3andrevise,asnecessary,astatewideassessmentsystemthatprovidesmaximumflexibilityfor 4localschooldistrictstodeterminethedegreetowhichstudentsinthepublicschoolsofthe 5stateareproficientintheknowledge,skills,andcompetenciesadoptedbysuchboard 6pursuanttosection160.514.Thestatewideassessmentsystemshallassessproblemsolving, 7analyticalability,evaluation,creativity,andapplicationabilityinthedifferentcontentareas 8andshallbeperformance-basedtoidentifywhatstudentsknow,aswellaswhattheyareable 3.Thestateboardofeducationshallsuggest,butnotmandate,criteriaforaschoolto 48demonstratethatitsstudentslearntheknowledge,skillsandcompetenciesatexemplary 49levelsworthyofimitationbystudentsinotherschoolsinthestateandnation.Exemplary 50levelsshallbemeasuredbythestatewideassessmentsystemdevelopedpursuantto 51subsection1ofthissection,oruntilsaidstatewideassessmentsystemisavailable,by 52indicatorsapprovedforsuchusebythestateboardofeducation.Theprovisionsofotherlaw 53tothecontrarynotwithstanding,thecommissionerofeducationmay,uponrequestofthe 54schooldistrict,presentaplanforthewaiverofrulesandregulationstoanysuchschool,tobe 55knownas"OutstandingSchoolsWaivers",consistentwiththeprovisionsofsubsection4of 56thissection. 57 4.Foranyschoolthatmeetsthecriteriaestablishedbythestateboardofeducationfor 58threesuccessiveschoolyearspursuanttotheprovisionsofsubsection3ofthissection,by 59Augustfirstfollowingthethirdsuchschoolyear,thecommissionerofeducationshallpresent 60aplantothesuperintendentoftheschooldistrictinwhichsuchschoolislocatedforthe 61waiverofrulesandregulationstopromoteflexibilityintheoperationsoftheschoolandto 62enhanceandencourageefficiencyinthedeliveryofinstructionalservices.Theprovisionsof 63otherlawtothecontrarynotwithstanding,theplanpresentedtothesuperintendentshall 64provideasummarywaiver,withnoconditions,forthepupiltestingrequirementspursuantto 65section160.257,intheschool.Further,theprovisionsofotherlawtothecontrary 66notwithstanding,theplanshalldetailameansforthewaiverofrequirementsotherwise 67imposedontheschoolrelatedtotheauthorityofthestateboardofeducationtoclassify 78suchstudenthasbeeneducatedforthreefullschoolyearsinaschoolinthisstate,orinany 79otherstate,inwhichEnglishistheprimarylanguage. 80 [6.]3.Thestateboardofeducationshallidentifyor,ifnecessary,establishoneor 81moredevelopmentallyappropriatealternateassessmentsforstudentswhoreceivespecial 82educationalservices,asthattermisdefinedpursuanttosection162.675.Inthedevelopment 83ofsuchalternateassessments,thestateboardshallestablishanadvisorypanelconsistingofa 84majorityofactivespecialeducationteachersresidinginMissouriandothereducation 85professionalsasappropriatetoresearchavailableassessmentoptions.Theadvisorypanel 86shallattempttoidentifypreexistingdevelopmentallyappropriatealternateassessmentsbut 87shall,ifnecessary,developalternateassessmentsandrecommendoneormorealternate 88assessmentsforadoptionbythestateboard.Thestateboardshallconsiderthe 89recommendationsoftheadvisorycouncilinidentifyingor,ifnecessary,establishingsuch 90alternateassessmentorassessments.Anystudentwhoreceivesspecialeducationalservices, 91asthattermisdefinedpursuanttosection162.675,shallbeassessedbyanalternate 92assessmentestablishedpursuanttothissubsectionuponadeterminationbythestudent's 93individualizededucationprogramteamthatsuchalternateassessmentismoreappropriateto 94assessthestudent'sknowledge,skillsandcompetenciesthantheassessmentdeveloped 95pursuanttosubsection1ofthissection.Thealternateassessmentshallevaluatethestudent's 96independentlivingskills,whichincludehoweffectivelythestudentaddressescommonlife 97demandsandhowwellthestudentmeetsstandardsforpersonalindependenceexpectedfor 98someoneinthestudent'sagegroup,socioculturalbackground,andcommunitysetting. 