12	12	34.042.1.Whenthecommissionerofadministrationdeterminesthattheuseof
13	13	2competitivebiddingiseithernotpracticableornotadvantageoustothestate,suppliesmaybe
14	14	3procuredbycompetitiveproposals.Thecommissionershallstatethereasonsforsuch
15	15	4determination,andareportcontainingthosereasonsshallbemaintainedwiththevouchersor
16	16	5filespertainingtosuchpurchases.Allpurchasesinexcessoftenthousanddollarstobemade
17	17	6underthissectionshallbebasedoncompetitiveproposals.

25	25	14commissionerofadministrationwhensuchothermethodsaredeemedmoreadvantageousfor
26	26	15thesuppliestobepurchased;

43	43	31solicitationrequirements.Thoseofferorsshallbeaccordedfairandequaltreatmentwith
44	44	32respecttoanyopportunityfornegotiationandsubsequentrevisionofproposals;however,a
45	45	33requestforproposalmaysetforththemannerfordeterminingwhichofferorsareeligiblefor
46	46	34negotiation,including,butnotlimitedto,theuseofshortlisting.Revisionsmaybepermitted

52	52	40 4.Thecommissionershallmakeavailable,uponrequest,toanymembersofthe
53	53	41generalassembly,informationpertainingtocompetitiveproposals,includingthenamesof
54	54	42biddersandtheamountofeachbidder'sofferingforeachcontract.
55	55	43 5.Ifidentifiedinthesolicitation,thecontractmaybeawardedtothelowestand
56	56	44bestresponsivevendororvendorsasdeterminedbytheevaluationcriteriasetoutinthe
57	57	45solicitation,whilereservingcertaincontractprovisionsfornegotiationafterthenotice
58	58	46ofaward.Thereservedcontractprovisionsforpost-awardnegotiationshallnotbe
59	59	47provisionsthatwerepartoftheevaluationcriteriaandscoringorprovisionsthat

67	67	55inthesolicitation.Foranyprovisionagreedtobythestateinpost-awardnegotiations
