SectionA.Chapter319,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection319.032,toreadasfollows:
319.032.1.Uponreceivinganoticeofintenttoexcavatefromanexcavator,the
2notificationcentershallpromptlytransmitalldetailsofsuchnoticesubmittedunder
3section319.026tothedepartmentofnaturalresources.Thedepartmentshall
4immediatelymakethefollowingdeterminationsandnotifytheexcavatorofsuch
5determinations:
6 (1)Determinewhethertheexcavationlocationiswithinasite:
7 (a)Onwhichthedepartmentisoverseeinganyenvironmentalremediationatthe
8timeoftheproposedexcavation;
9 (b)Thatrequiresaremedialresponse,assuchsiteisdescribedbythe
10departmentorinaUnitedStatesEnvironmentalProtectionAgencyrecordofdecision;
11or
12 (c)Forwhichenvironmentalremediationhasbeencompleted;or
13 (2)Determinewhethertheexcavationlocationiswithinasitethatis:
14 (a)Underenvironmentalinvestigationbythedepartment;or
15 (b)Listedonthedepartment'sregistryofabandonedoruncontrolledhazardous
16wastesites.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 2.(1)Iftheexcavationlocationiswithinasitedescribedinsubdivision(1)of
18subsection1ofthissectionatthetimeoftheproposedexcavation,thedepartmentshall
19notifyallpersonshavingcontroloverahazardoussubstance,asdefinedinsection
20260.500,responsibleforcontaminatingthesite,requireatestbysuchpersonsofthesoil
21attheexcavationlocationtoensurethesafetyoftheexcavatorsworkingatsuchsite,and
22notifytheexcavatorsofthetestresults.
23 (2)Iftheexcavationlocationiswithinasitedescribedinsubdivision(2)of
24subsection1ofthissectionatthetimeoftheproposedexcavation,thedepartmentshall
25testthesoilattheexcavationlocationtoensurethesafetyoftheexcavatorsworkingat
26suchsiteandnotifytheexcavatorsofthetestresults.