99 [7.]4.Thestateboardofeducationshallalsodeveloprecommendationsregarding 100alternateassessmentsforanymilitarydependentwhorelocatestoMissouriafterthe 101commencementofaschoolterm,inordertoaccommodatesuchstudentwhileensuringthat 102heorsheisproficientintheknowledge,skills,andcompetenciesadoptedundersection 103160.514. 160.526.1.Inestablishing,evaluating,modifying,andrevisingtheacademic 2performancestandardsandlearningstandardsauthorizedbysection160.514[andthe 3statewideassessmentsystemauthorizedbysubsection1ofsection160.518], thestateboard 4ofeducationshallconsidertheworkthathasbeendonebyotherstates,recognizedregional 5andnationalexperts,professionaleducationdiscipline-basedassociations,otherprofessional HB1123 10 6educationassociations,theworkproductfromthedepartmentofhighereducationand 7workforcedevelopment'scurriculumalignmentinitiative,oranyotherworkinthepublic 8domain. 9 2.[Thestateboardofeducationshallbycontractenlisttheassistanceofsuchnational 10expertstoreceivereports,adviceandcounselonaregularbasispertainingtothevalidityand 11reliabilityofthestatewideassessmentsystem.Thereportsfromsuchexpertsshallbe 12receivedbythestateboardofeducation.Withinsixmonthspriortoimplementationofor 13modificationorrevisiontothestatewideassessmentsystem,thecommissionerofeducation 14shallinformthepresidentprotemporeofthesenateandthespeakerofthehouseof 15representativesabouttheprocedurestoimplement,modify,orrevisethestatewideassessment 16system,includingareportrelatedtothereliabilityandvalidityoftheassessmentinstruments, 17andthegeneralassemblymay,withinthenextsixtylegislativedays,vetosuch 18implementation,modification,orrevisionbyconcurrentresolutionadoptedbymajority 19voteofboththesenateandthehouseofrepresentatives. 20 3.]Thecommissionerofeducationshallestablishaprocedureforthestateboardof 21educationtoregularlyreceiveadviceandcounselfromprofessionaleducatorsatalllevelsin 22thestate,districtboardsofeducation,parents,representativesfrombusinessandindustry,the 23generalassembly,andlaborandcommunityleaderspertainingtotheimplementationof 24sections160.514and160.518.ByDecember31,2014,thecommissionerofeducationshall 25revisethisproceduretoallowthestateboardofeducationtoregularlyreceiveadviceand 26counselfromprofessionaleducatorsatalllevelsinthestate,districtboardsofeducation, 27parents,representativesfrombusinessandindustry,thegeneralassembly,andlaborand 28communityleaderswheneverthestateboarddevelops,evaluates,modifies,orrevises 29academicperformancestandards[,] orlearningstandards[, orthestatewideassessment 30system] under[sections] section160.514[and160.518]. Theprocedureshallinclude,ata 31minimum,theappointmentofadhoccommittees. 160.570.1.Nothinginthissectionorsection105.1209shallbeconstruedtoaffector 2limitanystateagency'sauthorityregardingprofessionalregistration,licensingorissuanceof 3professionalcertificates,norshallthissectionbeconstruedtolimitoraffecttheauthorityof 4thestateboardofeducationtoexamineapplicantsandissuehighschoolequivalency 5certificates. 6 2.Theschoolboardofeachschooldistrictshallestablishawrittenpolicyonstudent 7participationin[statewide] nationallynorm-referencedassessments.Thepolicyshallbe 8providedtoeachstudentandtheparent,guardianorotherpersonresponsibleforevery 9studentundereighteenyearsofageatthebeginningofeachschoolyearandacopyofthe 10policyshallbemaintainedinthedistrictofficeandshallbeavailableforviewingbythe 11publicduringbusinesshoursofthedistrictoffice.Aschoolboardmayestablishapolicy HB1123 11 12designedtoencouragestudentstogivetheirbesteffortsoneachportionofany[statewide] 13nationallynorm-referencedassessmentestablishedpursuanttosection160.518whichmay 14includebutisnotlimitedtoincentivesorsupplementaryworkasaconsequenceof 15performance. 