
201-private home, and if the private home has not previously
202-been approved as a foster or adoptive home, all persons over
203-the age of [seventeen] eighteen residing in the home and all
204-children less than [seventeen] eighteen residing in the home
205-who the children's division has determined ha ve been
206- 7
207-certified as an adult for the commission of a crime shall
208-[report to a local law enforcement agency for the purpose of
209-providing fingerprints and accompanying fees ] be
210-fingerprinted, pursuant to sections 43.530 and 43.540. The
211-fingerprints shall be used for searching the state criminal
212-records repository and shall also be forwarded to the
213-Federal Bureau of Investigation for a federal criminal
214-records search under section 43.540. Results of the checks
215-shall be provided to the juvenile cour t or children's
216-division office requesting such information. Any child
217-placed in emergency placement in a private home shall be
218-removed immediately if any person residing in the home fails
219-to provide fingerprints after being requested to do so,
220-unless the person refusing to provide fingerprints ceases to
221-reside in the private home.
222- 3. If the placement of a child is denied as a result
223-of a name-based criminal history check and the denial is
224-contested, all persons over the age of [seventeen] eighteen
225-residing in the home and all children less than [seventeen]
226-eighteen years of age residing in the home who the
227-children's division has determined have been certified as an
228-adult for the commission of a crime shall, within fifteen
229-calendar days of conducting the Interstate Identification
230-Index (III) name-based check, submit [to the juvenile court
231-or the children's division ] fingerprints and any required
232-fees, in the same manner described in subsection 2 of this
233-section[, accompanying fees, an d written permission
234-authorizing the juvenile court or the children's division to
235-forward the fingerprints to the state criminal record
236-repository for submission to the Federal Bureau of
237-Investigation.
238- 4. No person who submits fingerprints under this
239-section shall be required to submit additional fingerprints
240- 8
241-under this section or section 210.487 unless the original
242-fingerprints retained by the division are lost or destroyed ].
243- [5.] 4. Subject to appropriation, the total cost of
244-fingerprinting required by this section may be paid by the
245-state, including reimbursement of persons incurring
246-fingerprinting costs under this section.
247- [6.] 5. For the purposes of this section, "emergency
248-placement" refers to those limited instances when t he
249-juvenile court or children's division is placing a child in
250-the home of private individuals, including neighbors,
251-friends, or relatives, as a result of a sudden
252-unavailability of the child's primary caretaker.
253- 210.487. 1. The children's division of the department
254-of social services shall require fingerprint submissions to
255-the Missouri state highway patrol for the purpose of
256-conducting a state and federal fingerprint -based criminal
257-background check. When conducting investigation s of persons
258-for the purpose of foster parent licensing, the children's
259-division shall:
260- (1) Conduct a search for all persons over the age of
261-[seventeen] eighteen in the applicant's household and for
262-any child less than [seventeen] eighteen years of age
263-residing in the applicant's home who the division has
264-determined has been certified as an adult for the commission
265-of a crime for evidence of full orders of protection. The
266-office of state courts administrator shall allow access to
267-the automated court information system by the division. The
268-clerk of each court contacted by the division shall provide
269-the division information within ten days of a request;
270- (2) Obtain fingerprints for any person over the age of
271-[seventeen] eighteen in the applicant's household and for
272-any child less than [seventeen] eighteen years of age
273-residing in the applicant's home who the division has

275-determined has been certified as an adult for the commission
276-of a crime [in the same manner set forth in subsecti on 2 of
277-section 210.482]. The fingerprints and any required fees
278-shall be sent to the Missouri state highway patrol's central
279-repository. The fingerprints shall be used for searching
280-the state criminal records repository and shall also be
281-forwarded to the Federal Bureau of Investigation for a
282-federal criminal records search under section 43.540. The
283-Missouri state highway patrol shall notify the juvenile
284-court or the division of any criminal history record
285-information or lack of criminal history record information
286-discovered on the individual. Notwithstanding the
287-provisions of section 610.120 to the contrary, all records
288-related to any criminal history information discovered shall
289-be accessible and available to the juvenile court or the
290-division. The highway patrol shall assist the division and
291-provide the criminal fingerprint background information,
292-upon request, under and in accordance with the provisions of
293-section 43.540; and
294- (3) Determine whether any person over the age of
295-[seventeen] eighteen residing in the home and any child less
296-than [seventeen] eighteen years of age residing in the
297-applicant's home who the division has determined has been
298-certified as an adult for the commission of a crime is
299-listed on the child abuse and neglect registry. For any
300-children less than seventeen years of age residing in the
301-applicant's home, the [children's] division shall inquire of
302-the applicant whether any children less than [seventeen]
303-eighteen years of age residing in the home h ave ever been
304-certified as an adult and been convicted of or pled guilty
305-or nolo contendere to any crime.
306- 2. [After the initial investigation is completed under
307-subsection 1 of this section:

309- (1) No person who submits fingerprints under
310-subsection 1 of this section or section 210.482 shall be
311-required to submit additional fingerprints under this
312-section or section 210.482 unless the original fingerprints
313-retained by the division are lost or destroyed;
314- (2) The highway patrol shall pro vide ongoing
315-electronic updates to criminal history background checks of
316-those persons previously submitted as part of the licensing
317-or approval process under subsection 1 of this section.
318-Ongoing electronic updates for such persons and for those in
319-their households shall terminate when such persons cease to
320-be applicant or licensed foster parents; and
321- (3) The children's division and the department of
322-health and senior services may waive the requirement for a
323-fingerprint background check for any subsequent
324-recertification.
325- 3.] Subject to appropriation, the total cost of
326-fingerprinting required by this section may be paid by the
327-state, including reimbursement of persons incurring
328-fingerprinting costs under this section.
329- [4.] 3. The division may make arrangements with other
330-executive branch agencies to obtain any investigative
331-background information.
332- [5.] 4. The division may promulgate rules that are
333-necessary to implement the provisions of this section. Any
334-rule or portion of a rule, as that term is defined in
335-section 536.010, that is created under the authority
336-delegated in this section shall become effective only if it
337-complies with and is subject to all of the provisions of
338-chapter 536 and, if applicable, section 536.028. This
339-section and chapter 536 are nonseverable and if any of the
340-powers vested with the general assembly pursuant to chapter
341-536 to review, to delay the effective date, or to disapprove

