4.AnapplicantforregistrationmaymakeadonationofonedollartotheMissouri 83medalofhonorrecipientsfund.Thedirectorofrevenueshallcollectthedonationsand 84depositallsuchdonationsinthestatetreasurytothecreditoftheMissourimedalofhonor 85recipientsfundasestablishedinsection226.925.Moneysinthemedalofhonorrecipients 86fundshallbeusedsolelyforthepurposesestablishedinsection226.925,exceptthatthe 87departmentofrevenueshallretainnomorethanonepercentforitsadministrativecosts.The 88donationprescribedinthissubsectionisvoluntaryandmayberefusedbytheapplicantfor 89registrationatthetimeofissuanceorrenewal.Thedirectorshallinquireofeachapplicantat HB1114 3 5.BeginningJuly1,2005,thedirectorshalldenythedrivingprivilegeofanyperson 93whocommitsfraudordeceptionduringtheexaminationprocessorwhomakesapplication 94foraninstructionpermit,driver'slicense,ornondriver'slicensewhichcontainsoris 95substantiatedwithfalseorfraudulentinformationordocumentation,orwhoknowingly 96concealsamaterialfactorotherwisecommitsafraudinanysuchapplication.Theperiodof 97denialshallbeoneyearfromtheeffectivedateofthedenialnoticesentbythedirector.The 98denialshallbecomeeffectivetendaysafterthedatethedenialnoticeismailedtotheperson. 99Thenoticeshallbemailedtothepersonatthelastknownaddressshownontheperson's 100drivingrecord.Thenoticeshallbedeemedreceivedthreedaysaftermailingunlessreturned 101bythepostalauthorities.Nosuchindividualshallreapplyforadriver'sexamination, 102instructionpermit,driver'slicense,ornondriver'slicenseuntiltheperiodofdenialis 103completed.Noindividualwhoisdeniedthedrivingprivilegeunderthissectionshallbe 104eligibleforalimiteddrivingprivilegeissuedundersection302.309. 105 6.Allappealsofdenialsunderthissectionshallbemadeasrequiredbysection 106302.311. 107 7.Theperiodoflimitationforcriminalprosecutionunderthissectionshallbe 108extendedundersubdivision(1)ofsubsection3ofsection556.036. 109 8.Thedirectormaypromulgaterulesandregulationsnecessarytoadministerand 110enforcethissection.Noruleorportionofarulepromulgatedpursuanttotheauthorityofthis 111sectionshallbecomeeffectiveunlessithasbeenpromulgatedpursuanttochapter536. 112 9.Notwithstandinganyprovisionofthischapterthatrequiresanapplicanttoprovide 113proofofMissouriresidencyforrenewalofanoncommercialdriver'slicense,noncommercial 114instructionpermit,ornondriver'slicense,anapplicantwhoissixty-fiveyearsandolderand 115whowaspreviouslyissuedaMissourinoncommercialdriver'slicense,noncommercial 116instructionpermit,orMissourinondriver'slicenseisexemptfromshowingproofofMissouri 117residency. 118 10.Notwithstandinganyprovisionofthischapter,fortherenewalofa 119noncommercialdriver'slicense,noncommercialinstructionpermit,ornondriver'slicense,a 120photocopyofanapplicant'sUnitedStatesbirthcertificatealongwithanotherformof 121identificationapprovedbythedepartmentofrevenue,including,butnotlimitedto,United 122StatesmilitaryidentificationorUnitedStatesmilitarydischargepapers,shallconstitute 123sufficientproofofMissouricitizenship. 124 11.Notwithstandinganyotherprovisionofthischapter,ifanapplicantdoesnotmeet 125therequirementsofsubsection9ofthissectionanddoesnothavetherequireddocumentsto 126proveMissouriresidency,UnitedStatesnaturalization,orlawfulimmigrationstatus,the HB1114 4 127departmentmayissueaone-yeardriver'slicenserenewal.Thisone-timerenewalshallonly 128beissuedtoanapplicantwhopreviouslyhasheldaMissourinoncommercialdriver'slicense, 129noncommercialinstructionpermit,ornondriver'slicenseforaperiodoffifteenyearsormore 130andwhodoesnothavetherequireddocumentstoproveMissouriresidency,UnitedStates 131naturalization,orlawfulimmigrationstatus.Aftertheexpirationoftheone-yearperiod,no 132furtherrenewalshallbeprovidedwithouttheapplicantproducingproofofMissouri 133residency,UnitedStatesnaturalization,orlawfulimmigrationstatus. 