1010 To repeal section 336.010, RSMo, and to enact in lieu thereof one new section relating to the

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Section 336.010, RSMo, is repealed and one new 1
1515 section enacted in lieu thereof, to be known as section 336.010, 2
1616 to read as follows:3
1717 336.010. 1. The "practice of optometry" is the 1
1818 examination, diagnosis, [treatment, and preventative care ] 2
1919 prevention, and treatment, surgical or nonsurgical, of the 3
2020 eye, adnexa, and vision. The practice includes, but is not 4
2121 limited to: 5
2222 (1) The examination of the eye, a dnexa, and vision to 6
2323 determine the accommodative and refractive states, visual 7
2424 perception, conditions, and diseases; 8
2525 (2) The diagnosis and treatment of conditions or 9
2626 diseases of the eye, adnexa, and vision; 10
2727 (3) The performance of diagnostic procedures and 11
2828 ordering of laboratory and imaging tests for the diagnosis 12
2929 of vision and conditions and diseases of the eye and adnexa; 13
3030 (4) The prescription and administration of 14
3131 pharmaceutical agents [, excluding injectable agents, ] for 15
3232 the purpose of examination, diagnosis, and treatment of 16
3333 vision and conditions or diseases of the eye and adnexa; 17 SB 956 2
3434 (5) The removal of superficial foreign bodies from the 18
3535 eye or adnexa; 19
3636 (6) Notwithstanding the provisions of any other law to 20
3737 the contrary, including section 334.010, the correction and 21
3838 relief of ocular abnormalities by surgical procedures not 22
3939 excluded under subsection 2 of this section; 23
4040 (7) The employment of objective or subjective 24
4141 mechanical means to determine the accommodative or 25
4242 refractive states of the human eye; 26
4343 [(7)] (8) The prescription or adaptation of lenses, 27
4444 prisms, devices, or ocular exercises to correct defects or 28
4545 abnormal conditions of the human eye or vision or to adjust 29
4646 the human eye to special conditions; 30
4747 [(8)] (9) The prescription and fitting of ophthalmic 31
4848 or contact lenses and devices; 32
4949 [(9)] (10) The prescription and administration of 33
5050 vision therapy; and 34
5151 [(10)] (11) The prescription and administration of low 35
5252 vision care. 36
5353 2. An optometrist [may] shall not perform [surgery, 37
5454 including the use of lasers for treatment of any disease or 38
5555 condition or for the correction of refractive error ] the 39
5656 following procedures, except for the preoperative and 40
5757 postoperative care of these procedures : 41
5858 (1) Retina laser procedures, laser -assisted in situ 42
5959 keratomileusis (LASIK), and photorefractive keratectomy 43
6060 (PRK); 44
6161 (2) Nonlaser surgery related to removal of the eye 45
6262 from a living human being; 46
6363 (3) Nonlaser surgery requiring full thic kness incision 47
6464 or excision of the cornea or sclera other than paracentesis 48 SB 956 3
6565 in an emergency situation requiring immediate reduction of 49
6666 the pressure inside the eye; 50
6767 (4) Penetrating keratoplasty (corneal transplant) or 51
6868 lamellar keratoplasty; 52
6969 (5) Nonlaser surgery requiring incision of the iris 53
7070 and ciliary body, including iris diathermy or cryotherapy; 54
7171 (6) Nonlaser surgery requiring incision of the 55
7272 vitreous; 56
7373 (7) Nonlaser surgery requiring incision of the retina; 57
7474 (8) Nonlaser surgical extraction of the crystalline 58
7575 lens; 59
7676 (9) Nonlaser surgical intraocular implants; 60
7777 (10) Incisional or excisional nonlaser surgery of the 61
7878 extraocular muscles; 62
7979 (11) Nonlaser surgery of the eyelid for eyelid 63
8080 malignancies or for incis ional cosmetic or mechanical repair 64
8181 of blepharochalasis, ptosis, and tarsorrhaphy; 65
8282 (12) Nonlaser surgery of the bony orbit, including 66
8383 orbital implants; 67
8484 (13) Incisional or excisional nonlaser surgery of the 68
8585 lacrimal system other than lacrimal probing or related 69
8686 procedures; 70
8787 (14) Nonlaser surgery requiring full thickness 71
8888 conjunctivoplasty with graft or flap; 72
8989 (15) Any nonlaser surgical procedure that does not 73
9090 provide for the correction and relief of ocular 74
9191 abnormalities; 75
9292 (16) Laser or nonlaser injection into the posterior 76
9393 chamber of the eye to treat any macular or retinal disease; 77
9494 and 78
9595 (17) The administration of general anesthesia . 79 SB 956 4
9696 3. As used in this chapter, except as the context may 80
9797 otherwise require, the foll owing terms mean: 81
9898 (1) "Eye", the human eye; 82
9999 (2) "Adnexa", all structures adjacent to the eye and 83
100100 the conjunctiva, lids, lashes, and lacrimal system; 84
101101 (3) "Board", the Missouri state board of optometry; 85
102102 (4) "Diagnostic pharmaceut ical agents", topically 86
103103 applied pharmaceuticals used for the purpose of conducting 87
104104 an examination of the eye, adnexa, and vision; 88
105105 (5) "Low vision care", the examination, treatment, and 89
106106 management of patients with visual impairments not treatable 90
107107 by conventional eyewear or contact lenses and may include a 91
108108 vision rehabilitation program to enhance remaining vision 92
109109 skills; 93
110110 (6) "Pharmaceutical agents", any diagnostic and 94
111111 therapeutic drug or combination of drugs that assist the 95
112112 diagnosis, prevention, treatment, or mitigation of abnormal 96
113113 conditions or symptoms of the human eye, adnexa, and vision; 97
114114 (7) "Therapeutic pharmaceutical agents", those 98
115115 pharmaceuticals[, excluding injectable agents, ] used for the 99
116116 treatment of conditions or dis eases of the eye, adnexa, and 100
117117 vision; 101
118118 (8) "Vision therapy", a treatment regiment to improve 102
119119 a patient's diagnosed visual dysfunctions, prevent the 103
120120 development of visual problems, or enhance visual 104
121121 performance to meet the defined needs of the pat ient. 105