16 3.Innocaseshallthestateboardofeducationoranyotherstateagencyestablishany 17singletestorgroupoftestsasaconditionorrequirementforhighschoolgraduationorasa 18requirementforastate-approveddiploma. 160.720.1.Thedepartmentofelementaryandsecondaryeducationshallidentifyas 2apriorityschoolanyschoolbuildingorattendancecenterthatfailstomeetacceptable 3standardsofstudentachievementestablishedbythestateboardofeducationandbasedupon 4factorswhichshallinclude,butnotbelimitedto,studentassessments,graduationrate,drop- 5outrate,schoolattendancerate,graduateplacementincollege,vocationalortechnicalschool, 6orhigh-wageemploymentandincidenceofschoolviolence. 7 2.Theboardofeducationofanydistrictthatcontainsapriorityschoolshallsubmita 8comprehensiveschoolimprovementplanthatprovidesforthefollowing: 9 (1)Identificationoftheareasofacademicdeficiencyinstudentperformanceonthe 10[statewide] nationallynorm-referencedassessmentestablishedpursuanttosection160.518 11bydisaggregatingscoresbaseduponschool,grade,academiccontentareaandstudent 12demographicsubgroups,whichshallinclude,butshallnotbelimitedto,race,ethnicity, 13disabilitystatus,migrantstatus,limitedEnglishproficiency,andeconomicdisadvantage; 14 (2)Implementationofresearch-basedstrategiestoassistthepriorityschoolin 15addressingtheareasofdeficiency; 16 (3)Alignmentofthepriorityschool'scurriculumtoaddressdeficienciesinstudent 17achievement; 18 (4)Reallocationofdistrictresourcestoaddresstheareasofacademicdeficiency, 19whichshallincludefocusingavailablefundingonprofessionaldevelopmentintheareasof 20deficiency;and 21 (5)Listingofallschoolbuildingsandattendancecentersdeclaredtobepriority 22schoolsinthedistrict'sannualschoolaccountabilityreportdistributedpursuanttosection 23160.522. 24 3.Thestateboardofeducationmayappointateamtoconductaneducationalauditof 25anypriorityschooltodeterminethefactorsthathavecontributedtothelackofstudent 26achievementandshallgiveauditprioritytoschoolsbaseduponfailuretomeetstandardsof 27studentachievementasestablishedpursuanttothissection. 28 (1)Anauditteamshallincludeanexperiencedteacherandanexperienced 29administratorfromsuccessfulschooldistrictsofcomparablesizeandper-pupilfunding.The 30sizeoftheauditteamshallbebaseduponthesizeoftheschooltobeaudited; HB1123 12 31 (2)Theauditteamshallreportitsfindingstothestateboardofeducationandthe 32localboardofeducation; 33 (3)Thestateboardmayrequireallorpartofthosefindingstobeaddressedinthe 34comprehensiveschoolimprovementplanrequiredpursuanttothissection. 35 4.Comprehensiveschoolimprovementplansshallbeevaluatedbaseduponstandards 36establishedpursuanttosubsection2ofthissectionanduponthefollowingtimelines: 37 (1)Thecomprehensiveschoolimprovementplanshallbesubmittedtothe 38departmentofelementaryandsecondaryeducationonorbeforeAugustfifteenthfollowing 39anyschoolyearinwhichaschooldistrictbuildingmeetsthecriteriaestablishedunder 40subsection1ofthissection; 41 (2)Thedepartmentofelementaryandsecondaryeducationshallreviewandidentify 42areasofconcernintheplanwithinsixtydaysofreceipt;and 43 (3)Changestotheplanshallbeforwardedtothedepartmentofelementaryand 44secondaryeducationwithinsixtydaysofnoticetothedistrictoftheareasofconcern. 45 5.Thedepartmentofelementaryandsecondaryeducationshallwithholdfunds 46authorizedinsection163.031fromanyschooldistrictthatfailstosubmitacomprehensive 47schoolimprovementplanbaseduponthestandardsandtimelinesestablishedinthissection. 