302.181.1.Thelicenseissuedpursuanttotheprovisionsofsections302.010to 2302.340shallbeinsuchformasthedirectorshallprescribe,butthelicenseshallbeacard 3madeofplasticorothercomparablematerial.Alllicensesshallbemanufacturedofmaterials 4andprocessesthatwillprohibit,asnearlyaspossible,theabilitytoreproduce,alter, 5counterfeit,forge,orduplicateanylicensewithoutreadydetection.Thelicenseshallalso 6beartheexpirationdateofthelicense,theclassificationofthelicense,thename,dateofbirth, 7residenceaddressincludingthecountyofresidenceoracodenumbercorrespondingtosuch 8countyestablishedbythedepartment,andbriefdescriptionandcoloreddigitizedimageofthe 9licensee,andafacsimileofthesignatureofthelicensee.Thedirectorshallprovideby 10administrativeruletheprocedureandformatforalicenseetoindicateonthebackofthe 11licensetogetherwiththedesignationforananatomicalgiftasprovidedinsection194.240the 12nameandaddressofthepersondesignatedpursuanttosections404.800to404.865asthe 13licensee'sattorneyinfactforthepurposesofadurablepowerofattorneyforhealthcare 14decisions.Nolicenseshallbevaliduntilithasbeensosignedbythelicensee.Ifanyportion 15ofthelicenseispreparedbyaprivatefirm,anycontractwithsuchfirmshallbemadein 16accordancewiththecompetitivepurchasingproceduresasestablishedbythestatedirectorof 17thedivisionofpurchasing.Notwithstandinganyprovisionofthischaptertothecontrary, 18thedirectorshallnotrequireapplicantstobephotographedwhenapplyingfornon- 19REALIDcompliantdriver'slicensesornondriver'slicenses;anapplicantmayinstead 20submitanalternativephotographordigitizedimageoftheapplicant,providedthatthe 21photographordigitizedimagesubmittedis: 22 (1)Incolor; 23 (2)Sizedsuchthattheapplicant'sheadisbetweenoneinchandoneandthree- 24eighthsinches; 25 (3)Takenwithinthelastsixmonthstoreflecttheapplicant'scurrent 26appearance; 27 (4)Takeninfrontofaplainwhiteorsolidcolorbackground;and 28 (5)Takeninfull-faceviewdirectlyfacingthecamerawithaneutralfacial 29expressionwithbotheyeswideopenandvisible. 30 HB1114 5 31Theapplicantshallnotwearahatorheadcoveringthatobstructstheapplicant'shair 32orhairlineinthealternativephotographordigitizedimageunlessthehatorhead 33coveringisworndailyforareligiouspurpose.Theapplicantshallnotwear 34headphones,wirelesshands-freedevices,orothersimilaritemsinthealternative 35photographordigitizedimage.Ifanapplicantnormallywearsamedicaldeviceor 36similararticle,suchitemmaybeworninanapplicant'salternativephotographor 37digitizedimage. 38 2.Alldigitalimagesproducedforlicensesshallbecomethepropertyofthe 39departmentofrevenue. 40 3.Thelicenseissuedshallbecarriedatalltimesbytheholderthereofwhiledrivinga 41motorvehicle,andshallbedisplayedupondemandofanyofficerofthehighwaypatrol,or 42anypoliceofficerorpeaceofficer,oranyotherdulyauthorizedperson,forinspectionwhen 43demandismadetherefor.Failureofanyoperatorofamotorvehicletoexhibithisorher 44licensetoanydulyauthorizedofficershallbepresumptiveevidencethatsuchpersonisnota 45dulylicensedoperator. 