343-and annul a rule are subsequently held unconstitutional,
344-then the grant of rulemaking authority and any rule proposed
345-or adopted after August 28, 2004, shall be invalid and void.
346- 301.551. 1. The department of revenue shall require
347-applicants to submit fingerprints to the Missouri state
348-highway patrol for the purpose of conducting a state and
349-federal fingerprint-based criminal history background check.
350- 2. The department of revenue may require that such
351-fingerprint submissions be made as part of an application
352-seeking licensure for a new motor vehicle franchise dealer,
353-used motor vehicle dealer, powersport dealer, wholesale
354-motor vehicle dealer, motor vehicle dealer, public motor
355-vehicle auction, recreational motor vehicle dealer, trailer
356-dealer, boat dealer, manufacturer, or boat manufacturer, as
357-such terms are defined in section 301.550.
358- 3. The fingerprints and any required fees shall be
359-sent to the Missouri state highway patrol's central
360-repository. The fingerprints shall be used for searching
361-the state criminal recor ds repository and shall also be
362-forwarded to the Federal Bureau of Investigation for a
363-federal criminal records search under section 43.540. The
364-Missouri state highway patrol shall notify the department of
365-any criminal history record information or la ck of criminal
366-history record information discovered on the individual.
367-Notwithstanding the provisions of section 610.120 to the
368-contrary, all records related to any criminal history
369-information discovered shall be accessible and available to
370-the department.
371- 311.661. 1. The division of alcohol and tobacco
372-control shall require any owner, as such term is defined in
373-subsection 3 of this section, or applicant, as such term is
374-defined in section 43.540, seeking a license for the
375-manufacture, sale, transport, consumption, or delivery of
376- 12
377-intoxicating liquors within this state, as provided in this
378-chapter, to submit fingerprints to the Missouri state
379-highway patrol for the purpose of conducting a state and
380-federal fingerprint-based criminal history background
381-check. The licenses provided by this chapter that require a
382-background check for licensure are as follows:
383- (1) Alcohol carrier or transportation license;
384- (2) Manufacturer-solicitor, domestic winery, or
385-microbrewery liquor license;
386- (3) Primary retail liquor license;
387- (4) Solicitor license;
388- (5) Wholesalers license; and
389- (6) Wine direct shipper license.
390- 2. The fingerprints and any required fees shall be
391-sent to the Missouri state highway p atrol's central
392-repository. The fingerprints shall be used for searching
393-the state criminal records repository and shall also be
394-forwarded to the Federal Bureau of Investigation for a
395-federal criminal records search under section 43.540. The
396-Missouri state highway patrol shall notify the division of
397-alcohol and tobacco control of any criminal history record
398-information or lack of criminal history record information
399-discovered on the individual. Notwithstanding the
400-provisions of section 610.120 t o the contrary, all records
401-related to any criminal history information discovered shall
402-be accessible and available to the division of alcohol and
403-tobacco control.
404- 3. For purposes of this section, the following terms
405-mean:
406- (1) "Alcohol carrier or transportation license", a
407-license issued to an applicant for the transport or delivery
408-of intoxicating liquor into, within, or through this state;

410- (2) "Manufacturer-solicitor, domestic winery, or
411-microbrewery liquor license", a license is sued to an
412-applicant authorizing the manufacturing, distilling,
413-blending, or brewing of intoxicating liquor in this state;
414- (3) "Owner", an individual holding ten percent or
415-greater financial interest or voting interest in an entity
416-seeking to be licensed;
417- (4) "Primary retail liquor license", a license issued
418-to an applicant for the retail sale of intoxicating liquor
419-in this state;
420- (5) "Solicitor license", a license issued to an
421-applicant which allows for the solicitation of orders f or
422-the sale of intoxicating liquor to wholesalers licensed in
423-this state;
424- (6) "Wholesalers license", a license issued to an
425-applicant authorizing the sale of intoxicating liquor to
426-retail licensees;
427- (7) "Wine direct shipper license", a lice nse issued to
428-an applicant allowing for the direct shipping of
429-intoxicating liquor to consumers who are residents of this
430-state and who are at least twenty -one years of age for the
431-personal use and not for resale.
432- 324.055. 1. The Missouri board of occupational
433-therapy shall require applicants to submit fingerprints to
434-the Missouri state highway patrol for the purpose of
435-conducting a state and federal fingerprint -based criminal
436-history background check.
437- 2. The Missouri board o f occupational therapy may
438-require that such fingerprint submissions be made as part of
439-an application seeking licensure as an occupational
440-therapist or an occupational therapy assistant, or a limited
441-permit to practice occupational therapy, as such te rms are

443-defined in section 324.050 and as provided in section
444-324.077.
445- 3. The fingerprints and any required fees shall be
446-sent to the Missouri state highway patrol's central
447-repository. The fingerprints shall be used for searching
448-the state criminal records repository and shall also be
449-forwarded to the Federal Bureau of Investigation for a
450-federal criminal records search under section 43.540. The
451-Missouri state highway patrol shall notify the Missouri
452-board of occupational therapy of any cr iminal history record
453-information or lack of criminal history record information
454-discovered on the individual. Notwithstanding the
455-provisions of section 610.120 to the contrary, all records
456-related to any criminal history information discovered shall
457-be accessible and available to the Missouri board of
458-occupational therapy.
459- 324.129. 1. The state board of registration for the
460-healing arts shall require applicants to submit fingerprints
461-to the Missouri state highway patrol for the p urpose of
462-conducting a state and federal fingerprint -based criminal
463-history background check.
464- 2. The state board of registration for the healing
465-arts may require that such fingerprint submissions be made
466-as part of an application seeking licensur e as a licensed
467-clinical perfusionist and provisional clinical licensed
468-perfusionist, as defined in section 324.128.
469- 3. The fingerprints and any required fees shall be
470-sent to the Missouri state highway patrol's central
471-repository. The fingerprints shall be used for searching
472-the state criminal records repository and shall also be
473-forwarded to the Federal Bureau of Investigation for a
474-federal criminal records search under section 43.540. The
475-Missouri state highway patrol shall notify the sta te board

477-of registration for the healing arts of any criminal history
478-record information or lack of criminal history record
479-information discovered on the individual. Notwithstanding
480-the provisions of section 610.120 to the contrary, all
481-records related to any criminal history information
482-discovered shall be accessible and available to the state
483-board of registration for the healing arts.
484- 324.246. 1. The board of therapeutic massage shall
485-require applicants to submit fingerprints t o the Missouri
486-state highway patrol for the purpose of conducting a state
487-and federal fingerprint -based criminal history background
488-check.
489- 2. The board of therapeutic massage may require that
490-such fingerprint submissions be made as part of an
491-application seeking a license, provisional license, or
492-student license as a massage therapist and a license as a
493-massage business, as such terms are defined in section
494-324.240 and as provided in sections 324.247 and 324.265.
495- 3. The fingerprints and any required fees shall be
496-sent to the Missouri state highway patrol's central
497-repository. The fingerprints shall be used for searching
498-the state criminal records repository and shall also be
499-forwarded to the Federal Bureau of Investigation for a
500-federal criminal records search under section 43.540. The
501-Missouri state highway patrol shall notify the board of
502-therapeutic massage of any criminal history record
503-information or lack of criminal history record information
504-discovered on the individual. Notwithstanding the
505-provisions of section 610.120 to the contrary, all records
506-related to any criminal history information discovered shall
507-be accessible and available to the board of therapeutic
508-massage.

