1010 SectionA.Section34.042,RSMo,isrepealedandonenewsectionenactedinlieu
1111 2thereof,tobeknownassection34.042,toreadasfollows:
1212 34.042.1.Whenthecommissionerofadministrationdeterminesthattheuseof
1313 2competitivebiddingiseithernotpracticableornotadvantageoustothestate,suppliesmaybe
1414 3procuredbycompetitiveproposals.Thecommissionershallstatethereasonsforsuch
1515 4determination,andareportcontainingthosereasonsshallbemaintainedwiththevouchersor
1616 5filespertainingtosuchpurchases.Allpurchasesinexcessoftenthousanddollarstobemade
1717 6underthissectionshallbebasedoncompetitiveproposals.
1818 7 2.Onanypurchasewheretheestimatedexpenditureshallbeonehundredthousand
1919 8dollarsorover,thecommissionerofadministrationshall:
2020 9 (1)Advertiseforproposalsinatleasttwodailynewspapersofgeneralcirculationin
2121 10suchplacesasaremostlikelytoreachprospectiveofferorsandmayadvertiseinatleasttwo

2323 12mediumavailabletothegeneralpublicatleastfivedaysbeforeproposalsforsuchpurchases
2424 13aretobeopened.Othermethodsofadvertisement,however,maybeadoptedbythe
2525 14commissionerofadministrationwhensuchothermethodsaredeemedmoreadvantageousfor
2626 15thesuppliestobepurchased;

4343 31solicitationrequirements.Thoseofferorsshallbeaccordedfairandequaltreatmentwith
4444 32respecttoanyopportunityfornegotiationandsubsequentrevisionofproposals;however,a
4545 33requestforproposalmaysetforththemannerfordeterminingwhichofferorsareeligiblefor
4646 34negotiation,including,butnotlimitedto,theuseofshortlisting.Revisionsmaybepermitted
4747 35aftersubmissionandbeforeawardforthepurposeofobtainingbestandfinaloffers.In
4848 36conductingnegotiationsthereshallbenodisclosureofanyinformationderivedfrom
4949 37proposalssubmittedbycompetingofferors.Thecommissionerofadministrationshallhave

5252 40 4.Thecommissionershallmakeavailable,uponrequest,toanymembersofthe
5353 41generalassembly,informationpertainingtocompetitiveproposals,includingthenamesof
5454 42biddersandtheamountofeachbidder'sofferingforeachcontract.
5555 43 5.Ifidentifiedinthesolicitation,thecontractmaybeawardedtothelowestand
5656 44bestresponsivevendororvendorsasdeterminedbytheevaluationcriteriasetoutinthe
5757 45solicitation,whilereservingcertaincontractprovisionsfornegotiationafterthenotice
5858 46ofaward.Thereservedcontractprovisionsforpost-awardnegotiationshallnotbe
5959 47provisionsthatwerepartoftheevaluationcriteriaandscoringorprovisionsthat
6060 48impactedsuchcriteriaorscoring.Thetimeframeforpost-awardnegotiationsshallbe