46 4.Thedirectorofrevenueshallnotissuealicensewithoutafacialdigitalimageof 47thelicenseapplicant,exceptasprovidedpursuanttosubsection7ofthissection.Adigital 48imageoftheapplicant'sfullfacialfeaturesshallbetakeninamannerprescribedbythe 49director.Nodigitalimageshallbetakenwearinganythingwhichcloaksthefacialfeaturesof 50theindividual. 51 5.Thedepartmentofrevenuemayissueatemporarylicenseorafulllicensewithout 52thephotographorwiththelastphotographordigitalimageinthedepartment'srecordsto 53membersoftheArmedForces,exceptthatwheresuchtemporarylicenseisissueditshallbe 54validonlyuntiltheapplicantshallhavehadtimetoappearandhavehisorherpicturetaken 55andalicensewithhisorherphotographissued. 56 6.Thedepartmentofrevenueshallissueuponrequestanondriver'slicensecard 57containingessentiallythesameinformationandphotographordigitalimage,exceptas 58providedpursuanttosubsection7ofthissection,asthedriver'slicenseuponpaymentofsix 59dollars.Allnondriver'slicensesshallexpireontheapplicant'sbirthdayinthesixthyearafter 60issuance.Apersonwhohaspassedhisorherseventiethbirthdayshalluponapplicationbe 61issuedanonexpiringnondriver'slicensecard.Notwithstandinganyotherprovisionofthis 62chapter,anondriver'slicensecontainingaconcealedcarryendorsementshallexpirethree 63yearsfromthedatethecertificateofqualificationwasissuedpursuanttosection571.101,as 64section571.101existedpriortoAugust28,2013.Thefeefornondriver'slicensesissuedfora 65periodexceedingthreeyearsissixdollarsorthreedollarsfornondriver'slicensesissuedfora 66periodofthreeyearsorless.Thenondriver'slicensecardshallbeusedforidentification 67purposesonlyandshallnotbevalidasalicense. HB1114 6 68 7.Ifotherwiseeligible,anapplicantmayreceiveadriver'slicenseornondriver's 69licensewithoutaphotographordigitalimageoftheapplicant'sfullfacialfeaturesexceptthat 70suchapplicant'sphotographordigitalimageshallbetakenandmaintainedbythedirectorand 71notprintedonsuchlicense.Inordertoqualifyforalicensewithoutaphotographordigital 72imagepursuanttothissectiontheapplicantmust: 73 (1)Presentaformprovidedbythedepartmentofrevenuerequestingtheapplicant's 74photographbeomittedfromthelicenseornondriver'slicenseduetoreligiousaffiliations. 75Theformshallbesignedbytheapplicantandanothermemberofthereligioustenant 76verifyingthephotographordigitalimageexemptiononthelicenseornondriver'slicenseis 77requiredaspartoftheirreligiousaffiliation.Therequiredsignaturesontheprescribedform 78shallbeproperlynotarized; 79 (2)ProvidesatisfactoryprooftothedirectorthattheapplicanthasbeenaUnited 80Statescitizenforatleastfiveyearsandaresidentofthisstateforatleastoneyear,exceptthat 81anapplicantmovingtothisstatepossessingavaliddriver'slicensefromanotherstatewithout 82aphotographshallbeexemptfromtheone-yearstateresidencyrequirement.Thedirector 83mayestablishrulesnecessarytodeterminesatisfactoryproofofcitizenshipandresidency 84pursuanttothissection; 85 (3)Applicationsforadriver'slicenseornondriver'slicensewithoutaphotographor 86digitalimagemustbemadeinpersonatalicenseofficedeterminedbythedirector.The 87directorisauthorizedtolimitthenumberofofficesthatmayissueadriver'sornondriver's 88licensewithoutaphotographordigitalimagepursuanttothissection. 89 8.Thedepartmentofrevenueshallmakeavailable,atoneormorelocationswithin 90thestate,anopportunityforindividualstohavetheirfullfacialphotographtakenbyan 91employeeofthedepartmentofrevenue,ortheirdesignee,whoisofthesamesexasthe 92individualbeingphotographed,inasegregatedlocation. 