BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Sections311.332,311.355,and311.520,RSMo,arerepealedandfournew 2sectionsenactedinlieuthereof,tobeknownassections311.332,311.355,311.520,and 3311.2026,toreadasfollows: 311.332.1.Itshallbeunlawfulforanywholesalerlicensedtosellintoxicatingliquor 2andwinecontainingalcoholinexcessoffivepercentbyweighttopersonsdulylicensedto 3sellsuchintoxicatingliquorandwineatretail,todiscriminatebetweenretailersorinfavorof 4oragainstanyretailerorgroupofretailers,directlyorindirectly,inprice,indiscountsfor 5timeofpayment,orindiscountsonquantityofmerchandisesold,ortograntdirectlyor 6indirectlyanydiscount,rebate,freegoods,allowanceorotherinducement,exceptinga 7discountnotinexcessofonepercentforquantityofliquorandwine,andadiscountnotin 8excessofonepercentforpaymentonorbeforeacertaindate.Thedeliveryofmanufacturer 9rebatecouponsbywholesalerstoretailersshallnotbeaviolationofthissubsection. 10 2.Manufacturersorwholesalersshallbepermittedtodonateordeliverorcausetobe 11deliveredbeer,wine,orbrandyfornonresalepurposestoanyunlicensedpersonorany 12licensedretaildealerwhoisacharitableorreligiousorganizationasdefinedinsection 13313.005oreducationalinstitution,atanylocationorlicensedpremises,provided,suchbeer, 14wine,orbrandyisunrelatedtotheorganization'sorinstitution'slicensedretailoperation.A 15chargeforadmissiontoaneventoractivityatwhichbeer,wine,orbrandyisavailable EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16withoutseparatechargeshallnotconstituteresaleforthepurposesofthissubsection.Wine 17usedinreligiousceremoniesmaybesoldbywholesalerstoareligiousorganizationas 18definedinsection313.005.Anymanufacturerorwholesalerprovidingnonresaleitemsshall 19keeparecordofanydeliveriesmadepursuanttothissubsection. 20 3.Manufacturers,wholesalers,retailersandunlicensedpersonsmaydonatewine, 21beer,maltliquor,orspirits,intheoriginalpackagetoacharitableorreligiousorganization 22asdefinedinsection313.005oreducationalinstitutionforthesolepurposeofbeing 23auctionedorraffledbytheorganizationorinstitutionforfund-raisingpurposes,providedthe 24auctionorraffletakesplaceonaretail-licensedpremisesandallproceedsfromthesalego 25intoafundofanorganizationorinstitutionthatisunrelatedtoanylicensedretailoperation. 311.355.1.Manufacturersofintoxicatingliquorotherthanbeer[orwine] shallbe 2permittedtoofferconsumercashrebatecouponsasprovidedinthissubsection: 3 (1)Consumercashrebatecouponsmaybepublishedoradvertisedbymanufacturers 4innewspapers,magazinesandothermassmedia; 5 (2)Couponadvertisementsmaylisttheamountofthecashrebate,butnottheretail 6priceoftheintoxicatingliquoraftertherebate; 7 (3)Applicationsforcashrebatesmustbemadedirectlyfromtheconsumertothe 8manufacturer,andnotthroughretailersorwholesalers; 9 (4)Cashrebatesmustbemadedirectlytoconsumersbymanufacturers; 10 (5)Wholesalersandmanufacturersmaydelivercashrebatecouponstoretailers, 11eitherfordistributionatthepointofsaleorinconnectionwithpackaging. 12 2.Manufacturersofintoxicatingliquorincludingbeerandwinemayoffercoupons 13redeemablefornonalcoholicmerchandise,exceptthatsuchredeemablecouponsmustbe 14madeavailablewithoutapurchaserequirementtoconsumersatthepointofsale,orby 15requestthroughthemail,orattheretailer'scashregister.Redeemablecouponsmaybe 16publishedoradvertisedbymanufacturersinnewspapers,magazinesandothermassmedia. 17Advertisementsmuststatethatnopurchaseisrequiredtoobtainthenonalcoholic 18merchandiseandprovideinformationontheproceduretoobtainsuchmerchandise.The 19retailvalueofthenonalcoholicmerchandiseshallnotbestatedintheadvertisementoronthe 20product.Wholesalersandmanufacturersmaydelivertheseredeemablecouponsatthepoint 21ofsaleorinconnectionwithpackaging. 311.520.