Torepealsection34.042,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
negotiationofstatecontractprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section34.042,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection34.042,toreadasfollows:
34.042.1.Whenthecommissionerofadministrationdeterminesthattheuseof
2competitivebiddingiseithernotpracticableornotadvantageoustothestate,suppliesmaybe
3procuredbycompetitiveproposals.Thecommissionershallstatethereasonsforsuch
4determination,andareportcontainingthosereasonsshallbemaintainedwiththevouchersor
5filespertainingtosuchpurchases.Allpurchasesinexcessoftenthousanddollarstobemade
6underthissectionshallbebasedoncompetitiveproposals.
7 2.Onanypurchasewheretheestimatedexpenditureshallbeonehundredthousand
8dollarsorover,thecommissionerofadministrationshall:
9 (1)Advertiseforproposalsinatleasttwodailynewspapersofgeneralcirculationin
10suchplacesasaremostlikelytoreachprospectiveofferorsandmayadvertiseinatleasttwo
11weeklyminoritynewspapersandmayprovidesuchinformationthroughanelectronic
12mediumavailabletothegeneralpublicatleastfivedaysbeforeproposalsforsuchpurchases
13aretobeopened.Othermethodsofadvertisement,however,maybeadoptedbythe
14commissionerofadministrationwhensuchothermethodsaredeemedmoreadvantageousfor
15thesuppliestobepurchased;
16 (2)Postnoticeoftheproposedpurchase;and

18publicfromprospectiveofferors.

20Allproposalsforsuchsuppliesshallbemailedordeliveredtotheofficeofthecommissioner
21ofadministrationsoastoreachsuchofficebeforethetimesetforopeningproposals.
22Proposalsshallbeopenedinamannertoavoiddisclosureofcontentstocompetingofferors
23duringtheprocessofnegotiation.
24 3.Thecontractshallbelettothelowestandbestofferorasdeterminedbythe
25evaluationcriteriaestablishedintherequestforproposalandanysubsequentnegotiations
26conductedpursuanttothissubsection.Indeterminingthelowestandbestofferor,asprovided
27intherequestforproposalsandunderrulespromulgatedbythecommissionerof
28administration,negotiationsmaybeconductedwithresponsibleofferorswhosubmit
29proposalsselectedbythecommissionerofadministrationonthebasisofreasonablecriteria
30forthepurposeofclarifyingandassuringfullunderstandingofandresponsivenesstothe
31solicitationrequirements.Thoseofferorsshallbeaccordedfairandequaltreatmentwith
32respecttoanyopportunityfornegotiationandsubsequentrevisionofproposals;however,a
33requestforproposalmaysetforththemannerfordeterminingwhichofferorsareeligiblefor
34negotiation,including,butnotlimitedto,theuseofshortlisting.Revisionsmaybepermitted
35aftersubmissionandbeforeawardforthepurposeofobtainingbestandfinaloffers.In
36conductingnegotiationsthereshallbenodisclosureofanyinformationderivedfrom
37proposalssubmittedbycompetingofferors.Thecommissionerofadministrationshallhave
38therighttorejectanyorallproposalsandadvertisefornewproposalsorpurchasethe
39requiredsuppliesontheopenmarketiftheycanbesopurchasedatabetterprice.
40 4.Thecommissionershallmakeavailable,uponrequest,toanymembersofthe
41generalassembly,informationpertainingtocompetitiveproposals,includingthenamesof
42biddersandtheamountofeachbidder'sofferingforeachcontract.
43 5.Ifidentifiedinthesolicitation,thecontractmaybeawardedtothelowestand
44bestresponsivevendororvendorsasdeterminedbytheevaluationcriteriasetoutinthe
45solicitation,whilereservingcertaincontractprovisionsfornegotiationafterthenotice
46ofaward.Thereservedcontractprovisionsforpost-awardnegotiationshallnotbe
47provisionsthatwerepartoftheevaluationcriteriaandscoringorprovisionsthat
48impactedsuchcriteriaorscoring.Thetimeframeforpost-awardnegotiationsshallbe
49setoutinthesolicitationitselfand,ifsuchnegotiationsfail,thecommissionermay
50canceltheawardandawardthecontracttothenextlowestandbestvendororvendors.
51Ifsatisfiedwiththelowestandbestresponsivevendor'sproposal,thecommissionermay
52waivepost-awardnegotiations.Forsolicitationsthatprovideforcontractawardstobe
53madetomultiplevendors,includingqualifiedvendorsolicitations,post-award
HB1009	2 54negotiationsmaybedoneseparatelywithallawardedvendors,ifneededandifspecified
55inthesolicitation.Foranyprovisionagreedtobythestateinpost-awardnegotiations
56withavendor,anyothervendorawardedacontractfromthesamesolicitationmay
57requestthesamenegotiatedprovisionfortheircontractandsuchprovisionshallbe
58addedthroughawrittencontractamendment.
