19 2.Ifcapacityisinsufficienttoenrollallpupilswhosubmitatimelyapplication,the
20charterschoolshallhaveanadmissionsprocessthatassuresallapplicantsofanequalchance
21ofgainingadmissionanddoesnotdiscriminatebasedonparents'abilitytopayfeesortuition
22exceptthat:
23 (1)Acharterschoolmayestablishageographicalareaaroundtheschoolwhose
24residentswillreceiveapreferenceforenrollingintheschool,providedthatsuchpreferences
25donotresultintheestablishmentofraciallyorsocioeconomicallyisolatedschoolsand
26providedsuchpreferencesconformtopoliciesandguidelinesestablishedbythestateboardof
27education;
28 (2)Acharterschoolmayalsogiveapreferenceforadmissionofchildrenwhose
29siblingsattendtheschoolorwhoseparentsareemployedattheschoolorinthecaseofa
30workplacecharterschool,achildwhoseparentisemployedinthebusinessdistrictoratthe
31businesssiteofsuchschool;
32 (3)Charterschoolsmayalsogiveapreferenceforadmissiontohigh-riskstudents,as

39section,proficiencyintheEnglishlanguageorathleticability,butmaylimitadmissionto
40pupilswithinagivenagegrouporgradelevel.Charterschoolsmaylimitadmissionbasedon
41genderonlywhentheschoolisasingle-genderschool.Studentsofacharterschoolwhohave
42beenenrolledforafullacademicyearshallbecountedintheperformanceofthecharter
43schoolon[thestatewideassessments] nationallynorm-referencedassessmentsinthat
44calendaryear,unlessotherwiseexemptedasEnglishlanguagelearners.[Forpurposesofthis
45subsection,"fullacademicyear"meansthelastWednesdayinSeptemberthroughthe
46administrationoftheMissouriassessmentprogramtestwithouttransferringoutoftheschool
47andre-enrolling.]
48 4.Acharterschoolshallmakeavailableforpublicinspection,andprovideupon
49request,totheparent,guardian,orothercustodianofanyschool-agepupilresidentinthe
50districtinwhichtheschoolislocatedthefollowinginformation:
51 (1)Theschool'scharter;
52 (2)Theschool'smostrecentannualreportcardpublishedaccordingtosection
53160.522;
54 (3)Theresultsofbackgroundchecksonthecharterschool'sboardmembers;and
55 (4)Ifacharterschoolisoperatedbyamanagementcompany,acopyofthewritten
56contractbetweenthegoverningboardofthecharterschoolandtheeducationalmanagement
57organizationorthechartermanagementorganizationforservices.Thecharterschoolmay
58chargereasonablefees,nottoexceedtheratespecifiedinsection610.026forfurnishing
59copiesofdocumentsunderthissubsection.
60 5.Whenastudentattendingacharterschoolwhoisaresidentoftheschooldistrictin
61whichthecharterschoolislocatedmovesoutoftheboundariesofsuchschooldistrict,the
62studentmaycompletethecurrentsemesterandshallbeconsideredaresidentstudent.The
63student'sparentorlegalguardianshallberesponsibleforthestudent'stransportationtoand
64fromthecharterschool.
65 6.Ifachangeinschooldistrictboundarylinesoccursundersection162.223,
66162.431,162.441,or162.451,orbyactionofthestateboardofeducationundersection
67162.081,includingattachmentofaschooldistrict'sterritorytoanotherdistrictordissolution,
68suchthatastudentattendingacharterschoolpriortosuchchangenolongerresidesina
69schooldistrictinwhichthecharterschoolislocated,thenthestudentmaycompletethe
70currentacademicyearatthecharterschool.Thestudentshallbeconsideredaresident
71student.Thestudent'sparentorlegalguardianshallberesponsibleforthestudent's
72transportationtoandfromthecharterschool.