48Withheldfundsshallbereleaseduponsubmissionofacomprehensiveschoolimprovement 49planthatmeetstheestablishedrequirements. 50 6.Designationasapriorityschoolandtheeffectivenessoftheschooldistrictin 51implementingthecomprehensiveschoolimprovementplanrequiredunderthissectionshall 52beconsideredbythestateboardofeducationintheschooldistrict'saccreditationgranted 53pursuanttosection161.092. 54 7.Noruleorportionofarulepromulgatedunderthissectionshallbecomeeffective 55unlessithasbeenpromulgatedpursuanttochapter536. 161.855.1.ByOctober1,2014,thestateboardofeducationshallconvenework 2groupscomposedofeducationprofessionalstodevelopandrecommendacademic 3performancestandards.Theworkgroupsshallbecomposedofindividualsasprovidedin 4section160.514.Thestateboardofeducationandtheworkgroupsshallfollowthe 5proceduresandconductthepublichearingsrequiredbysection160.514.Thestateboardof 6educationshallconveneseparateworkgroupsforthefollowingsubjectareas:English 7languagearts;mathematics;science;andhistoryandgovernments.Foreachofthesefour 8subjectareas,thestateboardofeducationshallconvenetwoseparateworkgroups,onework 9groupforgradeskindergartenthroughfiveandanotherworkgroupforgradessixthrough 10twelve. 11 2.Theworkgroupsshalldevelopandrecommendacademicperformancestandardsto 12thestateboardofeducationbyOctober1,2015.Theworkgroupsshallreportontheir HB1123 13 13progressindevelopingtheacademicperformancestandardstothepresidentprotemporeof 14thesenateandthespeakerofthehouseofrepresentativesonamonthlybasis. 15 3.Thestateboardofeducationshalladoptandimplementacademicperformance 16standardsbeginninginthe2016-17schoolyear.[Thestateboardofeducationshallalignthe 17statewideassessmentsystemtotheacademicperformancestandardsasneeded. 18 4.Thedepartmentofelementaryandsecondaryeducationshallpilotassessments 19fromtheSmarterBalancedAssessmentConsortiumduringthe2014-15schoolyear. 20Notwithstandinganyrulesadoptedbythestateboardofeducationorthedepartmentof 21elementaryandsecondaryeducationinplaceonAugust28,2014,forthe2014-15school 22year,andatanytimethestateboardofeducationorthedepartmentofelementaryand 23secondaryeducationimplementsanewstatewideassessmentsystem,developsnewacademic 24performancestandards,ormakeschangestotheMissourischoolimprovementprogram,the 25firstyearofsuchstatewideassessmentsystemandperformanceindicatorsshallbeutilizedas 26apilotyearforthepurposesofcalculatingadistrict'sannualperformancereportunderthe 27Missourischoolimprovementprogram.Theresultsofastatewidepilotshallnotbeusedto 28lowerapublicschooldistrict'saccreditationorforateacher'sevaluation. 29 5.]4.Anypersonperformingworkforaschooldistrictorcharterschoolforwhich 30teachercertificationoradministratorcertificationisregularlyrequiredunderthelawsrelating 31tothecertificationofteachersoradministratorsshallbeanemployeeoftheschooldistrictor 32charterschool.Allevaluationsofanysuchpersonshallbemaintainedintheteacher'sor 33administrator'spersonnelfileandshallnotbesharedwithanystateorfederalagency. 161.1085.Forpurposesofsections161.1080to161.1130,thefollowingtermsmean: 2 (1)"Department",thedepartmentofelementaryandsecondaryeducation; HB1123 17 12 2.Thedistrictpolicyshallrequireacademicandcareercounselingtotakeplaceprior 13tograduationsothattheschoolmayattempttoprovidesufficientopportunitiestothestudent 14tograduatecollege-readyorcareer-readyandontime. 15 3.Eachschooldistrictshalladoptapolicytopermitthewaiveroftherequirementsof 16thissectionforanystudentwithadisabilityifrecommendedbythestudent'sIEPcommittee. 17Forpurposesofthissubsection,"IEP"meansindividualizededucationprogram. 