510- 324.488. 1. The state board of chiropractic examiners
511-shall require applicants to submit fingerprints to the
512-Missouri state highway patrol for the purpose of conducting
513-a state and federal fingerprint -based criminal history
514-background check.
515- 2. The state board of chiropract ic examiners may
516-require that such fingerprint submissions be made as part of
517-an application seeking licensure as an acupuncturist, as
518-such term is defined in section 324.475.
519- 3. The fingerprints and any required fees shall be
520-sent to the Missouri state highway patrol's central
521-repository. The fingerprints shall be used for searching
522-the state criminal records repository and shall also be
523-forwarded to the Federal Bureau of Investigation for a
524-federal criminal records search under section 43.5 40. The
525-Missouri state highway patrol shall notify the state board
526-of chiropractic examiners of any criminal history record
527-information or lack of criminal history record information
528-discovered on the individual. Notwithstanding the
529-provisions of section 610.120 to the contrary, all records
530-related to any criminal history information discovered shall
531-be accessible and available to the state board of
532-chiropractic examiners.
533- 324.1105. 1. The board of private investigator and
534-private fire investigator examiners shall require applicants
535-to submit fingerprints to the Missouri state highway patrol
536-for the purpose of conducting a state and federal
537-fingerprint-based criminal history background check.
538- 2. The board of private inve stigator and private fire
539-investigator examiners may require that such fingerprint
540-submissions be made as part of an application seeking
541-licensure as a private investigator or private fire
542-investigator or as an employee of a private investigator

544-agency or private fire investigator agency, as such terms
545-are defined in section 324.1100.
546- 3. The fingerprints and any required fees shall be
547-sent to the Missouri state highway patrol's central
548-repository. The fingerprints shall be used for searching
549-the state criminal records repository and shall also be
550-forwarded to the Federal Bureau of Investigation for a

569-accountant and a permit for a certified public accounting
570-firm, as defined in section 326.256.

588-Missouri state highway patrol for the purpose of conducting

591- 2. The state board of podiatric medicine may require
592-that such fingerprint submissions be made as part of an
593-application seeking a permanent license or a temporary
594-license to practice podiatric medicine, as provided in
595-sections 330.045 and 330.065, or a permanent podiatric
596-medicine license with ankle certification, as such te rm is
597-defined in subsection 4 of this section.
598- 3. The fingerprints and any required fees shall be
599-sent to the Missouri state highway patrol's central
600-repository. The fingerprints shall be used for searching
601-the state criminal records repository and shall also be
602-forwarded to the Federal Bureau of Investigation for a

607-discovered on the individual. Notwithstanding the
608-provisions of section 610.120 to the contrary, all records

613- 4. For purposes of this section, the term "permanent
614-podiatric medicine license with ankle certification" means a
615-license issued to a doctor of podiatric medicine who has met
616-the requirements for performin g surgery on the ankle as
617-provided in section 330.010.
618- 331.025. 1. The state board of chiropractic examiners
619-shall require applicants to submit fingerprints to the
620-Missouri state highway patrol for the purpose of conducting
621-a state and federal fingerprint -based criminal history
622-background check.
623- 2. The state board of chiropractic examiners may
624-require that such fingerprint submissions be made as part of
625-an application seeking licensure to engage in the practice
626-of chiropractic, as such term is defined in section 331.010.
627- 3. The fingerprints and any required fees shall be
628-sent to the Missouri state highway patrol's central
629-repository. The fingerprints shall be used for searching
630-the state criminal records repository a nd shall also be
631-forwarded to the Federal Bureau of Investigation for a
632-federal criminal records search under section 43.540. The
633-Missouri state highway patrol shall notify the state board
634-of chiropractic examiners of any criminal history record
635-information or lack of criminal history record information
636-discovered on the individual. Notwithstanding the
637-provisions of section 610.120 to the contrary, all records
638-related to any criminal history information discovered shall
639-be accessible and availabl e to the state board of
640-chiropractic examiners.
641- 332.015. 1. The Missouri dental board shall require
642-applicants to submit fingerprints to the Missouri state

644-highway patrol for the purpose of conducting a state and
645-federal fingerprint-based criminal history background check.
646- 2. The Missouri dental board may require that such
647-fingerprint submissions be made as part of an application
648-seeking licensure as a dentist, a dental specialist, a
649-volunteer dentist, a temporary dentist, a d ental hygienist,
650-or a volunteer dental hygienist, a limited dental teaching
651-license, and a dental faculty permit, as provided in
652-sections 332.091, 332.112, 332.113, 332.171, 332.181,
653-332.183, 332.201, and 332.425.
654- 3. The fingerprints and any requ ired fees shall be
655-sent to the Missouri state highway patrol's central
656-repository. The fingerprints shall be used for searching
657-the state criminal records repository and shall also be

666-available to the Missouri dental board.
667- 334.015. 1. The state board of registration for the
668-healing arts shall require applicants to submit fingerprints
669-to the Missouri state highway patrol for the purpose of
670-conducting a state and federal fingerprint -based criminal
671-history background check.
672- 2. The state board of registration for the h ealing
673-arts may require that such fingerprint submissions be made
674-as part of an application for a permanent license, temporary
675-license, or limited license as a physician and assistant

678-334.045, 334.046, and 334.112.

701-anesthesiologist assistant, as such term is defined in
702-section 334.400, or a temporary license to practice as an
703-anesthesiologist assistant, as provided in section 334.406.
704- 3. The fingerprints and any required fees shall be

800-application seeking licensure as a respiratory care
801-practitioner, an educational permit to practice respiratory
802-care, or a temporary permit to practice respiratory care, as
803-such terms are defined in section 334.800 and as provided in
804-section 334.890.

