BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section558.031,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection558.031,toreadasfollows: 558.031.1.Asentenceofimprisonmentshallcommencewhenapersonconvictedof 2anoffenseinthisstateisreceivedintothecustodyofthedepartmentofcorrectionsorother 3placeofconfinementwheretheoffenderissentenced. 4 2.Suchpersonshallreceivecredittowardtheserviceofasentenceofimprisonment 5foralltimeinprison,jailorcustodyaftertheoffenseoccurredandbeforethecommencement 6ofthesentence,whenthetimeincustodywasrelatedtothatoffense.Thiscreditshallbe 7baseduponthecertificationofthesheriffasprovidedinsubdivision(3)ofsubsection2of 8section217.305andmaybesupplementedbyacertificateofasherifforothercustodial 9officerfromanotherjurisdictionhavingheldthepersononthechargeoftheoffenseforwhich 10thesentenceofimprisonmentisordered. 11 3.Theofficerrequiredbylawtodeliverapersonconvictedofanoffenseinthisstate 12tothedepartmentofcorrectionsshallendorseuponthepapersrequiredbysection217.305 13boththedatestheoffenderwasincustodyandtheperiodoftimetobecreditedtowardthe 14serviceofthesentenceofimprisonment,exceptasendorsedbysuchofficer. 15 4.Ifapersonconvictedofanoffenseescapesfromcustody,suchescapeshall 16interruptthesentence.Theinterruptionshallcontinueuntilsuchpersonisreturnedtothe 17correctionalcenterwherethesentencewasbeingserved,orinthecaseofapersoncommitted EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18tothecustodyofthedepartmentofcorrections,toanycorrectionalcenteroperatedbythe 19departmentofcorrections.Anescapeshallalsointerruptthejailtimecredittobeappliedtoa 20sentencewhichhadnotcommencedwhentheescapeoccurred. 21 5.Ifasentenceofimprisonmentisvacatedandanewsentenceimposeduponthe 22offenderforthatoffense,alltimeservedunderthevacatedsentenceshallbecreditedagainst 23thenewsentence,unlessthetimehasalreadybeencreditedtoanothersentenceasprovidedin 24subsection1ofthissection. 25 6.Ifapersonreleasedfromimprisonmentonparoleorservingaconditionalrelease 26termviolatesanyoftheconditionsofhisorherparoleorrelease,heorshemaybetreatedas 27aparoleviolator.Iftheparoleboardrevokestheparoleorconditionalrelease,theparoled 28personshallservetheremainderoftheprisontermandconditionalreleaseterm,asan 29additionalprisonterm,andtheconditionallyreleasedpersonshallservetheremainderofthe 30conditionalreleasetermasaprisonterm,unlessreleasedonparole. 31 7.[Subsection2ofthissectionshallbeapplicabletooffensesforwhichtheoffender 32wassentencedonorafterAugust28,2023.] Notwithstandinganyotherprovisionoflawto 33thecontrary,creditfortimeservedshallbeawardedasprovidedundersubsection2of 34thissectionregardlessofwhenanoffenseoccurred.Backcreditshallbeawardedtoany 35offenderwhowasincustodypriortoAugust28,2023,whodidnotreceivecredittoward 36theserviceofasentenceofimprisonmentforalltimeinprison,jail,orcustodyafteran 37offenseoccurredandbeforethecommencementofthesentence,whenthetimein 38custodywasrelatedtothatoffense. 39 8.Thetotalamountofcreditgivenshallnotexceedthenumberofdaysspentin 40prison,jail,orcustodyaftertheoffenseoccurredandbeforethecommencementofthe 41sentence. ✔ HB1127 2