74educationalrightsareapplicabletocharterschools.
160.518.1.(1)ForallschoolyearsendingbeforeJuly1,2026,consistentwiththe
2provisionscontainedinsection160.526,thestateboardofeducationshalldevelop,modify,
3andrevise,asnecessary,astatewideassessmentsystemthatprovidesmaximumflexibilityfor
4localschooldistrictstodeterminethedegreetowhichstudentsinthepublicschoolsofthe
5stateareproficientintheknowledge,skills,andcompetenciesadoptedbysuchboard
6pursuanttosection160.514.Thestatewideassessmentsystemshallassessproblemsolving,
7analyticalability,evaluation,creativity,andapplicationabilityinthedifferentcontentareas
8andshallbeperformance-basedtoidentifywhatstudentsknow,aswellaswhattheyareable
9todo,andshallenableteacherstoevaluateactualacademicperformance.Thestatewide
10assessmentsystemshallneitherpromotenorprohibitrotememorizationandshallnotinclude
11existingversionsoftestsapprovedforusepursuanttotheprovisionsofsection160.257,nor
12enhancedversionsofsuchtests.Afterthestateboardofeducationadoptsandimplements
13academicperformancestandardsasrequiredundersection161.855,thestateboardof
14educationshalldevelopandadoptastandardizedassessmentinstrumentunderthissection
15basedontheacademicperformancestandardsadoptedundersection161.855.Thestatewide
16assessmentsystemshallmeasure,whereappropriatebygradelevel,astudent'sknowledgeof
17academicsubjectsincluding,butnotlimitedto,readingskills,writingskills,mathematics
18skills,worldandAmericanhistory,formsofgovernment,geographyandscience.
19 (2)Forthe2026-27schoolyearandallsubsequentschoolyears:
20 (a)Thestateboardofeducationshallselectanavailableexistingnationally
21norm-referencedassessmentthatsatisfiesthefederalpupiltestingmandatesineffect
22underPub.L.114-95,asamended,andanyapplicablemodificationsorwaivers
23approvedundersuchfederallaw,foreachschoolyear;
24 (b)Theassessmentsshall:
25 a.Bealignedtostatestandards;
26 b.Provideaccesstonationalnorms;
27 c.Measurestudentgrowth;and
28 d.Assessstudentperformancerelativetogradelevel;
29 (c)Exceptasotherwiseprovidedinthissectionorsection160.522,resultsfrom
30assessmentscreatedunderthissubsectionshallbeusedonlyforthepurposeof
31compliancewiththerequirementsofsuchfederallawandfornootherpurpose;
32 (d)Aspermittedbyfederallawandapplicablewaivers,thestateboardof
33educationshallensurethatstandardizedassessmentsareadministeredtotheminimum
34extentpracticableandreduceinstructionaltimetotheminimumextentpracticable

40DepartmentofEducationhasbeenabolishedordismantledbyanactoftheUnited
41StatesCongress,paragraph(a)ofthissubdivisionshallnotapplyandthestateboardof
42educationshallselectanavailableexistingnationallynorm-referencedassessmentthat
43satisfiesparagraphs(b)to(d)ofthissubdivisionforeachschoolyear.
44 2.[Thestatewideassessmentsystemshallonlypermittheacademicperformanceof
45studentsineachschoolinthestatetobetrackedagainstprioracademicperformanceinthe
46sameschool.
47 3.Thestateboardofeducationshallsuggest,butnotmandate,criteriaforaschoolto
48demonstratethatitsstudentslearntheknowledge,skillsandcompetenciesatexemplary
49levelsworthyofimitationbystudentsinotherschoolsinthestateandnation.Exemplary
50levelsshallbemeasuredbythestatewideassessmentsystemdevelopedpursuantto
51subsection1ofthissection,oruntilsaidstatewideassessmentsystemisavailable,by
52indicatorsapprovedforsuchusebythestateboardofeducation.Theprovisionsofotherlaw
53tothecontrarynotwithstanding,thecommissionerofeducationmay,uponrequestofthe
54schooldistrict,presentaplanforthewaiverofrulesandregulationstoanysuchschool,tobe
55knownas"OutstandingSchoolsWaivers",consistentwiththeprovisionsofsubsection4of
56thissection.
57 4.Foranyschoolthatmeetsthecriteriaestablishedbythestateboardofeducationfor
58threesuccessiveschoolyearspursuanttotheprovisionsofsubsection3ofthissection,by
59Augustfirstfollowingthethirdsuchschoolyear,thecommissionerofeducationshallpresent
60aplantothesuperintendentoftheschooldistrictinwhichsuchschoolislocatedforthe
61waiverofrulesandregulationstopromoteflexibilityintheoperationsoftheschoolandto
62enhanceandencourageefficiencyinthedeliveryofinstructionalservices.Theprovisionsof
63otherlawtothecontrarynotwithstanding,theplanpresentedtothesuperintendentshall
64provideasummarywaiver,withnoconditions,forthepupiltestingrequirementspursuantto
65section160.257,intheschool.Further,theprovisionsofotherlawtothecontrary
66notwithstanding,theplanshalldetailameansforthewaiverofrequirementsotherwise
67imposedontheschoolrelatedtotheauthorityofthestateboardofeducationtoclassify
68schooldistrictspursuanttosubdivision(9)ofsection161.092andsuchotherrulesand
69regulationsasdeterminedbythecommissionerofeducation,exceptingsuchwaiversshallbe
70confinedtotheschoolandnototherschoolsinthedistrictunlesssuchotherschoolsmeetthe
71criteriaestablishedbythestateboardofeducationconsistentwithsubsection3ofthissection

4foranycommunicationarts,mathematics,science,orsocialstudiesunitrequiredforhigh
5schoolgraduationinanycombinationuptofulfillingonerequirementineachofthefour