824-for employment purpo ses with the state board of nursing.
825- 2. The fingerprints and any required fees shall be
826-sent to the Missouri state highway patrol's central
827-repository. The fingerprints shall be used for searching
828-the state criminal records repository and shall a lso be
829-forwarded to the Federal Bureau of Investigation for a
830-federal criminal records search under section 43.540. The
831-Missouri state highway patrol shall notify the state board
832-of nursing of any criminal history record information or
833-lack of criminal history record information discovered on
834-the individual. Notwithstanding the provisions of section

838- 335.042. 1. The state board of nursing shall require

873-repository. The fingerprints shall be used for searching
874-the state criminal records repository and shall also be
875-forwarded to the Federal Bureau of Investigation for a
876-federal criminal records search under section 43.540. The
877-Missouri state highway patrol shall notify the state board
878-of optometry of any criminal history record information or
879-lack of criminal history record information discovered on

883-history information discovered shall be accessible and
884-available to the state board of optometry.
885- 337.018. 1. The state committee of psychologists
886-shall require applicants to submit fingerprints to the
887-Missouri state highway patrol for the purpose of conducting
888-a state and federal fingerprint -based criminal history
889-background check.
890- 2. The state committee of psychologists may require
891-that such fingerprint submissions be made as part of an
892-application seeking licensure as a licensed psychologist,
893-provisional licensed psychologist, and temporary license for
894-a licensed psychologist.
895- 3. The fingerprints and any required fees shall be
896-sent to the Missouri state highway patrol's central
897-repository. The fingerprints shall be used for searching
898-the state criminal records repository and shall also be
899-forwarded to the Federal Bureau of Investigation for a
900-federal criminal records search un der section 43.540. The
901-Missouri state highway patrol shall notify the state
902-committee of psychologists of any criminal history record
903-information or lack of criminal history record information
904-discovered on the individual. Notwithstanding the
905-provisions of section 610.120 to the contrary, all records
906-related to any criminal history information discovered shall
907-be accessible and available to the state committee of
908-psychologists.
909- 337.308. 1. The behavior analyst advisory board sha ll
910-require applicants to submit fingerprints to the Missouri
911-state highway patrol for the purpose of conducting a state
912-and federal fingerprint -based criminal history background
913-check.

915- 2. The behavior analyst advisory board may require
916-that such fingerprint submissions be made as part of an
917-application seeking licensure, provisional licensure, or
918-temporary licensure as a licensed behavior analyst or a
919-licensed assistant behavior analyst, as such terms are
920-defined in section 337.300.
921- 3. The fingerprints and any required fees shall be
922-sent to the Missouri state highway patrol's central
923-repository. The fingerprints shall be used for searching
924-the state criminal records repository and shall also be
925-forwarded to the Federal Bureau of Inv estigation for a
926-federal criminal records search under section 43.540. The
927-Missouri state highway patrol shall notify the behavior
928-analyst advisory board of any criminal history record
929-information or lack of criminal history record information
930-discovered on the individual. Notwithstanding the
931-provisions of section 610.120 to the contrary, all records
932-related to any criminal history information discovered shall
933-be accessible and available to the behavior analyst advisory
934-board.
935- 337.501. 1. The committee for professional counselors
936-shall require applicants to submit fingerprints to the
937-Missouri state highway patrol for the purpose of conducting
938-a state and federal fingerprint -based criminal history
939-background check.
940- 2. The committee for professional counselors may
941-require that such fingerprint submissions be made as part of
942-an application seeking licensure as a licensed professional
943-counselor and provisional licensed professional counselor,
944-as defined in section 337.50 0.
945- 3. The fingerprints and any required fees shall be
946-sent to the Missouri state highway patrol's central
947-repository. The fingerprints shall be used for searching

949-the state criminal records repository and shall also be
950-forwarded to the Federal B ureau of Investigation for a
951-federal criminal records search under section 43.540. The
952-Missouri state highway patrol shall notify the committee for
953-professional counselors of any criminal history record
954-information or lack of criminal history record i nformation
955-discovered on the individual. Notwithstanding the
956-provisions of section 610.120 to the contrary, all records
957-related to any criminal history information discovered shall
958-be accessible and available to the committee for
959-professional counsel ors.
960- 337.605. 1. The state committee for social workers
961-shall require applicants to submit fingerprints to the
962-Missouri state highway patrol for the purpose of conducting
963-a state and federal fingerprint -based criminal history
964-background check.
965- 2. The state committee for social workers may require
966-that such fingerprint submissions be made as part of an
967-application seeking a license or a temporary permit to
968-practice as a licensed clinical social worker, licensed
969-advanced macro social worker, licensed master social worker,
970-and licensed baccalaureate social worker, as such terms are
971-defined in section 337.600 and as provided in section
972-337.621.
973- 3. The fingerprints and any required fees shall be
974-sent to the Missouri state highway patrol's central
975-repository. The fingerprints shall be used for searching
976-the state criminal records repository and shall also be
977-forwarded to the Federal Bureau of Investigation for a
978-federal criminal records search under section 43.540. The
979-Missouri state highway patrol shall notify the state
980-committee for social workers of any criminal history record
981-information or lack of criminal history record information