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Americanbrewery",thelandandbuildingslocatedintheUnitedStatesof 3Americawheremaltliquorsareproducedandpackaged; 4 (2)"Foreignimportmaltliquor",maltliquormanufacturedandimportedfrom 5outsidetheUnitedStatesofAmerica. HB1041 2 6 2.ForalltaxyearsbeginningonorbeforeDecember31,2025,asachargeforthe 7inspectionandgaugingofallmaltliquors,thedirectorofrevenueshallcollectthesumofone 8dollarandeighty-sixcentsperbarrel. 9 3.ForalltaxyearsbeginningonorafterJanuary1,2026,asachargeforthe 10inspectionandgaugingofmaltliquors,thedirectorofrevenueshallcollectthesumof 11sixty-twocentsperbarrelforallmaltliquorsmanufacturedinanAmericanbrewery 12andthesumofonedollarandeighty-sixcentsperbarrelforallforeignimportmalt 13liquor. 14 4.Everymanufacturer,out-of-statesolicitor,andwholesaledealerlicensed 15underthischaptershallmakeatrueduplicateinvoiceofthesame,showingthedate, 16amountandvalueofeachclassofsuchliquorsshippedordelivered,andthecountryof 17originforallforeignimportmaltliquorsandshallretainaduplicatethereof,subjectto 18theuseandinspectionofthedirectorofrevenueandsupervisorofalcoholandtobacco 19controlandtheirrepresentativesfortwoyears. 20 5.Thedirectorofrevenueandthesupervisorofalcoholandtobaccocontrolmay 21promulgateallnecessaryrulesandregulationsfortheadministrationofthissection. 22Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreated 23undertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 24withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section 25536.028.Thissectionandchapter536arenonseverableandifanyofthepowersvested 26withthegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate, 27ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant 28ofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2025,shall 29beinvalidandvoid. 311.2026.1.Forthepurposesofthissection,theterm"FIFAWorldCup 2Tournament"meanstheinternationalsoccertournamentthattakesplaceeveryfour 3yearsandisorganizedbytheFederationInternationaledeFootballAssociation. 4 2.Notwithstandinganyotherprovisionsofthischaptertothecontrary,any 5personorestablishmentpossessingthequalificationsandmeetingtherequirementsof 6thischapterthatislicensedtosellintoxicatingliquorbythedrinkatretailfor 7consumptiononthepremisesinanycity,county,district,orotherpoliticalsubdivision 8inthisstatemay,forthedurationofthe2026FIFAWorldCupTournament,beginning 9onJune11,2026,throughJuly19,2026,operatetwenty-fourhoursadayandsell,serve, 10andallowfortheconsumptionofalcoholicbeveragesbetweenthehoursof6:00a.m.and 115:00a.m.ofthefollowingday.Thistemporaryextensionofservicehoursshallapplyto 12alllicensedareasatalicensedestablishment.Theprovisionsofthischapterrelatingto 13hoursofoperation,timeofclosingoropening,orhoursofsaleofintoxicatingliquorby HB1041 3 14thedrinkatretailforconsumptiononthepremisesshallnotapplytosuchlicenseesfor 15thedurationofthistemporaryextension,exceptasprovidedunderthissection. 16 3.Licenseesarenotrequiredtoapplytothecommissionforapprovalandno 17specialtemporarylicenseorpermitshallberequiredofanylicenseeforthepurposesof 18thistemporaryextension,subjecttoanylocalrestrictionsonhoursofoperationas 19providedundersubsection4ofthissectionoradditionalconditionsforcompliance 20underanyapplicablelocallaws,ordinances,rules,orregulations. 21 4.Ifanycity,county,district,orotherpoliticalsubdivisioninthisstateobjectsto 22theextensionofhoursforlicenseeswithinitsjurisdiction,thegoverningbodyofsuch 23politicalsubdivisionmayexemptitselfbyordinancefromtheprovisionsofthissection 24ormaymodifybyordinancethehoursapplicabletosuchpoliticalsubdivisionforthe 25temporaryperiodallowedbythissectiontobenotlessthantheordinarypermissible 26hoursofserviceapplicabletosuchpoliticalsubdivisionbutnottoexceedthehours 27allowedunderthissection. 28 5.ThissectionshallexpireonJuly20,2026. ✔ HB1041 4