93 9.BeginningJuly1,2005,thedirectorshallnotissueadriver'slicenseora 94nondriver'slicenseforaperiodthatexceedsanapplicant'slawfulpresenceintheUnited 95States.Thedirectormay,byruleorregulation,establishprocedurestoverifythelawful 96presenceoftheapplicantandestablishthedurationofanydriver'slicenseornondriver's 97licenseissuedunderthissection. 98 10.(1)Notwithstandinganybiometricdatarestrictionscontainedinsection302.170, 99thedepartmentofrevenueisherebyauthorizedtodesignandimplementasecuredigital 100driver'slicenseprogramthatallowsapplicantsapplyingforadriver'slicenseinaccordance 101withthischaptertoobtainasecuredigitaldriver'slicenseinadditiontothephysicalcard- 102basedlicensespecifiedinthissection. 103 (2)Adigitaldriver'slicenseasdescribedinthissubsectionshallbeacceptedforall 104purposesforwhichalicense,asdefinedinsection302.010,isused. HB1114 7 105 (3)Thedepartmentmaycontractwithoneormoreentitiestodevelopthesecure 106digitaldriver'slicensesystem.Thedepartmentorentitymaydevelopamobilesoftware 107applicationcapableofbeingutilizedthroughaperson'selectronicdevicetoaccessthe 108person'ssecuredigitaldriver'slicense. 109 (4)Thedepartmentshallsuspend,disable,orterminateaperson'sparticipationinthe 110securedigitaldriver'slicenseprogramif: 111 (a)Theperson'sdrivingprivilegeissuspended,revoked,denied,withdrawn,or 112cancelledasprovidedinthischapter;or 113 (b)Thepersonreportsthattheperson'selectronicdevicehasbeenlost,stolen,or 114compromised. 115 11.Thedirectorofthedepartmentofrevenuemaypromulgaterulesasnecessaryfor 116theimplementationofthissection.Anyruleorportionofarule,asthattermisdefinedin 117section536.010thatiscreatedundertheauthoritydelegatedinthissectionshallbecome 118effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,if 119applicable,section536.028.Thissectionandchapter536arenonseverableandifanyofthe 120powersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe 121effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then 122thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2020, 123shallbeinvalidandvoid. 302.735.1.AnapplicationshallnotbetakenfromanonresidentafterSeptember30, 22005.Theapplicationforacommercialdriver'slicenseshallinclude,butnotbelimitedto, 3theapplicant'slegalname,mailingandresidenceaddress,ifdifferent,aphysicaldescription 4oftheperson,includingsex,height,weightandeyecolor,theperson'sSocialSecurity 5numberforapplicantsapplyingforaREALID-compliantlicense, dateofbirth,andany 6otherinformationdeemedappropriatebythedirector.Theapplicationshallalsorequire, 7beginningSeptember30,2005,theapplicanttoprovidethenamesofallstateswherethe 8applicanthasbeenpreviouslylicensedtodriveanytypeofmotorvehicleduringthe 9precedingtenyears. 10 2.Acommercialdriver'slicenseshallexpireontheapplicant'sbirthdayinthesixth 11yearafterissuance,unlessthelicensemustbeissuedforashorterperiodduetoother 12requirementsoflaworfortransitionorstaggeringofworkasdeterminedbythedirector,and 13mustberenewedonorbeforethedateofexpiration.Whenapersonchangessuchperson's 14nameanapplicationforaduplicatelicenseshallbemadetothedirectorofrevenue.Whena 15personchangessuchperson'smailingaddressorresidencetheapplicantshallnotifythe 16directorofrevenueofsaidchange,however,noapplicationforaduplicatelicenseisrequired. 17Acommerciallicenseissuedpursuanttothissectiontoanapplicantlessthantwenty-one 18yearsofageandseventyyearsofageandoldershallexpireontheapplicant'sbirthdayinthe HB1114 8 19thirdyearafterissuance,unlessthelicensemustbeissuedforashorterperiodasdetermined 20bythedirector. 