983-discovered on the individual. Notwithstanding the
984-provisions of section 610. 120 to the contrary, all records
985-related to any criminal history information discovered shall
986-be accessible and available to the state committee for
987-social workers.
988- 337.702. 1. The state committee of marital and family
989-therapists shall require applicants to submit fingerprints
990-to the Missouri state highway patrol for the purpose of
991-conducting a state and federal fingerprint -based criminal
992-history background check.
993- 2. The state committee of marital and family
994-therapists may require that such fingerprint submissions be
995-made as part of an application seeking licensure as a
996-licensed marital and family therapist or provisional
997-licensed marital and family therapist as such terms are
998-defined in section 337.700.
999- 3. The fingerprints and any required fees shall be
1000-sent to the Missouri state highway patrol's central
1001-repository. The fingerprints shall be used for searching
1002-the state criminal records repository and shall also be
1003-forwarded to the Federal Bureau of Investigatio n for a
1004-federal criminal records search under section 43.540. The
1005-Missouri state highway patrol shall notify the state
1006-committee of marital and family therapists of any criminal
1007-history record information or lack of criminal history
1008-record information discovered on the individual.
1009-Notwithstanding the provisions of section 610.120 to the
1010-contrary, all records related to any criminal history
1011-information discovered shall be accessible and available to
1012-the state committee of marital and family therap ists.
1013- 338.052. 1. The board of pharmacy shall require
1014-applicants to submit fingerprints to the Missouri state
1015- 31
1016-highway patrol for the purpose of conducting a state and
1017-federal fingerprint-based criminal history background check.
1018- 2. The board of pharmacy may require that such
1019-fingerprint submissions be made as part of an application
1020-seeking a license to practice pharmacy as a pharmacist, a
1021-certificate of registration as a pharmacy technician, a
1022-license as an intern pharmacist, a license as a wholesale
1023-drug distributor, a license as a third -party logistics
1024-provider, a temporary license as a pharmacist, a permit for
1025-the practice of pharmacy to be conducted at a pharmacy, and
1026-a license as a drug outsourcer, as provided in sectio ns
1027-338.010, 338.013, 338.035, 338.043, 338.050, 338.210, and
1028-338.330, and a manager -in-charge, wholesale drug distributor
1029-facility manager, third -party logistics provider facility
1030-manager, wholesale drug distributor facility owner, or third -
1031-party logistics provider facility owner, as such terms are
1032-defined in subsection 4 of this section.
1033- 3. The fingerprints and any required fees shall be
1034-sent to the Missouri state highway patrol's central
1035-repository. The fingerprints shall be used for search ing
1036-the state criminal records repository and shall also be
1037-forwarded to the Federal Bureau of Investigation for a
1038-federal criminal records search under section 43.540. The
1039-Missouri state highway patrol shall notify the board of
1040-pharmacy of any crimi nal history record information or lack
1041-of criminal history record information discovered on the
1042-individual. Notwithstanding the provisions of section
1043-610.120 to the contrary, all records related to any criminal
1044-history information discovered shall be accessible and
1045-available to the board of pharmacy.
1046- 4. For purposes of this section, the following terms
1047-mean:
1048- 32
1049- (1) "Manager-in-charge", a person who directly
1050-supervises a licensed wholesale drug distributor or a third -
1051-party logistics provide r, as such terms are defined in
1052-section 338.330, and whose fingerprints are required by
1053-federal or state law for licensure of a wholesale drug
1054-distributor facility or third -party logistics provider
1055-facility;
1056- (2) "Third-party logistics provider fa cility manager",
1057-a person who is a manager and direct supervisor of a
1058-licensed third-party logistics provider, as such term is
1059-defined in section 338.330, and whose fingerprints are
1060-required by federal or state law for licensure of a third -
1061-party logistics provider facility;
1062- (3) "Third-party logistics provider facility owner", a
1063-person who is an owner with greater than ten percent
1064-ownership interest of a licensed third -party logistics
1065-provider, as such term is defined in section 338.330, and
1066-whose fingerprints are required by federal or state law for
1067-licensure of a third -party logistics provider facility;
1068- (4) "Wholesale drug distributor facility manager", a
1069-person who is a manager of a wholesale drug distributor, as
1070-such term is defined in section 338.330, and whose
1071-fingerprints are required by federal or state law for
1072-licensure of a wholesale drug distributor facility;
1073- (5) "Wholesale drug distributor facility owner", a
1074-person who is an owner with greater than ten percent
1075-ownership interest of a licensed wholesale drug distributor,
1076-as such term is defined in section 338.330, and whose
1077-fingerprints are required by federal or state law for
1078-licensure of a wholesale drug distributor facility.
1079- 339.015. 1. The Missouri real estate commission shall
1080-require applicants to submit fingerprints to the Missouri
1081-state highway patrol for the purpose of conducting a state
1082- 33
1083-and federal fingerprint -based criminal history background
1084-check.
1085- 2. The Missouri real estate commission may require
1086-that such fingerprint submissions be made as part of an
1087-application seeking licensure as a real estate broker, real
1088-estate salesperson, and real estate broker -salesperson, as
1089-such terms are defined in section 339.010 and as provi ded in
1090-sections 339.030 and 339.040.
1091- 3. The fingerprints and any required fees shall be
1092-sent to the Missouri state highway patrol's central
1093-repository. The fingerprints shall be used for searching
1094-the state criminal records repository and shall also be
1095-forwarded to the Federal Bureau of Investigation for a
1096-federal criminal records search under section 43.540. The
1097-Missouri state highway patrol shall notify the Missouri real
1098-estate commission of any criminal history record information
1099-or lack of criminal history record information discovered on
1100-the individual. Notwithstanding the provisions of section
1101-610.120 to the contrary, all records related to any criminal
1102-history information discovered shall be accessible and
1103-available to the Missou ri real estate commission.
1104- 339.510. 1. The Missouri real estate appraisers
1105-commission shall require applicants to submit fingerprints
1106-to the Missouri state highway patrol for the purpose of
1107-conducting a state and federal fingerprint -based criminal
1108-history background check.
1109- 2. The Missouri real estate appraisers commission may
1110-require that such fingerprint submissions be made as part of
1111-an application seeking licensure as a certified residential
1112-appraiser, a certified residenti al appraiser trainee, a
1113-certified general appraiser, a certified general appraiser
1114-trainee, a licensed appraiser, a licensed appraiser trainee,

1119- 3. The fingerprints and any required fees shall be
1120-sent to the Missouri state highway patrol's central
1121-repository. The fingerprints shall be used for searching
1122-the state criminal records repository and shall also b e
1123-forwarded to the Federal Bureau of Investigation for a
1124-federal criminal records search under section 43.540. The
1125-Missouri state highway patrol shall notify the Missouri real
1126-estate appraisers commission of any criminal history record
1127-information or lack of criminal history record information
1128-discovered on the individual. Notwithstanding the
1129-provisions of section 610.120 to the contrary, all records
1130-related to any criminal history information discovered shall
1131-be accessible and available to the M issouri real estate
1132-appraisers commission.
1133- 4. For purposes of this section, the following terms
1134-mean:
1135- (1) "Appraisal management company", a person that
1136-utilizes an appraisal panel and performs appraisal
1137-management services, as defined in su bdivision (2) of this
1138-subsection, and who has met the qualifications for licensure
1139-as set forth in 20 CSR 2245 -10.010 and 10.040;
1140- (2) "Appraisal management services", to perform any of
1141-the following functions on behalf of a lender, financial
1142-institution, client, or any other person:
1143- (a) Administer an appraiser panel;
1144- (b) Recruit, qualify, verify licensing or
1145-certification, and negotiate fees and service level
1146-expectations with persons who are part of an appraiser panel;
1147- (c) Receive an order for an appraisal from one person
1148-and deliver the order for the appraisal to an appraiser that
1149-is part of an appraiser panel for completion;

