HB1032 2 379.1915.1.Exceptasprovidedinsubsection2ofthissection,apeer-to-peer 2car-sharingprogramshallassumeliabilityofasharedvehicleownerfor: 3 (1)Bodilyinjuryorpropertydamagetothirdparties; 4 (2)Uninsuredmotoristlosses;or 5 (3)Totheextentpersonalinjuryprotectioncoverageisrequiredbylaw, 6personalinjuryprotectionlosses 7 8duringthecar-sharingperiodinanamountstatedinthepeer-to-peercar-sharing 9programagreement,whichamountshallnotbelessthantheamountrequiredunder 10chapter303. 11 2.Notwithstandingthedefinitionof"car-sharingterminationtime"insection 12379.1910,theassumptionofliabilityundersubsection1ofthissectionshallnotapplyto 13anysharedvehicleownerwhen: 14 (1)Asharedvehicleownermakesanintentionalorfraudulentmaterial 15misrepresentationoromissiontothepeer-to-peercar-sharingprogrambeforethecar- 16sharingperiodinwhichthelossoccurred;or 17 (2)Actinginconcertwithasharedvehicledriverwhofailstoreturntheshared 18vehicleinaccordancewiththetermsofthecar-sharingprogramagreement. 19 3.Notwithstandingthedefinitionof"car-sharingterminationtime"insection 20379.1910,theassumptionofliabilityundersubsection1ofthissectionshallapplyto 21bodilyinjurylosses,propertydamagelosses,uninsuredmotoristlosses,ortotheextent 22personalinjuryprotectioncoverageisrequiredbylaw,personalinjuryprotection 23losses,bydamagedthirdpartiesasrequiredbychapter303. 24 4.Apeer-to-peercar-sharingprogramshallensurethat,duringeachcar-sharing 25period,thesharedvehicleownerandthesharedvehicledriverareinsuredundera 26motorvehicleliabilityinsurancepolicythatprovidesinsurancecoverageinamountsno 27lessthantheminimumamountssetforthinchapter303,andthat: 28 (1)Recognizesthatthesharedvehicleinsuredunderthepolicyismadeavailable 29andusedthroughapeer-to-peercar-sharingprogram;or 30 (2)Doesnotexcludeuseofasharedvehiclebyasharedvehicledriver. 31 5.Theinsurancedescribedundersubsection4ofthissectionmaybesatisfiedby 32motorvehicleliabilityinsurancemaintainedby: 33 (1)Asharedvehicleowner; 34 (2)Asharedvehicledriver; 35 (3)Apeer-to-peercar-sharingprogram;or 36 (4)Asharedvehicleowner,asharedvehicledriver,andapeer-to-peercar- 37sharingprogram. HB1032 3 38 6.Theinsurancedescribedinsubsection5ofthissectionthatissatisfyingthe 39insurancerequirementofsubsection4ofthissectionshallbeprimaryduringeachcar- 40sharingperiod.Ifaclaimoccursinanotherstatewithminimumfinancialresponsibility 41limitshigherthantheminimumfinancialresponsibilityrequirementsinchapter303 42duringthecar-sharingperiod,thecoveragemaintainedundersubsection5ofthis 43sectionshallsatisfythedifferenceinminimumcoverageamountsuptotheapplicable 44policylimits. 45 7.Theinsurer,insurers,orpeer-to-peercar-sharingprogramproviding 46coverageundersubsection4or5ofthissectionshallassumeprimaryliabilityfora 47claimwhen: 48 (1)Adisputeexistsastowhowasincontrolofthesharedvehicleatthetimeof 49thelossandthepeer-to-peercar-sharingprogramdoesnothaveavailable,didnot 50retain,orfailstoprovidetheinformationrequiredbysection379.1930;or 51 (2)Adisputeexistsastowhetherthesharedvehiclewasreturnedtothe 52alternativelyagreed-uponlocationasrequiredunderparagraph(b)ofsubdivision(5)of 53section379.1910. 