21 3.Acommercialdriver'slicensecontainingahazardousmaterialsendorsementissued 22toanapplicantwhoisbetweentheageoftwenty-oneandsixty-nineshallnotbeissuedfora 23periodexceedingfiveyearsfromtheapprovaldateofthesecuritythreatassessmentas 29toanapplicantwhoisseventyyearsofageoroldershallnotbeissuedforaperiodexceeding 30threeyears.Thedirectorshallnotrequiresuchdriverstoobtainasecuritythreatassessment 31morefrequentlythansuchassessmentisrequiredbytheTransportationSecurity 32AdministrationundertheUnitingandStrengtheningAmericabyProvidingAppropriate 33ToolsRequiredtoInterceptandObstructTerrorismAct(USAPATRIOTACT)of2001. 34 (1)Thestateshallimmediatelyrevokeahazardousmaterialsendorsementupon 35receiptofaninitialdeterminationofthreatassessmentandimmediaterevocationfromthe 36TransportationSecurityAdministrationasdefinedby49CFR1572.13(a). 37 (2)Thestateshallrevokeordenyahazardousmaterialsendorsementwithinfifteen 38daysofreceiptofafinaldeterminationofthreatassessmentfromtheTransportationSecurity 39AdministrationasrequiredbyCFR1572.13(a). 40 6.Thefeeforacommercialdriver'slicenseorrenewalcommercialdriver'slicense 41issuedforaperiodgreaterthanthreeyearsshallbefortydollars. 42 7.Thefeeforacommercialdriver'slicenseorrenewalcommercialdriver'slicense 43issuedforaperiodofthreeyearsorlessshallbetwentydollars. 44 8.Thefeeforaduplicatecommercialdriver'slicenseshallbetwentydollars. 45 9.Inorderforthedirectortoproperlytransitiondriver'slicenserequirementsunder 46theMotorCarrierSafetyImprovementActof1999andtheUnitingandStrengthening 47AmericabyProvidingAppropriateToolsRequiredtoInterceptandObstructTerrorismAct 48(USAPATRIOTACT)of2001,thedirectorisauthorizedtostaggerexpirationdatesand 49makeadjustmentsforanyfees,includingdriverexaminationfeesthatareincurredbythe 50driverasaresultoftheinitialissuanceofatransitionallicenserequiredtocomplywithsuch 51acts. 52 10.Withinthirtydaysaftermovingtothisstate,theholderofacommercialdriver's 53licenseshallapplyforacommercialdriver'slicenseinthisstate.Theapplicantshallmeetall 54otherrequirementsofsections302.700to302.780,exceptthatthedirectormaywaivethe 55drivingtestforacommercialdriver'slicenseasrequiredinsection302.720iftheapplicant HB1114 9 56foracommercialdriver'slicensehasavalidcommercialdriver'slicensefromastatewhich 57hasrequirementsforissuanceofsuchlicensecomparabletothoseinthisstate. 58 11.Anypersonwhofalsifiesanyinformationinanapplicationortestfora 59commercialdriver'slicenseshallnotbelicensedtooperateacommercialmotorvehicle,or 60theperson'scommercialdriver'slicenseshallbecancelled,foraperiodofoneyearafterthe 61directordiscoverssuchfalsification. 62 12.BeginningJuly1,2005,thedirectorshallnotissueacommercialdriver'slicense 63underthissectionunlessthedirectorverifiesthattheapplicantislawfullypresentinthe 64UnitedStatesbeforeacceptingtheapplication.Iflawfulpresenceisgrantedforatemporary 65period,nocommercialdriver'slicenseshallbeissued.Thedirectormay,byruleor 66regulation,establishprocedurestoverifythelawfulpresenceoftheapplicantandestablish 67thedurationofanycommercialdriver'slicenseissuedunderthissection.Noruleorportion 68ofarulepromulgatedpursuanttotheauthorityofthissectionshallbecomeeffectiveunlessit 69hasbeenpromulgatedpursuanttochapter536. 70 13.(1)EffectiveDecember19,2005,notwithstandinganyprovisionsofsubsections 711and5ofthissectiontothecontrary,thedirectormayissueanondomiciledcommercial 72driver'slicenseorcommercialdriver'sinstructionpermittoaresidentofaforeignjurisdiction 73iftheUnitedStatesSecretaryofTransportationhasdeterminedthatthecommercialmotor 74vehicletestingandlicensingstandardsintheforeignjurisdictiondonotmeetthetesting 75standardsestablishedin49CFR383. 