1151- (d) Track and determine the status of orders for
1152-appraisals performed by appraisers who are p art of an
1153-appraisal panel;
1154- (e) Conduct quality control of a completed appraisal
1155-performed by an appraiser who is part of an appraisal panel
1156-prior to the delivery of the appraisal to the person who
1157-ordered the appraisal; and
1158- (f) Provide a completed appraisal performed by an
1159-appraiser who is part of an appraisal panel to one or more
1160-persons who have ordered an appraisal;
1161- (3) "Certified general appraiser", an individual who
1162-is qualified by education, experience, and examination to
1163-appraise any real property pursuant to 20 CSR 2245 -9 and
1164-whose fingerprints are required for licensure pursuant to 20
1165-CSR 2245-3.010 and 12 CFR Chapter XI;
1166- (4) "Certified general appraiser trainee", an
1167-individual who, under supervision, is qualified to appraise
1168-certain real property pursuant to 20 CSR 2245 -9 and whose
1169-fingerprints are required for licensure pursuant to 20 CSR
1170-2245-6.017(3) and 12 CFR Chapter XI;
1171- (5) "Certified residential appraiser", an individual
1172-who is qualified by educati on, experience, and examination
1173-to appraise certain real property pursuant to 20 CSR 2245 -9
1174-and whose fingerprints are required for licensure pursuant
1175-to 20 CSR 2245-3.010 and 12 CFR Chapter XI;
1176- (6) "Certified residential appraiser trainee", an
1177-individual who, under supervision, is qualified to appraise
1178-certain real property pursuant to 20 CSR 2245 -9 and whose
1179-fingerprints are required for licensure pursuant to 20 CSR
1180-2245-6.017(3) and 12 CFR Chapter XI;
1181- (7) "Controlling person of an appr aisal management
1182-company":
1183- (a) An owner of an appraisal management company;
1184- 36
1185- (b) An individual employed, appointed, or authorized
1186-by an appraisal management company that has the authority to
1187-enter into a contractual relationship with other pe rsons for
1188-the performance of appraisal management services and has the
1189-authority to enter into agreements with appraisers for the
1190-performance of appraisals; or
1191- (c) An individual who possesses the power to direct or
1192-cause the direction of the mana gement or policies of an
1193-appraisal management company whose fingerprints are required
1194-for licensure pursuant to 20 CSR 2245 -10.010 and 12 CFR
1195-Chapter XI;
1196- (8) "Owner of an appraisal management company", a
1197-person who owns ten percent or more of a l icensed appraisal
1198-management company and whose fingerprints are required for
1199-licensure pursuant to 20 CSR 2245 -10.010 and 12 CFR Chapter
1200-XI;
1201- (9) "State-licensed appraiser", an individual who is
1202-qualified by education, experience, and examination to
1203-appraise certain real property pursuant to 20 CSR 2245 -9 and
1204-whose fingerprints are required for licensure pursuant to 20
1205-CSR 2245-3.010 and 12 CFR Chapter XI;
1206- (10) "State-licensed appraiser trainee", an individual
1207-who, under supervision, is q ualified to appraise certain
1208-real property pursuant to 20 CSR 2245 -9 and whose
1209-fingerprints are required for licensure pursuant to 20 CSR
1210-2245-6.017(3) and 12 CFR Chapter XI.
1211- 345.016. 1. The state board of registration for the
1212-healing arts shall require applicants to submit fingerprints
1213-to the Missouri state highway patrol for the purpose of
1214-conducting a state and federal fingerprint -based criminal
1215-history background check.
1216- 2. The state board of registration for the healing
1217-arts may require that such fingerprint submissions be made
1218- 37
1219-as part of an application seeking a license, as described in
1220-section 345.020, or provisional license, as described in
1221-section 345.021, as an audiologist, an audiology aide, a
1222-speech-language pathologist, a speech-language pathology
1223-aide, and a speech-language pathology assistant, as such
1224-terms are defined in section 345.015.
1225- 3. The fingerprints and any required fees shall be
1226-sent to the Missouri state highway patrol's central
1227-repository. The fingerprints shall be used for searching
1228-the state criminal records repository and shall also be
1229-forwarded to the Federal Bureau of Investigation for a
1230-federal criminal records search under section 43.540. The
1231-Missouri state highway patrol shal l notify the state board
1232-of registration for the healing arts of any criminal history
1233-record information or lack of criminal history record
1234-information discovered on the individual. Notwithstanding
1235-the provisions of section 610.120 to the contrary, al l
1236-records related to any criminal history information
1237-discovered shall be accessible and available to the state
1238-board of registration for the healing arts.
1239- 374.711. 1. The department of commerce and insurance
1240-shall require applicants for a license, and may require
1241-applicants for renewal of a license, to submit fingerprints
1242-to the Missouri state highway patrol for the purpose of
1243-conducting a state and federal fingerprint -based criminal
1244-history background check.
1245- 2. The department may require that such fingerprint
1246-submissions be made as part of an application seeking a
1247-license, or renewal of a license, for a general bail bond
1248-agent, a bail bond agent, or a surety recovery agent, as
1249-such terms are defined in section 374.700.
1250- 3. The fingerprints and any required fees shall be
1251-sent to the Missouri state highway patrol's central
1252- 38
1253-repository. The fingerprints shall be used for searching
1254-the state criminal records repository and shall also be
1255-forwarded to the Federal Burea u of Investigation for a
1256-federal criminal records search under section 43.540. The
1257-Missouri state highway patrol shall notify the department of
1258-any criminal history record information or lack of criminal
1259-history record information discovered on the in dividual.
1260-Notwithstanding the provisions of section 610.120 to the
1261-contrary, all records related to any criminal history
1262-information discovered shall be accessible and available to
1263-the department.
1264- 436.225. 1. The director of the divi sion of
1265-professional registration shall require applicants to submit
1266-fingerprints to the Missouri state highway patrol for the
1267-purpose of conducting a state and federal fingerprint -based
1268-criminal history background check.
1269- 2. The director of the d ivision of professional
1270-registration may require that such fingerprint submissions
1271-be made as part of an application seeking licensure as an
1272-athlete agent.
1273- 3. The fingerprints and any required fees shall be
1274-sent to the Missouri state highway patr ol's central
1275-repository. The fingerprints shall be used for searching
1276-the state criminal records repository and shall also be
1277-forwarded to the Federal Bureau of Investigation for a
1278-federal criminal records search under section 43.540. The
1279-Missouri state highway patrol shall notify the director of
1280-the division of professional registration of any criminal
1281-history record information or lack of criminal history
1282-record information discovered on the individual.
1283-Notwithstanding the provisions of sectio n 610.120 to the
1284-contrary, all records related to any criminal history
1285- 39
1286-information discovered shall be accessible and available to
1287-the director of the division of professional registration.
1288- 4. For purposes of this section, the term "athlete
1289-agent" means an individual who:
1290- (1) Recruits or solicits a student athlete to enter
1291-into an agency contract or, for compensation, procures
1292-employment or offers, promises, attempts, or negotiates to
1293-obtain employment for a student athlete as a professio nal
1294-athlete or member of a professional sports team or
1295-organization;
1296- (2) For compensation or in anticipation of
1297-compensation related to a student athlete's participation in
1298-athletics:
1299- (a) Serves the student athlete in an advisory capacity
1300-on a matter related to finances, business pursuits, or
1301-career management decisions, unless the individual is an
1302-employee of an educational institution acting exclusively as
1303-an employee of the educational institution for the benefit
1304-of the educational i nstitution; or
1305- (b) Manages the business affairs of the student
1306-athlete by providing assistance with bills, payments,
1307-contracts, or taxes; or
1308- (3) In anticipation of representing a student athlete
1309-for a purpose related to the student athlete's participation
1310-in athletics:
1311- (a) Gives consideration to the student athlete or
1312-another person;
1313- (b) Serves the student athlete in an advisory capacity
1314-on a matter related to finances, business pursuits, or
1315-career management decisions; or
1316- (c) Manages the business affairs of the student
1317-athlete by providing assistance with bills, payments,
1318-contracts, or taxes;