54 8.Ifinsurancemaintainedbyasharedvehicleownerorsharedvehicledriverin 55accordancewithsubsection5ofthissectionhaslapsedordoesnotprovidetherequired 56coverage,insurancemaintainedbyapeer-to-peercar-sharingprogramshallprovidethe 57coveragerequiredbysubsection4ofthissection,beginningwiththefirstdollarofa 58claim,andhavethedutytodefendsuchclaimexceptundercircumstancesassetforthin 59subsection2ofthissection. 60 9.Coverageunderanautomobileinsurancepolicymaintainedbythepeer-to- 61peercar-sharingprogramshallnotbedependentonanotherautomobileinsurerfirst 62denyingaclaimnorshallanotherautomobileinsurancepolicyberequiredtofirstdeny 63aclaim. 64 10.Nothinginthissection: 65 (1)Limitstheliabilityofthepeer-to-peercar-sharingprogramforanyactor 66omissionofthepeer-to-peercar-sharingprogramitselfthatresultsininjurytoany 67personasaresultoftheuseofasharedvehiclethroughapeer-to-peercar-sharing 68program;or 69 (2)Limitstheabilityofthepeer-to-peercar-sharingprogramto,bycontract, 70seekindemnificationfromthesharedvehicleownerorthesharedvehicledriverfor 71economiclosssustainedbythepeer-to-peercar-sharingprogramresultingfroma 72breachofthetermsandconditionsofthecar-sharingprogramagreement. 379.1920.Atthetimewhenavehicleownerregistersasasharedvehicleowner 2onapeer-to-peercar-sharingprogramandpriortothetimewhenthesharedvehicle HB1032 4 3ownermakesasharedvehicleavailableforcarsharingonthepeer-to-peercar-sharing 4program,thepeer-to-peercar-sharingprogramshallnotifythesharedvehicleowner 5that,ifthesharedvehiclehasalienagainstit,theuseofthesharedvehiclethrougha 6peer-to-peercar-sharingprogram,includingusewithoutphysicaldamagecoverage, 7mayviolatethetermsofthecontractwiththelienholder. 379.1925.1.Anauthorizedinsurerthatwritesmotorvehicleliabilityinsurance 2inthisstatemayexcludeanyandallcoverageandthedutytodefendorindemnifyfor 3anyclaimaffordedunderasharedvehicleowner'smotorvehicleliabilityinsurance 4policyincluding,butnotlimitedto: 5 (1)Liabilitycoverageforbodilyinjuryandpropertydamage; 6 (2)Personalinjuryprotectioncoverage; 7 (3)Uninsuredandunderinsuredmotoristcoverage; 8 (4)Medicalpaymentscoverage; 9 (5)Comprehensivephysicaldamagecoverage;and 10 (6)Collisionphysicaldamagecoverage. 11 2.Nothinginsections379.1900to379.1970invalidatesorlimitsanexclusion 12containedinamotorvehicleliabilityinsurancepolicy,includinganyinsurancepolicyin 13useorapprovedforusethatexcludescoverageformotorvehiclesmadeavailablefor 14rent,sharing,orhireorforanybusinessuse. 15 3.Nothinginsections379.1900to379.1970invalidates,limits,orrestrictsan 16insurer'sabilityunderexistinglawtounderwriteanyinsurancepolicy.Nothingin 17sections379.1900to379.1970invalidates,limits,orrestrictsaninsurer'sabilityunder 18existinglawtocancelandnonrenewpolicies. 379.1930.Apeer-to-peercar-sharingprogramshallcollectandverifyrecords 2pertainingtotheuseofavehicleincluding,butnotlimitedto,timesused,car-sharing 3periodpick-upanddrop-offlocations,feespaidbythesharedvehicledriver,and 4revenuesreceivedbythesharedvehicleowner.Thepeer-to-peercar-sharingprogram 5shallprovidesuchinformationuponrequesttothesharedvehicleowner,theshared 6vehicleowner'sinsurer,orthesharedvehicledriver'sinsurertofacilitateaclaim 7coverageinvestigation,settlement,negotiation,orlitigation.Thepeer-to-peercar- 8sharingprogramshallretaintherecordsforatimeperiodnotlessthantheapplicable 9personalinjurystatuteoflimitations. 