76 (2)Anyapplicantforanondomiciledcommercialdriver'slicenseorcommercial 77driver'sinstructionpermitmustpresentevidencesatisfactorytothedirectorthattheapplicant 78currentlyhasemploymentwithanemployerinthisstate.Thenondomiciledapplicantmust 79meetthesametesting,driverrecordrequirements,conditions,andissubjecttothesame 80disqualificationandconvictionreportingrequirementsapplicabletoresidentcommercial 81drivers. 82 (3)Thenondomiciledcommercialdriver'slicensewillexpireonthesamedatethat 83thedocumentsestablishinglawfulpresenceforemploymentexpire.Theword 84"nondomiciled"shallappearonthefaceofthenondomiciledcommercialdriver'slicense. 85AnyapplicantforaMissourinondomiciledcommercialdriver'slicenseorcommercial 86driver'sinstructionpermitmustfirstsurrenderanynondomiciledcommercialdriver'slicense 87issuedbyanotherstate. 88 (4)Thenondomiciledcommercialdriver'slicenseapplicantmustpaythesamefeesas 89requiredfortheissuanceofaresidentcommercialdriver'slicenseorcommercialdriver's 90instructionpermit. HB1114 10 91 14.Foreignjurisdictionforpurposesofissuinganondomiciledcommercialdriver's 92licenseorcommercialdriver'sinstructionpermitunderthissectionshallnotincludeanyof 93thefiftystatesoftheUnitedStatesorCanadaorMexico. 304.351.1.Thedriverofavehicleapproachinganintersectionshallyieldtheright- 2of-waytoavehiclewhichhasenteredtheintersectionfromadifferenthighway,provided, 3however,thereisnoformoftrafficcontrolatsuchintersection. 4 2.Whentwovehiclesenteranintersectionfromdifferenthighwaysatapproximately 5thesametime,thedriverofthevehicleontheleftshallyieldtheright-of-waytothedriverof 6thevehicleontheright.Thissubsectionshallnotapplytovehiclesapproachingeachother 7fromoppositedirectionswhenthedriverofoneofsuchvehiclesisattemptingtoorismaking 8aleftturn. 9 3.Thedriverofavehiclewithinanintersectionintendingtoturntotheleftshallyield 10theright-of-waytoanyvehicleapproachingfromtheoppositedirectionwhichiswithinthe 11intersectionorsoclosetheretoastoconstituteanimmediatehazard. 12 4.(1)Thestatehighwaysandtransportationcommissionwithreferencetostate 13highwaysandlocalauthoritieswithreferencetootherhighwaysundertheirjurisdictionmay 14designatethroughhighwaysanderectstopsignsoryieldsignsatspecifiedentrancesthereto, 15ormaydesignateanyintersectionasastopintersectionorasayieldintersectionanderect 16stopsignsoryieldsignsatoneormoreentrancestosuchintersection. 17 (2)Preferentialright-of-wayatanintersectionmaybeindicatedbystopsignsoryield 18signsasauthorizedinthissection: 19 (a)Exceptwhendirectedtoproceedbyapoliceofficerortraffic-controlsignal,every 20driverofavehicleapproachingastopintersection,indicatedbyastopsign,shallstopata 21clearlymarkedstopline,butifnone,beforeenteringthecrosswalkonthenearsideofthe 22intersection,orifnone,thenatthepointnearesttheintersectingroadwaywherethedriverhas 23aviewofapproachingtrafficintheintersectingroadwaybeforeenteringtheintersection. 24Afterhavingstopped,thedrivershallyieldtheright-of-waytoanyvehiclewhichhasentered 25theintersectionfromanotherhighwayorwhichisapproachingsocloselyonthehighwayas 26toconstituteanimmediatehazardduringthetimewhensuchdriverismovingacrossor 27withintheintersection. 