1320- 443.702. 1. The division of finance shall require
1321-applicants to submit fingerprints to the Missouri state
1322-highway patrol for the purpose of conducting a state and
1323-federal fingerprint-based criminal history background check.
1324- 2. The division of finance may require that such
1325-fingerprint submissions be made as part of an application
1326-seeking licensure to act as a residential mortgage loan
1327-broker or a mortgage loan broker.
1328- 3. The fingerprints and any required fees shall be
1329-sent to the Missouri state highway patrol's central
1330-repository. The fingerprints shall be used for searching
1331-the state criminal records repository and shall also be
1332-forwarded to the Federal Bureau of Investigation for a
1333-federal criminal records search under section 43.540. The
1334-Missouri state highway patrol shall notify the division of
1335-finance of any criminal history record inf ormation or lack
1336-of criminal history record information discovered on the
1337-individual. Notwithstanding the provisions of section
1338-610.120 to the contrary, all records related to any criminal
1339-history information discovered shall be accessible and
1340-available to the division of finance.
1341- 4. For purposes of this section, the following terms
1342-mean:
1343- (1) "Mortgage loan originator", an individual who for
1344-compensation or gain or in the expectation of compensation
1345-or gain takes a residential mortgage loan application, or
1346-offers or negotiates terms of a residential mortgage loan.
1347-Mortgage loan originator does not include:
1348- (a) An individual engaged solely as a loan processor
1349-or underwriter except as otherwise provided in sections
1350-443.701 to 443.893;
1351- (b) A person that only performs real estate brokerage
1352-activities and is licensed or registered in accordance with
1353- 41
1354-the law of this state, unless the person is compensated by a
1355-lender, a mortgage broker, or other mortgage loan originator
1356-or by any agent of such lender, mortgage broker, or other
1357-mortgage loan originator;
1358- (c) A person solely involved in extensions of credit
1359-relating to time-share plans, as the term time -share plans
1360-is defined in 11 U.S.C. Section 101(53D);
1361- (d) An individual who is servicing a mortgage loan; and
1362- (e) A person employed by a licensed mortgage broker or
1363-loan originator who accepts or receives residential mortgage
1364-loan applications;
1365- (2) "Residential mortgage loan broker", any person,
1366-other than an exempt person, engaged in the business of
1367-brokering, funding, servicing, or purchasing residential
1368-mortgage loans.
1369- 484.125. 1. The Missouri supreme court shall submit
1370-fingerprints to the Missouri state highway patrol for the
1371-purpose of conducting a state and federal fingerprint -based
1372-criminal history background check on applicants for
1373-admission or reinstatement to the Missouri Bar.
1374- 2. The Missouri supreme court may require that such
1375-fingerprint submissions be made as part of an application of
1376-licensure for admission or reinstatement to the Missouri Bar
1377-in order to engage in the practice of law or law business,
1378-as such terms are defined in section 484.010.
1379- 3. The fingerprints and any required fees shall be
1380-sent to the Missouri state highway patrol's central
1381-repository. The fingerprints shall be used for searching
1382-the state criminal records repository and shall also be
1383-forwarded to the Federal Bureau of Investigation for a
1384-federal criminal records search u nder section 43.540. The
1385-Missouri state highway patrol shall notify the Missouri
1386-supreme court of any criminal history record information or
1387- 42
1388-lack of criminal history record information discovered on
1389-the individual. Notwithstanding the provisions of s ection
1390-610.120 to the contrary, all records related to any criminal
1391-history information discovered shall be accessible and
1392-available to the Missouri supreme court.
1393- 640.011. 1. The department of natural resources shall
1394-require applicants to submit fingerprints to the Missouri
1395-state highway patrol for the purpose of conducting a state
1396-and federal fingerprint -based criminal history background
1397-check.
1398- 2. The department of natural resources may require
1399-that such fingerprint submiss ion be made as part of an
1400-application seeking employment or to volunteer with the
1401-department of natural resources.
1402- 3. The fingerprints and any required fees shall be
1403-sent to the Missouri state highway patrol's central
1404-repository. The fingerprints shall be used for searching
1405-the state criminal records repository and shall also be
1406-forwarded to the Federal Bureau of Investigation for a
1407-federal criminal records search under section 43.540. The
1408-Missouri state highway patrol shall notify the depar tment of
1409-natural resources of any criminal history record information
1410-or lack of criminal history record information discovered on
1411-the individual. Notwithstanding the provisions of section
1412-610.120 to the contrary, all records related to any criminal
1413-history information discovered shall be accessible and
1414-available to the department of natural resources.

