1616 5 2.Ifacontinuingcontractforthefurnishingoftransportationofpupilsinschool
1717 6districtsismade,itshallbeforatermnottoexceedfifteenyears.Acontractis
1818 7renewableattheoptionoftheschooldistrictandthepartycontractingtoprovide
1919 8transportationservices,jointly,attheendofthetermofthecontract.Thecontractas
2020 9renewedshallincludeallofthetermsandconditionsofthepreviouscontract,including

2222 11 3.Acontinuingcontractmaybemadefortheleaseorrentalofschoolbuses,not
2323 12toexceedfifteenyears,exceptthatifaleaseorrentalcontractprovidesthattheschool
2424 13districtmayexerciseanoptioneithertopurchasethebusesortocanceltheleaseatthe
2525 14endofeachannualperiodduringtheperiodofthecontract,thecontractmaybemade
2626 15foratermnottoexceedtwentyyears.
2727 16 4.Notwithstandinganyotherlawtothecontrary,acontinuingcontractexecuted
2828 17underthissectionmaybenegotiatedannuallywithinthecontractperiodwhen

3939 6 (1)Busoperatedbyapublicutility,municipalcorporation,orcommoncarrier
4040 7authorizedtoconductlocalorinterstatetransportationofpassengerswhensuchbusis
4141 8nottravelingaspecificschoolbusroutebutis:
4242 9 (a)Onaregularlyscheduledrouteforthetransportationoffare-paying
4343 10passengers;or
4444 11 (b)Furnishingcharterserviceforthetransportationofpersonsenrolledas
4545 12studentsonfieldtripsorotherspecialtripsorinconnectionwithotherspecialevents;or
4646 13 (2)Passengercars,multipurposepassengervehicles,andtrucksasdefinedin49
4747 14CFRpart571,asamended.
4848 15 2.BeginningJanuary1,2036,onehundredpercentofallnewlypurchasedor
4949 16contractedschoolbusesshallbezero-emissionvehicles,wherefeasible.
5050 17 3.Ifaschooldistrictdeterminesthatthepurchaseorcontractingofazero-
5151 18emissionschoolbusisnotfeasibleduetobothterrainandrouteconstraints,theschool
5252 19districtmayrequestaone-timeextensionforatermnottoexceedfiveyearsinorderto
5353 20meettherequirementsofsubsection2ofthissection,providedthatthefollowing
5454 21conditionsaremet:
5555 22 (1)Theschooldistrictcanreasonablydemonstratethatadailyplannedbus
5656 23routefortransportingpupilstoandfromschoolcannotbeservicedthroughavailable
5757 24zero-emissiontechnologyin2036;and
5858 25 (2)Thedepartmentofnaturalresources,inconsultationwiththeMissouriair
5959 26conservationcommission,receivesandevaluatesaschooldistrict'srequestandgrantsa
6060 27one-timeextensionbasedonthelocalschooldistrictreasonablydemonstratingthe
6161 28conditioninsubdivision(1)ofthissubsection.
6262 29 4.BeginningJanuary1,2041,ifaschooldistrictwithanaveragedaily
6363 30attendanceofthreehundredfiftyorlessdeterminesthatthepurchaseorcontractingof
6464 31azero-emissionschoolbusisnotfeasibleduetobothterrainandrouteconstraints,such
6565 32schooldistrictmayrequestannualextensions,withthelastextensionexpiringon

6767 34providedthatthefollowingconditionsaremet:
6868 35 (1)Theschooldistrictcanreasonablydemonstratethatadailyplannedbus
6969 36routefortransportingpupilstoandfromschoolcannotbeservicedthroughavailable
7070 37zero-emissiontechnologyintheperiodinwhichtheannualwaiverissought;and
7171 38 (2)Thedepartmentofnaturalresources,inconsultationwiththeMissouriair
7272 39conservationcommission,receivesandevaluatestheschooldistrict'srequestandgrants
7373 40anannualextensionbasedonthelocalschooldistrictreasonablydemonstratingthe
7474 41conditioninsubdivision(1)ofthissubsection.
