SectionA.Section162.700,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection162.700,toreadasfollows:
162.700.1.Theboardofeducationofeachschooldistrictinthisstate,exceptschool
2districtswhicharepartofaspecialschooldistrict,andtheboardofeducationofeachspecial
3schooldistrictshallprovidespecialeducationalservicesforchildrenwithdisabilitiesthree
4yearsofageormoreresidinginthedistrictasrequiredbyP.L.99-457,ascodifiedandasmay
5beamended.Anychild,determinedtobeachildwithdisabilities,shallbeeligibleforsuch
6servicesuponreachinghisorherthirdbirthdayandstateschoolfundsshallbeapportioned
7accordingly.ThissubsectionshallapplytoeachfullschoolyearbeginningonorafterJuly1,
81991.Intheeventthatfederalfundingfailstobeappropriatedattheauthorizedlevelas
9describedin20U.S.C.1419(b)(2),theimplementationofthissubsectionrelatingtoservices
10forchildrenwithdisabilitiesthreeandfouryearsofagemaybedelayeduntilsuchtimeas
11fundsareappropriatedtomeetsuchlevel.Eachlocalschooldistrictandeachspecialschool
12districtshallberesponsibletoengageinaplanningprocesstodesigntheservicedelivery
13systemnecessarytoprovidespecialeducationandrelatedservicesforchildrenthreeandfour
14yearsofagewithdisabilities.Theplanningprocessshallincludepublic,private,andprivate
15not-for-profitagencieswhichhaveprovidedsuchservicesforthispopulation.Theschool
16district,orschooldistricts,orspecialschooldistrict,shallberesponsiblefordesigningan
17efficientservicedeliverysystemwhichusesthepresentresourcesofthelocalcommunity
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18whichmaybefundedbythedepartmentofelementaryandsecondaryeducationorthe
19departmentofmentalhealth.Schooldistrictsmaycoordinatewithpublic,private,andprivate
20not-for-profitagenciespresentlyinexistence.Theservicedeliverysystemshallbeconsistent
21withtherequirementsofthedepartmentofelementaryandsecondaryeducationtoprovide
22appropriatespecialeducationservicesintheleastrestrictiveenvironment.
23 2.Everylocalschooldistrictor,ifaspecialdistrictisinoperation,everyspecial
24schooldistrictshallobtaincurrentappropriatediagnosticreportsforeachchildwith
25disabilities[child] priortoassignmentinaspecialprogram.Theserecordsmaybeobtained
26withparentalpermissionfrompreviousmedicalorpsychologicalevaluation,maybe
27providedbycompetentpersonnelofsuchdistrictorspecialdistrict,ormaybesecuredby
28suchdistrictfromcompetentandqualifiedmedical,psychological,orotherprofessional
29personnel.
30 3.Evaluationsofprivateschoolstudentssuspectedofhavingadisabilityunderthe
31IndividualsWithDisabilitiesEducationActwillbeconductedasappropriatebytheschool
32districtinwhichtheprivateschoolislocatedoritscontractor.
33 4.Wherespecialdistrictshavebeenformedtoservechildrenwithdisabilitiesunder
34theprovisionsofsections162.670to[162.995] 162.974, suchchildrenshallbeeducatedin
35programsofthespecialdistrict,exceptthatcomponentdistrictsmayprovideeducation
36programsforchildrenwithdisabilitiesagesthreeandfourinclusiveinaccordancewith
37regulationsandstandardsadoptedbythestateboardofeducation.
38 5.Forthepurposesofthisact,remedialreadingprogramsarenotaspecial
39[education] educationalserviceasdefinedbysubdivision(4)ofsection162.675.
40 6.Anyandallstatecostsrequiredtofundspecialeducationservicesforthree-and
41four-year-oldchildrenunderthissectionshallbeprovidedforbyaspecific,separate
42appropriationandshallnotbefundedbyareallocationofmoneyappropriatedforthepublic
43schoolfoundationprogram.
44 7.Schooldistrictsprovidingearlychildhoodspecialeducationshallgive
45considerationtothevalueofcontinuingserviceswithPartCearlyinterventionsystem
46providersfortheremainderoftheschoolyearwhendevelopinganindividualizededucation
47programforastudentwhohasreceivedservicesunderPartCoftheIndividualswith
48DisabilitiesEducationActandreachestheageofthreeyearsduringaregularschoolyear.
49ServicesprovidedshallbeonlythosepermissibleaccordingtoSection619oftheIndividuals
50withDisabilitiesEducationAct.
51 8.(1)ForthepurposesofprovidingspecialeducationalservicesunderPartBof
52thefederalIndividualswithDisabilitiesEducationAct(IDEA),asamended,ayoung
53childwithadevelopmentaldelayisachildwho:
54 (a)Isatleastthreeyearsofagebutundernineyearsofage;
HB1008	2 55 (b)Isexperiencingdevelopmentaldelays,asmeasuredbyappropriate
56evaluationinstrumentsandprocedures,inoneormoreofthefollowingareas:
57 a.Physicaldevelopment;
58 b.Cognitivedevelopment;
59 c.Communicationdevelopment;
60 d.Socialoremotionaldevelopment;or
61 e.Adaptivedevelopment;and
62 (c)Needsspecialeducationalservicesandrelatedservices.
63 (2)(a)Achildmaybeidentifiedasayoungchildwithadevelopmentaldelay
64beforesuchchildreachesnineyearsofage.
65 (b)Achildwhoisidentifiedasayoungchildwithadevelopmentaldelaywhose
66agemakesthechildeligibleforkindergartenorgradeonemaycontinueeligibilityasa
67youngchildwithadevelopmentaldelayifthechildisidentifiedasayoungchildwitha
68developmentaldelaybeforesuchchildreachesnineyearsofage.
69 (3)Thecategoryofyoungchildwithadevelopmentaldelayshallnotbeusedto
70determinecontinuingeligibilityforspecialeducationalservicesforastudentwho
71reachesnineyearsofagebeforeAugustfirstofagivenschoolyear,buteligibilityfor
72specialeducationalservicesmaybedeterminedforsuchstudentsthroughanyother
73disabilitycategory.
74 9.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
75createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
76withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
77Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
78generalassemblyunderchapter536toreview,todelaytheeffectivedateortodisapproveand
79annularulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority
80andanyruleproposedoradoptedafterAugust28,2002,shallbeinvalidandvoid.