46+ 43.549. The Missouri state highway patrol shall notify 1
47+the office of athlete agents within the division of 2
48+professional registration of the department of commerce and 3
49+insurance of any criminal history record information or lack 4
50+of criminal history record information discovered on the 5
51+individual. Notwithstanding the provisions of section 6
52+610.120 to the contrary, all records related to any criminal 7
53+history information d iscovered shall be accessible and 8
54+available to the office of athlete agents. 9
55+ 168.014. 1. The state board of education shall 1

84+require that such fingerprint submissions be made as part of 7
85+an application seeking licensure as an emergency medical 8
86+technician or "EMT", advanced emergency medical technician 9
87+or "AEMT", a paramedic, and an application seeking 10
88+certification as an emergency medical technician -community 11
89+paramedic or "EMT-CP". 12

109+ 2. The Missouri Medicaid audit and compliance unit may 6
110+require that such fingerprint submissions be made as part of 7
111+an application seeking to be licensed as a MO HealthNet 8

136+providing services to eligible persons, and obtaining from 33

192+ 2. The division of alcohol and tobacco control may 7
193+require that such fingerprint submissions be made as part of 8 SB 875 7
194+an application seeking a liquor license or permit, as 9

212+the Missouri state highway patrol for the purpose of 3
213+conducting a state and federal fingerprint -based criminal 4
214+history background check. 5
215+ 2. The Missouri board of occupational therapy may 6
216+require that such fingerprint submissions be made a s part of 7
217+an application seeking licensure as an occupational 8
218+therapist, an occupational therapy assistant, or a limited 9
219+permit to practice occupational therapy, as such terms are 10
220+defined in section 324.050 and as provided in section 11
221+324.077. 12
222+ 3. The fingerprints and any required fees shall be 13
223+sent to the Missouri state highway patrol's central 14
224+repository. The fingerprints shall be used for searching 15

750+338.010, 338.013, 338.035, 338.043, 338.050, 338.210, and 14
751+338.330, and a manager -in-charge, manager, or owner of a 15
752+wholesale drug distributor facility or third -party logistics 16
753+provider facility. 17
754+ 3. The fingerprints and any required fees shall be 18
755+sent to the Missouri state highway patrol's central 19
756+repository. The fingerprints shall be used for searching 20
757+the state criminal records repository and shall also be 21
758+forwarded to the Federal Bureau of Investigation for a 22
759+federal criminal records search under section 43.540. The 23
760+Missouri state highway patrol shall notify the board of 24
761+pharmacy of any criminal history record information or lack 25
762+of criminal history record information discovered on the 26
763+individual. Notwithstanding the provisions of section 27

771+party logistics provider, as such term is defined in section 35
772+338.330, and whose fingerprints are required by federal or 36
773+state law for licensure of a drug distributor or third -party 37
774+logistics provider facility; 38
775+ (2) "Third-party logistics provider fac ility manager", 39
776+a person who is a manager and direct supervisor of a 40
777+licensed third-party logistics provider, as such term is 41
778+defined in section 338.330, and whose fingerprints are 42
779+required by federal and state law for licensure of a third - 43
780+party logistics facility; 44
781+ (3) "Third-party logistics facility owner", a person 45
782+who is an owner with greater than ten percent ownership 46
783+interest of a licensed third -party logistics provider, as 47
784+such term is defined in section 338.330, and whose 48
785+fingerprints are required by federal and state law for 49
786+licensure of a third -party logistics facility; 50
787+ (4) "Wholesale drug distributor facility manager", a 51
788+person who is a manager of a licensed third -party logistics 52
789+provider, as such term is defined in section 338.330, and 53
790+whose fingerprints are required by federal or state law for 54
791+licensure of a drug distributor facility; 55
792+ (5) "Wholesale drug distributor facility owner", a 56
793+person who is an owner with greater than ten percent 57
794+ownership interest of a lic ensed wholesale drug distributor 58
795+facility, as such term is defined in section 338.330, and 59
796+whose fingerprints are required by federal or state law for 60
797+licensure of a wholesale drug distributor facility. 61 SB 875 26
798+ 339.015. 1. The Missouri real estate commission shall 1
799+require applicants to submit fingerprints to the Missouri 2
800+state highway patrol for the purpose of conducting a state 3
801+and federal fingerprint -based criminal history background 4

823+commission shall require applicants to submit fingerprints 2
824+to the Missouri state highway patrol for the purpose of 3
825+conducting a state and federal fingerprint -based criminal 4

848+be accessible and available to t he Missouri real estate 27
849+appraisers commission. 28

851+healing arts shall require applicants to submit fingerprints 2
852+to the Missouri state highway patrol for the purpose of 3
853+conducting a state and federal fingerprint -based criminal 4
854+history background check. 5
855+ 2. The state board of registration for the healing 6
856+arts may require that such fingerprint submissions be made 7
857+as part of an application seeking a license, or provisional 8
858+license, as an audiologist, an audiology aide, a speech - 9
859+language pathologist, a speech -language pathology aide, and 10
860+a speech-language pathology assistant, as such terms are 11 SB 875 28
861+defined in section 345.015 and as provided in sections 12
862+345.021 and 345.085. 13
863+ 3. The fingerprints and any required fees shall be 14
864+sent to the Missouri state highway patrol's central 15
865+repository. The fingerprints shall be used for searching 16

867+forwarded to the Federal Bureau of Inve stigation for a 18
868+federal criminal records search under section 43.540. The 19
869+Missouri state highway patrol shall notify the state board 20
870+of registration for the healing arts of any criminal history 21
871+record information or lack of criminal history record 22
872+information discovered on the individual. Notwithstanding 23
873+the provisions of section 610.120 to the contrary, all 24
874+records related to any criminal history information 25
875+discovered shall be accessible and available to the state 26
876+board of registration for the healing arts. 27
877+ 374.711. 1. The department of commerce and insurance 1
878+shall require applicants for a license, and may require 2
879+applicants for renewal of a license, to submit fingerprints 3
880+to the Missouri state highway patrol for the purp ose of 4
881+conducting a state and federal fingerprint -based criminal 5
882+history background check. 6
883+ 2. The department may require that such fingerprint 7
884+submissions be made as part of an application seeking a 8
885+license, or renewal of a license, for a general bail bond 9
886+agent, a bail bond agent, or a surety recovery agent. 10

888+sent to the Missouri state highway patrol's central 12
889+repository. The fingerprints shall be used for searching 13

917+sections 443.701 to 443.893, may require app licants seeking 3
918+licensure as a mortgage loan broker, or mortgage loan 4

920+highway patrol for the purpose of conducting a state and 6

936+to the Missouri state highway patrol for the purpose of 2
937+conducting a state and federal fingerprint -based criminal 3

941+admission or reinstatement to the Missouri Bar for purposes 7
942+of licensure to practice law as an attorney or counselor in 8
