SectionA.Chapter160,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection160.421,toreadasfollows:
160.421.1.Nomunicipalityshalladopt,enforce,impose,oradministeran
2ordinance,localpolicy,orlocalresolutionthatprohibitsschooldistrictpropertyfrom
3beingsold,leased,ortransferredtoacharterschoolforanylawfuleducationalpurpose.
4 2.Nomunicipalityshallimpose,enforce,orapplyanydeedrestrictionthat
5expressly,orbyitsoperation,prohibitspropertysold,leased,ortransferredfrombeing
6usedbyacharterschoolforanylawfuleducationalpurpose.Anydeedrestrictionor
7affirmative-usedeedrestrictionthataffirmativelyallowsforonlyoneormorespecified
8usesorpurposesthatdonotincludeanyeducationaluseorpurposebyacharterschool
9isprohibitedunderthissection.Anydeedrestrictionoraffirmative-usedeedrestriction
10ineffectontheeffectivedateofthissectionthatprohibitsordoesnotpermitproperty
11previouslyusedforanyeducationalpurposefrombeingusedforanyfutureeducational
12purposebyacharterschoolisvoid.
13 3.Anyagreementtosell,lease,ortransferpropertyusedbyacharterschoolas
14authorizedunderthissectionshallcontainprovisionsrelatedtothemaintenanceand
15upkeepofsuchproperty.