168.749.1.Beginningwithschoolyear2010-11,teacherswhoelecttoparticipatein 2theteacherchoicecompensationpackageshallbeeligibleforstipendsbasedonthefollowing 3criteria: 4 (1)Scoreonavalue-addedtestinstrumentorinstruments.Suchinstrumentsshallbe 5definedasthosewhichgiveareliablemeasurementoftheskillsandknowledgetransferredto 6studentsduringthetimetheyareinateacher'sclassroomandshallbeselectedbytheschool 7districtfromoneormoreofthefollowingassessments: 8 (a)Alistofrecognizedvalue-addedinstrumentsdevelopedbythedepartmentof 9elementaryandsecondaryeducation; 10 (b)Scoresonthe[statewide] assessmentsestablishedundersection160.518maybe 11usedforthispurpose,andthedepartmentofelementaryandsecondaryeducationshall 12developaprocedureforidentifyingthevalueaddedbyteachersthataddressesthefactthat 13notallsubjectsarenecessarilytestedatallgradelevelseachyear[underthestateassessment 14program]; 15 (c)ScoresonannualtestsrequiredbythefederalElementaryandSecondary 16EducationActreauthorizationof2002forthirdthrougheighthgrademaybeusedasvalue- 17addedinstrumentsiffoundappropriateafterconsiderationandapprovalbythestateboardof 18education; 19 (d)Adistrictmaychooseaninstrumentafterapublichearingofthedistrictboardof 20educationonthematter,withthereasonsfortheselectionenteredupontheminutesofthe 21meeting;provided,however,thatthisoptionshallnotbeavailabletodistrictsafterscoresare 22establishedforparagraphs(a),(b),and(c)ofthissubdivision; 23 (2)Evaluationsbyprincipalsorotheradministratorswithexpertisetoevaluate 24classroomperformance; 25 (3)Evaluationsbyparentsandbystudentsattheirappropriatedevelopmentallevel. 26 27Modelinstrumentsfortheseevaluationsshallbedevelopedoridentifiedbythedepartmentof 28elementaryandsecondaryeducation.Districtsmayusesuchmodels,mayuseotherexisting 29models,ormaydeveloptheirowninstruments.Adistrictthatdevelopsitsowninstrument 30shallnotusethatinstrumentasitssolemethodofevaluation. HB1123 18 31 2.Thedepartmentofelementaryandsecondaryeducationshalldevelopcriteriafor 32determiningeligibilityforstipendincrements,includingarangeoftargetscoreson 33assessmentsforusebythedistricts.Thetest-scoreoptionslistedinsubdivision(1)of 34subsection1ofthissectionshallbegivenhigherweightthantheevaluationoptionslistedin 35subdivisions(2)and(3)ofsubsection1ofthissection.Thedecisionofindividualdistricts 36aboutthequalificationsforeachincrementbasedontheevaluationslistedinsubdivisions(2) 37and(3)ofsubsection1ofthissectionandforvalue-addedinstrumentsforwhichtargetscores 38havenotbeendevelopedbythedepartmentofelementaryandsecondaryeducationmay 39addressthedistrict'suniquecharacteristicsbutshallrequiredemonstrablysuperior 40performanceonthepartoftheteacher,basedprimarilyonimprovedstudentachievement 41whiletakingintoaccountclassroomdemographicsincludingbutnotlimitedtostudents' 42abilities,specialneeds,andclasssize. 170.017.Thedepartmentofelementaryandsecondaryeducationshall,byJuly1, 22015,developahighschoolgraduationpolicythatallowsastudenttofulfilloneunitof 3academiccreditwithadistrict-approvedagricultureorcareerandtechnicaleducationcourse 4foranycommunicationarts,mathematics,science,orsocialstudiesunitrequiredforhigh 5schoolgraduationinanycombinationuptofulfillingonerequirementineachofthefour 6subjectareas.[Thesubstitutionmaynotbemadewherethecourseforwhichtheagriculture 7orcareerandtechnicaleducationcourseisbeingsubstitutedrequiresanend-of-course 8statewideassessment.Thecreditcannotbesubstitutedforanycoursewhichrequiresa 9statewideend-of-courseassessment.] Thepolicyrequiredunderthissectionshallbein 10additiontotheoptionalwaiverofoneunitofacademiccreditforathree-unitcareerand 11technicalprogramofstudies.
