1212 191.227.1.Allphysicians,chiropractors,hospitals,dentists,andotherdulylicensed
1313 2practitionersinthisstate,hereincalled"providers",shall,uponwrittenrequestofapatient,or
1414 3guardianorlegallyauthorizedrepresentativeofapatient,furnishacopyofhisorherrecord
1515 4ofthatpatient'shealthhistoryandtreatmentrenderedtothepersonsubmittingawritten
1616 5request,exceptthatsuchrightshallbelimitedtoaccessconsistentwiththepatient'scondition
1717 6andsoundtherapeutictreatmentasdeterminedbytheprovider.BeginningAugust28,1994,
1818 7suchrecordshallbefurnishedwithinareasonabletimeofthereceiptoftherequesttherefor

6868 56administrator,oragenthasnotbeenappointed,thedeceasedpriortodeathdidnotspecifically
6969 57objecttodisclosureofhisorherrecordsinwriting,andsuchdisclosureisnotinconsistent
7070 58withanypriorexpressedpreferenceofthedeceasedthatisknowntothehealthcareprovider,
7171 59adeceasedpatient'shealthcarerecordsmaybereleaseduponwrittenrequestofapersonwho
7272 60isdeemedasthepersonalrepresentativeofthedeceasedpersonunderthissubsection.
7373 61Priorityshallbegiventothedeceasedpatient'sspouseandtherecordsshallbereleasedonthe
7474 62affidavitofthesurvivingspousethatheorsheisthesurvivingspouse.Ifthereisnosurviving
7575 63spouse,thehealthcarerecordsmaybereleasedtooneofthefollowingpersons:
7676 64 (1)Theactingtrusteeofatrustcreatedbythedeceasedpatienteitheraloneorwith
7777 65thedeceasedpatient'sspouse;
7878 66 (2)Anadultchildofthedeceasedpatientontheaffidavitoftheadultchildthatheor
7979 67sheistheadultchildofthedeceased;
8080 68 (3)Aparentofthedeceasedpatientontheaffidavitoftheparentthatheorsheisthe
