19 3.Inanactionfornegligenthiringagainstanemployer,generalcontractor,
20premisesowner,orotherthirdpartyforactsofanemployeeorindependentcontractor
21thatisbasedonatheoryofliabilityotherthanthatdescribedinsubsection2ofthis
22section,thefactthattheemployeeorindependentcontractorwasconvictedofa
23nonviolent,nonsexualoffensebeforetheemployeeorindependentcontractor's
24employmentorcontractualobligationwiththeemployer,generalcontractor,premises
25owner,orotherthirdpartyshallbeinadmissibleasevidence.
26 4.Theprovisionsofthissectionshallnotprecludeanyexistingcauseofaction
27forfailureofanemployertoprovideadequatesupervisionofanemployeeor
28independentcontractor,exceptthatthefacttheemployeeorindependentcontractorhas
29beenconvictedofanonviolent,nonsexualoffenseshallbeadmissibleasevidenceinsuch
30actiononlyiftheemployer:
31 (1)Knewoftheconvictionorwasgrosslynegligentinthefailuretoknowofthe
32conviction;and
33 (2)Theconvictionwasdirectlyrelatedtothenatureoftheemployee'sor
34independentcontractor'sworkandtheconductthatgaverisetotheallegedinjurythat
35isthebasisoftheaction.
36 5.Theprotectionsinthissectionprovidedtoanemployer,generalcontractor,
37premisesowner,orthirdpartydonotapplyinanactionconcerning:
38 (1)Themisuseoffundsorpropertyofapersonotherthantheemployer,general
39contractor,premisesowner,orthirdpartybyanemployeeorindependentcontractorif,
40onthedatetheemployeeorindependentcontractorwashired,theemployeeor
41independentcontractorhadbeenconvictedofanoffensethatincludesfraudorthe
42misuseoffundsorpropertyasanelementoftheoffenseanditwasforeseeablethatthe
43positionforwhichtheemployeeorindependentcontractorwashiredwouldinvolve
44dischargingafiduciaryresponsibilityinthemanagementofthefundsorproperty;
45 (2)Themisappropriationoffundsbyanemployeeorindependentcontractorif
46theemployeeorindependentcontractorwashiredasanattorneyand,onthedatethe
47employeeorindependentcontractorwashired,theemployeeorindependentcontractor
48hadbeenconvictedofanoffensethatincludesfraudorthemisuseoffundsorproperty
49asanelementoftheoffense;or
50 (3)Aviolentoffenseoranimproperuseofexcessiveforcebyanemployeeor