379.1935.Apeer-to-peercar-sharingprogramandasharedvehicleownershall 2beexemptfromvicariousliabilityinaccordancewith49U.S.C.Section30106andunder 3anystateorlocallawthatimposesliabilitysolelybasedonvehicleownership. 379.1940.Amotorvehicleinsurerthatdefendsorindemnifiesaclaimagainsta 2sharedvehiclethatisexcludedunderthetermsofitspolicyshallhavetherighttoseek HB1032 5 3recoveryagainstthemotorvehicleinsurerofthepeer-to-peercar-sharingprogramif 4theclaimis: 5 (1)Madeagainstthesharedvehicleownerorthesharedvehicledriverforloss 6orinjurythatoccursduringthecar-sharingperiod;and 7 (2)Excludedunderthetermsofitspolicy. 379.1945.1.Notwithstandinganyotherlaw,statute,rule,orregulationtothe 2contrary,apeer-to-peercar-sharingprogramshallhaveaninsurableinterestina 3sharedvehicleduringthecar-sharingperiod. 4 2.Nothinginthissectioncreatesliabilityonapeer-to-peercar-sharingprogram 5tomaintainthecoveragemandatedbysection379.1915. 6 3.Apeer–to–peercar-sharingprogrammayownandmaintainasthenamed 7insuredoneormorepoliciesofmotorvehicleliabilityinsurancethatprovidescoverage 8for: 9 (1)Liabilitiesassumedbythepeer–to–peercar-sharingprogramunderapeer– 10to–peercar-sharingprogramagreement; 11 (2)Anyliabilityofthesharedvehicleowner; 12 (3)Damageorlosstothesharedvehicle;or 13 (4)Anyliabilityofthesharedvehicledriver. 379.1950.Eachcar-sharingprogramagreementmadeinthisstateshalldisclose 2tothesharedvehicleownerandthesharedvehicledriver: 3 (1)Anyrightofthepeer-to-peercar-sharingprogramtoseekindemnification 4fromthesharedvehicleownerorthesharedvehicledriverforeconomiclosssustained 5bythepeer-to-peercar-sharingprogramresultingfromabreachofthetermsand 6conditionsofthecar-sharingprogramagreement; 7 (2)Thatamotorvehicleliabilityinsurancepolicyissuedtothesharedvehicle 8ownerforthesharedvehicleortothesharedvehicledriverdoesnotprovideadefense 9orindemnificationforanyclaimassertedbythepeer-to-peercar-sharingprogram; 10 (3)Thatthepeer-to-peercar-sharingprogram'sinsurancecoverageonthe 11sharedvehicleownerandthesharedvehicledriverisineffectonlyduringeachcar- 12sharingperiodandthat,foranyuseofthesharedvehiclebythesharedvehicledriver 13afterthecar-sharingterminationtime,thesharedvehicledriverandthesharedvehicle 14ownermaynothaveinsurancecoverage; 15 (4)Thedailyrate,fees,andifapplicable,anyinsuranceorprotectionpackage 16coststhatarechargedtothesharedvehicleownerorthesharedvehicledriver; 17 (5)Thatthesharedvehicleowner'smotorvehicleliabilityinsurancemaynot 18providecoverageforasharedvehicle; HB1032 6 19 (6)Anemergencytelephonenumbertopersonnelcapableoffieldingroadside 20assistanceandothercustomerserviceinquiries;and 21 (7)Whetherthereareconditionsunderwhichasharedvehicledriverisrequired 22tomaintainapersonalautomobileinsurancepolicywithcertainapplicablecoverage 23limitsonaprimarybasisinordertobookasharedmotorvehicle. 