SectionA.Chapters571and630,RSMo,areamendedbyaddingtheretothreenew
2sections,tobeknownassections571.055,571.056,and630.1040,toreadasfollows:
571.055.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Child",anypersonundereighteenyearsofage;
3 (2)"Lockingdevice",adevicethatprohibitstheoperationordischargeofa
4firearmandthatcanbedisabledonlywiththeuseofakey,combination,orbiometric
5data;
6 (3)"Personalizedfirearm",afirearmthathas,aspartofitsoriginal
7manufacture,incorporateddesigntechnologythatallowsthefirearmtobefiredonly
8bytheauthorizeduserandpreventsanyofthesafetycharacteristicsofthefirearmfrom
9beingreadilydeactivatedbyanyoneotherthantheauthorizeduser.Thetechnology
10limitingthefirearm'soperationmayinclude,butisnotlimitedto,fingerprint
11verification,magneticencoding,radiofrequencytagging,orautomaticuser
12identificationsystemsthatutilizebiometric,mechanical,orelectronicsystems;
13 (4)"Unauthorizedperson",anypersonwhoisineligibletopossessafirearm
14understateorfederallaw.
15 2.Thefollowingactionsshallbedeemedresponsibleandsecurestorageofa
16firearm:
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (1)Withtheexceptionofaconcealedoropenlycarriedfirearminasecure
18holster,firearmsshallbekeptunloadeduntilreadytouse;
19 (2)Withtheexceptionofaconcealedoropenlycarriedfirearminasecure
20holster,firearmsshallbesecurelystoredinamannerthatensures:
21 (a)Thefirearmsarenotaccessibletounauthorizedpersons,includingchildren.
22Examplesofsecurestorageinclude,butarenotlimitedto,triggerlocks,cablelocks,
23lockingguncases,strongboxes,securitycases,lockingguncabinets,andgunsafes;and
24 (b)Unauthorizedpersonsandchildrendonothaveaccesstothekey,
25combination,orotherunlockingmechanismnecessarytoopenthestoragecontainer
26orremovethelockingdevice;and
27 (3)Withtheexceptionofaconcealedoropenlycarriedfirearminasecure
28holster,apersonalizedfirearm'ssafetycharacteristicsshallbeactivated.
29 3.Apersoncommitstheoffenseofunlawfulstorageofafirearmiftheperson
30failstoresponsiblyandsecurelystoreafirearm,asdescribedundersubsection2ofthis
31section,uponanypremisesthatthepersonownsorcontrols,and:
32 (1)Thepersonknowsorreasonablyshouldknowachildcangainaccesstothe
33firearmwithoutthepermissionofthechild'sparentorguardianandwithoutdirect
34adultsupervision;or
35 (2)Thepersonknowsorreasonablyshouldknowacotenantisineligibleto
36possessafirearmunderstateorfederallaw.
37 4.Thissectionshallnotapplytothestoringofanantiquefirearm,asdefined
38under18U.S.C.Section921,oracurioorrelic,asdefinedunder27CFR478.11.
39 5.Theoffenseofunlawfulstorageofafirearmispunishablebyafive-hundred-
40dollarfineforafirstviolationandpunishableasaclassBmisdemeanorforasecondor
41subsequentviolation.
42 6.Itisadefensetotheoffenseofunlawfulstorageofafirearmifachildor
43cotenantgainedpossessionofandusedthefirearminalawfulactofself-defense,
44defenseofothers,ordefenseoflivestock.
571.056.1.Anyfirearmsdealerlicensedunder18U.S.C.Section923shallpost,
2inaconspicuouslocationonitspremisesandatanyotherlocationatwhichthedealer
3sellsafirearm,thefollowingnotice,inwriting,onaprintedcard,witheachletterata
4minimumofoneinchinheight:
5	Notice
6 Unlawfulstorageofafirearmmayresultinimprisonmentorfine.
HB104	2 7 2.Aviolationofthissectionbyalicensedfirearmsdealerispunishablebya
8warningforafirstviolationandpunishablebyafineofnotmorethanfivehundred
9dollarsforasecondorsubsequentviolation.
630.1040.1.(1)Thedepartmentofpublicsafetyshallincludeonapublicpage
2ofthedepartment'swebsiteaddressingsuicidepreventionthefollowinginformation:
3 (a)Theoffenseofunlawfulstorageofafirearmundersection571.055;and
4 (b)Thepenaltiesforanoffenserelatedtoprovidingafirearmtoachildor
5allowingachildtopossessafirearminviolationofsection571.060.

7TheinformationshallbeinbothEnglishandSpanish.
8 (2)Thedepartmentshallincludereferencestotheoffensesdescribedunder
9subdivision(1)ofthissubsectionanddirectiontothedepartmentwebsiteformore
10informationaboutthoseoffensesinanymaterialsprovidedto:
11 (a)Licensedfirearmsdealers,shootingranges,andsafetyinstructors;and
12 (b)Healthcareproviders,includingfacilitieslicensedunderchapters197and
13198.
14 2.Thedepartmentofpublicsafetyshalldevelopanoticeintendedtobe
15displayedonthepremisesofalicensedfirearmsdealer,anddesignedtobeprintedwith
16eachletterataminimumofoneinchinheight,thatinformsfirearmspurchasersthat
17unlawfulstorageofafirearmmayresultinimprisonmentorfine.Thedepartmentshall
18makeelectroniccopiesofthenoticepubliclyavailablefordownloadfromitswebsite
19withoutcharge.