28 (b)Thedriverofavehicleapproachingayieldsignshallinobediencetothesign 29slowdowntoaspeedreasonabletotheexistingconditionsand,ifrequiredforsafetytostop, 30shallstopataclearlymarkedstopline,butifnone,thenatthepointnearesttheintersecting 31roadwaywherethedriverhasaviewofapproachingtrafficontheintersectingroadway. 32Afterslowingorstoppingthedrivershallyieldtheright-of-waytoanyvehicleinthe 33intersectionorapproachingonanotherhighwaysocloselyastoconstituteanimmediate 34hazardduringthetimesuchtrafficismovingacrossorwithintheintersection. HB1114 11 35 5.Thedriverofavehicleabouttoenterorcrossahighwayfromanalley,buildingor 36anyprivateroadordrivewayshallyieldtheright-of-waytoallvehiclesapproachingonthe 37highwaytobeentered. 38 6.Thedriverofavehicleintendingtomakealeftturnintoanalley,privateroador 39drivewayshallyieldtheright-of-waytoanyvehicleapproachingfromtheoppositedirection 40whenthemakingofsuchleftturnwouldcreateatraffichazard. 41 7.Thestatehighwaysandtransportationcommissionorlocalauthoritieswithrespect 42toroadsundertheirrespectivejurisdictions,onanysectionwhereconstructionormajor 43maintenanceoperationsarebeingeffected,mayfixaspeedlimitinsuchareasbypostingof 44appropriatesigns,andtheoperationofamotorvehicleinexcessofsuchspeedlimitinthe 45areasopostedshallbedeemedprimafacieevidenceofcarelessandimprudentdrivinganda 46violationofsection304.010. 47 8.Notwithstandingtheprovisionsofsection304.361,violationofthissectionshall 48bedeemedaclassCmisdemeanor. 49 9.Inadditiontothepenaltyspecifiedinsubsection8ofthissection,anypersonwho 50pleadsguiltytoorisfoundguiltyofaviolationofthissectioninwhichtheoffenderisfound 51tohavecausedphysicalinjury,thereshallbeassessedapenaltyofuptotwohundreddollars. 52Thecourtmayissueanorderofsuspensionofsuchperson'sdrivingprivilegeforaperiodof 53thirtydays. 54 10.Inadditiontothepenaltyspecifiedinsubsection8ofthissection,anypersonwho 55pleadsguiltytoorisfoundguiltyofaviolationofthissectioninwhichtheoffenderisfound 56tohavecausedseriousphysicalinjury,thereshallbeassessedapenaltyofuptofivehundred 57dollars.Thecourtmayissueanorderofsuspensionofsuchperson'sdrivingprivilegefora 58periodofninetydays. 59 11.Inadditiontothepenaltyspecifiedinsubsection8ofthissection,anypersonwho 60pleadsguiltytoorisfoundguiltyofaviolationofthissectioninwhichtheoffenderisfound 61tohavecausedafatality,thereshallbeassessedapenaltyofuptoonethousanddollars.The 62courtmayissueanorderofsuspensionofsuchperson'sdrivingprivilegeforaperiodofsix 63months. 64 12.Asusedinsubsections9and10ofthissection,theterms"physicalinjury"and 65"seriousphysicalinjury"shallhavethemeaningsascribedtotheminsection556.061. 66 13.Foranycourt-orderedsuspensionundersubsection9,10,or11ofthissection,the 67directorofthedepartmentshallimposesuchsuspensionassetforthinthecourtorder.The 68orderofsuspensionshallincludethenameoftheoffender,theoffender'sdriver'slicense 69number,[SocialSecuritynumber,]andtheeffectivedateofthesuspension.Anyappealofa 70suspensionimposedundersubsection9,10,or11ofthissectionshallbeadirectappealofthe 71courtorderandsubjecttoreviewbythepresidingjudgeofthecircuitcourtoranotherjudge HB1114 12 72withinthecircuitotherthanthejudgewhoissuedtheoriginalordertosuspendthedriver's 73license.Thedirectorofrevenue'sentryofthecourt-orderedsuspensiononthedrivingrecord 74isnotadecisionsubjecttoreviewundersection302.311.Anysuspensionofthedriver's 75licenseorderedbythecourtunderthissectionshallbeinadditiontoanyothersuspensionthat 76mayoccurasaresultoftheconvictionunderotherprovisionsoflaw. ✔ HB1114 13