379.1955.1.Apeer-to-peercar-sharingprogramshallnotenterintoapeer-to- 2peercar-sharingprogramagreementwithadriverunlessthedriverwhowilloperate 3thesharedvehicle: 4 (1)Holdsadriver'slicenseissuedbythisstatethatauthorizesthedriverto 5operatevehiclesoftheclassofthesharedvehicle; 6 (2)Isanonresidentwho: 7 (a)Hasadriver'slicenseissuedbythestateorcountryofthedriver'sresidence 8thatauthorizesthedriverinthatstateorcountrytodrivevehiclesoftheclassofthe 9sharedvehicle;and 10 (b)Isatleastthesameageastheagerequiredofaresidenttodriveinthisstate; 11or 12 (3)Otherwiseisspecificallyauthorizedbythisstatetodrivevehiclesoftheclass 13ofthesharedvehicle. 14 2.Apeer-to-peercar-sharingprogramshallkeeparecordof: 15 (1)Thenameandaddressofthesharedvehicledriver; 16 (2)Thenumberofthedriver'slicenseofthesharedvehicledriverandofeach 17otherperson,ifany,whowilloperatethesharedvehicle;and 18 (3)Theplaceofissuanceofthedriver'slicense. 379.1960.Apeer-to-peercar-sharingprogramshallhavesoleresponsibilityfor 2anyequipment,suchasaGPSsystemorotherspecialequipment,thatisputinoronthe 3vehicletomonitororfacilitatethecar-sharingtransaction,andshallagreetoindemnify 4andholdharmlessthesharedvehicleownerforanydamagetoortheftofsuch 5equipmentduringthecar-sharingperiodnotcausedbythesharedvehicleowner.The 6peer-to-peercar-sharingprogramhastherighttoseekindemnityfromtheshared 7vehicledriverforanylossordamagetosuchequipmentthatoccursduringthecar- 8sharingperiod. 379.1965.1.Atthetimewhenavehicleownerregistersasasharedvehicle 2owneronapeer-to-peercar-sharingprogramandpriortothetimewhentheshared 3vehicleownermakesasharedvehicleavailableforcarsharingonthepeer-to-peercar- 4sharingprogram,thepeer-to-peercar-sharingprogramshall: 5 (1)Verifythatthesharedvehicledoesnothaveanysafetyrecallsonthevehicle 6forwhichtherepairshavenotbeenmade;and HB1032 7 7 (2)Notifythesharedvehicleowneroftherequirementsundersubsection2of 8thissection. 9 2.(1)Ifthesharedvehicleownerhasreceivedanactualnoticeofasafetyrecall 10onthevehicle,thesharedvehicleownershallnotmakethevehicleavailableasashared 11vehicleonapeer-to-peercar-sharingprogramuntilthesafetyrecallrepairhasbeen 12made. 13 (2)Ifasharedvehicleownerreceivesanactualnoticeofasafetyrecallona 14sharedvehiclewhilethesharedvehicleismadeavailableonthepeer-to-peercar-sharing 15program,thesharedvehicleownershallremovethesharedvehicleasavailableonthe 16peer-to-peercar-sharingprogramassoonaspracticableafterreceivingthenoticeofthe 17safetyrecallanduntilthesafetyrecallrepairhasbeenmade. 18 (3)Ifasharedvehicleownerreceivesanactualnoticeofasafetyrecallwhilethe 19sharedvehicleisbeingusedinthepossessionofasharedvehicledriver,assoonas 20practicableafterreceivingthenoticeofthesafetyrecall,thesharedvehicleownershall 21notifythepeer-to-peercar-sharingprogramaboutthesafetyrecallsothattheshared 22vehicleownermayaddressthesafetyrecallrepair. 379.1970.Thedepartmentofcommerceandinsurancemaypromulgateall 2necessaryrulesandregulationsfortheadministrationofsections379.1900to379.1970. 3Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreated 4undertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 5withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section 6536.028.Thissectionandchapter536arenonseverableandifanyofthepowersvested 7withthegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate, 8ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant 9ofrulemakingauthorityandanyruleproposedoradoptedaftertheeffectivedateofthis 10sectionshallbeinvalidandvoid.
